The Council may,at this time,take single action on any or all items listed as consent agenda items.These items may include,but are not

other items which do not require a public hearing. The Consent Agenda is a timesaving device of which the Mayor and City Council is to
receive documentation on these items from the City Manager for their review prior to the meeting Any member of the Council may remove any
item from the Consent Agenda for discussion and cause a separate vote on the matter later in the agenda.
1. Acceptance of Agenda.
2. Approval of Minutes of Regular Meeting of March 15,2011.
3. Appointments to fill vacancies on the Superstition Mountains Community Facilities District No. 1 Board of Directors.
Council interviewed applicants to this board at the April 4 Work Session There are currently two vacancies with term expirations of
July 7, 2016
4. Consideration of Resolution No. 11-11,authorizing the City of Apache Junction to enter into an intergovernmental
agreement with Arizona Department of Public Safety for participation in the Arizona Vehicle Theft Task Force.
The Arizona Vehicle Theft Task Force is a multi-agency task force that conducts complex investigations aimed at identifying,
apprehending, and prosecuting individuals and criminal organizations that profit from the theft of motor vehicles and related crimes.
Resolution No. 11-11 will authorize the city to enter into an intergovernmental agreement with DPS to allow for city participation in
Arizona Vehicle Theft Task Force activities,for which the city agrees to recommend and commit an AJPD officer
E. AWARDS, PRESENTATIONS AND PROCLAMATIONS.
Awards,presentations from other organizations,proclamations issued by the mayor,and acknowledgement of distinguished guests and
visitors,and staff presentation of receipt of grant or donated funds are permitted at this time.
5. OATH OF OFFICE FOR COUNCILMEMBER SMITHSON.
As required by law,the city clerk will administer the Oath of Office to Councilmember Smithson
6. PRESENTATION OF A CHECK BY THE FRIENDS OF APACHE JUNCTION.
Lucy J Young, President of the Friends of Apache Junction Board of Directors,will present a check for$3,500.00 to Mayor lnsalaco
and the Chair of the Parks Commission.
Recently,the Friends hosted a benefit performance by the Salt River Brass The concert raised funds for the Parks and
Recreation Department's Special Events Program.
7. PROCLAMATION DESIGI/"N'ING APRIL 2011 AS "FAIR HOUSING 1V. TH".
April 2011 is being designated as"Fair Housing Month"in accordance with the Arizona Department of Housing and the U.S.
Department of Housing and Urban Development
8. PRESENTATION AND DISCUSSION REGARDING THE SUCCESS OF THE EARNED INCOME TAX CREDIT
AND TAX COUNSELING FOR THE ELDERLY INITIATIVES FOR THE 2010 TAX YEAR.
The City of Apache Junction participates in the coordination of the Earned Income Tax Credit and the Tax Counseling for the Elderly
Initiatives with the Internal Revenue Service and American Association of Retired Persons(AARP) in providing opportunities for all
residents to seek out and obtain assistance in completing their tax returns by AARP volunteers In addition to receiving free tax
preparation, residents are also advised of potential tax credits that are offered to households and families Apache Junction offers two
locations to receive this service The Moose Lodge generously offers its hall for vclunteers to provide this service on Wednesdays and
Thursdays In addition,the City of Apache Junction and the staff at the city library offer exceptional accommodations for assistance to
residents on Fridays and Saturdays

National Crime Victims'Rights Week reaffirms the commitment of Apache Junction to helping victims of crime rebuild their lives

The regular meeting of the City Council of the City of
Apache Junction, Arizona, was held on March 15, 2011, at the
Apache Junction City Council Chambers pursuant to the notice

Mayor Insalaco called the meeting to order at 7 : 00 p.m.

THAT THE CONSENT AGENDA BE ACCEPTED AS PRESENTED; AND
THAT APPROVAL BE GIVEN TO THE AMENDMENT TO THE EXISTING
AGREEMENT BETWEEN THE ARIZONA DEPARTMENT OF COMMERCE AND THE
CITY OF APACHE JUNCTION, CONTRACT NUMBER R016-10-01, TO ALLOW
THE CITY TO USE THE BALANCE OF GRANT MONIES AWARDED IN LATE 2009
FOR ENERGY EFFICIENCY AND CONSERVATION IMPROVEMENTS PROJECTS TO .�►
CITY FACILITIES, AND THAT AUTHORIZATION BE GIVEN FOR THE MAYOR
TO SIGN THE AGREEMENT; AND
THAT THE AWARD OF BID FOR PW 2010-19, PURCHASE AND INSTALLATION

ANNOUNCEMENT OF CURRENT EVENTS
Councilmember Wilson announced he attended the Antique Engine
and Tractor Show last weekend. He assisted them at the gate by
giving them their buttons as they paid for their admission. He
started talking to an individual from Australia who came
specifically to Arizona to attend some of our events. He just
came the week before so he was unaware of Lost Dutchman Days .
He came out with 7 other people that are here for a month. It
shows they knew what was going on out here and our activities .
He commented he loved our community and the area and they are
coming back next year. The show felt it had a record turnout
this year, possibly close to 5, 000 people over the two days .
They will be expanding it next year.

Councilmember Barker commented she went to the Boys and Girls
Club spaghetti dinner on Thursday along with the mayor, the city
manager, the police chief and half the town. It was marvelous.
It was all the spaghetti you could eat and lots of people to
talk to. There was great artwork. The club is doing a great
job. They were trying to pay for the mural that was painted
behind the stage. They are hoping they made enough to do that.
4.1. Councilmember Barker commented she, Councilmember Wilson and
Vice Mayor Dietz on Friday attended the police awards ceremony.
It was a lovely ceremony, and she congratulated all the men and
women who got the awards . It was a privilege for her to be
there.

CITY MANAGER' S REPORT
City Manager George Hoffman commented on an article in the East
Valley Tribune on parks that recognized our parks and recreation
department facilities, and commented on the various events
happening in the city including the opening of Mountain Health
and Wellness, the improvements being done on Plaza Drive, the
landscaping and drainage improvements being done on Apache
Trail, significant improvements taking place at Central Arizona
College, and infrastructure improvements taking place on
Winchester.

were having a car show there.
Ralph stated they will be
having their annual car show. It will be the second annual show
with the same set up they have had in the past year. The cars
will be set up on the west side near the highway.

speak, he closed the public hearing and reopened the item to
council discussion. There being no further discussion, he
called for a motion.

PROPOSED RESOLUTION NO. 11-07 :
DECLARING AND ADOPTING THE RESULTS
OF THE MARCH 8, 2011 PRIMARY
ELECTION AND RECALL ELECTION
Vice Mayor Dietz thanked
Aft. Mr. Eck for 14 years of dedicated service to the city. The city
has been his top priority and they have a special bond. When he
was first appointed to the council in 1998, there was no
orientation or anything for a new councilmember. Mr. Eck showed
him where to pick up his book and where to sit down for the
meetings . He had no idea. R. E. helped him through a lot and
taught him a lot . He loves him and thanked him for everything
he has done for the council and the city.
Mayor Insalaco stated he
thinks that goes for all the council.
Councilmember Serdy commented
he would not be sitting here if not for Councilmember Eck. He
encouraged him to run. He did not think he could do it but
Councilmember Eck said he should do it . He would not be here if
not for R.E.
Councilmember Wilson
commented he wanted to also say thanks to Mr. Eck. Even though
they did get some information when they first came on board the
city council, R. E. was the individual who helped him out with
the aspect of what goes on behind the scenes and what they need
to be involved with. He also talked to him about running for
city council . He basically cornered him, told him he was very
active in the community and needed to step forward and do it.
He thanked him for his leadership and assistance.
Mayor Insalaco thanked him
for saying that and added he believes they all feel the same
about Councilmember Eck.
Councilmember Eck commented
he appreciated what all of them have said. He has been on the
council 14 years now. It has been a large part of his life,

especially when his 22-year-old son looked at him and said he
was not going to be on the council anymore. That is all he has
known. He was 6 or 7 when he got on. He really appreciated
working with professional people of different backgrounds. He
believes the last 4 years has been the best council he has had
the opportunity to work with. There are several different
backgrounds and he believed it showed on several different
issues . A successful organization cannot be run without
successful staff. He thinks the city is at the top end. He was
fortunate enough to be here when the city hired Joel; it was
shortly after he took office. Then eventually George came
along. They are both blessings . He remembered Bryant coming
on, and the new people like Giao and Chief Monahan. He is very
impressed with who we have, like Jeff Bell in parks and
recreation and Spencer with the library. We have true
professionals, and that is what makes an organization work. It
has been an absolute pleasure and honor to serve. He feels like
this has been a family after a decade-and-a-half. He
appreciated it very much, and thanked them for all their kind
words . They will be seeing him around. He is not leaving
Apache Junction.

The Arizona Vehicle Theft Task Force is a multi-agency task force that conducts complex investigations aimed at identifying,
apprehending, and prosecuting individuals and criminal organizations that profit from the theft of motor vehicles and related
crimes. Resolution No. 11-11 will authorize the city to enter into an intergovernmental agreement with DPS to allow for city
participation in Arizona Vehicle Theft Task Force activities, for which the city agrees to recommend and commit an AJPD
officer.

A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY
OF APACHE JUNCTION, ARIZONA, AUTHORIZING THE CITY OF
APACHE JUNCTION TO ENTER INTO AN INTERGOVERNMENTAL
AGREEMENT WITH ARIZONA DEPARTMENT OF PUBLIC SAFETY FOR
PARTICIPATION IN THE ARIZONA VEHICLE THEFT TASK FORCE
WHEREAS, the Arizona Department of Public Safety, a
political subdivision of the State of Arizona ("DPS") and the
City of Apache Junction, an Arizona municipal corporation
("City") , desire to enter into an Intergovernmental Agreement
("IGA") allowing City to participate in the Arizona Vehicle
Theft Task Force ("task force") ; and
WHEREAS, the task force is comprised of city, county, state
and federal law enforcement agencies working together to
identify, apprehend, and prosecute individuals and criminal
organizations who commit theft of motor vehicles and related
crimes; and
WHEREAS, City' s participation in this multi-agency task
force will benefit the City by focusing proactive vehicle theft
enforcement and deterrence efforts in the City; and
WHEREAS, the parties have crafted a written agreement which
sets forth the conditions for such arrangement; and
WHEREAS, pursuant to A R. S. § 11-952 (A) , public entities
may enter into intergovernmental agreements with other
municipalities and governmental entities for joint or

NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL
OF THE CITY OF APACHE JUNCTION ARIZONA, AS FOLLOWS :
1) The Mayor and City Council approve the Intergovernmental
Agreement Regarding Arizona Vehicle Task Force; and the
Police Chief is hereby authorized to sign the agreement on
behalf of the City
2 . Staff shall record such document in the Pinal County
Recorder' s office within sixty (60) days after full
execution by all Parties .

INTERGOVERNMENTAL AGREEMENT
REGARDING
ARIZONA VEHICLE THEFT TASK FORCE
Recitals
A. This Intergovernmental Agreement ("IGA") is entered into between the State of Arizona,
through its Department of Public Safety, hereinafter referred to as "DPS", and the City of .-.
Apache Junction,an Arizona municipal corporation,hereinafter referred to as"Agency."
B. The purpose of this Agreement is to enhance law enforcement services concerning vehicle theft
through the cooperative efforts of the parties to this Agreement.
C. DPS is authorized and empowered to enter into this IGA pursuant to A.R.S § 41-1713 B.3, both
parties are authorized and empowered to enter into this IGA pursuant to A.R.S. § 11-952
Agreement
Now, in consideration of the mutual promises set forth herein, the parties hereby agree to the
following terms and conditions
I. Participation
The Agency agrees to assign one (1) P O.S.T certified sworn law enforcement officer, herein
referred to as "officer", to the Arizona Vehicle Theft Task Force on a full-time basis, for such
assignments within the purposes of this contract, as directed by DPS During this assignment,
DPS and the Agency agree to allow the officer to maintain all benefits, rights and pnvileges
available to the officer as if the officer were assigned on a full-time basis to the Agency The
officer must abide by all of the applicable rules and regulations of the Agency and is subject to
the Agency's disciplinary process. In the event the officer is involved in a critical incident, as
defined by DPS policy,the Agency agrees to cooperate with, and participate in,any investigation
and/or critical incident review conducted by DPS for the purpose of evaluating the policies and
procedures utilized by the Task Force
IL Reimbursement
DPS agrees to reimburse the Agency on a quarterly basis, for 75% of the salary of the assigned
police officer and 100% of pre-authorized Task Force related overtime hours per month
(depending upon funding by the Anzona Automobile Theft Authority), based on DPS weekly
time accounting summary. The Agency agrees to provide to DPS the following information the
officer's annual and hourly rate of pay, the officer's hourly overtime rate of pay and associated
ERE(employee related expenses)costs DPS is not obligated to reimburse the Agency for salary
raises or modifications to base salaries unless the Agency notifies DPS at least ninety (90)
calendar days prior to the effective date of such modification. All approved travel expenses will
be reimbursed directly to the officer by DPS under the employee travel reimbursement
guidelines established by the Arizona Department of Administration. DPS shall assign and
maintain a vehicle which will be provided in accordance with DPS vehicle policy to the Agency
the Agency officer assigned to the Task Force The maintenance and use of the DPS vehicle will
be in conformance and compliance with all DPS rules and regulations
III. Availability of Funds
Every payment obligation of DPS under this agreement is conditioned upon the availability of
funds appropriated or allocated for the payment of such obligation. If funds are not allocated and
,..1k available for the continuance of the agreement, the agreement may be terminated by DPS at the
end of the period for which funds are available No liability shall accrue to DPS in the event this
provision is exercised, and DPS shall not be obligated or liable for any future payments or for
any damages as a result of termination under this paragraph
IV. Nondiscrimination
All parties agree to comply with the non-discrimination provisions of the Governor's Executive
Order 99-4.
V. Indemnification
Each party(as `indemnitor')agrees to indemnify, defend, and hold harmless the other party from
and against any and all claims, losses, liability, costs, or expenses, including reasonable
attorney's fees, arising out of the bodily injury of any person or property damage, but only to the
extent that such claims are caused by the act, omission, negligence, misconduct, or other fault of
the indemnitor, its officers, agents, or employees
VI. Drug Free Workplace
Any officer assigned to the task force will be subject to random and/or for cause drug and
alcohol testing in accordance with the Agency's guidelines and the DPS Drug Free Workplace
Program guidelines. Each assigned officer shall be subject to the responsibilities of and shall
retain all rights as provided for in the DPS Drug Free Workplace Program Manual, DPS Form
Number DPS 932-02056 DPS shall not charge any fee or cost to the Agency for any assigned
officer who undergoes testing Officer may be removed from the task force for failure to comply
with the Agency's guidelines/drug screening requirement or for his/her failure to comply with
DPS program/drug screening requirements.
VII. Immigration Compliance
All parties agree to comply with all applicable federal immigration laws and regulations of the
Governor's Executive Order 2005-30.
VIII. Termination
Either party may terminate this Agreement for convenience or cause with thirty (30) calendar
days written notice to the other party Upon termination, DPS shall pay the Agency all
outstanding amounts up through the time at which the termination becomes effective. All
property shall be returned to the owning party upon termination.

IX. Cancellation
All parties are hereby put on notice that this contract is subject to cancellation for conflicts of
interest,pursuant to A.R.S. § 38-511
X. Recordkeeping
All records regarding this Agreement, including officer's time accounting logs, must be retained
for five(5)years after completion of this Agreement,in compliance with A R.S. § 35-214
XI. Fees
Neither party may charge the other for any administrative fees for work performed pursuant to
this Agreement.
XII. Jurisdiction
DPS gives prior consent to extend law enforcement authority of the participating Agency to the
jurisdiction of DPS, pursuant to A R S § 13-3871. The Agency agrees to permit their officer to
work outside of their regular jurisdictional boundaries, as any peace officer can in the State of
Arizona.
XIII. Limitations
This agreement does not relieve either agency of its official duties and shall not be construed as
limiting or expanding the statutory responsibilities of the parties. .-.
XIV. Arbitration
In the event of a dispute under this IGA,the parties agree to use arbitration to the extent required
under A R S. §§ 12-1518 and 12-133.
XV. Effective Date/Duration
This Agreement shall become effective upon the execution of two (2) originals by the parties.
This Agreement shall be for a term of one (1) year after the Agreement becomes effective, but
shall automatically renew itself on July 1st of each year if DPS sends out a written notice of
funding availability to the Agency within thirty (30) calendar days prior to the end of each year
All prior agreements regarding the task force are canceled as of the effective date of this
agreement.

XVI. Worker's Compensation Benefits
Pursuant to A R S. § 23-1022 D, for the purposes of worker's compensation coverage, all
employees covered by this Agreement shall be deemed to be an employee of both agencies. The
primary employer shall be solely liable for payment of worker's compensation benefits.

SUBJECT: 2011 Fair Housing Proclamation
REQUEST
Staff respectfully requests that the City Council proclaim April 2011 as Fair Housing Month.
This proclamation will fulfill one of the City's requirements as a recipient of grant funds from the
Arizona Department of Housing. If the proclamation is not made,the City's ability to receive further
funds would be limited
BACKGROUND
Affirmatively Furthering Fair Housing was first included in the Fair Housing Act of 1964, which, in .•
Title VI, prohibited discrimination in housing on the basis of race, color, and national origin
This Act also required that the United States Department of Housing and Urban Development
("HUD")administer its programs including the Community Development Block Grant("CDBG")
program in a manner that affirmatively promotes fair housing.
Title VIII of the Civil Rights Act of 1968 covered housing discrimination on the basis of race, color,
religion, sex or national origin. Title VIII was amended in 1988 by the Fair Housing Act which added
two categories of protected persons from housing discrimination: 1) families with children(anyone
under 18), and 2) individuals with disabilities.
The Housing and Community Development Act of 1974, as amended, in Section 104, specifically
states that communities shall affirmatively further fair housing. HUD regulations require that the state
CDBG program affirmatively further fair housing This Act requires each community to certify that it
will affirmatively further fair housing.
When a community is involved in the provision of housing or housing services,whether funded
through CDBG or with other public funds, it must ensure that such programs are designed and
implemented in a non-discriminatory way
DISCUSSION
The Arizona Department of Housing ("ADOH"), the regulatory agency, has indicated that each
community must complete the minimum requirements to further fair housing. These minimum
requirements include.
1) Adopt a Fair Housing Proclamation or Resolution,
2) Display a Fair Housing poster in at least one public area of the community's administration
building/office year round, and
3) Undertake at least one additional action that is specifically designed to
further fair housing and/or educate the public about fair housing laws.
Currently, the City displays an English and Spanish Fair Housing poster in the lobby of the
Development Services Department and undertakes several additional eligible activities that comply
with the requirements of ADOH These activities include the distribution of the State Fair Housing
brochure and the attendance of the City's Staff at local/regional training relating to fair housing.
If a declaration of Fair Housing Month is not adopted, the City will be in violation of the laws as
identified above and the regulations set forth by HUD and ADOH, thus jeopardizing future funding
through CDBG
.•. RECOMMENDATION
Staff respectfully recommends that the City Council declare April 2011 as Fair Housing Month
ACTION REQUIRED
The following actions are required:
1) The Council adopt the Proclamation declaring April 2011 as Fair Housing Month; and
2) The Mayor shall read the Proclamation aloud during the April 5, 2011 Council meeting

SUBJECT: Earned Income Tax Credit Program and Tax Counseling for the Elderly
REQUEST
Staff respectfully requests that the City Council receives a presentation regarding the success of the
Earned Income Tax Credit Program("EITC")and Tax Counseling for the Elderly("TCE") Initiatives
for the 2010 tax year within Apache Junction.
BACKGROUND
The City of Apache Junction participates in the coordination of the EITC and TCE Initiatives with the
Internal Revenue Service("IRS")and American Association of Retired Persons("AARP") in
providing opportunities for all residents to seek out and obtain assistance in completing their tax
returns by AARP volunteers In addition to receiving free tax preparation,residents are also advised of
potential tax credits that are offered to households and families.Apache Junction offers two locations
to receive this service. The Moose Lodge generously offers its hall for volunteers to provide this
service on Wednesday and Thursday. In addition, the City of Apache Junction Public Library offers
exceptional accommodations with computers for assistance to residents on Fridays and Saturdays
DISCUSSION
From February 1, 2011 to April 15, 2011, twenty-four AARP volunteers will provide over 2,700
volunteer hours to prepare the taxes of Apache Junction residents.The volunteer hours are valued at
$54,121 From April 1S`to March 6th, volunteers completed 443 returns equaling a total refund amount
of$378,857.This amount includes tax credits such as the EITC credit(43 returns, $51,336 refunded),
and the Child Tax Credit(20 returns, $29,932 refunded).The average adjusted gross income for those
citizens who utilized these services was$22,605 compared to$23,373.50 from tax year 2009 It is
anticipated that the above numbers will double with the second month of returns filed

WHEREAS, more than 33 million Americans are victims of crime each year,and
WHEREAS, victims may suffer emotional,physical, psychological and financial harm
as a result of crime,and
WHEREAS, victim services and compensation programs across the country provide
vital and supportive services for victims that help individual,families and
communities cope with the impact of crime,and
WHEREAS, the Victims of Crime Act(VOCA)passed by Congress in 1984,affirmed a
national commitment to helping victims rebuild their lives by establishing
the Crime Victims Fund, a major source of funding for services and
compensation to victims of crime throughout the Untied States,and
WHEREAS, the Fund comprises fine and penalties levied on offenders and affirms the
principle that those who commit crimes should be held accountable for
their actions. and
WHEREAS, the Crime Victims Fund provides support to states for victim services and
victim compensation programs, as well as support for federal victims of
crime, child abuse prosecution, emergency reserve to assist victims of
terrorism, and training and technical assistance for the victim services
field,and
WHEREAS, victim compensation programs pay for medical and counseling cost,
funeral bills,crime scene cleanup and lost wages for victims of crime,and
WHEREAS, National Crime Victims' rights Week—April 10th—April 16th, 2011 —
provides an opportunity for our country to recognize the Victim of Crime
Act as a major bedrock of support for victim services and to reaffirm our
nation's commitment to addressing the needs of victims of crime,and
WHEREAS, the City of Apache Junction is joining forces with victims services
programs, criminal justice officials and concerned citizens throughout
Apache Junction and America to observe the 27th anniversary of VOCA
