REGULAR MEETING
JANUARY 3,1984
The regular meeting of the City Council of the City of Apache Junction,
Arizona,was held on January 3,1984,at the Apache Junction City Council
Chambers pursuant to the notice required by law.
CALL TO ORDER
Mayor Clarke called the meeting to order at 7:00 p.m.

CITY MANAGER'S REPORTS
City Manager Mike McNulty informed the Council and public that the
Certificate of Convenience and Necessity for the sewage service of Sierra
Entrada was transferred by the Corporation Commission from P &P Development
Company to American Public Service,and introduced Mr.Lester Smith to
answer questions.
Mr.Lester Smith,Chief Executive Officer,American Public Service,
stated that as of December 21,1983,the Certificate of Convenience and
Necessity was transferred,and that American Public Service has filed for an
emergency rate increase with the Corporation Commission in order to finance
the improvements that are necessary with the Sierra Entrada sewage plant.
Mayor Clarke requested an approximate dollar amount of the increase.
Mr.Smith explained that this will probably be a temporary rate
increase of approximately three times the present amount,and outlined the
improvements necessary to solve the problems with the system.
Councilman Steelsmith wished to know what steps could be taken for a
short term solution,until •the improvements are made.
Mr.Smith stated that i t would be at least 45 days before Phase I can
begin,and reported what has been accomplished,and answered questions from
Councilmembers and members of the public regarding the operations of the
sewage system,and the odor problem.
Mayor Clarke recessed the meeting at 7:40 p.m..
Mayor Clarke reconvened the meeting 7:55 p.m..
Mayor Clarke asked that the record show that Councilman Shanks had been
excused,as she was ill.

Mayor Clarke opened the hearing to
Associate Planner Jim Nakagawa
briefed the Council on rezoning case no.PZ-15-83,from GR General Rural to
Trailer Homesite Zone (TH),stating that on a previous application,
Mr.Leigh was not able to obtain a quit claim from the Farmers Home
Administration,and is now requesting rezoning of the adjacent parcel,owned
by Saldana.
Mr.Ted Leigh,1367 W.Teepee,
Apache Junction,stated that this parcel would have one trailer placed on i t
and requested approval of the application.

There being no one wishing to address the Council,Mayor Clarke closed the

Mr.Nakagawa stated that the
Development Coordinating Committee and the Planning and Zoning Commission
have no objections to the rezoning application,provided adequate
right-of-way is dedicated.

Mr.Nakagawa briefed the Council on
the proposed annexation to the City of a vacant 20 acre parcel located on
the south side of Southern Avenue between S.Idaho Rd.,and S.Winchester
Rd..
Mr.Jim Murphy,1322 N.1st St.,
Phoenix,Arizona,a developer of the parcel,asked i f there were any
questions.
Mayor Clarke stated that there were
some questions at the Work Session and maybe they should be repeated for the
benefit of the public.
Councilman Damiano wished to know i f
the request for rezoning of this same parcel should be denied,would the
applicants still desire the annexation.
Mr.Murphy stated that as the County
does not provide this type of rezoning,the parcel has city boundaries on
two sides,and the purpose for the annexation is to develop this property in
a condominium mode,annexation would be beneficial.
Mayor Clarke asked i f there was

Mr.Nakagawa stated that the
Development Coordinating Committee and the Planning and Zoning Commission
both recommend approval of the annexation,as this particular site lies
within the General Plan.

Mr.Nakagawa explained that this is
a proposed amendment to the Zoning Ordinance regarding the unanimous consent
provision,which is a County provision and that a different provision exists
for cities in the Arizona Revised Statutes.

City Manager McNulty stated that the
problem is that the City has a requirement that is contrary to State law.
City Attorney David Alexander
explained that the Statutes for County zoning,there are two provisions that
have caused confusion,because they became part of the City Zoning Ordinance
when only applicable to counties,and read those provisions from the Arizona
Revised Statutes.
Mayor Clarke asked i f there was

Mr.George Baljo 1070 E.Navajo,
Apache Junction,voiced his opinion in regards to protest requirements of
rezoning applications.
Mayor Clarke commented that legal
requirements are very clear.
City Attorney Alexander reiterated
that Section 9-46204 (G)of the Arizona Revised Statutes specifically
states what the mandatory percentage requirements are,and that the City is
granted the power to zone and no more restrictive legislation is allowed
than that specified by the Statutes.
Mr.Nakagawa stated that the
Planning and Zoning Commission recommended denial of this ordinance,with
the opinion that this would diminish the property rights of the neighboring
properties in the area to be rezoned.
Mr.Baljo stated that the City
Attorney's interpretation is a judgement as an individual protecting the
rights of a property owner to do his will with his property,and that
adjacent property owners should also be protected.

Council that amendments to Title 28 of the Arizona Revised Statutes now
permit cities to provide civil penalties for local minor traffic ordinance
violations that are presently considered to be misdemeanors,and on January
1,1984,certain traffic violations become civil rather than criminal
offenses.

Councilman Damiano informed the
Council that there are Talent Bank applications from Mr.Ken Sanchez and Mr.
Arthur Dwight Pierce for the vacancy.

RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,THAT MR.ARTHUR DWIGHT PIERCE,BE APPOINTED TO THE LIBRARY BOARD TO
FILL THE VACANCY CREATED BY THE RESIGNATION OF MS MARGARET CARLIN,SAID

CITY POLICY REGARDING
FEDERAL PATENTED EASEMENTS
)Mr.McNulty explained that the
request is not for the purpose of access to property,but necessity for
waterline installation,and would simply let the citizens know that this is
not a city maintained right-of-way.
Councilman Steelsmith MOVED THAT BE
IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,THAT THE CITY MANAGER DIRECT THE DEPARTMENT OF PUBLIC WORKS TO
IMPLEMENT A POLICY FOR ROAD IMPROVEMENT AND MAINTENANCE,SUCH THAT WILL
INCLUDE ONLY THOSE ROADWAYS NOW BEING MAINTAINED,THOSE ROADWAYS IMPROVED TO
CITY AND THOSE ROADWAYS AUTHORIZED BY THE CITY.ALL ROADWAYS NOT MEETING
THESE CRITERIA MAY BE POSTED WITH A NOTICE STATING "THIS IS NOT A
DEDICATED STREET AND IS NOT MAINTAINED BY THE CITY OF APACHE—MICTION."

RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,THAT A WORK SESSION BE HELD ON JANUARY 16,1984,AT 7:00 P.M.,IN
THE COMMUNITY SERVICES BUILDING.
BE IT FURTHER RESOLVED THAT AN EXECUTIVE SESSION AND A WORK SESSION BE HELD
ON JANUARY 17,1984,AT 6:00 P.M.,IN THE CITY COUNCIL CHAMBERS.
Councilman Damiano seconded the
motion.

IMPROVEMENT TO IDAHO ROAD AND U.S.
HIGHWAY 60 INTERSECTION,PW-83-3 )
)Director of Public Works Richard
Broman,stated that this improvement had been requested before the City's
incorporation,and funds have been allocated by the State,this year.
Mr.Broman explained that requests for bids were advertised and the bid
opening took place on January 3,1984,and recommended the low bid,Nesbitt
Contracting,Inc.,for $40,360.00,and there may be an additional project
which could be included at a later date.
Councilman Damiano MOVED THAT BE IT
RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,THAT THE PROPOSAL BY NESBITT CONTRACTING,INC.,DATED JANUARY 3,
1984,IN THE AMOUNT OF $40,340.00,FOR THE CITY OF APACHE JUNCTION PUBLIC
WORKS PROJECT NO.PW-83-3,BE ACCEPTED AND THAT AUTHORIZATION BE GIVEN TO
THE DIRECTOR OF PUBLIC WORKS THROUGH THE CITY MANAGER TO FINALIZE
ARRANGEMENTS,IN ACCORDANCE WITH THE BID DOCUMENTS.
Councilman Hill seconded the motion.
VOTE:Unanimous
The motion carried.
INTERSECTION OF PHELPS
DRIVE AND U.S HIGHWAY 60
)Councilman Steelsmith MOVED THAT BE
IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,THAT THE ITEM REGARDING THE INTERSECTION OF PHELPS DRIVE AND U.S.
HIGHWAY 60,BE POSTPONED UNTIL THE REGULAR MEETING OF JANUARY 17,1984.

motion.

located near the City Attorney and City Manager.
