CALL TO ORDER Mayor Hill called the meeting to order at 7:00 p.m. INVOCATION Councilman Eidson gave the Invocation. PLEDGE OF ALLEGIANCE Councilman Baljo led the Pledge of Allegiance. Lieutenant George Baker,representing the Salvation Army,addressed the Council regarding Salvation Army services in Apache Junction. CITY MANAGER'S REPORT None. POLK HEARINGS PROPOSED ORDINANCE NO.380, PZ-21-85,BRINKMAN )Mayor Hill opened the hearing to the Public. Director of Planning Chuck Newcomer briefed the Council on the request for rezoning from GR General Rural to TH Trailer Homesite of a 1 1 /4 acre parcel,located on the northeast corner of the intersection of West Foothill Street and North Cedar Drive in Section 18. Mr.Jim Brinkman,265 W.5th Avenue, Apache Junction,requested approval of the application. Mayor Hill asked i f there was anyone who wished to speak in favor of or in opposition to the application.There being no one wishing to address the Council,Mayor Hill called upon the Director of Planning for recommendations. Councilwoman Gardner seconded the )Mayor Hill opened the hearing to the Mr.Newcomer stated that this is a request for rezoning from Gr General to TH Trailer Homesite Zone of two 5 acre parcels,located between North Warner and North Desert View Drives from West Foothill to West Smoketree Streets in Section 18,with designation of Medium to High Density Residential Opportunity on the General Plan. Mr.A.E.Sullivan,438 N.Saguaro, Apache Junction,asked i f there were any questions from the Council. Councilwoman Gardner wished to know what was the proposed use for the property. Mr.Sullivan stated that there are three people involved,and they would hire an engineer to suggest the best use,but at this time the applicants don't know. Mayor Hill asked i f there was anyone who wished to speak in favor of or in opposition to the petition.There being no one wishing to address the Council,Mayor Hill called upon the Director of Planning for recommendation. Mr.Newcomer explained that this is a request for rezoning from GR General Rural to TH Trailer Homesite Zone,of a 1.12 acre parcel located on the south side of East 4th Avenue, approximately 165 feet east of South Royal Palm Road in Section 21. Mr.Mike Kovacs,710 S.Lawson, Apache Junction,representing the applicant,addressed the Council. Councilman Jimenez asked what was the intent of rezoning. Mr.Kovacs stated that the applicant wishes to divide the property into three lots for resale. Associate Planner Jim Nakagawa explained that this is a Commission -initiated amendment to the Zoning Ordinance,to add Article 23 Outdoor Light Control Regulations (Dark Sky Ordinance),with the purpose of keeping outdoor light from escaping upward into the night sky through shielding and filtering devices and placing restrictions on lamp types,as Arizona is one of the few places in the world ideal for celestial observations,and that this ordinance has already been adopted by many cities and towns in Arizona.Mr.Nakagawa stated that the billboard industry advocated changing the hours of operation for the lighting of their signs from 11:00 p.m.to midnight,but was rejected by the Planning and Zoning Commission,and Salt River Project recommended going with the more lenient ordinance adopted by the City of Mesa,which also was rejected by the Commission. Mr.Bill Robinson of Kitt Peak National Observatory,gave a slide presentation on the outdoor lighting problem in Arizona,and requested approval of the proposed ordinance. A representative of Gannett Outdoor Systems addressed the Council,stated that Maricopa County did adopt a similar ordinance and requested that the hours of operation for lighting signs be until midnight. Mr.Rex Cunney,representing another advertising company,also requested midnight as the requirement. Councilman Jimenez asked i f Mr.Robinson had a problem with a midnight stipulation rather than 11:00 p.m. Mr.Robinson replied that there was not a strong objection to midnight,but would prefer 11:00 p.m. Councilman Eidson asked about security and advertising lights on business sights. Councilwoman Gardner seconded the motion. Vice Mayor Bakkedahl stated that an extra hour should not create a-probleuvand possibly the CounciI:should consider the midnight _cutoff. Councilwoman Taylor stated that this would be an agreeable compromise. NEW BUSINESS PROPOSED RESOLUTION NO.85-26, AB -85-05,MINNICK )Director of Public Works briefed the Council on the request for abandonment of Smoketree Street from Saguaro Drive to Ironwood Drive,which is not open or maintained by the City and all property owners have access from other streets.Mr.Broman stated that the Development Coordinating Committee has no objection to the application. Dr.R.S.Minnick,Los Angeles, California,previous owner of Sierra Leone Mobile Home Park,explained that he wished to build a mobile home park and the abandonment of Smoketree Street would be necessary prior to construction of the development. Councilwoman Gardner commented that upon checking the site,i t was apparent that the road is Vitrayeled.(Amended 2t, Councilman Baljo asked what the General Plan designation is for this area. Mr.Newcomer stated that i t is medium to high density residential opportunity which could include a mobile home park. 8/?,0/85. Councilwoman Gardner seconded the Councilwoman Taylor voiced her Councilman Jimenez stated that the Mayor Hill agreed that the street Councilwoman Taylor stated that this is unfair to the property owner,as other similar abandonments have been approved,and to deny this request is prejudiced. Mayor Hill expressed his feeling that possibly the Council should be more cautious before approving abandonments in the future. REQUEST FOR EXTENSIONS TO CLEAN PROPERTY )City Clerk Kathleen Connelly stated that there are requests from three property owners,two of which wish extensions,and the third,Mr.Robert Maples does not feel there is a violation and wishes to appeal the action. Mr.McNulty informed the Council that staff has met with BLM and other agencies regarding the Weeks Wash Dam and have been monitoring this project. INFORMATION AND REPORTS (COUNCIL LIAISON REPORTS) Councilman Jimenez reported a meeting with the mental health group and DES has not awarded the bid for health services for the District Schools as yet. REQUESTS OF COUNCIL Councilman Jimenez requested that a meeting be held with the City Council,homeowners,State,utilities and Hearst Corporation,to resolve the problem with Sierra Entrada sewage. Ms Kay Morgan,W.9th Avenue,Apache Junction,addressed the Council in regards to Waste Management refusing to pick up garbage in the alley. Mr.McNulty stated that the City does not have an ordinance requiring garbage companies to pick up in the alley,and that due to cables,utility boxes,the garbage companies are open to suit because of damages,but that staff will check into this and report to the Council.
