CALL TO ORDER Mayor Clarke called the meeting to order at 7:00 p.m. INVOCATION Vice Mayor Eidson led the Invocation. PLEDGE OF ALLEGIANCE Councilman Damiano led the Pledge of Allegiance. CITY MANAGER'S REPORT City Manager Michael J.McNulty reported that the architect is presenting preliminary plans for the new Library,and that confirmation has been received from AORCC on Prospector Park. PUBLIC HEARINGS PROPOSED ORDINANCE NO.321,PZ-54-84, JONES AND BURGESS the public. Mayor Clarke opened the hearing to Associate Planner Jim Nakagawa, briefed the Council on the request for rezoning from GR General Rural to CB -1 Local Business Zone of a 30,621 square feet gross,located at the northwest corner of the intersection of North Delaware Drive and West Greasewood Street. Mr.Jerry Burgess,349 S.Saguaro, Apache Junction,requested approval of the application. Mayor Clarke asked i f there was anyone who wished to speak in favor of or in opposition to the application. Mr.Keith Stachar,6301 E.Roundup, Apache Junction,questioned the necessity for this rezoning. There being no one else wishing to address the item,Mayor Clarke called upon the Associate Planner to give recommendations. Mayor Clarke opened the hearing to Mr.Nakagawa addressed the request for rezoning from GR General Rural to CB -1 Local Business Zone of a 2.6 acre parcel,located on the south side of Superstition Boulevard between Ocotillo and Palo Verde Drives. Mr.Bill Beaulieu,306 E.Frontier Road,Apache Junction,requested that the rezoning be approved. Mayor Clarke asked i f there was anyone who wished to speak in favor of or in opposition to the petition. There being no one wishing to address the Council,Mayor Clarke called upon the Associate Planner for recommendations. REGULAR MEETING OF THE CITY COUNCIL FEBRUARY 5,1985 PAGE 3 Mr.Nakagawa stated that the staff has no objections,finding that the proposed zoning would be in compliance with the City's General Plan with stipulations of dedications of rights -of -way,and that the Planning and Zoning Commission recommends approval with the stipulations. Mayor Clarke opened the hearing to Mr.Nakagawa briefed the Council on the request for rezoning from GR General Rural to CB -1 Local Business Zone of a 13,843 square foot parcel,located on the southeast corner of Superstition Boulevard and Rennick Drive in Section 20. Mr.Keith Stachar,6301 E.Roundup, Apache Junction,explained that the property would be developed with an office building,and requested approval of this application. Councilman Damiano asked what was directly east of the property. Mr.Stachar stated that there is a storage buildings directly east. There being no one wishing to address the Council,Mayor Clarke called upon the Associate Planner for recommendations. Mr.Nakagawa stated that the Planning staff has no objections to the rezoning and that the Planning and Zoning Commission recommends approval with screening or a wall as a stipulation. REGULAR MEETING OF THE CITY COUNCIL FEBRUARY 5,1985 PAGE 5 Mr.Nakagawa stated that this is a rezoning request from GR General Rural to CB -1 Local Business of the eastern parcel and CR-5 Multiple Residence for the western parcel,located on the west side of Ironwood Drive,250 feet south of Superstition Boulevard in Section 19. Mr.Don Kos,1011 N.Vista,Apache Junction,requested approval. Mayor Clarke asked i f there was anyone who wished to speak in favor of or in opposition to the petition. There being no one wishing to address the Council,Mayor Clarke called upon the Associate Planner for recommendations. Councilman Damiano seconded the Mayor Clarke opened the hearing to City Clerk Kathleen Connelly explained that periodically ordinances have been submitted to bring sections of the City Code into compliance with adopted practices and procedures,and that this amendment eliminates public hearings for roadway abandonments. Councilman Hill seconded the motion. )Mayor Clarke opened the hearing to City Manager Michael J.McNulty explained that this ordinance was a solution to the problems involved with recreational vehicles,and that Councilman Taylor would like to submit a counter proposal. Councilman Taylor suggested forming a committee,consisting of one dealer,one installer,one year -around resident,two park owners and Building Official Leo Frazier,Jr.,as Chairman,all to be appointed by the City Manager to bring back a proposal that will reflect all sides of the issue. Councilman Hill MOVED THAT ORDINANCE NO.352,BE CONTINUED FOR 90 DAYS AND THAT THE COMMITTEE AS OUTLINED BY APPOINTED BY THE CITY MANAGER. Councilman Baljo seconded the motion. Mr.Nakagawa explained that this is a list of commercial zones and that there are two versions of this proposal; the first having five zones which is the Planning and Zoning Commission recommendation,the second being the staff recommendation. Mr.Keith Stachar,6301 E.Roundup, Apache Junction,addressed the item,pointing out various objections to the amendments throughout the ordinance. Councilman Baljo agreed with Mr.Stachar on some comments but disagreed with others. Mr.Chuck Jastremzski,5722 E.10th Avenue,Apache Junction,member of the Zoning Ordinance Rewrite Committee, stated that this ordinance was considered priority due to problems caused by using only two commercial zones,rebutted comments made by Mr.Stachar. City Attorney David Alexander suggested postponing this ordinance and considering with other amendments to the Zoning Ordinance. REGULAR MEETING OF THE CITY COUNCIL FEBRUARY 5,1985 PAGE 12 NEW BUSINESS BUREAU OF LAND MANAGEMENT,LEASE FOR TRAIL SYSTEMS- )Mr.McNulty explained that BLM has presented this lease as a stipulation for the Trail System that is part of the City's General Plan,and requested authorization to sign this lease for a period of 25 years. Councilman Damiano wished to know what developments the City is required to accomplish. Mr.McNulty stated that we are responsible for developing the archaelogical sites,plus patrolling and protecting the eleven sites,and if we don't do anything for three years they can take the leases back. Councilman Damiano MOVED THAT AUTHORIZATION BE GIVEN TO THE CITY MANAGER TO SIGN THE LEASE FOR THE TRAIL SYSTEM,FOR A PERIOD OF 25 YEARS. Councilman Baljo seconded the motion.
