CALL TO ORDER. B. INVOCATION AND PLEDGE OF ALLEGIANCE. C. ROLL CALL. D. CONSENT AGENDA. The Council may, at this time,take single action on any or all items listed as consent agenda items.These items may include,but are not limited to,acceptance of agenda, acceptance of minutes,appointments, acceptance of resignations and adoption of certain resolutions and other items which do not require a public hearing.The Consent Agenda is a timesaving device of which the Mayor and City Council is to receive documentation on these items from the City Manager for their review prior to the meeting.Any member of the Council may remove any item from the Consent Agenda for discussion and cause a separate vote on the matter later in the agenda. 1• Acceptance of Agenda. 2• Approval of minutes of Regular Meeting of January 19,2010. 3• Appointment of candidate to fill one Library Board vacancy. Perris Tebon, Colleen Hill and Robert Mayo were interviewed on February 1, 2010 and would like to be considered to fill the vacancy for a term which expires in 2011. / 4. Consideration of Resolution No.09-58,approving an intergovernmental agreement with Pinal County for reimbursement of overtime and employment related expenses incurred due to Pinal County local law enforcement agency participation in the Governor's Office of Highway Safety contract No.2010-410-024 for the High Visibility Impaired Driving Enforcement Program. Last year the City participated in a DUI Task Force Program which was funded by the State which allowed for overtime and employment related expenses to be reimbursed in the amount of$65,000.This year a similar arrangement is offered through the Governor's Office in the amount of$97,500. Resolution No. 09-58 authorizes the City to enter into an IGA with Pinal County to allow reimbursement of City overtime and employment related expenses incurred by its police officers while participating in the DUI Enforcement Program. 5. Fifth Amendment to Cable System License Agreement between Mediacom and City of Apache Junction(Temporary Extension). The City and Mediacom representatives are in active negotiations for an amended term of Mediacom's cable license due to expire on January 31,2010. It is anticipated such negotiations will continue through February and March,therefore additional time is needed to conclude negotiations. Staff requests that City Council authorize this fifth and hopefully final extension of the cable license agreement through April 6, 2010.The copy of the proposed extension is attached. E. AWARDS, PRESENTATIONS AND PROCLAMATIONS. Awards,presentations from other organizations,proclamations issued by the mayor,and acknowledgement of distinguished guests and visitors,and staff presentation of receipt of grant or donated funds are permitted at this time. n 6. PRESENTATION OF 25-YEA�RVICE AWARD TO THERYN HANSEN,ro-JBLIC WORKS ADMINISTRATIVE ASSISTANT. Presentation of 25-year service award to Theryn Hansen, Public Works Administrative Assistant,for completion of 25 years of service with the City of Apache Junction. 7. PRESENTATION OF CHECK BY THE SUPERSTITION MOUNTAIN PROMOTIONAL CORPORATION. The Superstition Mountain Promotional Corporation is donating funds to support Parks and Recreation Department sponsored events. 8• PRESENTATION OF CERTIFICATES OF APPRECIATION TO ADOPT A STREET PARTICIPANTS. The City of Apache Junction would like to recognize all the volunteers that help the City keep our streets free of litter. Certificates of Appreciation will be presented to the Adopt A Street participants by Mayor Insalaco. R ANNOUNCEMENT OF CURRENT EVENTS. n The Mayor or any member of Council may at this time present a brief summary of current events. However, no discussion shall take place on such items except for clarifying comments related to substance,time and location. G. CITY MANAGER'S REPORT. The City Manager,members of City staff or those individuals designated by the Manager may present information pertinent to items under consideration or information related to the operation of the City.There shall however be no discussion at this time except for clarification inquiries. 9• MANAGER'S REPORT. 10. PRESENTATION AND DISCUSSION ON THE UTILIZATION OF VOLUNTEERS IN THE CITY'S LIBRARY. Tracie Curtis,Supervisory Librarian,will provide an overview on the utilization of volunteers in the City's library. 11. PRESENTATION AND DISCUSSION ON THE UTILIZATION OF VOLUNTEERS IN THE APACHE JUNCTION PARKS AND RECREATION DEPARTMENT. Staff will provide an overview on the utilization of volunteers in the City of Apache Junction Parks and Recreation Department. H. PUBLIC HEARINGS. Public hearings required by applicable law shall be conducted by the Council and any person shall be given the opportunity to speak.All remarks shall be addressed to the Council as a whole and not to any member thereof.Such remarks shall be limited to five(5) minutes unless additional time is granted by the Mayor.This time limitation shall not apply to applicants and their agents appearing before the Council. 12. APPLICATION FOR A TEMPORARY EXTENSION OF PREMISES FOR.THE HITCHING POST PIZZA PUB. Application for a one-day extension of premises during Lost Dutchman Days on February 26,2010, requested by the Hitching Post Pizza Pub. State law requires the Council hold a public hearing on the item and make their recommendation for approval or denial the Arizona Department of Liquor Licenses and Control. 13. APPLICATION FOR A NEW LICENSE,CLUB,SERIES 14 LIQUOR LICENSE FOR LAWRENCE C. GARRETT VETERANS OF FOREIGN WARS(VFW)POST#7968. This is the next step in the application process. The city council must have a public hearing and make a recommendation for approval or denial to be forwarded to the Arizona Department of Liquor Licenses and Control. 14. APPLICATION FOR A BINGO LICENSE FOR VFW POST#7968. VFW Post#7968 is applying for a bingo license. State law requires a public hearing in front of the city council with their recommendation for approval or denial forwarded to the Arizona Department of Revenue, Bingo Section. 15. PUBLIC HEARING FOR THE USE OF FISCAL YEAR 2010 COMMUNITY DEVELOPMENT BLOCK GRANT FUNDS AND FISCAL YEAR 2009 AND 2010 STATE SPECIAL PROJECT FUNDS;PROPOSED RESOLUTION NUMBERS 09-60(AUTHORITY TO SUBMIT)AND 09-62(COMMITMENT OF LEVERAGE FUNDS). The City of Apache Junction is eligible to submit applications to the Arizona Department of Housing for both a Community Development Block Grant and State Special Project application.As part of the application requirements,a final public hearing is necessary to adopt a resolution that authorizes the City to submit applications to the Arizona Department of Housing for funding and a resolution is required when leverage funds are being utilized. �• OLD BUSINESS. The Council shall consider any business that has been previously considered and which is still unfinished to include those items previously postponed or tabled.No member of the public shall be permitted to speak on these items unless invited to do so by the Mayor after first n � submitting a written request-to-speak form with the City Clerk. COUNCIL DIRECTION TO STAFF. This item allows the Mayor and City Council to direct staff on specifically listed matters. n 16. COUNCIL DIRECTION TO STAFF ON CITY-HOSTED PUBLIC FORUM UPDATING ECONOMIC DEVELOPMENT RELATED TOPICS. Staff seeks direction on last night's work session item regarding the city hosting a public forum to update residents on economic development related topics. �• SELECTION OF MEETING DATES, TIMES, LOCATIONS, AND PURPOSES: 17. EXECUTIVE SESSION AT 5:45 P.M.AND WORK SESSION AT 7:00 P.M.FOR MONDAY,FEBRUARY 15,2010 IS CANCELED DUE TO THE PRESIDENT'S HOLIDAY. 18. EXECUTIVE SESSION AT 5:45 P.M.AND WORK SESSION AT 7:00 P.M.FOR TUESDAY,FEBRUARY 16,2010. OTHER MEETINGS IF NECESSARY. M. CALL TO PUBLIC. At this time the public has the privilege to address the Council with requests,communications,comments or suggestions relating to City business that are not listed on the agenda.All speakers must have already submitted a written"Request to Speak"form to the City Clerk no later than the conclusion of the City Manager's Report portion of the agenda. CALL TO ORDER Mayor Insalaco called the meeting to order at 7 : 19 p.m. INVOCATION Councilmember Coleman gave the Invocation. PLEDGE OF ALLEGIANCE Councilmember Barker led the Pledge of Allegiance. ANNOUNCEMENT OF CURRENT EVENTS Mayor Insalaco commented he attended a Court of Honor for an eagle scout last Sunday. It was very heartwarming and the boy was very excited. CITY MANAGER' S REPORT City Manager George Hoffman stated the council and management team will be working on next fiscal year' s budget in the months ahead. Key to understanding the budget is that we are a service industry with most services provided by paid staff. The chief will be talking about volunteerism at the police department tonight . Upcoming meetings will have presentations by the library and parks and recreation on volunteers . Public Safety Director Jerald Monahan gave a powerpoint �} presentation on the volunteer opportunities at the police department and animal control, the explorer program, the police reserves program, community service program, police auxiliary program, business watch partnership program, and mentioned Will Haynes . Mayor Insalaco commented there has been a lot of counterfeit money going around in the city. The hanks have been Yot+ ; ,, bunch of tens . Best Hardware took in two twenty dollar bills that have been works of art . REGULAR MEETING OF THE CITY COUNCIL JANUARY 19, 2010 PAGE 2 OF 8 Public. Safety Director Jerald Monahan stated the Secret Service has agreed to provide training for city staff in the near future. He will try to expand it to the business community. They are the experts in identifying the funny money. Mayor Insalaco stated he saw one of the twenties and it was a work of art . PUBLIC HEARINGS APPLICATION FOR A NEW LICENSE, CORPORATION, SERIES 10 LIQUOR LICENSE FOR WALGREENS #06333 ) City Clerk Kathleen Connelly briefed the council on the item. Mayor Insalaco requested the applicant address the council . A representative of Walgreen' s addressed the council . City Clerk Kathleen Connelly commented this application is for the Ironwood Drive location. She asked if they would be getting one for the Idaho Road location soon. The representative of Walgreen' s stated the Idaho location already has one . Mayor Insalaco opened the public hearing on the item. There being no one wishing to speak, he closed the public hearing and reopened the item to council discussion. There being no discussion, he called for a motion. Vice Mayor Eck MOVED THAT THE APPLICATION FOR A NEW LICENSE, CORPORATION, SERIES 10 LIQUOR LICENSE FOR WALGREENS #06333, SUBMITTED BY RANDY GUSE, BE RECOMMENDED FOR APPROVAL TO THE ARIZONA DEPARTMETNTT OF LIQUOR LICENSES AND CONTROL. OLD BUSINESS None . t- NEW BUSINESS FISCAL YEAR 2009-2010 PROFESSIONAL SERVICES AGREEMENT WITH APACHE JUNCTION COMMUNITY DEVELOPMENT CORPORATION FOR ECONOMIC DEVELOPMENT SERVICES/FISCAL YEAR 2009-2010 PROFESSIONAL SERVICES AGREEMENT WITH APACHE JUNCTION MAIN STREET FOR ECONOMIC DEVELOPMENT SERVICES ) City Clerk Kathleen Connelly briefed the council on the items . Councilmember Barker commented B under the bullet points on the Community Development Corporation says the consultant will provide a speaker to explain the capitalized project . She asked what the project is . City Clerk Kathleen Connelly stated the project is the function of the Community .Development Corporation itself. Councilmember Barker commented the function of the Community Development Corporation is what follows with those bullet points . City Clerk Kathleen Connelly stated the Community Development Corporation }-lac a different 501 (C) than Main Street . It has a greater ability to initiate and get funding for projects and be responsible for the funding of the projects . It is a higher level of economic development REGULAR MEETING OF THE CITY COUNCIL JANUARY 19, 2010 PAGE 4 OF 8 engine. In other communities, they actually own real estate and do real estate transactions . The West Mesa Community Development Corporation was very active in light rail and the redevelopment of West Mesa. The director of that is now a member of the Mesa City Council . Councilmember Barker commented in bullet C of the Main Street contract it states the consultant shall provide technical assistance for local businesses . She wondered what that meant, as some technical assistance would call for some pretty high qualifications, such as the understanding of codes, ordinances and development services . City Clerk Kathleen Connelly stated it is technical assistance that fits within their area of expertise, such as how to begin a business, how to do store front improvements, and business plans . People just do not wake up in the morning and start a business, although a lot of people might try. Councilmember Barker agreed. City Clerk Kathleen Connelly stated it is their level of technical assistance. They are very good, when they come across something they are not familiar with, at directing someone to Steve Filipowicz, Janine Solley or the city clerk. Councilmember Barker stated that clears everything up for her. While she was reading, those two things had jumped out at her. City Clerk Kathleen Connelly stated she does not expect them to interpret city ordinances . Councilmember Barker commented they could not expect them to do that . The council frequently cannot do it . Mayor Insalaco closed the discussion with no further comments and called for a motion. He has been advised he did not get the number of the store correct. He missed a digit . He asked if he could make another motion with the accurate number. For the purpose of workers' compensation, an employee of any party to this agreement, who works under the jurisdiction or control of, or who works within the jurisdictional boundaries of any other party pursuant to this Agreement shall be deemed to be an employee of the party who is his primary employer and of the party under whose jurisdiction and control he is then working as provided in A.R.S. § 23-1022(D). The primary employer party of such an employee shall be solely liable for payment of workers'compensation benefits for the purpose of this section. Each party herein shall. comply with the provisions of A.R.S. § 23-1022(E)by posting the public notice required by that section. 7. In addition to any insurance coverage required by this Agreement, each party agrees that it will be solely responsible for and will assume sole liability for its officer's acts or omissions of any kind, while performing any service or activity under this Agreement. In the event that a claim is made against any party for acts or omissions of any of its employees or officers, it is the intent of the parties to cooperate fully in the defense of said claim or claims and to cause their insurers to do likewise, to the extent practicable. 8. To the extent permitted by law, each party(as indemnitor)agrees to indemnify, defend and hold harmless the other party or parties (as indemnitee) from and against all claims, losses, liability, costs, or expenses (including reasonable attorneys fees) arising out of bodily injury or death of any person or any property damage, but only to the extent that such claims which result in vicarious, derivative or other form of liability to the indemnitee, are caused by the act, omission,negligence, misconduct, or other fault of the indemnitor or its employees or officers assigned to this DUI enforcement program. 9. Fern, P.E., Public Works Director Subject: Adopt-A-Street-Program The City of Apache Junction would like to recognize all the volunteers that help the City with additional-resources for the "Adopt-A-Street Program": This program was developed about 18 years ago, and has been one of our most successful volunteer programs. One of the City of Apache Junction's aesthetic improvement goals is to keep our streets free of debris and litter. The Adopt-A-Street-Program encourages groups, organizations, families and businesses to pick up litter along a specific length of street. Appropriate recognition signage is erected by the City showing which group or individuals have volunteered their time to assist in this effort. The minimum length of each street section is usually approximately one mile. Shorter lengths are sometimes permitted in heavy litter control areas. The City also provides safety training for those working within City right-of-ways adjacent to traffic and provides equipment and supplies needed for the trash pick-ups. Once that training is completed, the City issues a permit for two years with the requirement that the group pick up trash on that segment of roadway at least three times a year(or as needed). Over the past year alone, these volunteer efforts have saved Apache Junction approximately 750 hours in labor time. To show our appreciation, we will be asking the 19 volunteer groups (representing about 130 individuals) to come to the February 2"d Council Meeting where they can be named, congratulated and presented with individual Certificates of Appreciation by the Mayor in front of Council and attending citizens. 575 E. This application is due June 1, 2010. n n The City of Apache Junction is anticipating submitting an application for the FY09 SSP funds which the City may request up to $300,000 to be used over a two year period of time. These funds are a statewide competitive grant. The City may retain up to 18%of these funds for administrative costs. The FY09 SSP application is due February 15, 2010. On November 12, 2009 a public meeting was held to solicit input from the public on potential projects for the submission of an application. Technical assistance was provided to the community until n November 29, 2009 to help formulate projects for consideration and to determine if potential projects met the requirements of the CDBG program. Additionally, on November 12, 2009 The Leadership Team met to discuss potential projects for presentation to Council. On November 30, 2009 staff presented the proposed projects for Council's review and discussion. During the December 15, 2009 Council Meeting a public hearing was held to gain input from the public and from the Council on potential projects for the submission of the FY 2010 CDBG RA and FY 2009 and FY 2010 SSP funding. At that time the City Council selected two projects to be submitted for funding to the Arizona Department of Housing. Additionally, the City Council recommended that an application for FYI SSP be held until the summer of 2010 for further evaluation and discussion on a potential project. The application due date has not yet been determined. The projects requested to be submitted were: 1) FY 2010 CDBG RA—Plaza Drive Street Improvements; and 2) FY 2009 SSP—Federal Emergency management Agency("FEMA") Study. Since the Council's decision was made,the Arizona Department of Housing has determined that, although theoretically eligible,that ADOH would not fund a FEMA study. Therefore the City will be required to submit an application for the back-up project identified for these funds: 1) FY 2010 CDBG RA—Plaza Drive Street Improvements; and 2) FY 2009 SSP—Owner Occupied Housing Rehabilitation. n DISCUSSION As part of the application requirements for submission of CDBG RA and SSP applications, a resolution is required that authorizes the City to submit applications to the Arizona Department of Housing for funding. Resolution Number 09-60 further authorizes the Mayor to sign the applications, contracts, and grant documents, and take all actions necessary to implement and complete the activities submitted within the applications. We strongly suggest avoiding use of the term"Town Hall" as it has different connotations to different individuals. At your request and with growing Council consensus, should Council decide to give direction to staff, we are preparing to organize a city-hosted "public forum"for the purpose of updating our community on economic development related topics of interest. The event will be primarily presentation-oriented with a Q&A opportunity toward the end. It will be open to the,public and may include invited guests from other entities to be able to respond to questions (i.e. Pinal County Econ Dev, CAC, AJUSD, etc.)or interact with the public in the post-event environment. From a media and logistics support perspective it is highly desirable to host the forum in the City Council Chamber where it can be recorded and aired on both the city's public access TV channel-11 and streamed over the web. Council Chamber also provides ready access to power point presentations and web access to demonstrate "gee whiz" capabilities and features the public might not otherwise be familiar with. However the focus may be toward the audience seats instead of the usual focus toward the dais. It is highly desirable that the event be kept to approx. two (2) hours-including Q&A. Were we to be wildly successful we might see a surge in citizen involvement with these organizations or causes, and there would be greater participation by our business community in such things as Shop AJ or the new Corporate Partnership program! Possible Hurdles to overcome: Audience &Array of topics: In exploring Jim Nelson's availability to participate and do a possible EDAPT Update Jim cautions that his many years of experience strongly suggest that Economic Development and Tourism are two very different sets of participants and rolling these items together may not prove as productive as it might seem at first glance. Timing: I know you expressed a strong desire that this be accomplished in the next 3-4 weeks. Ed Gawf tells me G&G's workload and a significant investment to bring an Expert Panel together here in AJ currently schedule for February 4th will also require some time to process and absorb following that &qtP_ Realictirnily we may ha Innkinn nt the last week of Februa x, to allow for G&G's full participation.
