REGULAR MEETING
SEPTEMBER 7, 2010
The regular meeting of the District Board of the Water
Utilities Community Facilities District (Apache Junction Water
Company), City of Apache Junction, Arizona, was held on
September 7, 2010, at the Apache Junction City Council Chambers
pursuant to the notice required by law.
CALL TO ORDER
Chairperson Insalaco called the meeting to order at 6:15
p.m.

THE MOTION.
VOTE:Unanimous.
The motion carried.
PROPOSED RESOLUTION NO. 2010-008,
REPEALING RESOLUTION NO. 2010-007
AND WITHDRAWING APPLICATION FOR
ACQUIRING SURPLUS FEDERAL LAND FROM
UNITED STATES HEALTH AND HUMAN
SERVICES DEPARTMENT )
)Legal Counsel Kay Bigelow
commented this repeals the former resolution and removes one of
the methods of obtaining the Central Arizona Project parcel for
no cost or nearly no cost.Pinal County is still on the hook to
pay for it at a negotiated price.This resolution is required
so that the district is not going after the low cost or no cost
method.
Vice Chairperson Eck asked if
this is basically giving the district the opportunity to
purchase it.He asked if this is stating it will not cost the
district anything to purchase the parcel.
Legal Counsel Kay Bigelow
stated that is correct.The district will not pay anything for
the purchase of the property.This particular methodology that
they had signed up for was difficult and could have added a
restriction to separate it into two parcels.They wanted us to
have a water treatment facility within 36 months.They thought
they would do the first phase of it and the next phase would be
a negotiated sale.It would have caused too many problems.
Vice Chairperson Eck
commented the 36 months is out.
Legal Counsel Kay Bigelow
stated that is correct.By removing this as a methodology,
there will be a direct sale that will be negotiated with the
district and Central Arizona Project in the room, as well as

Pinal County, since Pinal County is writing the check.Pinal
County agrees to have this removed.
Chairperson Insalaco closed
the discussion with no further comments and called for a motion.
Vice Chairperson Eck MOVED
THAT RESOLUTION NO. 2010-008, A RESOLUTION OF THE BOARD OF
DIRECTORS OF THE WATER UTILITIES COMMUNITY FACILITIES DISTRICT
(CITY OF APACHE JUNCTION, ARIZONA) TO REPEAL RESOLUTION NO.
2010-007 BE APPROVED.
Mrs. Barker SECONDED THE
MOTION.
VOTE:Unanimous.
The motion carried.

EXECUTIVE SESSION BE HELD AT 6:00 P.M.ON TUESDAY, SEPTEMBER 7,
2010, IN THE CITY COUNCIL CONFERENCE ROOM FOR THE PURPOSE OF
CONSULTATION FOR LEGAL ADVICE WITH THE DISTRICT'S ATTORNEY IN
ACCORDANCE WITH A.R.S. § 38-431.03(A)(3)(4) AND AS FURTHER
OUTLINED ON THIS AGENDA.
MOTION.
VOTE:Unanimous.
The motion carried.
