ORDINANCE NO. 1564
AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF
APACHE JUNCTION, ARIZONA, AMENDING APACHE JUNCTION CITY
CODE, VOLUME I, CHAPTER 8 : BUSINESS, BY AMENDING ARTICLE
8-1 GENERAL BUSINESS AND LICENSING PROVISIONS, SECTION
8-1-1 DEFINITIONS AND ARTICLE 8-2 SPECIFIC LICENSING AND
REGISTRATION PROVISIONS, SECTION 8-2-7 PERMITS; FEES,
BOTH RELATING TO FORTUNE TELLING BUSINESSES; REPEALING
ANY CONFLICTING PROVISIONS; PROVIDING FOR SEVERABILITY;
AND PROVIDING FOR PENALTIES.
WHEREAS, on May 6, 2026, the city council gave direction to
staff to review and consider updates to Apache Junction City Code,
Volume I, Chapter 8 : Business, concerning fortune telling businesses
and the permit fees prescribed for them; and
WHEREAS, it is the desire of the city council to modify and
update these provisions to better reflect the modern business
environment.
NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF
THE CITY OF APACHE JUNCTION, ARIZONA, AS FOLLOWS:
SECTION I IN GENERAL
1 . That existing Apache Junction City Code, Volume I,
Chapter 8 : Business, Article 8-1 : General Business and
Licensing Provisions, § 8-1-1 Definitions, be amended by
removing the following:
FORTUNE TELLER. A person who purports to have the ability to
predict a person' s future by palmistry, using a crystal ball
or cards, or similar methods.
2 . That existing Apache Junction City Code, Volume I,
Chapter 8 : Business, Article 8-2 : Specific Licensing and
Registration Provisions, § 8-2-7 Permits; Fees, be amended by
removing the following row from the permit table:
Type of Permit: Fortuneteller, palmist (with approval of the
director of public safety)
Initial Fee: $1200 . 00
Renewal Fee: $1200 . 00

SECTION II REPEALING ANY CONFLICTING PROVISIONS
All ordinances and parts of ordinances in conflict with the
provisions of this ordinance or any part of the codes adopted
herein by reference are hereby repealed.
SECTION III PROVIDING FOR SEVERABILITY
If any section, subsection, sentence, phrase, clause or portion of
this ordinance or any part of the codes or regulations adopted
herein by reference is for any reason held to be invalid or
unconstitutional by the decision of any court of competent
jurisdiction, such decision shall not affect the validity of the
remaining portions thereof.
SECTION IV PROVIDING FOR PENALTIES
Unless noted otherwise, any violation of any provisions adopted
herein, shall be punishable as a class 1 misdemeanor consistent
with Apache Junction City Code, Volume 1, Chapter l : General,
Article 1-1 : General, § 1-1-11 (A) Penalty.
