SPECIAL MEETING
NOVEMBER 12,1985
The special meeting of the City Council of the City of Apache Junction,
Arizona,was held on November 12,1985,at the Apache Junction City Council
Chambers pursuant to the notice required by law.
CALL TO ORDER
Mayor Hill called the meeting t o order at 6:00 p.m.

PROPOSED RESOLUTION NO.85-49,
SUPPORTING SEPTIC TANK PUMPERS
AND DEALING WITH HEALTH PROBLEMS
RELATING TO SEPTIC TANKS AND
HAZARDOUS WASTES
)Mr.Roger Grimh,President of Sun
Unlimited,1225 S.Tomahawk,Apache Junction,addressed the Council i n
regards t o the new Groundwater Act on hazardous waste disposal,and stated
that many of the waste disposal companies have formed an association to deal
with the problems created by the new requirements and they feel that the
burden should fall on the generators,not the carriers.
Councilman Baljo asked i f these are
State EPA requirements.
Mr.Grimh confirmed this,and
further state that they are being enforced by the Attorney General.
Director of Public Safety Bill
McDaniel further explained an incident that had ocurred with Sun Unlimited.
Councilman Baljo MOVED THAT
RESOLUTION O.85-49,A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY
OF APACHE JUNCTION,ARIZONA,REQUESTING THE STATE LEGISLATURE AND STATE
DEPARTMENT OF HEALTH TO CONSIDER ALL OPTIONS IN THE ADOPTION AND ENACTMENT
OF LEGISLATION PERTAINING TO THE PUMPING AND DISPOSAL OF HAZARDOUS WASTE,BE
APPROVED AND ADOPTED,AND FURTHER GAVE DIRECTION TO THE CITY MANAGER,CITY
ATTORNEY AND DIRECTOR OF PUBLIC SAFETY TO STAY ON TOP OF THE SITUATION.
Councilwoman Gardner seconded the
motion.
VOTE:Unanimous
The motion carried.
Councilwoman Gardner questioned
whether the items for discussion on the Executive Session Agenda were
appropriate for that type of session.
City Attorney David Alexander stated
that i f the questions regarding the items were legal i n subject matter and
of interest to the entire Council,this should be done together at one time,
but further discussion would not be appropriate.

)Councilwoman Taylor MOVED THAT AN
EXECUTIVE SESSION BE HELD ON NOVEMBER 12,1985,AT 6:00 P.M.,IN THE CITY
HALL CONFERENCE ROOM.
Councilman Baljo seconded the
motion.
VOTE:In Favor:Councilwoman Taylor,Councilman Baljo,Councilman Eidson,
Mayor Hill
Opposed:Councilwoman Gardner
The motion carried.
ADJOURNMENT
)Councilwoman Gardner MOVED THAT THE
SPECIAL MEETING BE ADJOURNED AT 6:38 P.M.
Councilman Eidson seconded the
motion.
VOTE:Unanimous
The motion carried.
