CALLTO ORDER Mayor Hill called the meeting to order at 7:00 p.m. INVOCATION Councilwoman Gardner gave the Invocation. PLEDGE OF ALLEGIANCE Vice Mayor Bakkedahl led the Pledge of Allegiance. AWARDS,PRESENTATIONS AND COMMUNICATIONS Mr.Charles Russell,742 S.Grand,Apache Junction,Arizona,member of the Library Board,addressed the Council regarding the disposition of the old Library building. Councilman Jimenez stated that the Council would look into this matter. CITY,MANAGER'S REPORT City Manager Michael J.McNulty reported that the Prospector Park groundbreaking took place,that the drainage project on Pinal Street is underway. PUBLIC HEARINGS Councilman Jimenez explained to the public that certain rezoning cases will be postponed due to protests submitted,as a three-quarter vote would be required for approval and only five Councilmembers being present,this requirement could not be met. Mayor Hill stated that these cases would be heard on July 2,1985. PROPOSED ORDINANCE NO.358, PZ-7-85,HOOVER public. )Mayor Hill opened the hearing to the Director of Planning Chuck Newcomer briefed the Council on the request for rezoning from GR General Rural to TH Trailer Homesite of a 39,204 square foot parcel,located on the southwest corner of the intersection of West Shiprock Street and North Desert View Drive in Section 18. approval of the application. Councilwoman Gardner seconded the )Mayor Hill opened the hearing to the Mr.Newcomer addressed the request for rezoning from CR-3 Single Residence Zone to CR-5 Multiple Residence by Planned Development of a 33,000 square foot parcel,located on the east side of Monterey Drive between 19th and 20th Avenues in Section 29,with the applicant proposing 10 twin home units. Mr.Larry Richardson,8600 San Ardo, Scottsdale,representing Lewis -Brewer Development,requested approval of the application for rezoning. Councilwoman Gardner asked i f there would be any two-story homes. Mr.Richardson replied that there would be no two-story,but would be all one-story homes. Mr.Newcomer stated that the Development Coordinating Committee and the Subdivision Committee have reviewed this project and recommend approval and the Planning and Zoning Commission also recommend approval of the request. Mr.Newcomer addressed the request for rezoning from GR General Rural to TH Trailer Homesite Zone of a 1.1 acre parcel,located on the north side of Junction Drive,about 500 feet west of Tomahawk Road and is currently developed with a mobile home,with surrounding uses of mobile homes,a house and an RV park. Ms Angelina Tice,585 W.16th Avenue,Apache Junction,requested approval of the rezoning to divide i t into three lots. Mr.Newcomer stated that the staff has no objections to the rezoning and the Planning and Zoning Commission recommend approval with the stipulation that the parcel not be developed into a mobile home park. Mr.Keith Stachar,6301 E.Roundup,Apache Junction,representing the applicant,stated that a letter had been submitted requesting that i t be returned to Planning and Zoning Commission for a change in application and rehearing. Mr.McNulty asked the Director of Planning i f this possibility had been discussed at the Planning and Zoning Commission meeting. PROPOSED ORDINANCE NO.362,PZ-11-85, BRADLEY AND VANDEVER )Mr.Newcomer requested that this item be postponed until the regular meeting of July 2,1985,due to protest petitions submitted,requiring a three-quarter vote of the Council. Councilman Gardner MOVED THAT ORDINANCE NO.362,PZ-11-85,BE POSTPONED UNTIL THE NEXT REGULAR MEETING OF THE CITY COUNCIL ON JULY 2,1985. Councilman Baljo seconded the motion. VOTE:Unanimous The motion carried. PROPOSED ORDINANCE NO.364, PZ-12-85,LAKE Mayor Hill opened the hearing to the public. Mr.Newcomer briefed the Council on the request for rezoning from GR General Rural to C-2 Local Commercial District of a 47,400 square foot parcel,located on the west side of Ironwood Drive,about 800 feet north of Apache Trail and in Section 19. Mr.Bob Lake,2066 W.Apache Trail, Suite 101,Apache Junction,outlined the proposed use of a small shopping complex. Mayor Hill asked i f there was anyone who wished to speak in favor of or in opposition to the application.There being no one wishing to address the Council,Mayor Hill called upon the Director of Planning for recommendations. Mr.Newcomer stated that the staff recommends approval of the rezoning and the Planning and Zoning Commission also recommend approval with stipulations of roadway right-of-way dedications. Councilwoman Gardner seconded the Mayor Hill opened the hearing to the Mr.Newcomer addressed the application for rezoning from GR General Rural to TH Trailer Homesite Zone of a 3.0 acre parcel,located on the east side of Saguaro Drive,about 1,000 feet north of Apache Trail in Section 19. Mr.A.E.Sullivan,438 N.Saguaro, Apache Junction,stated that he would answer any questions the Council may have. Councilwoman Gardner asked i f there were plans to sell and develop into subdivision. Mr.Sullivan explained that this consists of three separate parties,all wishing to place two to three mobile homes on their respective lots,but there are no present plans for developing into subdivisions. Councilwoman Gardner seconded the REGULAR MEETING OF THE CITY COUNCIL JUNE 18,1985 PAGE 8 PROPOSED ORDINANCE NO.369, PZ-17-85,RIDDLE )Mayor Hill opened the hearing to the public. Mr.Newcomer briefed the Council on the application for rezoning from GR General Rural to C-4 Heavy Commercial District of a 1.1 acre parcel,located on the northeast side of Highway 60 at the Wickiup Road and 16th Avenue alignments in Section 27. Ms Patricia Meyer,1981 S.Cactus, Apache Junction,representing the applicants,requested approval of the application. Mayor Hill asked i f there was anyone who wished to speak in favor of or in opposition to the petition. There being no one wishing to address the Council,Mayor Hill closed the hearing to the public. Mr.Newcomer stated that staff recommends rezoning to C-4 by Planned Development and that the Planning and Zoning Commission recommends stipulates dedication of roadways and that the rezoning be done by Planned Development. Councilman Jimenez asked i f this proposed change in the application had been discussed with the applicant. Associate Planner Jim Nakagawa stated that the applicant has no definite plans for the property,but wished the rezoning for increase in property value,and that the applicant was advised of Planned Development requirements. Ms Meyer stated that the applicant does not have a problem with adding Planned Development to the rezoning. City Attorney David Alexander stated that the Council cannot add Planned Development to the application at this point,but i t would have to return to the Planning and Zoning Commission for a change in the application. Councilwoman Gardner MOVED THAT ORDINANCE NO.369,PZ-17-85,BE SENT BACK TO THE PLANNING AND ZONING COMMISSION FOR RECONSIDERATION. Councilman Jimenez seconded the motion. VOTE:Unanimous The motion carried. PROPOSED ORDINANCE NO.370, PZ-18-85,TRAIL )Mr.Newcomer briefed the Council on the application for rezoning from GR General Rural to C-4 Heavy Commercial District of a 1.43 acre parcel,located on the northeast side of Highway 60 at the Bowman Road alignment in Section 27. Ms Patricia Meyer,representing the applicants,stated that this is very similar to the previous case. Mayor Hill asked i f there was anyone who wished to speak in favor of or in opposition to the application.There being no one wishing to address the Council,Mayor Hill called upon the Director of Planning for recommendations. REGULAR MEETING OF THE CITY COUNCIL JUNE 18,1985 PAGE 9 City Attorney David Alexander stated that the applicant may provide a sketch plan and change the rezoning request to C-4 by Planned Development. Councilwoman Gardner MOVED THAT ORDINANCE NO.370,PZ-18-85,BE SENT BACK TO THE PLANNING AND ZONING COMMISSION FOR RECONSIDERATION. Vice Mayor Bakkedahl seconded the motion. VOTE:Unanimous The motion carried. PROPOSED ORDINANCE NO.376, PZ-20-85,PERRAULT AND FORD )Mr.Newcomer stated that requests for quit claim deeds have not been returned to the Planning Department and recommended postponement until this matter is settled. NEW BUSINESS PROPOSED RESOLUTION NO.85-21 INVESTMENT OF FUNDS )City Manager Michael J.McNulty explained that this is required by law to authorize the City Treasurer to invest city funds and to establish guidelines for the investment of these funds. Councilman Jimenez MOVED THAT RESOLUTION NO.85-21,A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,PROVIDING FOR THE DEPOSIT OF CITY FUNDS OF LESS THAN $100,000.00 AND AUTHORIZING THE CITY TREASURER TO INVEST CITY FUNDS,BE APPROVED AND ADOPTED. Councilman Baljo seconded the motion. VOTE:Unanimous The motion carried. PROPOSED RESOLUTION NO.85-24, WITHDRAWAL OF APPLICATION TO STATE LAND DEPARTMENT )Mr.Newcomer stated that this resolution directs staff to submit to the State Land Department a withdrawal of the application submitted in December of 1984 to reclassify REGULAR MEETING OF THE CITY COUNCIL JUNE 18,1985 PAGE 10 approximately 11,000 acres of land for urban planning,at which time the Land Commissioner had changed his mind on how the land should be developed and would prefer to develop on a project to project basis. Councilman Baljo MOVED THAT RESOLUTION NO.85-24,A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,REQUESTING WITHDRAWAL OF THE CITY'S APPLICATION TO THE STATE LAND DEPARTMENT FOR "DESIGNATION AND RECLASSIFICATION OF STATE LANDS AS URBAN LANDS SUITABLE FOR URBAN PLANNING"FOR STATE TRUST LANDS IN THE APACHE JUNCTION AREA,BE APPROVED AND ADOPTED. RELEASE OF RETAINAGE MONIES FOR THE PLANNING BUILDING )Mr.McNulty stated that final inspections on the Planning Building have been made and the tenants of the contract have been met. REQUEST FOR EXTENSION TO CLEAN PROPERTY )City Clerk Kathleen Connelly stated that this is a request from Mr.Chester Powell of Barrington,Illinois,to be granted a 30 day extension as he is in the process of selling the lot, however,the lot is a fire hazard and i f the new owner does not clean the property upon purchase,the notification process would have to been done over again. Councilman Jimenez expressed his opinion that an extension should not be granted as this would delay cleaning up the weeds and creating a further fire hazard. Councilwoman Gardner asked how high the weeds are on the lot. Ms Connelly stated that City Code requires that they not exceed 18"and the weeds are considerably over 18". Councilman Jimenez addressed the item questioning the necessity of purchasing the equipment at this time, other than the portable bleachers. Representatives from the Jaycee's addressed the Council,stating that i f the City purchased new bleachers and equipment the cost would be much higher.
