CALL TO ORDER Mayor Hill called the meeting to order at 7:00 p.m. INVOCATION Councilman Eidson gave the Invocation. PLEDGE OF ALLEGIANCE Vice Mayor Bakkedahl led the Pledge of Allegiance. Introduction of Distinguished Visitors and Guests Mayor Hill recognized State Representative Roy Hudson,ex -Mayor Wendell Clarke and his wife,President of the Chamber of Commerce Sandy Smith. AWARDS,PRESENTATIONS AND COMMUNICATIONS Councilwoman Taylor objected to the Council seating arrangement. CITY MANAGER'S REPORT None. PUBLIC HEARINGS PRELIMINARY PLANNED DEVELOPMENT CONSIDERATION,SUPERSTITION HEIGHTS ) public. Mayor Hill opened the hearing to the REGULAR MEETING OF THE CITY COUNCIL JULY 2,1985 PAGE 2 OF 21 Director of Planning Chuck Newcomer explained that this is a preliminary subdivision plat for a 47 lot twin -home subdivision,and that the two rezoning cases,PZ-8-85 and PZ-30-83,have been approved by the Council. Mr.Larry Richardson,8600 San Ardo, Scottsdale,representing Lewis -Brewer Development,addressed the Council outlining the proposed development,and that there will be fences surrounding the homes with gates. Councilman Jimenez wished to know what the selling price would be per home,what was the square footage per unit,and what parking allotment would be. Mr.Richardson stated that the goal for the selling price would be under $50,000,each house would have it's own carport and driveway in the front and there would be a 20 -car parking lot for visitors,and the square footage would be around 900 feet. Mayor Hill asked i f there was anyone who wished to speak in favor of or in opposition to the application.There being no one wishing to address the Council,Mayor Hill called upon the Director of Planning for recommendations. Mr.Newcomer stated that the Development Coordinating Committee recommends approval of the proposal. Councilman Baljo MOVED THAT PRELIMINARY •PLANNED DEVELOPMENT FOR SUPERSTITION HEIGHTS (PZ-8-85 AND PZ-30-83)BASED UPON THE ELEVATIONS,PLANS,FLOOR PLANS AND RENDERINGS,AND INCLUDING THE AMENDED PRELIMINARY PLANNED DEVELOPMENT SITE PLAN DATED JUNE 24,1985 BE APPROVED. Councilwoman Taylor seconded the motion. VOTE:Unanimous The motion carried. PROPOSED ORDINANCE NO.361, PZ-10-85,MEADE )Mr.Newcomer addressed the request for rezoning from GR General Rural to CR-5 Multiple Residence Zone of a 17,780 square foot parcel,located on the east side of Ironwood Drive approximately 500 feet north of Roosevelt Street in Section 20,and stated that a letter was submitted by Mr.Keith Stacher,representative for the applicants,requesting that the Council consider CR-4 rather than CR-5, noting that the Planning and Zoning Commission did not address CR-4 in their transmittal to the Council. Mr.Keith Stachar,6301 E.Roundup, Apache Junction,again requested that this case be referred back to the Planning and Zoning Commission to be considered for CR-4 rather than CR-5. Mayor Hill asked i f there was anyone who wished to speak in favor of or in opposition to the rezoning. Mr.Larry Barrington,359 N. Ironwood,Apache Junction,representing protesters of the case addressed the Council in opposition of the application. Mr.Newcomer stated that the Planning and Zoning Commission recommends denial of the application and the staff also recommends denial,with stipulations i f approved. Mr.Stachar replied to the oppositions,stating that the parcel is large enough for the request and is compatible with existing neighborhood uses. Councilwoman Taylor MOVED THAT ORDINANCE NO.361 BE READ BY TITLE ONLY AND THE READING OF THE ENTIRE ORDINANCE BE WAIVED. Councilman Baljo seconded the motion. VOTE:Unanimous The motion carried. PROPOSED ORDINANCE NO.362,PZ-11-8-5, BRADLEY AND VANDEVER )Mr.Newcomer briefed the Council on the request for rezoning from GR General Rural to TH Trailer Homesite Zone of two separate 1.25 acre parcels,located between Ironwood and Gold Drives, about 330 feet south of Tepee Street in Section 20. Mr.Manard Vandever,requested approval of the application. Mayor Hill asked i f there was anyone who wished to speak in favor of or in opposition to the rezoning. A resident at 1477 N.Ironwood, Apache Junction,addressed the Council in favor of the application. Mayor Hill closed the hearing to the public and called upon the Director of Planning for recommendations. Mr.Newcomer addressed the Council, stating that this is an application for rezoning from GR General Rural to TH Trailer Homesite Zone of a 1.25 acre parcel,located on the north side of Fourth Avenue between Hopi and Arizona Roads in Section 21. Ms Dorothy Eckard Ramsey,950 E.4th Avenue,Apache Junction,requested approval and explained that the purpose of this rezoning would be to set up a mobile home for a relatives use. trailers presently on the parcel. Councilwoman Taylor asked about two Ms Ramsey stated that one is a travel trailer and the other is a trailer that is not set up or occupied. Mayor Hill asked i f there was anyone who wished to speak in favor of or in opposition to the application.There being no one wishing to address the Council,Mayor Hill called upon the Director of Planning for recommendations. PROPOSED ORDINANCE NO.368, PZ-16-85,BEAULIEU )Mr.Newcomer briefed the Council on the request for rezoning from GR General Rural to C-2 Local Commercial District of a 27,150 square foot parcel,located on the southwest corner of Valley Drive and Superstition Boulevard in Section 20,and that protest petitions have been filed requiring a three-quarter vote of the Council for approval. Mr.Bill Beaulieu,306 E.Frontier Rd.,Apache Junction,requested rezoning of the parcel,proposing shops to be developed on the property. Mayor Hill asked i f there was anyone who wished to speak in favor of or in opposition to the application.There being no one wishing to address the Council,Mayor Hill called upon the Director of Planning for recommendations. Mr.Newcomer stated that staff has no objections to the rezoning as is consistent with General Plan designations,and that the Planning and Zoning Commission recommends approval with stipulations. Councilwoman Taylor seconded the PROPOSED ORDINANCE NO.376, PZ-20-85,PERRAULT AND FORD )Mr.Newcomer stated that this is a request for rezoning from GR General Rural to TH Trailer Homesite Zone of a 1.1 acre parcel,located on the east side of Main Drive between Foothill and Smoketree Streets in Section 18. Ms lone Chivonnic,of East Gate Realty,1980 W.Canyon,Apache Junction,representing the applicants, requested approval of the rezoning. Councilwoman Gardner wished to know how many trailers the owners proposed to place on the property. Ms Chivonnic stated that possibly three trailers. Mayor Hill asked i f there was anyone who wished to speak in favor of or in opposition to the application.There being no one wishing to address the Council,Mayor Hill called upon the Director of Planning for recommendations. Mr.Newcomer addressed the Council, stating that staff has no objections to the case and that the Planning and Zoning Commission recommends approval with stipulations including that the site not be developed into a mobile home or RV park. Mayor Hill recessed the meeting at 8:35 p.m. Mayor Hill reconvened the meeting at 8:45 p.m. PROPOSED ORDINANCE NO.380, PZ-21-85,BRINKMAN public. )Mayor Hill opened the hearing to the Mr.Newcomer stated that this is a request for rezoning from GR General Rural to TH Trailer Homesite Zone of a 1.25 acre parcel,located on the northeast corner of the intersection of West Foothill Street and North Cedar Drive,and as the applicant has not signed the quit claim deed for the dedication of rights -of -way,recommended that the Council postponed until this is completed. Councilwoman Gardner MOVED THAT PROPOSED ORDINANCE NO.380,PZ-21-85,BE POSTPONED UNTIL THE NEXT REGULAR COUNCIL MEETING OF JULY 16,1985. Councilman Baljo seconded the motion. REGULARAEETINGiOF THE CITY COUNCIL JULY 2,,1985 PAGE 8 OF 21 PROPOSED ORDINANCE NO.381, PZ-22-85,BURKINSHAW )Mr.Newcomer briefed the Council on the application for rezoning from GR General Rural to TH Trailer Homesite of a 1.25 acre parcel,with a mobile home on the site,located on the northwest corner of the intersection of West Shiprock Street and North Cedar Drive in Section 18 with surrounding land uses including mobile homes and a house. Ms Martha Burkinshaw,303 W.6th St.,Mesa,requested approval of the rezoning,and stated that they proposed to split the parcel in half and place another mobile home on the east side. Mayor Hill asked i f there was anyone who wished to speak in favor of or in opposition to the rezoning.There being no one wishing to address the Council,Mayor Hill called upon the Director of Planning for recommendations. Mr.Newcomer stated that staff has no objections with stipulations,and that the Planning and Zoning Commission recommends approval of the application with stipulations. CALL TO THE PUBLIC Ms Donna Loewenstein,101 S.Ironwood Drive,Apache Junction,addressed the Council requesting a 90 day extension for the opening of 4th Avenue. Mr.Keith Stachar,6301 E.Roundup,protested that the public hearing on Ordinance No.361 which was denied,was not closed and sufficient consideration given to the rezoning,and requested that the case be put back on the agenda for reconsideration to CR-4. INFORMATION AND REPORTS (COUNCIL LIAISON REPORTS) Councilman Jimenez stated that parents of the children involved with Southwest Human Development should be aware that work is being done to resolve this issue. Councilman Baljo read a letter from the Department of Transportation in regards to the scheduling of the construction on U.S.Highway 60 and S.R.88,which is rescheduled for May of 1986 to better accomodate winter visitor traffic. REQUESTS OF COUNCIL ,Councilman Eidson requested a public apology from the new Councilmembers for past statements against the incumbent Councilmembers.
