This is for a special event on December 10-11,2010.This public hearing is the next step in the process for approval.Council shall make a recommendation for approval or denial to be fonwarded to the Arizona Department of Liquor Licenses and Control. 6.CONSIDERATION OF DEVELOMENT FEE ORDINANCE APPEAL FROM JUVER HEREDIA. Juver Heredia is appealing the city's development fee ordinance and requesting relief from the $9,508.00 residential fee for placement of a mobile home on property located at 1675 E.Cody Street. I-OLD BUSINESS. The Council shall consider any business that has been previously considered and which is still unfinished to include those items previously postponed or tabled.No member of the public shall be permitted to speak on these items unless invited to do so by the Mayor after first submitting a written request-to-speak form with the City Clerk. The Downtown Redevelopment and Implementation Strategy identified,as part of the revitalization/economic vitality effort,a goal to promote tourism in Apache Junction and the downtown as the home base or trail head for visiting the area's attractions.Staff will discuss efforts to date,opportunities yet untapped,and the consideration of identifying funding and staff resources to support a tourism effort.Larry Johnson,Apache Junction Chamber of Commerce President,will be available as a resource to answer questioris. 8.PRESENTATION AND DISCUSSION OF CODE ENFORCEMENT PROTOCOL. The city council will review and discuss the city's code enforcement protocol to determine if a change of program direction and/or priorities is warranted. Mr.Mehmood Mohiuddin stated three months ago he walked into the city office and talked to one of the city officials.He notified the city official that he has a chicken that is a piece of decoration that he would like set up as a landmark on top of his roof.The official said they would look into it and let him know.He came back a week later and asked if they had found anything.They said they were looking into it.They asked if it is a sign.He told them it is not a sign.They asked if it had any writing on it.He told them it does not.They stated there is no city policy or ordinance on this situation.They are sending out an email and they will notify him.He came back in 3 weeks later and asked if he had found anything as he did not want to violate any city rules^regulations or policies.He would like to put the chicken on the roof and make it a landmark.They are selling chicken and pizza.He was again told they had found nothing yet and they would let him know.He visited their office 4 times. The last time he was there he told them he would be putting the chicken up in 2 weeks.He gave them his cell phone number and home phone number and his restaurant number and told them to notify him if he needs anything like a permit or anything else in order to comply with city rules and regulations.Nobody notified him.He put the chicken up on Saturday.Monday was Columbus Day.On Tuesday morning city officials showed up and asked why he put the chicken up.He told them what happened and they said he violated rules and regulations.He asked them how he could have violated them if he had complied.He visited the city officials 4 times and they did not notify him back.He had told them he was putting the chicken up and asked them if there were any issues or problems or permits that he wanted to comply. They never notified him and they came out and gave him a citation because he did not have a permit.They asked him for the drawing and he gave it to them.The drawing was from the engineer and it had the stamps on it.The zoning department stated they are considering it a sign and he cannot have it on the top of the building.He was told to take it off.Within 7 days he took the chicken off the roof..They told him the next time he wanted to do anything,he needs to tell them in advance. Mr.Heredia is hoping that the Council will waive the fee due to their financial condition and the fact that a home previously existed on the property [Note:The development fee ordinance provides that if a building permit was issued within one year of the previous residence being removed,no development efe would be required.As it turns out,the previous residence was removed approximately 21 years ago]. Clearly,we do not have adequate resources or the political desire to proactively pursue allpossiblecodeviolations.Therefore,we have maintained an internal policy of proactivelypursuingcertainpropertymaintenanceviolationsaslistedabove.Since this policy has neverbeenformallyorofficiallyadoptedbythecouncil,we continue to put our code complianceofficers,and perhaps the city,in a precarious position.n More specifically,the code compliance officers and regulatory staff are paid to,among otherthings,implement and enforce your laws.If we fail to do this,we could be in jeopardy ofcommittingintentionalornegligentmisconductorbreachandderelictionofduty.Thisbecomesaconcernwhereastaffermayobserveacodeviolation,but not pursue it becauseitsnotontheproactiveenforcementlist. For example,if a code officer happens to observe a structure built without a permit that haspotentiallifeand/or safety,implications,and that structure falls and injures someone,thatcodeofficercouldbelegallyexposedsincetheyobservedtheviolationbutdidnotactonitCouncilmembersareadvisedthattherearehundredsofbuildingpermitviolationsthroughoutthecitythatcouldgiverisetothisconcern). Additionally,there continues to be misunderstandings and resulting frustration from citizensandcodecompliancestaffwithourcurrentvagueandunofficialapproachtoproactiveandreactiveenforcement.Citizens don't understand why we are passive with some types ofviolationsandaggressivewithothers,while staffers are not clear about the council'senforcementexpectations. Therefore,I am asking the council to review and address our code compliance protocol andformallyadoptapreferredprotocolthatgivesstaffers,citizens,and the council a firm anddirectunderstandingofenforcementresponsibilities.The following options are offered foryourconsideration: n Option 1 (Passive Approach^ This option proposes that the unofficial list of proactive and reactive violations presentedabovebeofficiallyacceptedbythecouncilthrougharesolution.This would memorialize andcontinuethecityshistoricallypassiveapproachtocodeenforcementbyproactivelyenforcingcertainpropertymaintenanceviolations,but not such things as illegal home occupations,Illegal dwelling units,illegal businesses,and building code violations.The practical concernwiththispassiveapproach,as described earlier,is that the city could be accused of ignoringimportantlifeand/or safety building code violations,and be subject to legal action resultingfromaccidentsandinjuries. 2 on Option 2 (Passive Plus Approach) This option includes the proactive enforcement of certain property maintenance violations as reflected in Option 1,but establishes an additional expectation that any potential life and/or safety building violation that is observed by staff shall be followed up with,enforcement.For example,if a code officer is driving down the road,or reviewing plans/documents,or talking with residents/public officials/staff and happens to hear about or observe a possible life and/or safety building code violation,they will be required to follow-up with enforcement. This does not suggest that the staffer is proactively patrolling the streets looking for life/safety building code violations,but only that they will not ignore such violations if observed or brought to their attention. n Option 3 (Aggressive Approach) This option also includes the proactive enforcement of certain property maintenance violations as reflected in Option 1,but establishes a more aggressive expectation that any code violation (not just life/safety violations)that the code officer happens to observe will be followed-up with enforcement.Again,this does not mean that the staffer is proactively looking for these violations,but once discovered or brought to their attention,the staffer will be required to enforce.
