CALL TO ORDER Mayor Clarke called the meeting to order at 7:00 p.m. ROLL CALL Councilmen Present:Councilman Hill,Councilman Shanks,Councilman Steelsmith, Councilman Damiano,Vice Mayor Eidson,Mayor Clarke Councilman Absent:Councilman Taylor Staff Present:City Manager Michael J.McNulty City Clerk Kathleen Connelly Director of Public Safety Bill McDaniel City Attorney David Alexander PROPOSED ORDINANCE NO.268,AMENDING CHAPTER 5 OF THE CITY CODE, MAGISTRATE COURT (Second Reading)) )Councilman Shanks MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,THAT ORDINANCE NO.268,BE READ BY TITLE ONLY AND THE READING OF THE ENTIRE ORDINANCE BE WAIVED. Councilman Steelsmith seconded the motion. VOTE:In Favor:Councilman Shanks,Councilman Steelsmith,Councilman Hill Vice Mayor Eidson,Mayor Clarke Opposed:Councilman Damiano The motion failed. Mayor Clarke called upon the City Clerk to read Ordinance No.268 in it's entirety. City Clerk Kathleen Connelly,read as follows: ORDINANCE NO.268,AN ORDINANCE OF MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,AMENDING. THE APACHE JUNCTION CITY CODE CHAPTER 5 MAGISTRATE COURT,ARTICLE 5-2 PRESIDING OFFICER;SECTION 5-2-1 CITY MAGISTRATE AND SECTION 5-2-2 ACTING CITY MAGISTRATE;REPEALING ANY CONFLICTING PROVISIONS;AND PROVIDING FOR SEVERABILITY. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,AS FOLLOWS: SECTION I IN GENERAL That Chapter 5 MAGISTRATE COURT,Article 5-2 PRESIDING OFFICER, Section 5-2-1 City Magistrate and Section 5-2-2 Acting City Magistrate, be amended to read as follows: Section 5-2-1 City Magistrate The presiding officer of the Magistrate Court shall be the City Magistrate who shall be appointed by the City Council for a term of two (2)years commencing on May 1st of every even -numbered year ending on April 30th of every even -numbered year,unless sooner removed for misfeasance,malfeasance or non-feasance of office. Section 5-2-2 Assistant City Magistrate In the absence of the City Magistrate,the presiding officer of the Magistrate Court shall be the Assistant City Magistrate.The Assistant City Magistrate shall be appointed by the City Council for a term of two (2)years commencing on May 1st of every even -numbered year and ending on April 30th of every even -numbered year,unless sooner removed for misfeasance,malfeasance or non-feasance of office. SECTION I I REPEALING ANY CONFLICTING PROVISIONS All ordinances and parts of ordinances in conflict with the provisions of this ordinance or any part of the code adopted herein by reference are hereby repealed. SECTION III PROVIDING FOR SEVERABILITY I f any section,subsection,sentence,clause,phrase or portion of this ordinance or any part of the code adopted herein by reference is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction,such decision shall not affect the validity of the remaining portions thereof. Councilman Steelsmith MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,THAT ORDINANCE NO.268,AN ORDINANCE OF MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,AMENDING THE APACHE JUNCTION CITY CODE CHAPTER 5 MAGISTRATE COURT,ARTICLE 5-2 PRESIDING OFFICER,SECTION 5-2-1 CITY MAGISTRATE AND SECTION 5-2-2 ACTING CITY MAGISTRATE;REPEALING ANY CONFLICTING PROVISIONS;AND PROVIDING FOR SEVERABILITY,BE AND HEREBY IS APPROVED AND ADOPTED. VOTE:Unanimous The motion carried. DISCUSSION AND/OR ACTION REGARDING THE APACHE JUNCTION CITY MAGISTRATE POSITION asked for direction. City Manager Michael J.McNulty Councilman Steelsmith MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,THAT DIRECTION BE GIVEN TO THE CITY MANAGER TO PREPARE ADVERTISEMENTS FOR THE CITY MAGISTRATE POSITION. Vice Mayor Eidson seconded the motion. VOTE:Unanimous The motion carried. APPROVAL OF STATE LAND APPRAISAL ) )City Manager McNulty explained that the City Complex is located on State land,which has been appraised at $20,000.00 per acre,which i f appealed would take a lengthy procedure,and i f accepted will be put up for bid to anyone.Mr.McNulty also stated that governmental agencies have priority,so i f another agency bids for the land, they would be required to reimburse the City for all capital improvements. Councilman Hill expressed his feeling that i f the City waits to bid on the land,i t will be more expensive in the future. Councilman Damiano MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,THAT THE STATE LAND APPRAISED FOR THE 20 ACRE CITY COMPLEX SITE BE ACCEPTED AS PRESENTED. Councilman Hill seconded the motion. VOTE:Unanimous The motion carried. DETERMINATION OF BOND ADVISOR FOR STREET IMPROVEMENT BONDS )Mr.McNulty stated that i f the Council accepts the resolution to submit to the voters a proposition for street improvement (gas tax)bonds,i t will be necessary to contact bond advisors for presentations for the Council Work Session of April 2,1984. Councilman Steelsmith MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,THAT THE CITY MANAGER IS HEREBY AUTHORIZED TO CONTACT BOND ADVISORS FOR THE PURPOSE OF MAKING PRESENTATIONS ON STREET IMPROVEMENT BONDS TO THE CITY COUNCIL AT THE APRIL 2,1984,WORK SESSION. motion. VOTE:Unanimous The motion carried. Councilman Damiano seconded the ADJOURNMENT )Councilman Damiano MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,THAT THE MEETING BE ADJOURNED AT 7:17 P.M.
