REGULAR MEETING
MARCH 1,2004
The regular meeting of the District Board of the Water Utilities
Community Facilities District (Apache Junction Water Company),City of Apache
Junction,Arizona,was held on March 1,2004,at the Apache Junction City
Council Chambers pursuant to the notice required by law.
CALL TO ORDER
Chairperson Coleman called the meeting to order at 6:00 p.m.

CONSIDERATION OF PROFESSIONAL SERVICES
AGREEMENT WITH SOUTHWEST GROUND -WATER
CONSULTANTS,INC.FOR PREPARATION OF
APPLICATION FOR ASSURED WATER SUPPLY
)District Water Superintendent
Brian Hall briefed the board on the item.Steve Noel with Southwest Ground-
water met with the Department of Water Resources twice and,after several more
phone calls,gave the district a proposal to complete this portion.It shOuld
not exceed $10,800,but because of the nature of this "moving target",the
propensity for the Department of Water Resources to change their minds,and
that there will not be other meetings for the next couple of weeks,he is
asking for a little more latitude to take care of this.The proposal is
written on a time and expense basis not to exceed $10.800,but should there
need to be some change orders to expedite this and get it done,he would like
the authority to do that.They have gone beyond the standard 10%for
contingencies in this case.
There was general discussion on
whether the company was on the district's consulting list and how old the
current list is.
Chairperson Coleman closed the
discussion with no further comments and called for a motion.
Mr.Milkey MOVED THAT WE APPROVE A
PROFESSIONAL SERVICES AGREEMENT WITH SOUTHWEST GROUND -WATER CONSULTANTS,INC.,
FOR THE PREPARATION OF AN APPLICATION FOR ASSURED WATER SUPPLY IN AN AMOUNT
NOT TO EXCEED $20,000.00 TO INCLUDE THE INITIAL PROPOSAL OF $10,800.00 PLUS AN
ADDITIONAL $9,200.00 FOR POSSIBLE ADJUSTMENTS IN THE FINAL SCOPE OF WORK,SAID
AGREEMENT TO BE SUBJECT TO APPROVAL OF DISTRICT LEGAL COUNSEL AS TO FORM AND
CONTENT.
Mr.Dietz SECONDED THE MOTION.
VOTE:Unanimous.
