MARCH 6,1984
The regular meeting of the City Council of the City of Apache Junction,
Arizona,was held on March 6,1984,at the Apache Junction City Council
Chambers pursuant to the notice required by law.
CALL TO ORDER
Mayor Clarke called the meeting to order at 7:03 p.m.

Introduction of Distinguished Guests and Visitors

AWARDS,PRESENTATIONS,AND COMMUNICATIONS
Mayor Clarke read the following memorandum from Director of Public
Safety,William E.McDaniel:
"Apache Junction Police Department has retired badge #19 in honor of Officer
Russ Duncan,who gave his life,while training to be more efficient in his
job as a Police Officer,to better serve the community in which he lived and
worked.
We are respectfully requesting that this badge and plaque be presented to
Mrs.Russ Duncan in memory of her husband."
Mayor Clarke presented Mrs.Russ Duncan with the badge and plaque,and
presented Certificates of Award to Mr.and Mrs.Richard Taylor and others
for holding a benefit auction for the Russell Duncan Memorial Fund.
Mr.William Gresser,President,American Greyhound Racing,gave a
presentation on the improvements to the Apache Junction Greyhound Park,
including the new teletrack facilities.He announced that the track was
scheduled to be opened on March 20.
Mayor Clarke commented that this facility has attracted nationwide
attention.
CITY MANAGER'S REPORT
City Manager Michael J.McNulty announced that a presentation of the
final draft of the Magistrate Court Study would be given by Mr.John Bolling
of Arthur Young and Company.
Mr.Bolling stated that the volume of citations has increased from 2700
in 1980 to over 4200 in 1983,and the amount collected in fines has risen
from $116,000.00 to over $313,000.00 in the same four-year period,and that
i t is necessary to improve the efficiency of the court system.Mr.Bolling
expanded on the various areas needing improvements and offered alternatives
and solutions.
Mayor Clarke expressed his disappointment that the Study didn't go into
areas such as amounts of fines and bonds.
Mr.Bolling stated that the bail and fine schedules had been reviewed
and they seemed to be in order.
Councilman Damiano asked i f they were in order in comparison to other
courts.
Mr.Bolling stated that yes,in comparison to other courts in the
County and State.

briefed the Council,stating that since the utilization of the Consent
Agenda,several zoning amendments have been passed not including terms and
conditions that were agreed upon by the applicants prior to approval by the
Council,and this ordinance amends several ordinances passed previously to
include the stipulations.

Mayor Clarke opened the hearing to
City Manager McNulty explained that
a legal holiday that had normally been observed was replaced with the
employees birthday,but that since the Court cannot legally conduct business
on this holiday.The Court employees would substitute their birthday holiday
for Lincoln's Day.
Mayor Clarke asked i f there was
anyone who wished to speak in favor of or in opposition to the amendment.
There being no one wishing to address the Council,Mayor Clarke closed the
hearing to the public.

Councilman Damiano seconded the
MAJOR AMENDMENTS TO PLANNED DEVELOPMENT
ROADHAVEN PHASE I AND I I
)Mayor Clarke opened the hearing to
the public.
Associate Planner Jim Nakagawa
briefed the Council,stating that this is a request by Roadhaven to reduce
minimum travel trailer unit separation from 19.5 feet to 16.5 feet,and to
reduce the minimum space line setback from three feet to zero,and that a
letter had been received from Mr.Harry Bidwell mentioning meetings with Mr.
Gero where i t was agreed that the Covenants,Conditions,and Restrictions
may be amended by Mr.Gero,who advised the staff that he does not recall
any such agreement.Mr.Nakagawa reminded the Council that Roadhaven Phase
I and I I were approved in 1983,and further stated that the staff foresee
future problems were this to be approved.
Mayor Clarke asked i f there was
anyone who wished to speak in favor of or in opposition to the petition.
Mr.Roger Short,1256 S.Buena
Vista,Apache Junction,addressed the Council in opposition to the petition.
Mr.Nakagawa stated that there was
little objection from the Development Coordinating Committee in regards to
the amendment,however,dissenting from the other members of the Development
Coordinating Committee,the Planning staff would recommend denial.

Councilman Shanks MOVED THAT BE IT
RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,THAT A PLANNED DEVELOPMENT MAJOR AMENDMENT BY HARRY BIDWELL FOR A
REDUCTION TO 16.5 FEET IN THE DISTANCE BETWEEN TRAILER UNITS AND FOR A
REDUCTION TO ZERO FEET IN THE SETBACK DISTANCE TO SPACE LINES FOR ROADHAVEN

Mr.Nakagawa briefed the Council on
the rezoning application from GR General Rural to Trailer Homesite Zone
(TH),a vacant 1.25 acre parcel located on the south side of East 2nd Avenue
between Hopi and Arizona Roads in Section 21.
Mr.Jerry Burgess,349 S.Saguaro,
Apache Junction,addressed the Council in favor of the rezoning.
Mr.Nakagawa stated that the
Development Coordinating Committee has no objection and the Planning and
Zoning recommends approval of the application.

Trail,Apache Junction,explained that this business had been sold but has
now repossessed it,which is the purpose for the transfer of the liquor
license.
Councilman Shanks MOVED THAT BE IT
RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,THAT THE APPLICATION FOR PERSON TRANSFER OF A SERIES 6 LIQUOR
LICENSE,SUBMITTED BY MR.HOWARD KELLER AGENT FOR THE CACTUS CLUB,DUE TO
THE FACT THAT THERE IS A QUESTION OF OWNERSHIP OF THE LICENSE AT THIS TIME,
THAT NO RECOMMENDATION BE GIVEN.
Councilman Damiano seconded the
motion.
Councilman Shanks clarified the
purpose of the motion,stating that until the litigation is cleared up,the
Council chooses to not make a recommendation.
Vice Mayor Eidson asked what the cost was to process a liquor license
application.
City Clerk Kathleen Connelly replied that the cost is in the area of
$200,with an initial liquor license fee and a yearly renewal fee of $35.00.
Vice Mayor Eidson stated that he felt that the Council did the citizens
a injustice by denying the fee increase proposed at a previous meeting and
would bring i t to their attention from time to time.

Mayor Clarke made the following
"At the last Council meeting,we held a public hearing on this issue.We
listened to both sides at great length,both sides were very sincere in
their respective positions.We even let people speak after the public
hearing was closed.I feel that we did a good job of listening to some good
presentations.I t may have seemed a difficult issue to decide but i f one
would analyze what really is best for the entire area,the answer is easy to
see what is best for the entire area.First,the comments:i t is zoned
CR-3 now,put houses there.By putting 10 more acres of houses next to
mobile zoning will not improve the situation that already exists.I f houses
are constructed there ,the traffic problem would be greater than i f i t were
developed into an adult R.V.subdivision.There would be no walls around
the project and a possibility of 8 to 10 driveways on San Marcos plus 3 or 4
drives on 12th Avenue.Most homes in a residential area have 2 cars,some
with 3 cars,plus motorcycles,boats,et.
Secondly,to construct apartments on this 10 acres may not be financially
feasible as there are many units being repossessed at the present time in
Apache Junction.This parcel of land,i f rezoned CR-5,could accommodate a
minimum of 70 living units.To place this many units on the property,no
doubt i t would have to be two story construction.The view would definitely
be blocked more than R.V.or mobile units.Again no walls,more driveways,
more vehicles.Not to mention the possibility of more trash as we now are
confronted within new apartment complexes in several areas.
As long as I have been on the Council,the word from the public has been to
place all TH zoning in one area whenever possible."
Vice Mayor Eidson stated that upon
speaking with the homeowners in the area of this proposed RV park,he has
concluded that the protests will not be dropped and the homeowners will
continue to oppose this development.

Councilman Damiano stated that the
development is an "RV Park"and not a "trailer park",further expanding on
the differences,and that this is preferable to apartments in this
particular area.
Councilman Shanks expressed
opposition to additional parks being built in this area.
Councilman Hill seconded the motion.

NEW BUSINESS
ACCEPTANCE OF FINAL REPORT AND
RECOMMENDATIONS OF THE CITIZENS
ADVISORY COMMITTEE ON CABLE TV )
Director of Public Works Rich Broman
introduced Mr.Jack Barrett,Chairman of the Citizens Advisory Committee on
Cable TV.
Mr.Barrett informed the Council
that there were two bids submitted,and recommended Dowden Communications,
Inc.be awarded the bid,and further explained the specifics of the contract
to install Cable TV in Apache Junction.
Councilman Damiano MOVED THAT BE IT
RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,THAT THE CITY MANAGER IS HEREBY AUTHORIZED TO INITIATE COORDINATION
WITH REPRESENTATIVES OF DOWDEN COMMUNICATIONS,INC.,IN ORDER TO PREPARE
NECESSARY DOCUMENTS FOR THE CONSIDERATION OF A CABLE TELEVISION LICENSE
ENABLING ORDINANCE.
BE IT FURTHER RESOLVED THAT THE CITIZENS ADVISORY COMMITTEE ON CABLE
TELEVISION BE DISCONTINUED,AS THEIR CHARGES HAVE BEEN FULFILLED.

his regret that the Committee would be discontinued.
Councilman Taylor stated that the
Committee had performed their duties efficiently and excellently.

INTERGOVERNMENTAL AGREEMENT WITH
PINAL COUNTY ELECTIONS DEPARTMENT
FOR MAY 15TH SPECIAL ELECTION
City Clerk Kathleen Connelly
informed the Council that Pinal County services had been utilized for the
General Election last May and had saved the City considerable time and a
great deal of money.Ms Connelly recommended the use of these services
provided by County Elections Director Gilbert Hoyos and his staff for the
May 15th Special Election for the one-time budget override.
Councilman Damiano wished to know
the number of precincts in the City.
Ms Connelly stated that there are
unofficially six precincts,which have not as yet been approved by the
Justice Department .

RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,THAT THE INTERGOVERNMENTAL AGREEMENT WITH PINAL COUNTY,TO PROVIDE
SERVICES SUPPLIES NECESSARY FOR THE MAY 15,1984,SPECIAL ELECTION,IN THE
AMOUNT NOT TO EXCEED $3,000.00,BE AND HEREBY IS APPROVED.

ARIZONA,THAT THE LEASE PURCHASE OF A W20C WHEEL LOADER FROM CASE POWER &

)Mayor Clarke stated that there will
not be a Work Session held on March 19,1984.
Councilman Shanks MOVED THAT BE IT
RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,THAT AN EXECUTIVE SESSION AND A WORK SESSION BE HELD ON MARCH 20,
1984,AT 6:00 P.M.,IN THE CITY COUNCIL CHAMBERS.
Vice Mayor Eidson seconded the
motion.

CALL TO THE PUBLIC
Mr.Harvey Morrison,1834 W.Roundup St.,Apache Junction,requested a
four-way stop at Ironwood Drive and Superstition Boulevard,due to traffic
problems.
Councilman Hill agreed that this intersection is a problem and should
have a four-way stop.
Mayor Clarke stated that the Council appreciates public comment on
similar situations,and would act whenever possible.
Mr.Tom Sansoni,1560 W.Superstition Blvd.,Space 16,Apache Junction,
requested factual information from the Council or homeowners proving that
trailers or trailer parks depreciate the value of homes.
Mr.Frank Jimenez,1800 S.Monterey,Apache Junction,addressed the
Council in regards to two subjects;Trailer Homesite rezoning cases,and the
Magistrate Court study,expressing his opposition to trailer and RV parks.
Mr.Charles Harrison,1265 N.Warner Dr.,Apache Junction,spoke in
opposition to Judge Leo Coombs and the City Council,stating that a legal
petition would be circulated for the removal of the City Council from
office.
