REGULAR MEETING
AUGUST 20, 2007
The regular meeting of the District Board of the Water
Utilities Community Facilities District (Apache Junction Water
Company), City of Apache Junction, Arizona, was held on August
20, 2007, at the Apache Junction City Council Chambers pursuant
to the notice required by law.
CALL TO ORDER
Chairperson Insalaco called the meeting to order at 6:02
p.m.

2007, IN THE CITY COUNCIL CONFERENCE ROOM FOR THE PURPOSE OF
CONSULTATION FOR LEGAL ADVICE WITH THE DISTRICT'S ATTORNEY IN
ACCORDANCE WITH A.R.S. § 38-431.03(A)(3),(4) AND (7) AS FURTHER
OUTLINED ON THIS AGENDA.
Mrs. Barker SECONDED THE
MOTION.
VOTE: Unanimous.
The motion carried.

adjourned the meeting to go into executive session.

SECOND AMENDMENT TO PURCHASE AND
SALE AGREEMENT WITH EMPIRE
SOUTHWEST LLC FOR APPROXIMATELY
16.20 ACRES OF DISTRICT PROPERTY

called for a motion.
Mr. Dietz MOVED THAT A
SECOND AMENDMENT TO PURCHASE AND SALE AGREEMENT BETWEEN EMPIRE
SOUTHWEST LLC AND THE WATER UTILITIES COMMUNITY FACILITIES
DISTRICT (CITY OF APACHE JUNCTION, ARIZONA)FOR APPROXIMATELY
16.20 ACRES OF DISTRICT PROPERTY FOR THE AMOUNT OF $3.3
MILLION;AND OF THE MODIFICATION OF CLOSE OF ESCROW TO BE ON OR
BEFORE AUGUST 31, 2007; AND THAT AUTHORIZATION BE GIVEN FOR THE
BOARD CHAIR TO SIGN THE AGREEMENT PENDING FINAL APPROVAL AS TO
FORM BY THE DISTRICT COUNSEL.
