REGULAR MEETING
APRIL 20, 2010
The regular meeting of the District Board of the Water
Utilities Community Facilities District (Apache Junction Water
Company), City of Apache Junction, Arizona, was held on April
20, 2010, at the Apache Junction City Council Chambers pursuant
to the notice required by law.
CALL TO ORDER
Chairperson Insalaco called the meeting to order at 6:25
p.m.

RESOLUTION NO. 2010-002, ADOPTING
THE 2010 EDITION OF THE CITY OF
APACHE JUNCTION PERSONNEL RULES FOR
WATER DISTRICT EMPLOYEES
)District Legal Counsel Kay
Bigelow briefed the board on the item.She stated they have
done this as city council members, they are being asked to adopt
this for the water district employees.
Chairperson Insalaco called
for any discussion.There being no discussion, he called for a
motion.
Mrs. Barker MOVED THAT
RESOLUTION NO. 2010-002, A RESOLUTION OF THE BOARD OF DIRECTORS
OF THE WATER UTILITIES COMMUNITY FACILITIES DISTRICT (CITY OF
APACHE JUNCTION, ARIZONA) ADOPTING THE 2010 EDITION OF THE CITY
OF APACHE JUNCTION PERSONNEL RULES FOR WATER DISTRICT EMPLOYEES,
BE APPROVED.
Vice Chairperson Eck SECONDED
THE MOTION.
VOTE:6-0 (Mr. Serdy had left the room.)
The motion carried.
Chairperson Insalaco stated
they would skip No. 5 Executive Session and go on with the
District Manager Report.

DISTRICT DIRECTOR REPORT
District Director Frank Blanco provided a brief update.The
interconnect is running under automated operations, effective
March 22, 2010.It is the 30 day commissioning period.It
gives flexibility in filling the storage tanks, and assists in
redundancy in transferring water from Mesa or pump groundwater
wells for supplies.The Central Arizona Project water versus
the well production and consumption was basically at 38 million
gallons for the month at the end of April, versus 9.7 million
gallons for the month of April.The Central Arizona Project
water was underutilized in January through March of 2009.In
January the Mesa plant was down and we were unable to take
Central Arizona Project water.Since then they have been
progressing with 20.9 million gallons being used by April versus
23.5 million gallons of well water.We are starting to get
closer to our 50/50 target and will then move towards our 75%
Central Arizona Project water and 25% groundwater.The
designation of assured water supply letter is pending; the draft
has been done by the Phoenix AMA.It is needed for development
for occur.They now have a draft water master plan that
addresses water quality, regulatory requirements, water demands,
water resources, water production infrastructure, water
distribution infrastructure, costs related to a future Central
Arizona Project plant, and recommendations for capital
improvement programs.They are still in process for acquiring
land for the Central Arizona Project Water Treatment Plant,
either state or federal surplus land.They will be coming to
the board for support for either an Apache Junction plant or one
in partnership with another water supplier.
Mr. Dietz asked where they stand with the property from Pinal
County and the bridge swap land.
District Legal Counsel Kay Bigelow stated this week they got
updates on both pieces of property.The preferred location is
the Central Arizona Project excess property and it is going out
for appraisal.
District Director Frank Blanco stated it was published in the
federal register last week.It is still up for Housing and

Urban Development review.The General Services Administration
is handling the sale of that parcel.
District Legal Counsel Kay Bigelow stated that is something they
will negotiate with the district.They will not put it out to
bid or auction.The county just finished their appeal process
and it is going out for auction on July 13.
Vice Chairperson Eck asked what is going out for auction.
District Legal Counsel Kay Bigelow stated the piece of state
land that is next to the sewer district parcel.
Mr. Dietz commented he believes the district wants the other
one.
District Legal Counsel Kay Bigelow stated that is correct.She
thinks Pinal County is still going to buy them both and will use
the piece the district does not want.It looks like both
processes seem to be finishing up.
Mr. Dietz asked where they are in the 18 -month process.
District Legal Counsel Kay Bigelow stated they are outside of it
but that is why we did the amendment.It held the date for an
extra 12 months so that they could get these two processes taken
care of.
Mr. Dietz commented it is important that they get this done as
soon as possible so that we can carry on with what we are doing.
It seems to be getting the governmental business of being drawn
out and drawn out.
District Legal Counsel Kay Bigelow stated it is like moving two
really big gorillas across the finish line.She thinks Pinal
County has really pursued the process with State Land heavily,
but they did get dealt a bad card as the appraisal was an
exorbitant amount.
Mr. Dietz asked if they could get the section we are interested
in taken care of since it is our top priority, even though they
are going for both.They could continue on with the other and

get ours taken care of.We have not been collecting any toll on
our bridge.
Vice Chairperson Eck asked if they are still trying to get
property for this line to continue on.They do not have a
designated inlet to a designated outlet across the state.They
are still trying to find property to get the line to go south.
District Director Frank Blanco stated the property they are
talking about is specific to the future water treatment plant.
Vice Chairperson Eck commented he understood that, but he made a
comment earlier where there were still buyers interested in
purchasing the land.He asked if the main land was purchased.
District Director Frank Blanco asked if he meant the part that
they are looking at that is in Apache Junction by Houston Road.
Vice Chairperson Eck stated he is talking about from Lake Havasu
all the way down in the white.
District Director Frank Blanco stated that is in place.He was
using the graphic to show where the Apache Junction water
treatment plant would be, more or less.

MOTION FOR EXECUTIVE SESSION
)Mr. Coleman MOVED THAT AN
EXECUTIVE SESSION BE HELD AT 6:00 P.M. ON TUESDAY, APRIL 20,
2010, IN THE CITY COUNCIL CONFERENCE ROOM FOR THE PURPOSE OF
CONSULTATION FOR LEGAL ADVICE WITH THE DISTRICT'S ATTORNEY IN
ACCORDANCE WITH A.R.S. § 38-431.03(A)(3) AND (4) AS FURTHER
OUTLINED ON THIS AGENDA.
