CALL TO ORDER Mayor Hill called the meeting t o order at 7:00 p.m. INVOCATION Councilman Eidson gave the Invocation. PLEDGE OF ALLEGIANCE Councilman Baljo led the Pledge of Allegiance. Councilman Baljo seconded the motion. VOTE:Unanimous The motion carried. Introduction of Distinguished Visitors and Guests Mayor Hill recognized Ex -Mayor Wendell Clarke and his wife,and members of the press. AWARDS,PRESENTATIONS AND COMMUNICATIONS None. CITY MANAGER'S REPORT City Manager Michael J.McNulty introduced the new Editor of the Apache Junction Independent and News,Dean Rhodes. Mr.Dean Rhodes,addressed the Council stating that the newspaper would do it's best to assist the community in it's growth. COuncilman Baljo _requested that the newspaper cover PinaliCounty Board of Supervisor meetings,as they do influence Apache Junction. Mr.McNulty reminded :the Council and public that Library contracts and pre -construction conferences will be held on October 16th and the ground will be broken on October 23rd.Mr.McNulty added that hopefully construction will be completed about April 25,1986. REGULAR MEETINGAY THE CITY COUNCIL OCTOBER 15,1985 PAGE 2 OF 14, PUBLIC HEARINGS PROPOSED ORDINANCE NO.407, PZ-41-85,WIRTH )Mayor Hill opened the hearing to the public. Director of Planning Chuck Newcomer briefed the Council on the rezoning application for Lot #20 at the Francis M.Schmitz Business Lot Subdivision,on the west side of South Ironwood Drive approximately 250'north of West Broadway Avenue,from CB -2 to C-3, with special use permits for a mobile home caretaker's unit on the property which i s not permitted under CB -2 zoning classification.Mr.Newcomer also stated that Mr.Wirth,at the Planning and Zoning Commission meeting had indicated that the rezoning would only be acceptable with the special use permit,and that the Planning and Zoning Commission approved the permit contingent upon Council approval of the rezoning to C-3 with stipulations. Mr.Richard Wirth explained to the Council that the property i s currently developed with a mini -storage,and proposed to place a mobile home caretaker's unit on the parcel. Councilman Baljo stated that i f this special use permit were granted for a mobile home unit,any mobile home structure may be placed on the parcel. Mr.Wirth stated that the application i s specifically for the one structure only and that other property uses are being given up to accomplish this. would be i n favor i f there was precedent. Councilman Baljo stated that he some way to do so without setting a Mr.Newcomer explained that prior to pulling the permit,the Building Department,Department of Public Works,and the Department of Planning will review i t and would ensure that i t i s exactly what was proposed to the Planning and Zoning Commission. City Attorney David Alexander stated that the amendment to the Zoning Ordinance i s under consideration,not the special use permit,the Council may vote yes or no or send that application back to the Planning and Zoning Commission. Councilman Baljo stated that he did not wish the applicant to undergo hardship,but would recommend that the application be resubmitted to the Planning and Zoning Commission. Councilman Baljo that this could be a parcels have been recently rezoned to Vice Mayor Bakkedahl agreed with problem i n the future. Mr.Wirth stated that adjacent commercial. Mayor Hill asked i f there was anyone who wished to speak in favor of or in opposition to the application.There being no one wishing to address the Council,Mayor Hill called upon the Director of Planning for recommendations. Mr.Newcomer stated that staff recommends approval of the rezoning with the stipulation of dedication of the east 15'for roadway purposes and that the Planning and Zoning Commission recommends approval with the same stipulation. REGULAR MEETING OF THE CITY COUNCIL OCTOBER 15,1985 PAGE 3 OF 14 Councilman Baljo MOVED THAT ORDINANCE NO.407 BE SENT BACK TO THE PLANNING AND ZONING COMMISSION FOR FURTHER CONSIDERATION OF A SPECIFIC BUILDING CONSTRUCTION TO ACCOMMODATE THE BUILDING THAT THE APPLICANT WISHES TO PLACE ON THE PROPERTY. motion. an unusual circumstance. Councilwoman Gardner seconded the Councilman Jimenez asked i f this was Mr.Newcomer replied that the rezoning to a less intense use to be able to apply for the special use permit i s unusual,and that this was suggested by staff. Councilman Jimenez stated that as staff recommended this type of application there should not be a problem. VOTE:In Favor:Councilman Eidson,Councilwoman Gardner,Councilman Baljo, Councilwoman Taylor,Vice Mayor Bakkedahl,Mayor Hill Opposed:Councilman Jimenez The motion carried. PZ-62-85,PLANNED DEVELOPMENT OPEN SPACE AMENDMENT )Director of Planning Chuck Newcomer requested that this item be postponed as the Planning and Zoning Commission felt the issue necessitates further study and will have a recommendation available by November 5,1985. Councilman Baljo felt that this should be discussed longer and possibly postponed until the regular Council meeting of November 19,1985. Councilwoman Gardner MOVED THAT REZONING CASE NO.PZ-62-85 BE POSTPONED UNTIL THE REGULAR MEETING OF NOVEMBER 19,1985. motion. VOTE:Unanimous The motion carried. PROPOSED ORDINANCE NO.408, PZ-42-85,EQUINE REGULATIONS public. Councilwoman Taylor seconded the Mayor Hill opened the hearing to the Mr.Newcomer explained that this i s a proposed amendment to the Zoning Ordinance,providing for specific regulations for the keeping of horses in the City. Mr.Chuck Jazstremski,5722 E.10th Avenue,Apache Junction,representing the Superstition Horsemen's Association,requested that this ordinance be adopted. Mayor Hill asked i f there was anyone else who wished to speak on this item.There being no one else wishing to address the Council,Mayor Hill closed the hearing to the public. Councilman Baljo MOVED THAT ORDINANCE NO.408,BE READ BY TITLE ONLY AND THE READING OF THE ENTIRE ORDINANCE BE WAIVED. City Clerk Kathleen Connelly read as follows: ORDINANCE NO.408,AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,AMENDING THE APACHE JUNCTION,ARIZONA,ZONING ORDINANCE BY ADDING SECTION 6.0130 EQUINE REGULATIONS;REPEALING ANY CONFLICTING PROVISIONS;AND PROVIDING FOR SEVERABILITY. Councilman Baljo MOVED THAT ORDINANCE NO.408,AS READ BY THE CITY CLERK BE APPROVED AND ADOPTED. Councilwoman Taylor seconded the motion. VOTE:Unanimous The motion carried. PROPOSED ORDINANCE NO.431, HUD STANDARD MOBILE HOMES )Mayor Hill opened the hearing to the public. Mr.Newcomer stated that staff was asked to submit a proposal addressing HUD standard mobile homes in the City, which was compiled with ordinances used by other cities.Mr.Newcomer explained that two alternatives have been submitted;the first provides that any mobile home to be installed or relocated within the City would have to be a Department of Housing and Urban sticker and the date of manufacture, which could not have been prior to June 15,1976 which was the beginning of the HUD certification program,and the second would also permit either the HUD compliance mobile homes not prior to 1976,or the State of Arizona insignia of approval manufactured not prior to September 17,1972. Mayor Hill asked i f there was anyone who wished to speak on this item. Mr.Sonny Rickles,Executive Director of Manufactored Housing Association,addressed the Council i n opposition to the proposed ordinance and asked various questions regarding the proposal. Councilman Eidson stated that residents should not have their homes,pre -1972 models,condemned. Mr.Gil Verley,620 S.Palo Verde, Apache Junction,expressed opposition to the ordinance,and asked that a committee be appointed to further study this issue prior to Council action. Mr.Jim Hearst,1065 N.San Marcos, Space 2,Apache Junction,Manager of Baywood Mobile Home Park,stated that there are 20 old trailers in the Park,and that these trailers would not have a resale even though they are in good repair,and further stated that this issue should have additional study. Mr.Al McDaley,545 N.Ocotillo, Space 40,Apache Junction,also opposed the amendment. REGULAR MEETING OF THE CITY COUNCIL OCTOBER 15,1985 PAGE 5 OF 14 Mr.Bud Davis,representing Central Arizona Mobile Homeowners Association,spoke in opposition to the ordinance. Councilman Baljo MOVED THAT ORDINANCE NO.431 BE RETURNED TO THE PLANNING AND ZONING COMMISSION FOR FURTHER CONSIDERATION AND A STUDY COMMITTEE BE FORMED TO INCLUDE REPRESENTATION OF THE MOBILE HOME ASSOCIATION,OFFICE OF MANUFACTURED HOUSING,MANUFACTURED HOUSING ASSOCIATION OF ARIZONA,TWO OWNERS OF PARKS WHICH HAVE PRE -1976 MOBILE HOMES,AND AT LEAST TWO RESIDENTS THAT LIVE IN PRE -1976 MOBILE HOMES. Vice Mayor Bakkedahl seconded the motion. Councilwoman Taylor commented that the Council needs to look into other industries,such as subdivisions,real estate,and conventional housing. Councilman Jimenez asked i f this i s a typical ordinance in other cities and towns. Mr.Newcomer replied that cities such as Bullhead City,Yuma have a similar ordinance,and Mesa has some mobile home restrictions. Councilman Jimenez added that State and Federal laws reflect some guidelines and that this i s a necessary ordinance for the health and safety of the citizens of Apache Junction. Councilman Baljo added to the motion THAT THE ORDINANCE BE RETURNED TO THE CITY COUNCIL WITHIN A MAXIMUM OF 120 DAYS. Vice Mayor Bakkedahl agreed to this. VOTE:Unanimous The motion carried. PROPOSED ORDINANCE NO.435, PZ-52-85,BEAULIEU )Mayor Hill opened the hearing to the public. Mr.Newcomer briefed the Council on the request for rezoning of a 20,768 square foot parcel located 100'feet south of Superstition Boulevard on North Valley Drive on the east side of the street,from GR General Rural to C-2 Local Commercial District. Mr.Bill Beaulieu,306 E.Frontier Rd.,Apache Junction,requested approval of the rezoning application. Mayor Hill asked i f there was anyone who wished to speak in favor of. or in.opposition to the application.There being no one wishing to address the Council,Mayor Hill called upon the Director of Planning for recommendations. Mr.Newcomer stated that staff has no objection to the application and that the Planning and Zoning Commission recommends approval of the rezoning. Councilwoman Taylor MOVED THAT ORDINANCE NO.435 BE READ BY TITLE ONLY AND THE READING OF THE ENTIRE ORDINANCE BE WAIVED. Councilman Baljo seconded the motion. Councilman Baljo seconded the Mayor Hill opened the hearing to the Mr.Newcomer stated that this i s an application to rezone a 1 1/4 acre parcel,located at the southeast corner of the intersection of South Royal Palm Road and East 4th Avenue i n Section 21,from GR General Rural to TH Trailer Homesite. Mr.A.E.Sullivan,438 N.Saguaro, Apache Junction,representing the applicant,offered to answer any questions. Councilwoman Gardner wished to know what was the applicant proposed to do about the wash through the property. Mr.Sullivan replied that possibly a culvert would be placed in the wash. Mr.McNulty explained that the applicant would have to comply with the Floodplain regulations prior to development. Mayor Hill asked i f there was anyone who wished to speak in favor of or in opposition to the rezoning.There being no one wishing to address the Council,Mayor Hill called upon the Director of Planning for recommendations. Mr.Newcomer stated that staff recommends approval of the rezoning with stipulations and that the Planning and Zoning Commission voted unanimously to approve the application with the dedication of rights -of -way for public roadway and associated purposes. Councilman Eidson MOVED THAT ORDINANCE NO.436 BE READ BY TITLE ONLY AND THE READING OF THE ENTIRE ORDINANCE BE WAIVED. Councilman Baljo seconded the motion. Mayor Hill recessed the meeting. Mayor Hill reconvened the meeting at 8:37 p.m. PROPOSED ORDINANCE NO.437, PZ-54-85,WHITE public. Mayor Hill opened the hearing to the Mr.Newcomer explained that this is a request for rezoning of a 1 1/4 acre parcel,located at the northwest corner of West Windsong Street and North Main Drive i n Section 18,from GR General Rural to TH Trailer Homesite Zone. Mr.Frank Talbott,Superstition Realty,735 S.Ocotillo,representing the applicant,requested approval of the application. Councilwoman Gardner asked what the proposed use would be. Mr.Talbott replied that the property would be split and three mobile homes placed on the parcels. Mayor Hill asked i f there was anyone who wished to speak i n favor of or in opposition to the rezoning.There being no one wishing to address the Council,Mayor Hill called upon the Director of Planning for recommendations. Mr.Newcomer stated that the staff has no objections to the rezoning and that the Planning and Zoning Commission recommends approval with the stipulation that the east and south 33'be dedicated for public roadway and associated purposes and that this parcel not be development into a mobile home or RV park unless otherwise permitted by the City. Mr.Newcomer briefed the Council on the rezoning of two combined parcels of 65,000 square feet,located 500' north of the Apache Trail on North Ironwood Drive on the west side of the street from GR General and CR-4 Multiple Family Residence to C-2 Local Commercial District. Mr.Robert W.Lake,2066 W.Apache Trail,Apache Junction,explained that they wished to build a complex on the two lots. Mayor Hill asked i f there was anyone who wished to speak in favor of or in opposition to the rezoning.There being no one wishing to address the Council,Mayor Hill called upon the Director of Planning for recommendations. Mr.Newcomer stated that staff has no objections having received dedication of rights -of -way,and that the Planning and Zoning Commission recommends approval of the application. NEW BUSINESS APPOINTMENTS TO THE PERSONNEL BOARD ) )City Clerk Kathleen Connelly explained that there are two existing vacancies on the Personnel Board and that two Talent Bank application have been received. Councilman Baljo MOVED THAT JEAN PERKINS AND WANDA J.GONCALO BE APPOINTED TO THE PERSONNEL BOARD,SAID TERMS TO EXPIRE JUNE 30,1987. Councilman Eidson seconded the motion. VOTE:Unanimous The motion carried. CONTRACT BETWEEN THE CITY OF APACHE JUNCTION AND COMMUNITY FOUNDATION ) )City Manager Michael J.McNulty explained that this i s a proposed contract between the City and the Apache Junction Area Community Foundation,the funds for which were approved i n the Budget. Councilwoman Taylor MOVED THAT THE CONTRACT BETWEEN THE CITY OF APACHE JUNCTION,AND THE APACHE JUNCTION AREA COMMUNITY FOUNDATION BE ACCEPTED AS PRESENTED. Councilman Baljo seconded the motion. VOTE:Unanimous The motion carried. REGULAR MEETING OF THE CITY COUNCIL OCTOBER 15,1985 PAGE 10 OF 14 PROPOSED RESOLUTION NO.85-42, QUARTERLY PUBLIC FORUMS )Councilman Jimenez stated that at a previous work session i t was suggested that the Council hold quarterly informal public forums to give the public the opportunity to get to know the Counbilmembers and to discuss what they wish. Councilman Baljo requested that meetings not be scheduled on weekends or near holidays. Councilman Eidsorvstated that due to past turnout for:forums,the Council Chambers:should be sufficient. Councilman Jimenez suggested holding the forums in the Chamber of Commerce as a more informal atmosphere. Councilman Eidson felt that someone should chair the forums,possibly the Mayor. City Attorney David Alexander further suggested that some procedure should be considered,whereby questions or topics be submitted to the City Clerk for the preparation of an agenda,as spontaneous discussion would be violating the Open Meeting Law. Councilwoman Gardner MOVED THAT RESOLUTION NO.85-42,A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,DECLARING INTENT TO CONDUCT PUBLIC FORUMS,ON A QUARTERLY BASIS,WITH THE FIRST FORUM TO BE HELD THE FIRST WEEK IN DECEMBER, AND THAT AN AGENDA OR TOPIC MATTER BE PREPARED AND PUBLISHED PRIOR TO THE FORUM,BE APPROVED AND ADOPTED. Councilman Jimenez seconded the motion. VOTE:Unanimous The motion carried. LIBRARY SERVICES AND CONSTRUCTION ACT GRANT PROPOSAL ENTITLED "SENIOR CITIZENS'SERVICES PROJECT" )Director of Library Pam Loui explained that this i s the second year the City of Apache Junction has applied for this particular grant,the funds to be used for Library equipment such as cassettes,video equipment,and also travel.Ms Loui stated that they are requesting $21,000,which does not necessarily mean the entire amount will be awarded as a number of libraries are competing for the grant. Councilman Baljo MOVED THAT THE CITY COUNCIL GIVE SUPPORT TO THE LIBRARY SERVICES AND CONSTRUCTION ACT GRANT FOR A SUBSTANTIAL IMPROVEMENT TO THE LIBRARY'S SERVICES TO THE ELDERLY AND THAT THE CITY MANAGER BE AUTHORIZED TO EXECUTE THE GRANT APPLICATION FOR THE CITY. Councilwoman Gardner seconded the motion. VOTE:Unanimous The motion carried. Vice Mayor Bakkedahl seconded the REGULAR MEETING OF THE CITY COUNCIL OCTOBER 15,1985 PAGE 13 OF 14 CALL TO THE PUBLIC Mr.Gil Verley,620 S.Palo Verde,Apache Junction,expressed a wish to solicit the landscaping for the new Library project,also wished to know how items are placed on the agenda,specifically the mobile home standards ordinance. City Clerk Kathleen Connelly stated that the item referred to has been on at least two Work Session agenda in the past. Mr.Verley added a complaint against peddlers selling the same products that local businesses are selling. Mayor Hill replied that the City has an ordinance referring to peddlers.
