JULY 16,1985
The regular meeting of the City Council of the City of Apache Junction,
Arizona,was held on July 16,1985,at the Apache Junction City Council
Chambers pursuant to the notice required by law.
CALL TO ORDER
Mayor Hill called the meeting to order at 7:00 p.m.

briefed the Council on the request for rezoning from GR General Rural to TH
Trailer Homesite of a 1 1 /4 acre parcel,located on the northeast corner of
the intersection of West Foothill Street and North Cedar Drive in
Section 18.
Mr.Jim Brinkman,265 W.5th Avenue,
Apache Junction,requested approval of the application.
Mayor Hill asked i f there was anyone
who wished to speak in favor of or in opposition to the application.There
being no one wishing to address the Council,Mayor Hill called upon the
Director of Planning for recommendations.

Apache Junction,asked i f there were any questions from the Council.
Councilwoman Gardner wished to know
what was the proposed use for the property.
Mr.Sullivan stated that there are
three people involved,and they would hire an engineer to suggest the best
use,but at this time the applicants don't know.

Mr.Newcomer explained that this is
a request for rezoning from GR General Rural to TH Trailer Homesite Zone,of
a 1.12 acre parcel located on the south side of East 4th Avenue,
approximately 165 feet east of South Royal Palm Road in Section 21.
Mr.Mike Kovacs,710 S.Lawson,
Apache Junction,representing the applicant,addressed the Council.
Councilman Jimenez asked what was
the intent of rezoning.
Mr.Kovacs stated that the applicant
wishes to divide the property into three lots for resale.
Mayor Hill asked i f there was anyone

being no one wishing to address the Council,Mayor Hill called upon the
Director of Planning for recommendations.

DARK SKY ORDINANCEl(EmergencyClause))
)'Mayor Hill opened the 'hearing'to the
public.
Associate Planner Jim Nakagawa
explained that this is a Commission -initiated amendment to the Zoning
Ordinance,to add Article 23 Outdoor Light Control Regulations (Dark Sky
Ordinance),with the purpose of keeping outdoor light from escaping upward
into the night sky through shielding and filtering devices and placing
restrictions on lamp types,as Arizona is one of the few places in the world
ideal for celestial observations,and that this ordinance has already been
adopted by many cities and towns in Arizona.Mr.Nakagawa stated that the
billboard industry advocated changing the hours of operation for the
lighting of their signs from 11:00 p.m.to midnight,but was rejected by the
Planning and Zoning Commission,and Salt River Project recommended going
with the more lenient ordinance adopted by the City of Mesa,which also was
rejected by the Commission.
Mr.Bill Robinson of Kitt Peak
National Observatory,gave a slide presentation on the outdoor lighting
problem in Arizona,and requested approval of the proposed ordinance.
A representative of Gannett Outdoor
Systems addressed the Council,stated that Maricopa County did adopt a
similar ordinance and requested that the hours of operation for lighting
signs be until midnight.
Mr.Rex Cunney,representing another
advertising company,also requested midnight as the requirement.
Councilman Jimenez asked i f
Mr.Robinson had a problem with a midnight stipulation rather than
11:00 p.m.
Mr.Robinson replied that there was
not a strong objection to midnight,but would prefer 11:00 p.m.
Councilman Eidson asked about
security and advertising lights on business sights.
Mr.Nakagawa statedAhatAhe
ordinance Would not affect security lights.

Councilwoman Gardner seconded the

Vice Mayor Bakkedahl stated that an
extra hour should not create a-probleuvand possibly the CounciI:should
consider the midnight _cutoff.
Councilwoman Taylor stated that this
would be an agreeable compromise.

MOTION TO READ THAT THERE BE A PROVISION FOR TURNING THE LIGHTS OFF AT UNDER

NEW BUSINESS
PROPOSED RESOLUTION NO.85-26,
AB -85-05,MINNICK
)Director of Public Works briefed the
Council on the request for abandonment of Smoketree Street from Saguaro
Drive to Ironwood Drive,which is not open or maintained by the City and all
property owners have access from other streets.Mr.Broman stated that the
Development Coordinating Committee has no objection to the application.
Dr.R.S.Minnick,Los Angeles,
California,previous owner of Sierra Leone Mobile Home Park,explained that
he wished to build a mobile home park and the abandonment of Smoketree
Street would be necessary prior to construction of the development.
Councilwoman Gardner commented that
upon checking the site,i t was apparent that the road is Vitrayeled.(Amended

Councilman Baljo asked what the
General Plan designation is for this area.
Mr.Newcomer stated that i t is
medium to high density residential opportunity which could include a mobile
home park.

RESOLUTION NO.85-25,A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY
OF APACHE JUNCTION,ARIZONA,DECLARING THAT A CERTAIN FEDERALLY PATENTED
EASEMENT FOR PUBLIC RIGHT-OF-WAY PURPOSES ON FIFTH AVENUE FROM WICKIUP ROAD
TO CHAPARRAL ROAD AS DESCRIBED IN STREET ABANDONMENT CASE AB -85-04,ARE NO
LONGER NECESSARY FOR PUBLIC USE AS A ROADWAY AND ARE HEREBY ABANDONED AND
EXTINGUISHED AS PRESENT OR FUTURE PUBLIC RIGHT-OF-WAY,BE APPROVED AND
ADOPTED.
Councilman Eidson seconded the
motion.

Councilman Jimenez,Councilwoman Taylor,Mayor Hill
Opposed:Vice Mayor Bakkedahl,Councilman Baljo
The motion carried.
PROPOSED FREEZE ON RESIDENTIAL ZONING)
)Mayor Hill expressed his opinion
that a freeze is nct necessary.
Councilwoman Gardner as having made
the request for a proposed freeze,withdrew that request.

City Attorney David Alexander
informed the Council that i f there is not a motion made,the item may be
dropped.
Councilman Jimenez commented on the
"lot split ordinance"and the status.
Mr.Roy Hudson,2084 W.9th Avenue,
Apache Junction,addressed the Council in regards to lot splitting.
REQUEST FOR EXTENSIONS
TO CLEAN PROPERTY
)City Clerk Kathleen Connelly stated
that there are requests from three property owners,two of which wish
extensions,and the third,Mr.Robert Maples does not feel there is a
violation and wishes to appeal the action.
Councilwoman Taylor asked i f the
Maples violation is weeds or trash.
Ms Connelly stated that there are
weeds well over 18"high,and some scrap concrete.
Councilman Jimenez MOVED THAT THE
REQUEST FOR EXTENSIONS TO CLEAN PROPERTY BE GRANTED AS FOLLOWS:
MR.PETER BODNAR FOR 30 DAYS
MR.KENNETH BLAIR FOR 30 DAYS
MR.ROBERT MAPLES FOR 30 DAYS

INTERGOVERNMENTAL AGREEMENT WITH
PINAL COUNTY FOR HEALTH SERVICES )
)City Manager Michael J.McNulty
explained that this would be an agreement for Pinal County to provide health
services that the City desires at no fee,but the responsibility and
liability is with the City to request those services.
Councilman Baljo MOVED THAT THE
INTERGOVERNMENTAL AGREEMENT BETWEEN THE CITY OF APACHE JUNCTION AND PINAL
COUNTY HEALTH SERVICES,FOR SPECIFIC HEALTH SERVICES BE ACCEPTED AS
PRESENTED.
Vice Mayor Bakkedahl seconded the
motion.
VOTE:Unanimous

ADOPTION OF INTERIM CODE OF CONDUCT )
)Ms Connelly explained that due to
new requirements to receive Federal funding,it's necessary for the Council
to have an adopted Code of Conduct,which addresses Conflict of Interest and
Neputism,and at present our City Code does not have these as a General Law
City.Ms Connelly also informed the Council that they have received a copy
of the two proposed documents for adoption,"You as a Public Official"and
"CDBG Information Bulletin No.10".

Mr.Newcomer stated that by adoption
of these,it would relieve the City of an complications in receiving grant
funds.
Councilman Baljo MOVED THAT THE
LEAGUE OF ARIZONA CITIES IANDTOWNS BULLETIN "YOU AS A PUBLIC OFFICIAL"BE
ADOPTED IN CONJUNCTION WITH CDBG INFORMATION BULLETIN NO.10 AS THE OFFICIAL
CODE OF CONDUCT FOR THE CITY OF APACHE JUNCTION UNTIL SUCH TIME THAT A CITY
ORDINANCE ON CONDUCT IS ADOPTED.
Councilwoman Taylor seconded the
motion.

REQUEST FOR EXTENSION OF OPENING
OF FOURTH AVENUE,LOEWENSTEIN )
)Mr.Broman stated that
Mrs.Loewenstein has requested an extension of 90 days prior to opening 4th
Avenue,to provide her time to make certain corrections to the offsite
improvement and install landscaping.
Councilman Baljo suggested a
compromise by giving Mrs.Loewenstein 30 days to construct a gate.
Councilman Baljo MOVED THAT
MRS.LOEWENSTEIN BE GRANTED A 30 DAY EXTENSION COMMENCING FROM DATE OF
CURRENT TERMINATION AND IIN LIEU OF OPENING FOURTH AVENUE,A WALK-THROUGH
GATE BE CONSTRUCTED ON THE RIGHT-OF-WAY.

CALL TO THE PUBLIC
Mr.Clay Worst,5289 E.Apache Trail,Apache Junction,addressed the
Council regarding the Buckhorn Mesa Watershed Project,conceived about 15
years ago,a series of flood retention and diversion structures that has
been dormant for many. years.Mr.Worst requested that a Council liaison
attend the meeting concerning this project.
Mr.McNulty informed the Council that staff has met with BLM and other
agencies regarding the Weeks Wash Dam and have been monitoring this project.
INFORMATION AND REPORTS
(COUNCIL LIAISON REPORTS)
Councilman Jimenez reported a meeting with the mental health group and
DES has not awarded the bid for health services for the District Schools as
yet.
Vice Mayor'BakkedahlTeportedAhatthe Little ,League was rained out at
their last game but wouldiplay:this meek.
REQUESTS OF COUNCIL
Councilman Jimenez requested that a meeting be held with the City
Council,homeowners,State,utilities and Hearst Corporation,to resolve the
problem with Sierra Entrada sewage.
Ms Kay Morgan,W.9th Avenue,Apache Junction,addressed the Council in
regards to Waste Management refusing to pick up garbage in the alley.
Mr.McNulty stated that the City does not have an ordinance requiring
garbage companies to pick up in the alley,and that due to cables,utility
boxes,the garbage companies are open to suit because of damages,but that
staff will check into this and report to the Council.
