In the companion Planned Development case PZ-21-83, the applicant is proposing a 244-lot travel trailer resort. The site is a vacant 20-acre parcel located on the south side of West Southern Avenue between South Idaho and South Winchester Roads in Section 33. The proposed density would be 24.4 persons per acre which would comply with the General Plan. The companion preliminary plat (SD-12-83) would be considered by the Subdivision Committee if the annexation and rezoning are approved. The DCC does recommend stipulating that the annexation be approved in conjunction with, but prior to the approval of the companion rezoning case PZ-21-83. The DCC has determined that the annexation requirements outlined in A.R.S. 9-471 have been complied with. CITY MANAGER'S REPORTS City Manager Mike McNulty informed the Council and public that the Certificate of Convenience and Necessity for the sewage service of Sierra Entrada was transferred by the Corporation Commission from P & P Development Company to American Public Service, and introduced Mr. Lester Smith to answer questions. Mr. Lester Smith, Chief Executive Officer, American Public Service, stated that as of December 21, 1983, the Certificate of Convenience and Necessity was transferred, and that American Public Service has filed for an emergency rate increase with the Corporation Commission in order to finance the improvements that are necessary with the Sierra Entrada sewage plant. Mayor Clarke requested an approximate dollar amount of the increase. Mr. Smith explained that this will probably be a temporary rate increase of approximately three times the present amount, and outlined the improvements necessary to solve the problems with the system. Councilman Steelsmith wished to know what steps could be taken for a short term solution, until the improvements are made. Mr. Smith stated that it would be at least 45 days before Phase I can begin, and reported what has been accomplished, and answered questions from Councilmembers and members of the public regarding the operations of the sewage system, and the odor problem. Mayor Clarke recessed the meeting at 7:40 p.m.. Mayor Clarke reconvened the meeting 7.55 p.m Mayor Clarke asked that the record show that Councilman Shanks had been excused, as she was ill. PUBLIC HEARINGS PROPOSED ORDINANCE NO. 188, LEIGH (First Reading Mayor Clarke opened the hearing to the public. Associate Planner Jim Nakagawa briefed the Council on rezoning case no. PZ-15-83, from GR General Rural to Trailer Homesite Zone (TH), stating that on a previous application, Mr. Leigh was not able to obtain a quit claim from the Farmers Home Administration, and is now requesting rezoning of the adjacent parcel, owned by Saldana. Mr. Ted Leigh, 1367 W. Navajo, Apache Junction, voiced his opinion in regards to protest requirements of rezoning applications. Mayor Clarke commented that legal requirements are very clear. THE HONORABLE MAYOR AND MEMBERS �OId Business OF THE CITY COUNCIL ✓New Business Consent Agenda THROUGH: CITY MANAGER 41 FROM: DIRECTOR OF PUBLIC SAFETi"' Wad DIRECTOR OF PUBLIC WORKS ' �.; REGARDING: INTERSECTION OF PHELPS DRIVE AND U.S. HWY 60 (Agenda Item) With the increase in the volume of traffic along U.S. Highway 60, there is a noticeable increase in the number of accidents at the above referenced location. Current records reveal two accidents in 1982, and six accidents in 1983. In making field observations, we believe the existing driveway access on the west side of Phelps Drive, immediately at the curb return, poses a potential hazard to local and transient traffic. Exhibit "A", attached, shows four potential situations that cause concern. We believe that eliminating this driveway approach and requiring motorists to use the alternative existing driveway access, approximately 135 feet south, will improve traffic safety. We further believe that the elimination of this driveway will pose no hardship on the businessmen as access is still provided from Phelps Drive and from U.S. Highway 60. The owner of the subject property has been contacted and observed the traffic condi- tions, and agrees to the potential hazard. At this time, the only inquiry has come from Mr. Joe Valarkis, owner of "Lucky Bob's Liquor" , who has expressed concern for his patronage, and that of other businesses to the west of him. The corrective measures being recommended at this time are to remove the exist- ing roll curb for approximately 135 feet, and replace it with 6 inch vertical curb and gutter. This modification will force motorists to access "Lucky Bob's" from Phelps Drive, south of the immediate intersection, thereby eliminating some of the various complex traffic movements at the intersection. The final inspection was made by both City and School officials. With two contracts being awarded on this project, one for bathhouse construction and one for swimming pool construction, it is necessary that both portions be accepted by the City Council. It is recommended that the entire Swimming Pool Project be accepted, and that final payment be made to Robert DeBow, Jr. , Construction, Inc. , and Aqua Fab Supply Co. , Inc. Am. The City Council has now approved that case, so the material was once again advertised and was on the September 13, 1983 Commission agenda. "West Wells Fargo Avenue" appears to be a substitute road for the "West Twelfth Avenue" alignment. The facts known are: .ry 1 . There is an alley platted along the Twelfth Avenue alignment. (See Ironwood Manor, Unit I Subdivision. ) 2. Wells Fargo was dedicated about 136' feet (centerline to centerline) south of the alley which is about a half block width. 3. Twelfth Avenue is a collector road alignment. 4. In case PZ-17-83, the rezoning proposal by the City Council brings Wells Fargo into alignment with the future alignment for Twelfth Avenue. Thereafter, the new street name would be required. The street name change would not affect the house numbers. Should the City Council approve the change, each affected property owner would be encouraged to provide notice of change of address as soon as possible. The current street name is not in compliance with the Street Naming Policy Guide. Development Coordinating Committee (DCC) Comments The DCC has reviewed the situation and has no objection to approval of the Ordinance, noting the current name does not comply with current policy. Specific legal requirements must be met in order for such an election to take place. The first step would be the adoption of a resolution declaring the intent of the Council to conduct such an election. The adoption of this resolution, however, is not binding and the Council still has the option of not holding the one-time override election if that decision is made at a later date. This resolution is necessary to begin the preliminary steps in preparing for such an election in the event one is held. After adoption of this resolution, preparations will begin to compile a list of projects that could be covered by the override election. In addition, it will be necessary to complete a contract with the Pinal County Elections Department, arrange for election boards, polling places, etc. This resolution will be placed on the January 17th agenda for Council consideration. They have approached the City of Apache Junction in order to enlist additional support of this rail service. Even though a stop would not be located in Apache Junction, the close proximity of stops in Mesa and Coolidge would be of great benefit to our city which even now lacks direct access to a major freeway. If established, daily communter rail service would exist between the Phoenix-East Valley area, Tucson, Wickenburg, Sun City, northern Arizona, Albuquerque, Kansas City and Chicago. Building inspections have increased to the point that it has become necessary to have two and sometimes three inspectors in the field simul- taneously which is, at best, difficult with two vehicles. Fortunately, this increase in demand was anticipated and an additional vehicle was provided for in this year's budget. If the Council approves, we propose to purchase a new vehicle which will be assigned to Mr. Keller with his present vehicle being assigned to Mr. Henry. The remaining vehicle will be shared by the remaining Division staff. In addition, Mr. Keller's present vehicle is from State surplus and has high mileage on it (83,000). Mr. Keller has been averaging 1 ,000+ miles per month. We hope to gain several more years of use from Mr. Keller's vehicle by placing it into secondary useage. A request for bids was published on December 28, 1983, in the Mesa Tribune and, in addition, requests for bids were mailed to twelve Valley dealers. Bid opening has been set for 10:00 a.m. on Monday, January 16, 1984. The firm of Morris, Clester, Abegglen & Associates, Inc. (MCA) met with staff and the City Manager to develop a scope of work and fee. Attached is a proposal from MCA outlining the scope of work, services and fee. Considering the concern for sewage treatment over the last year and a half, this study should provide us with information so that future decisions may be made in regard to the need for a community wastewater system. This study will be essen- tially a desktop study, with the consultant meeting with staff and researching information from public officials, drillers, septic pumpers and health department officials. Perhaps the most critical portion of the study will be the aspect per- taining to the potential of groundwater contamination. As this portion of the study does not provide for field testing, it is questionable whether or not information derived will be absoloutely conclusive. However, Mr. Schmidt, who will be perform- ing the groundwater portion of the study, has 17 years experience in groundwater geology and hydrology studies. The study will be complete with conclusions and recommendations that will form the basis for the direction the City should be taking; ie: Status Quo or development of a sewer system. Accidents for December have increased within the city and this coincides with the large number of winter visitors now residing in the city. Most index crimes in- creased during December, but this is not unusual due to the Holiday season and the increased winter visitor population. In 1983 accidents without injuries increased slightly while accidents with injuries decreased over 1982. The only significant change in 1983 accident statistics was the huge increase (314%) in speed related non injury accidents. Total roadway accidents reported in 1983 were 274. This does not include the 126 non-roadway and private property accidents worked by our Department during the past year. These non-roadway accidents will be reported on the Apache ''^ Junction Police Department Departmental Report in 1984. Most index crimes increased in 1983 with the exception of theft which was down 3% from 1982.
