CALL TO PUBLIC At this time the public has the privilege to address the council with requests, communications, comments or suggestions relating to city business.All speakers must have already submitted a written "Request to Speak"form to the city clerk no later than the conclusion of the city manager's report portion of the agenda. If there is a group speaking on the same item, they should select a spokesperson.All such remarks shall be addressed to the council as a whole and not to any member thereof. PUBLIC HEARING City of Apache Junction,Arizona Pagel Special Meeting of the Apache Meeting Minutes May 15,2023 Junction City Council 1. 23-277 Discussion, consideration and public hearing of approval of Resolution No. 23-10, adoption of tentative budget for Fiscal Year 2023-2024. This resolution adopts the tentative budget for Fiscal Year 2023-2024 and sets the date, time and location for a public hearing on final budget adoption and declares an emergency. Vice Mayor Schroeder moved,seconded by Councilmember Nesser to approve Resolution No. 23-10 adopting the tentative budget,giving date,time and location for the public hearing and final adoption of the budget for fiscal year 2023-24 and declaring an emergency be approved. Yes 7- Mayor Wilson,Vice Mayor Schroeder,Councilmember Cross,Councilmember Heck,Council member Johnson,Council member Nesser and Councilmember Soller No 0 City Manager Bryant Powell stated this is one of the steps the city council does in order to adopt the city's final budget for Fiscal Year 2023-24. He announced the Governor and Legislature adopted the state budget of$18 billion. There are still bills active at the legislature the city is continuing to monitor. These are financial bills and zoning bills that would impact the city greatly. Assistant City Manager Matt Busby stated two weeks ago the city council heard the budget presentation from Finance Director Leslie DeReche. During the annual budget process and last council meeting, staff kept track of the questions asked by council and provided those answers to council. Finance Director Leslie DeReche addressed the change to the format of the presentation document council had previously seen compared to what was included in the packet for tonight's meeting. The"pretty"document is the formal document that is sent to the Government Finance Officers Association (GFOA)for a budgeting award. There is a change in the budget, and that is the addition of$5.8 million for the Superstition Vistas Community Facilities District in case they issue bonds. Ms. DeReche stated the numbers are all the same, but it was the format that changed, the old version was page 3 and 4, in the new format it is located on page 25. Councilmembers stated they had several months to review and ask questions on the budget. Mayor Wilson opened the public hearing; receiving no comments from the public he closed the public hearing. 2. 23-242 Presentation, discussion, public hearing and consideration of Resolution No. 23-09, declaring as a public record and adopting certain documents filed with the city clerk entitled "City of Apache Junction Civilian Classification and Compensation Plan for Fiscal Year 2023-2024"and "City of Apache Junction Recruit and Sworn Compensation Plan for Fiscal Year 2023-2024"; and declaring an emergency. REGIONAL INTERGOVERNMENTAL UPDATES 7, Brief summary ofintergovernmental updates from mayor and oounoUmembere. Councilmember Cross announced his attendance at the ribbon cutting ceremony that occurred at the Phoenix-Mesa Gateway Airport for DSV. DSV is the world's third largest freight forwarder and recently signed a 39-month lease with the Phoenix-Mesa Airport Authority for a 22,000-square-foot hangar that will function as a makeshift terminal for processing cargo moving on large freighter aircraft. DSV has engaged Cargo|ux and Atlas Air toprovide dedicated transport utilizing Boeing 747 cargo jets. Cargolux will begin weekly scheduled service from Luxembourg on June 5. Tentative plans call for Atlas Air to deliver cargo from Hong Kong and Taipei, Taiwan, to Phoenix-Mesa starting sometime in Ju|y, but final routing decisions are oU|| being worked out. G. CITY MANAGER'S REPORT 8, City Manager's Report. City Manager Bryant Powell otobad the off-leash dog park will reopen this week. During the seasonal change from winter grass to summer grass and summer to winter grass the park will close to give it time to rejuvenate from all the use and to adjust to the seasonal change and give the seasonal grass time ho fill in. They also installed the Dry Well. He recognized the many employees that work hard to keep the city streets clean, save and traffic flowing with the resources they are o||nootod. It is a significant responsibility. City vr Apache Junction,Arizona Page City Council Meeting Meeting Minutes May 16,2023 9. 23-276 Announcement of Current Events. Public Information Officer Al Bravo stated Mayor Wilson wished to announce they have had three meetings with the states congressional delegation. Most recently Congressman Biggs was present to hear the City's issues, ideas and proposals to address the severe flooding that occurs throughout the city related to the Weeks Wash area. The city has discussed and devised a flood control project with a plan to mitigate the extensive damage caused by this flooding. This would be a significant project that would need several partners to include Maricopa and Pinal County Flood Control, the state of Arizona and federal assistance. He announced tomorrow morning, May 17th, is the Police Memorial Ceremony that will take place across from the police station. The Superstition Vistas Multi-model Transportation Planning Study will hold a virtual meeting Thursday, June 1st at 6:00 p.m. This is the next phase of the transportation area study. This will look at transportation issues and will include the area south of US 60 and include areas of Queen Creek, Mesa and Apache Junction. You can register for the Zoom meeting at: https://bit.ly/440fmd4. The Books and Brews book club meets on the third Thursday of the month through October from 6:30-8:00 p.m. at the Handlebar Pub and Grill. There is a 10% discount off food and drinks. He reminded everyone to check out the city's homepage and the calendar for happenings around the city. Councilmember Soller stated there was a wreath placed at the Washington DC service for Officer Russell Lowell Duncan who was killed in the line of duty while working for Apache Junction on November 9, 1983. H. PUBLIC HEARINGS I. OLD BUSINESS J. NEW BUSINESS 10. 23-289 Presentation and discussion of Rodeo Grounds purchase. Parks and Recreation Director Liz Langenbach provided the City Council with an update on the purchase of the rodeo grounds. She stated the city acquired the use of the rodeo grounds through a parks and public use agreement in 1986 from the Bureau of Land Management (BLM). It is one of four leased properties the city has. In 2020 the city entered into an agreement to pursue the process of purchasing this property from the BLM, under this type of lease, it does not allow any for profit events or commercial events like concerts. The Bureau of Land Management conducted a survey on the value of the land, excluding the value of the improvements the city had made. The purchase is only for the 20 acres within the fenced area of the rodeo grounds. They tried to purchase more acreage, but that acreage is tied to the Prospector Park lease, which would require a new acquisition process. The third-party appraiser valued the land at and the city paid $1.4 million. The city will still be able to use all the remaining area for parking, but the city cannot make money for parking. City of Apache Junction,Arizona Page 3 City Council Meeting Meeting Minutes May 16,2023 That money is to be re-invested into Prospector Park. Final title and ownership documents should be received by mid June. The next steps in the coming year include planning sessions so future events are successful and with minimal hiccups. They have been visiting other rodeo grounds and parks in other cities especially the Queen Creek facility. Over the next year matters to be addressed include review and update of the city's master plan for the parks which was done in 2006, design review, evaluating electricity for the vendor area and updating and increasing water lines . This will be a public process to include several user groups. These changes will take time, but once the city is the official owner, it can rent and utilize the property to bring in extra funds to aid with those upgrades. Ms. Langenbach then reviewed the fees adopted by city council for use of the rodeo grounds. She responded to questions from city council. Councilmember Nesser would like to see the city look into purchasing more land from the BLM including the parking lot and land affiliated with Prospector Park. K. COUNCIL DIRECTION TO STAFF L. SELECTION OF MEETING DATES, TIMES, LOCATIONS, AND PURPOSES M. CALL TO PUBLIC Gail Evans, 913 South Del Rio Court, Apache Junction, addressed council representing the Community Development Corporation. The Corporation is a 501(C)(3)volunteer organization that works on city projects and also works very closely with the city's code compliance division. They help with city projects such as the memorial bricks, and Make a Difference Day. They help residents who are struggling with code compliance violations and clean up properties to help them avoid going to court and being issued fines. She thanked the council and the Health and Human Services Commission for their support and funds,and the AJ Mounted Rangers for their donation to help with their youth project. She wanted to share two significant projects the CDC worked on last year. One was to help an elderly man who's wheelchair ramp was destroyed when a large Saguaro cactus crashed down on it during a severe storm. She wanted to recognize Urias Strickler,from the NextDoor app who spent several days building the ramp. Another individual, Ron Crow donated his John Deere front loader to the CDC. It needs a little work, and they have a volunteer for the labor, they are looking for donations to purchase needed parts. She wanted to recognize so many of these volunteers and those who go unrecognized for their generosity. N. WHEREAS, the provisions of A.R.S. § 48-616 require the governing body to levy taxes upon all property in municipal street lighting improvement districts („Districts") to pay the annual expenses of said Districts; and WHEREAS, the governing body of the municipality shall crake annual statements and estimates of the expenses of the Districts, which shall be provided for by the levy and collection of ad valorem taxes capon the assessed value of all the .real and personal property in the Districts; and WHEREAS, the mayor and council desire to adapt fiscal year 2024 final budget for the Districts. Staff has found the proposed final plat to be in conformance with the preliminary plat, the Auction Property at Superstition Vistas Master Planned Community plan and the Superstition Vistas Master Infrastructure Reports . PROPOSALS The final plat requests approval of a 158-lot residential subdivision with typical lot sizes of ranging from 6, 000 to 6, 600 square feet. The property is generally located near the southwest corner of Radiance Avenue Ironwood Drive . PLANNING STAFF ANALYSIS Relationship to General Plan: The subject site is designated by the city' s General Plan as "Master Planned Community" . The proposed density of 3 . 55 du/acre is consistent with the City of Apache Junction' s General Plan and density limits as established by the Auction Property at Superstition Vistas Master Planned Community plan. Infrastructure Improvements: Road improvements and necessary utility infrastructure improvements will be built and dedicated to the city prior to the final inspection and approval of any individual residential lots . Furthermore, all other necessary on-site improvements, such as community amenities, retention basins, accessible routes, and landscape buffers, will be built during the first phase of on- site construction. Employee shall be permitted to adjust his work schedule as he deems appropriate and consistent with the FLSA, so long as he is available and the judicial administration of the City is not harmed. SECTION 6. PROFESSIONAL DEVELOPMENT A. City hereby agrees to budget and to pay the travel and subsistence expenses of Employee for professional and official travel, meetings and occasions adequate to continue the State Supreme Court required or recommended professional development of Employee. & City also agrees to budget and to pay for travel and subsistence expenses of Employee for short courses, institutes and seminars which are necessary for professional development and for the good of City, subject to the mayor's determination as to what is necessary. C. City agrees to pay professional dues and association dues, which are necessary for participation in national, regional, state and local professional associations, or are reasonably related for the maintenance of professional credentials, or for reasonable professional development, subject to the mayor's determination as to what is necessary. SECTION 7. OTHER TERMS AND CONDITIONS A. City shall fix any such other terms and conditions of employment, as it may determine from time to time, relating to the performance of Employee, provided such terms and conditions are not inconsistent with or conflict with the provisions of this Agreement, the Apache Junction City Code, Arizona Revised Statutes, or any other statute, ordinance or regulation. B. All action taken by City relating to fringe benefits for employees in the executive ranges shall be considered actions granting the same benefits to Employee. The term "fringe benefits" include vacation and sick leave, holidays, medical/visionidental/life insurance, equivalent percentage as a step adjustment or equivalent percent increase as a base wage adjustment or cost of living or other general citywide increases adopted by the City or city manager however coded in the City's payroll system under the same terms and conditions as are available to all non-sworn City employees, except, however: 1) in the case of medical/RX/dental/vision insurance, City shall pay all Employee and family premiums at no cost to Employee for Employee, spousal and dependent child coverage for Medical/RX PPO Buy- Up Plan, Dental Buy-Up plan, and Vision Buy-Up plan or as otherwise 4 directed by Employeei I initially selec time of any open enrollment; general citywide salary, base wage adjustmentliving increases i 4 shall not be provided agreesC.
