Mayor Wilson read and presented the proclamation to Parks and Recreation staff. F. REGIONAL INTERGOVERNMENTAL UPDATES 12. 23-380 Brief summary of intergovernmental updates from mayor and councilmembers. *Attendance at an active shooter training held at Cactus Canyon Junior High School * Mesa Parks and Recreation brought a great number of kids to the Superstition Mountain Museum for Western Day *Attendance at the rededication of the Apache Junction Animal Control *August 16, 2023, 6:00 p.m. -8:00 p.m. at the Apache Junction Multigenerational Center, ADOT will be hosting a meeting to seek public input on the reopening of State Route 88 G. CITY MANAGER'S REPORT 13. 23-381 City Manager's Report. City Manager Bryant Powell reported: * Recognition to Apache Junction Parks and Recreation for the professionalism and outstanding leadership over the past several years *A very successful Job Fair hosted by the City of Apache Junction staff and community organizations * Mayor Wilson has been selected as the Chair for the Phoenix Mesa Gateway Airport Authority *City Clerk Jennifer Pena has attained the position of President for Arizona Municipal Clerk's Association 14. 23-373 Presentation and discussion on the Public Works' Fiscal Year 2023-2024 Capital Improvement and Street Maintenance Plan. City staff will present information regarding the status of the city's streets and upcoming capital improvement and street maintenance projects for the new fiscal year. Public Works Director Ted Wolff and Public Works Manager Shane Kiesow presented the various street maintenance projects slated for the upcoming year. Photos of previous completed projects were shared, as well as a map that includes the projects for FY 23-24. Mr. Kiesow explained the process involved in rating the streets to determine which are most important to address for maintenance and/or complete reconstruction. 15. 23-382 Announcement of Current Events. Public Information Officer Al Bravo shared the following updates: *Apache Junction Animal Control had a ribbon cutting ceremony for the renovated facility. A reminder was shared that there is always a great selection of pets for adoption at the facility. * Recognized all who were involved in putting on a great 4th of July celebration at City of Apache Junction,Arizona Page 3 City Council Meeting Meeting Minutes July 18,2023 Superstition Shadows Park. NEW BUSINESS 16. 23-374 Presentation and discussion on the procurement of new and replacement fleet vehicles outfitted with lighting and equipment in the amount of $2,819,084.00, budgeted for the current fiscal year utilizing the cooperative contracts with the State of Arizona Contract Numbers CTR041810 and CTR059323 and the City of Tempe cooperative contract number T21-003-02. Public Works Director Ted Wolff summarized his council memo which covered the following: The public works department budgeted $2,230,084 for three replacement detective vehicles, 4 additional detective vehicles, two replacement vehicles in the evidence division, three replacements in the patrol division, two additional police motorcycles, seven additional patrol vehicles, one replacement prisoner transport van and seven replacement parks and recreation vehicles. The purchase of these vehicles includes lighting and all equipment using general funds in the city's Fiscal Year 2023/2024 budget approved by the city council in June. Police Department Detectives 1-2023 Ford Explorer to replace unit 20-366 with 102,992 miles in fair condition. 1-2022 Ford F-150 Super Crew Cab to replace unit 20-377 with 111,858 miles in fair condition. 1-2023 Ford Explorer to replace unit 20-378 with 119,320 miles in fair condition. This vehicle was rolled over from FY 2022-2023 budget year. The purchase of these vehicles would be through the State of Arizona Cooperative Contract# CTR059323 with San Tan Ford. The lighting and equipment would be through the City of Tempe Cooperative Contract#T21-003-02. Proposed Purchase of HURF Fund Equipment and Vehicle for Public Works The public works department budgeted $589,000 for one replacement bucket truck, two replacement vehicles, two additional vehicles and one new certified street sweeper. Equipment and vehicle purchases include lighting and equipment using highway user revenue funds (HURF) in the city's Fiscal Year 2023/2024 budget approved by city council in June. 1-2023 Ford F-450 DRW Sign Truck to replace unit 30-271 with 120,620 miles and in poor condition. This vehicle is a rollover from FY 2022-2023 budget year. 1- Ford F-550 XL Bucket Truck to replace unit 30-210 with 128,467 miles in poor condition. 2-2023 Ford-250 XL to replace unit 30-278 with 164,310 miles in poor condition. 3-2023 Ford F-350 with dump beds- new additions 1-2023 Freightliner M2-6-chasis with a Regen X Sweeper PM-10 Certified Street Sweeper. -new addition. This will be a 5.7% grant match with the Maricopa Association of Government. The purchase of the Freightliner would be through the State of Arizona Cooperative Contract# CTR041810. The vehicles would be through the State of Arizona Cooperative Contract# CTR059323 with San Tan Ford. The lighting and equipment would be through the City of Tempe Cooperative Contract#T21-003-02. Items of discussion from Council included the possibility of purchasing other makes of vehicles in the future and clarification on the mileage and condition of the vehicles for replacements. Mr. Wolff addressed these concerns. This expenditure was approved iO the FY2O23/24Budget. Vice Mayor Schroeder moved,seconded by Councilmember Nesser that the construction agreement with Vevegy through the 1Government Procurement Alliance Cooperative Contract No. 22-11 PV-08 to replace and upgrade lighting at the Prospector Park softball complex to energy efficient and dark sky-friendly lighting in an amount not to exceed$841,470.00 be approved. Counoi|mombor Cross and Counoi|m*mbor SoUor No: O Liz Langenbach presented information regarding the lighting upgrade at Prospector Park. The Prospector Park sports field and rodeo arena lighting within City of AJ Parks and Rec facilities are among some of the oldest infrastructure in the parks. The lighting is old and has significant required maintenance issues. The high use energy lights have been due for upgrade for many years. The Little League complex lighting was updated to shielded/LED structures several years ago through a Diamondbacks grant, and the city has scheduled changing all other lighting to be shielded/LED lights over the course of the 2023-2024 budget years. Prospector Park softball fields#1 and#2 are the first, and most expensive, due to additional pole replacements and will dually serve the purpose of first row lighting for the adjacent fields#3 and#4. City staff selected Musco lighting to perform the work. They are one of the premier manufacturers for sports field lighting, with a focus on energy-efficient, shielded LED lighting. There are several reasons why this is the best choice for the city's facilities: 1. This is the same system that is at the Little League fields; and the automated system is already integrated into the facility reservation nofbwuna and additionally allows light activation by city staff from u mobile device orucomputer. 2. K4unoo lighting has experience designing sports field lighting that in compliant with Dark Sky Friendly Sports Field Lighting and their design will assist in gaining that designation at each field. 3. Over time, the city will have substantial savings through lower electrical costs and lower maintenance/replacement costs. The City will utilize Musco's vendor, Veregy, for this replacement project under the 1 Government Procurement Alliance (1 GPA)Cooperative Contract 22-11 PV-08 thus fulfilling procurement and open market procedures. Staff is recommending a construction contract be awarded to Veregy, in an amount not to exceed: $841,470.00 (which includes a 5% owner-controlled contingency for unforeseen oinoumetanmee). Time ionf the essence for this project. The best time frame for construction to take place is during the annual shutdown of fields for over seeding which occurs during October. K. COUNCIL DIRECTION TO STAFF L. SELECTION OF MEETING DATES, TIMES, LOCATIONS, AND PURPOSES M. CALL TO PUBLIC Denise Austin, Apache Junction, addressed the council with the challenges that exist for the homeless in Apache Junction. Jane Brown, Val Vista Road, Apache Junction, expressed her thoughts on the hours at the Dutchman Dog Park and the pavement surrounding the grounds. Donna Carr, Apache Junction, voiced her concerns of the reflectors on city streets and the city code regarding setbacks. George Martinez, 1075 S. Cortez Road, Apache Junction, commented on a recent citation he received regarding the number of RV's allowed in current city code, and would like to see this number increased. Andre Meek, 1327 S. Belair Road, Apache Junction, shared his concerns regarding the design at the intersection of Lost Dutchman and Highway 88, the current city code allowing one RV per parcel and the homeless situation in Apache Junction. The subject area consists of approximately . 92 net acres, upon which sixteen (16) units are proposed, resulting in a density of approximately 17 . 4 units per acre, which is within the maximum density permitted in the "RM-2" High Density Multiple-Family Residential zone of twenty-two (22) units per acre . The development plan proposes eight (8) two-story buildings, with two (2) two-bedroom units in each building. There are thirty-six (36) proposed parking spots, with one garage parking space allotted for each unit, and the other eighteen (20) parking spaces being an uncovered space. Four (4) of these spaces are guest spaces provided beyond the minimum resident parking requirement. Access into the community is proposed only on N. Plaza Drive, as driveway access cannot be permitted onto W. Superstition Boulevard, a main arterial, so close to an intersection. On-site amenities consist of patio spaces with picnic tables . Case P-22-130-PZ June 27,2023 Planning and Zoning Commission Staff Report 3 PLANNED DEVELOPMENT REQUEST As defined by the Apache Junction Zoning Ordinance, Planned Development Overlay Districts ("PD") are intended to allow site and building design flexibility which may not otherwise be allowed through conventional base zoning. The applicant has requested the use of a PD to apply two deviations to the typical RM-2 Bulk Standards have been requested, and one deviation to the landscape standards, as noted: • A reduction of the Minimum Front Building Setback from twenty feet (20' ) to ten feet (10' ) . • A reduction of the Minimum Rear Building Setback from twenty feet (20' ) to ten feet (10' ) . • The Zoning Ordinance Landscape Regulations require a ten foot (10' ) landscape strip shall be provided within the property lines, however the applicant is requesting that their street frontage landscaping shall be placed within the approximately thirteen foot (13' ) area between the property line and the edge of the sidewalk along W. Superstition Boulevard and the approximately eleven foot (11' ) area between the property line and the edge of the sidewalk along N. Plaza Drive. PLANNING STAFF ANALYSIS Relationship to General Plan: The subject site is designated by the city' s General Plan as part of the "Downtown Redevelopment Area", and is categorized for "Downtown Mixed Use, " which supports residential densities between 10 dwelling units per acre to 40 dwelling units per acre . The proposed density of 17 . 4 units per gross acre complies with this General Plan designation and does not require a General Plan Amendment. In Staff' s analysis of this location and the proposal, Staff believes this proposed development plan utilizes a historically vacant property in a manner that complies with the General Plan by meeting the following General Plan Goals : • Goal 3 . 2 - Diversify housing stock and neighborhoods by incorporating a variety of housing types and associated values to allow for a diverse demographic of residents . • Goal 3 . 4 - Incorporate sustainable practices in all housing development. All other necessary and required on-site and off-site improvements, including retention basins, perimeter walls, amenities and landscape buffers will be built at the time of development. Public Input: The applicant sent out neighborhood meeting notification letters to the property owners within a 300-foot radius, notifying neighbors of the proposed development and providing them contact information to learn more about the project. The advertised Case P-22-130-PZ June 27,2023 Planning and Zoning Commission Staff Report 6 neighborhood meeting was held at a local nearby restaurant as advertised on Saturday May 20, 2023 at 11 : 30 AM. No neighbors attended to express any comments regarding the development. The applicant' s Public Participation Plan Report has been included as Exhibit #7 . Staff have not received any comments via phone or e-mail regarding the proposed development at the time of this staff report. FINDINGS OF FACT FOR PLANNED DEVELOPMENT REZONING As required by the Apache Junction Zoning Ordinance, a Planned Development request may be approved by the City Council after consideration has been given to three different criteria. The criteria is outlined in the text below: 1 . That a better design cannot be achieved by applying the strict provisions of the underlying zoning district. Applicant Response: This project fits the intent by promoting the most appropriate land use, and facilitating flexible building design, site design, and amenities. A better design is achieved by not applying the strict provisions of the zoning district. The deviation to the RM-2 Zone district are as follows: • Front Setback 10ft. (shown) vs 20ft. (required) • Rear Setback 10ft. (shown) vs 20ft. (required) This is a better design outweighing the deviation to the RM-2 requirements as follows: • Maximum Density 1 7. 4 unitslac (shown) vs 22 unitslac (allowed) • Onsite parking spaces 18 (shown) vs (16 required) • Additional offsite parking is available as developed by the City of Apache Junction for the use allowed to the general public. Planning Division Note: The applicant indicates that reducing the setbacks allowed them to increase the density to reach the higher density goals of the Downtown Mixed Use area, while still providing more parking than the minimum requirement. They also note that the plan to utilize the off-site on-street parking along N. Plaza Drive, however this cannot be included in the applicant' s parking requirement, as they must be self-sufficient within their own site . PLANNING DIVISION RECOMMENDATION In review of the project proposal, the conditions and context of the subject site, the General Plan land use designation, and the need for downtown housing, Staff is supportive of the proposed rezoning P-22-130-PZ and respectfully recommends to the Commission a favorable recommendation to the City Council, subject to the conditions of approval noted below. Superstition Boulevard and N. Plaza Drive are permitted to be located outside of the property line to provide enough property depth for the proposed building arrangement. These landscape, screening and irrigation improvements that are located within the W. Superstition Boulevard right-of-way and N. Plaza Drive right-of-way must comply with the Apache Junction Public Works requirements including the spacing away from streetlights . Maintenance, replacement, and possible relocation of the landscaping within the adjacent right-of-way shall remain the responsibility of the property owner and their successors per the standards contained in Apache Junction City Code, Volume II, Land Development Code, Chapter 1, Zoning Ordinance, Article 1-8, Landscape Regulations . As the property is surrounded by commercial uses and bordered by an RV park, no house has been built here and the property has remained undeveloped, with minor adjacent street improvements that the city has constructed along N. Plaza Drive. PROPOSALS P-22-130-PZ is a proposed Planned Development Rezoning of parcel 101-11-003B, from "RS-20" Medium Density Single-Family Detached Residential to "RM-2/PD" High Density Multiple-Family Residential by Planned Development to facilitate a 16-unit two- story duplex community. The subject area consists of approximately . 92 net acres, upon which sixteen (16) units are proposed, resulting in a density of approximately 17 . 4 units per acre, which is within the maximum density permitted in the "RM-2" High Density Multiple-Family Residential zone of twenty-two (22) units per acre . The development plan proposes eight (8) two-story buildings, with two (2) two-bedroom units in each building. There are thirty-six (36) proposed parking spots, with one garage parking space allotted for each unit, and the other eighteen (20) parking spaces being an uncovered space. Four (4) of these spaces are guest spaces provided beyond the minimum resident parking requirement. Access into the community is proposed only on N. Plaza Drive, as driveway access cannot be permitted onto W. Superstition Boulevard, a main arterial, so close to an intersection. On-site amenities consist of patio spaces with picnic tables . Case P-22-130-PZ June 27,2023 Planning and Zoning Commission Staff Report 3 PLANNED DEVELOPMENT REQUEST As defined by the Apache Junction Zoning Ordinance, Planned Development Overlay Districts ("PD") are intended to allow site and building design flexibility which may not otherwise be allowed through conventional base zoning. The applicant has requested the use of a PD to apply two deviations to the typical RM-2 Bulk Standards have been requested, and one deviation to the landscape standards, as noted: • A reduction of the Minimum Front Building Setback from twenty feet (20' ) to ten feet (10' ) . • A reduction of the Minimum Rear Building Setback from twenty feet (20' ) to ten feet (10' ) . • The Zoning Ordinance Landscape Regulations require a ten foot (10' ) landscape strip shall be provided within the property lines, however the applicant is requesting that their street frontage landscaping shall be placed within the approximately thirteen foot (13' ) area between the property line and the edge of the sidewalk along W. Superstition Boulevard and the approximately eleven foot (11' ) area between the property line and the edge of the sidewalk along N. Plaza Drive. PLANNING STAFF ANALYSIS Relationship to General Plan: The subject site is designated by the city' s General Plan as part of the "Downtown Redevelopment Area", and is categorized for "Downtown Mixed Use, " which supports residential densities between 10 dwelling units per acre to 40 dwelling units per acre . The proposed density of 17 . 4 units per gross acre complies with this General Plan designation and does not require a General Plan Amendment. In Staff' s analysis of this location and the proposal, Staff believes this proposed development plan utilizes a historically vacant property in a manner that complies with the General Plan by meeting the following General Plan Goals : • Goal 3 . 2 - Diversify housing stock and neighborhoods by incorporating a variety of housing types and associated values to allow for a diverse demographic of residents . • Goal 3 . 4 - Incorporate sustainable practices in all housing development. Across N. Plaza Drive, to the northeast, is the Arroyo Hermosa Mexican Village commercial strip center, which has office, service, and restaurant uses . • To the south & west of the property is the Lost Dutchman RV Resort, zoned Recreational Vehicle Park "RVP, " which has a comparable density of 17 . 9 units per acre; Case P-22-130-PZ June 27,2023 Planning and Zoning Commission Staff Report • To the east of the property is the Horizon Health & Wellness center, zoned "B-3" City Center; The property' s surrounding uses, location in the Downtown Mixed Use area, and the uncharacteristic context for a single-family residential property have been taken into account in making staff' s recommendation. rk Infrastructure & Site Improvements: The applicant will be required to connect the units to all necessary services, including electricity through SRP, water through the Arizona Water Company, and sewer connections . All other necessary and required on-site and off-site improvements, including retention basins, perimeter walls, amenities and landscape buffers will be built at the time of development. Public Input: The applicant sent out neighborhood meeting notification letters to the property owners within a 300-foot radius, notifying neighbors of the proposed development and providing them contact information to learn more about the project. The advertised Case P-22-130-PZ June 27,2023 Planning and Zoning Commission Staff Report 6 neighborhood meeting was held at a local nearby restaurant as advertised on Saturday May 20, 2023 at 11 : 30 AM. No neighbors attended to express any comments regarding the development. The applicant' s Public Participation Plan Report has been included as Exhibit #7 . Staff have not received any comments via phone or e-mail regarding the proposed development at the time of this staff report. FINDINGS OF FACT FOR PLANNED DEVELOPMENT REZONING As required by the Apache Junction Zoning Ordinance, a Planned Development request may be approved by the City Council after consideration has been given to three different criteria. The criteria is outlined in the text below: 1 . That a better design cannot be achieved by applying the strict provisions of the underlying zoning district. Applicant Response: This project fits the intent by promoting the most appropriate land use, and facilitating flexible building design, site design, and amenities. A better design is achieved by not applying the strict provisions of the zoning district. The deviation to the RM-2 Zone district are as follows: • Front Setback 10ft. (shown) vs 20ft. (required) • Rear Setback 10ft. (shown) vs 20ft. (required) This is a better design outweighing the deviation to the RM-2 requirements as follows: • Maximum Density 1 7. 4 unitslac (shown) vs 22 unitslac (allowed) • Onsite parking spaces 18 (shown) vs (16 required) • Additional offsite parking is available as developed by the City of Apache Junction for the use allowed to the general public. Planning Division Note: The applicant indicates that reducing the setbacks allowed them to increase the density to reach the higher density goals of the Downtown Mixed Use area, while still providing more parking than the minimum requirement. They also note that the plan to utilize the off-site on-street parking along N. Plaza Drive, however this cannot be included in the applicant' s parking requirement, as they must be self-sufficient within their own site . That strict adherence to the provisions of the zoning ordinance is not required in order to ensure the health, safety and welfare of the inhabitants of the proposed development. Applicant Response: The two minor deviations to the RM-2 Zoning ordinance will not affect the health, safety, and welfare of the inhabitants of the development. 3 . That strict adherence to the ordinance is not required to ensure that property values of adjacent properties will not be reduced. Applicant Response: The two minor deviations to the R-2 Zoning ordinance will not reduce the property values of adjacent properties. Adjacent to this development is a mobile home park, and rehabilitation center, both vastly different uses to this site. New construction always enhances the neighborhood. PLANNING DIVISION RECOMMENDATION In review of the project proposal, the conditions and context of the subject site, the General Plan land use designation, and the need for downtown housing, Staff is supportive of the proposed rezoning P-22-130-PZ and respectfully recommends to the Commission a favorable recommendation to the City Council, subject to the conditions of approval noted below. As always, Commissioners may recommend changes or additional conditions which they feel will improve the development plan. RECOMMENDED MOTION FOR PLANNED DEVELOPMENT REZONING I move that the Planning and Zoning Commission recommend to the Apache Junction City Council the approval of planned development rezoning case P-22-130-PZ, a request by John Fox of William Seymour Co, Inc. to rezone Parcel 101-11-003B, located at the southwest corner of W. Plaza Drive, from "RS-20" Medium Density Single-Family Detached Residential to "RM-2/PD" High Density Multiple-Family Residential by Planned Development, to facilitate a 16-unit two- story duplex community, subject to the following conditions of approval : Case P-22-130-PZ June 27,2023 Planning and Zoning Commission Staff Report 1) The project shall be developed in compliance with the plans attached and associated with case P-22-130-PZ and all the provisions of the zoning ordinance and city codes applicable to this case . 2) The proposed development will not be age-restricted. 3) The minimum front setback and the minimum rear setback for main structures shall be reduced from 20 feet to 10 feet. 4) Landscape, screening and irrigation improvements along W. Superstition Boulevard and N. Plaza Drive are permitted to be located outside of the property line to provide enough property depth for the proposed building arrangement. These landscape, screening and irrigation improvements that are located within the W. Superstition Boulevard right-of-way and N. Plaza Drive right-of-way must comply with the Apache Junction Public Works requirements including the spacing away from streetlights . Maintenance, replacement, and possible relocation of the landscaping within the adjacent right-of-way shall remain the responsibility of the property owner and their successors per the standards contained in Apache Junction City Code, Volume II, Land Development Code, Chapter 1, Zoning Ordinance, Article 1-8, Landscape Regulations . All required trees shall be at least 24" box and all required shrubs shall be at least 5-gallon in size . 5) All applicable permits shall be applied for, and plans shall be designed to current city codes prior to any lot grading or construction. 6) The developer' s engineer shall meet the civil engineering improvement plans and document requirements in accordance with the city' s approved engineering standards that are in effect at the time of plan submittal . I understand that guest parking is needed then the two required parking spots for each multifamily unit is a garage but my experience is if parking is open (no assigned parking)that there is more then enough parking for residents and guest. With the new trend of residents working from home the number uftwo bedrooms that are rented to a single person has greatly increased over the last few years so parking has not been an issue, day nrnight. As bicycle parking(bike racks)we have them an our property's and our residents that have bike use them some, but most keep there bikes in there apartments or storage units. There was a bike that was stolen a few weeks ago from one of our bike racks. Seams like tomne this is something the owner/ designer of the community's should be able tochose. Electric vehicle charging stations,they are very new and just in the beginning stages astowhat is needed with charging different brand cars and what equipment is needed to charge them. This is changing all the time. We are having two chargers installed at each of our three locations and the chargers have changed twice in the three months since we started the process of having them installed. I think it is a good idea on having chargers but it is very new and no one has any idea on what is needed for them. To have them installed is not a lot of money if your electric panel has the power that is needed, but if you have to upgrade the power that is needed for the charges it can add $10 of thousands of dollars to a project that could be obsolete in a few years. Also it take 6-10 hours to charge a vehicle on a level 2 so it would not be of much use if you have to rely on the charger being open to charge for you to get to work the next day and someone else is using the charger. | understand the town is trying to get a head of things that could be an issue but with all of the increased cost for someone to build a new community it will limit the number of units that can and will be built. This also might be a moot point since the state is trying to make building affordable housing easier and over riding towns plans (| am not a fan of what the state is trying todo). No driveway over 300 feet long shall exceed a 10% grade, and no driveway shall exceed a 17% grade. (R).-kg) Shared access, Common driveways between adjacent properties are encouraged and may be required as a condition of site plan approval. A perpetual cross access and maintenance agreement between the adjoining properties shall be required in a form approved by the City Attorney. (S)4T) Parking lot surface. The following requirements shall apply to loading spaces, maneuvering areas, and driveways for new development or redevelopment and/or additions where 50% expansion of the existing building floor area occurs, shall be surfaced as follows: (1) B-1, B-3, B-4, B-4, RM-1, RM-2 and RM-3 Zoning Districts. Asphalt, concrete or masonry pavers installed at a depth approved by the Development Services Engineer shall be required for new development or redevelopment and/or additions where 50% expansion of the existing building floor area occurs. It is recommended to that an additional number of parking spaces are constructed with convenient access to electrical connections to preemptively prepare for potential conversions of normal parking stalls to EV charging;stations, in case future demand were to require more charging stations. (1) Level 2 EV charging stations are defined by their capacity to provide 30-80 amperes using a 208 to 240 volt outlet. If the number of proposed parking stalls does not comply with the standards in Y- ' �� - Apache Junction City Code,Vol. I1, 1-7 3, Table 7-,1,, the Zoning Administrator may reduce the required number of stalls by up to 10% following review and determination of the following: (1) Technical evidence that the proposed use(s) generates a parking demand that is at least 10% less than the required parking standard in . 1f� �7-6 Apache Junction City Code, Vol. 1l, § 1-7-3, Table 7-1; and/or (2) Determination by the Zoning Administrator that a portion of the required parking can be accommodated with existing public parking that is available within 100 feet of the property. Off-street loading, unloading and the maneuvering of commercial vehicles shall be subject to the following: (A) Circulation. There shall be no loading or unloading of commercial vehicles on the public street. Off-street maneuvering space shall be provided so that no backing onto or from a public street is required. [2023] Page 11 (B) Screened. The loading area shall be screened from adjacent residentially zoned property with a solid 8 foot high wall, and located to minimize visibility from a public street. (C) Size. Off-street loading spaces shall be at least 12 feet wide and 35 feet deep, exclusive of access aisles and maneuvering space. § 1-7-6 PRIVATE STREET STANDARDS. (A) Private streets shall be a minimum of 28 feet in unobstructed width of paved surface (back of curb to back of curb, if curbs are installed) with a 20-foot by 20-foot cutoff at intersections or a minimum turning radius of 20 feet. Narrower private streets may be permitted subject to City Council, review and approval. (B) A private street may be permitted where its use is logically consistent with a desire for neighborhood identification and control of access and where special design concepts may be involved, such as within planned development areas, manufactured home developments, subdivisions or with CUPs. (C) Private streets shall be subject to Planning and Zoning Commission recommendation, City Council approval and the following requirements: (1) Paving shall be installed according to City Engineering Guidelines for public residential streets, or in accordance with subdivision regulations, if applicable. Curbs, gutters, sidewalks and streetlights may be required by the Council. Alternative paving surfaces may be permitted by the Development Services Engineer; (2) Other requirements may be imposed by the Council for vehicular and pedestrian safety, utilities and emergency vehicle access; (3) Private streets shall not be allowed if, in the opinion of the City Council, a public street would better serve the public health, safety and welfare, or the location of the private access way presents a potential hazard to vehicular or pedestrian traffic at the intersection of the private street with a public street; and (4) City approvals shall be required for private streets. The design engineer shall be responsible that their design meets the geometrical and structural street design requirements and policies in accordance with general engineering standards. Testing and inspection for conformance of construction to minimum requirements of approved plans shall be the responsibility of the developer, who shall provide the city with proof that the requirements have been satisfied prior to project acceptance. No driveway over 300 feet long shall exceed a 10% grade, and no driveway shall exceed a 17% grade. A perpetual cross access and maintenance agreement between the adjoining properties shall be required in a form approved by the City Attorney. (S)4T) Parking lot surface. The following requirements shall apply to loading spaces, maneuvering areas, and driveways for new development or redevelopment and/or additions where 50% expansion of the existing building floor area occurs, shall be surfaced as follows: (1) B-1, B-3, B-4, B-4, RM-1, RM-2 and RM-3 Zoning Districts. (C) Size. Off-street loading spaces shall be at least 12 feet wide and 35 feet deep, exclusive of access aisles and maneuvering space. § 1-7-6 PRIVATE STREET STANDARDS. (A) Private streets shall be a minimum of 28 feet in unobstructed width of paved surface (back of curb to back of curb, if curbs are installed) with a 20-foot by 20-foot cutoff at intersections or a minimum turning radius of 20 feet. Narrower private streets may be permitted subject to City Council, review and approval. (B) A private street may be permitted where its use is logically consistent with a desire for neighborhood identification and control of access and where special design concepts may be involved, such as within planned development areas, manufactured home developments, subdivisions or with CUPs. (C) Private streets shall be subject to Planning and Zoning Commission recommendation, City Council approval and the following requirements: (1) Paving shall be installed according to City Engineering Guidelines for public residential streets, or in accordance with subdivision regulations, if applicable. Alternative paving surfaces may be permitted by the Development Services Engineer; (2) Other requirements may be imposed by the Council for vehicular and pedestrian safety, utilities and emergency vehicle access; (3) Private streets shall not be allowed if, in the opinion of the City Council, a public street would better serve the public health, safety and welfare, or the location of the private access way presents a potential hazard to vehicular or pedestrian traffic at the intersection of the private street with a public street; and (4) City approvals shall be required for private streets. The design engineer shall be responsible that their design meets the geometrical and structural street design requirements and policies in accordance with general engineering standards. Testing and inspection for conformance of construction to minimum requirements of approved plans shall be the responsibility of the developer, who shall provide the city with proof that the requirements have been satisfied prior to project acceptance. In short, a recreational vehicle is a portable camping trailer, motor home, park trailer or park model, travel trailer, and a portable truck camper.
