HomeMy WebLinkAbout2012-07-03 WUCFD MINUTESWATER UTILITIES COMMUNITY FACILITIES DISTRICT CITY OF APACHE JUNCTION, ARIZONA REGULAR MEETING July 3, 2012 The regular meeting of the District Board of the Water Utilities Community Facilities District, City of Apache Junction, Arizona, was held on July 3, 2012, at the Apache Junction City Council Chambers pursuant to the notice required by law. CALL TO ORDER Vice Chairperson Dietz called the meeting to order at 6:00 p.m. ROLL CALL Board Members Present:Vice Chairperson Dietz Mrs. Barker. Mrs. Evans Mr. Serdy (arrived late) Mr. Waldron Mr. Wilson Staff Present: Others Present: (Chairperson Insalaco was absent.) George Hoffman, District Manager Kathleen Connelly, District Clerk Frank Blanco, District Director John White, District Finance Manager Donna Meinerts, District Finance Director Joel Stern, District Legal Counsel Bryant Powell, Assistant City Manager Hazel Randall, Administrative Assistant Matt Busby, Assistant to the City Manager APPROVAL OF MINUTES OF JUNE 19, 2012 Water Utilities Community Facilities District Meeting Minutes of July 3, 2012 Page 1 of 7 ) Mrs. Barker MOVED THAT THE MINUTES OF JUNE 19, 2012, BE APPROVED. Mr. Waldron SECONDED THE MOTION. VOTE:Unanimous.(During the vote District Clerk Kathleen Connelly announced that Mr. Serdy was now present.) The motion carried. DISCUSSION ON PROPOSED DISTRICT BUDGET FOR FISCAL YEAR 2012-2013 TO INCLUDE PROPOSED RATES, FEES AND CHARGES APPLICABLE ) Vice Chairperson Dietz commented they will be going into a 15 to 20 minute executive session after the water board and before the special meeting tonight. District Finance Manager John White commented he passed out a handout summarizing the same information presented at the last meeting when they went over the budget.He also passed out a rate comparison sheet showing last year's rates and the new rates. Mrs. Barker commented she realized there was a time when they had a huge increase because there had been a long period of time during which they had no rate increase.They were playing catch up.They are currently asking for a 3% hike and she hopes they are not going to continue to automatically presume that we have a 3% increase every year.Over a 10 year period it becomes a large increase. Vice Chairperson Dietz commented the study that was done had proposed a 20% increase. They said that was too much at that time. Mrs. Barker commented she would like them to keep in mind that if they need it, great, if they do not, then cut it back to 2% or something, because after a while, over a ten year period, it is a large increase. Mrs. Barker stated that was her only comment.They did a wonderful job On this. District Finance Manager John White stated in their recent capital improvement program one of the recommendations from the consultant was to have a 3% to 4% increase annually in order to maintain the capital improvements. It is a point well taken.The district's finances have stabilized and we do have a healthy contingency that is funded. They will welcome input from the board in future years if :they wanted to lower rates or have a rate hike holiday. PUBLIC HEARING ON PROPOSED BUDGET AND RATE SCHEDULES FOR FISCAL YEAR 2012-2013 ')Vice Chairperson Dietz opened the public hearing on the item.There being no one wishing to speak, he closed the public hearing and moved on to the next item. RESOLUTION NO. 2012-005, DECLARING AS A PUBLIC RECORD AND ADOPTING THE CLASSIFICATION PLAN FOR FISCAL YEAR 2012-2013 AND THE COMPENSATION PLAN FOR FISCAL YEAR 2012-2013 )Vice Chairperson Dietz called for a motion. Mr. Waldron MOVED THAT RESOLUTION NO. 2012-005, A RESOLUTION OF THE WATER UTILITIES COMMUNITY FACILITIES DISTRICT (CITY OF APACHE JUNCTION, ARIZONA) DECLARING AS A PUBLIC RECORD AND ADOPTING CERTAIN DOCUMENTS FILED WITH THE DISTRICT CLERK ENTITLED "THE CLASSIFICATION PLAN FOR FISCAL YEAR 2012-2013" AND "THE COMPENSATION PLAN FOR FISCAL YEAR 2012-2013", BE APPROVED. RESOLUTION NO. 2012-006, ADOPTING PROPOSED BUDGET FOR FISCAL YEAR 2012-2013 AND ADOPTING PROPOSED RATES, FEES AND CHARGES APPLICABLE FOR FISCAL YEAR 2012-2013 )Vice Chairperson Dietz called for any discussion.There being no discussion, he called for a motion. Mrs. Barker MOVED THAT RESOLUTION NO. 2012-006, A RESOLUTION OF THE WATER UTILITIES COMMUNITY FACILITIES DISTRICT (CITY OF APACHE JUNCTION, ARIZONA), PURSUANT TO A.R.S. § 48-716, ADOPTING A PROPOSED BUDGET FOR THE FISCAL YEAR BEGINNING JULY 1, 2012 AND ENDING JUNE 30, 2013; ADOPTING PROPOSED RATES, FEES AND CHARGES APPLICABLE FOR THE FISCAL YEAR BEGINNING JULY 1, 2012 AND ENDING ON JUNE 30, 2013; ESTABLISHING A PUBLIC HEARING ON THE PROPOSED BUDGET; AND DIRECTING STAFF TO SOLICIT COMMENTS FROM THE CITY OF APACHE JUNCTION ON THE PROPOSED ANNUAL BUDGET BE APPROVED; AND I FURTHER MOVE THE PUBLIC HEARING FOR FINAL BUDGET ADOPTION BE HELD ON AUGUST 7, 2012 AT 6:00 P.M. IN THE APACHE JUNCTION CITY COUNCIL CHAMBERS, 300 EAST SUPERSTITION BOULEVARD, APACHE JUNCTION, ARIZONA. I FURTHER MOVE THAT WATER DISTRICT OFFICES AND FACILITIES BE CLOSED WHERE POSSIBLE ON MONDAY, DECEMBER 24, 2012 AND THAT WE APPROVE:(1) 8 HOURS OF TEMPORARY PERSONAL LEAVE FOR DECEMBER 24, 2012 FOR FULL TIME CAREER STATUS EMPLOYEES WHO WORK THE EQUIVALENT OF A 5 DAY/8 HOURS PER DAY SCHEDULE AT 40 HOURS PER WEEK;(2) 10 HOURS OF TEMPORARY PERSONAL LEAVE FOR DECEMBER 24, 2012 FOR FULL TIME CAREER STATUS EMPLOYEES WHO WORK A 4 DAY/10 HOURS PER DAY SCHEDULE AT 40 HOURS PER WEEK;(3) 5 HOURS OF TEMPORARY PERSONAL LEAVE FOR DECEMBER 24, 2012 FOR PART TIME CAREER STATUS EMPLOYEES WHO REGULARLY WORK 24 TO 31 HOURS PER WEEK. Water Utilities Community Facilities District Meeting Minutes of July 3, 2012 Page 4 of 7 THIS SHALL ALL BE SUBJECT TO THE FOLLOWING TERMS:(1) THIS LEAVE SHALL BE PLACED IN A SEPARATE BILLING ACCOUNT APART FROM VACATION AND SICK LEAVE;(2) IT WILL BE CONSIDERED STRAIGHT TIME AND WILL NOT BE CONSIDERED IN THE CALCULATION OF OVERTIME OR CAUSE AN EMPLOYEE TO BE PAID FOR OVER 40 HOURS IN A WORK WEEK; (3) FOR THOSE EMPLOYEES WHO MUST WORK ON DECEMBER 24, 2012, THIS LEAVE WILL ONLY BE AVAILABLE FOR USE BEGINNING DECEMBER 24, 2012 AND UP TO AND INCLUDING JUNE 30, 2013;(4) THERE WILL BE NO CARRYOVER OF THIS LEAVE BEYOND JUNE 30, 2013;(5) PRIOR TO TAKING THIS LEAVE, AN EMPLOYEE SHALL OBTAIN APPROVAL FROM HIS/HER DEPARTMENT DIRECTOR;(6) IT SHALL BE EXTENDED TO NON- EXEMPT AND EXEMPT CITY (DISTRICT) EMPLOYEES WHO REGULARLY WORK 24 HOURS OR MORE PER WEEK;(7) IT SHALL BE EXTENDED TO ONLY THOSE EMPLOYEES WHO ARE AN EMPLOYEE OF RECORD ON OR BEFORE DECEMBER 2, 2012;(8) IT SHALL NOT BE INCLUDED IN ANY PAY OUT PROVISIONS OR AGREEMENTS; AND (9) THE DISTRICT MANAGER IS AUTHORIZED TO MAKE FINAL ADMINISTRATIVE ADJUSTMENTS TO THESE TERMS. Mr. Wilson asked if it should say district employees instead of city employees on number 6. District Clerk Kathleen Connelly stated it should be district employees. Mrs. Barker AMENDED HER MOTION TO READ DISTRICT EMPLOYEES ON NUMBER 6. Mr. Wilson SECONDED THE MOTION WITH THE AMENDMENT. VOTE:Unanimous. The motion carried. DISTRICT MANAGER REPORT District Manager George Hoffman welcomed as legal counsel Joel Stern.He also thanked the staff for their hard work on the budget.They make it look easy but there is so much work that goes into it.He appreciates it.He thanked Kathy for her help in the motion that was just read.He wanted to give the Water Utilities Community Facilities District Meeting Minutes of July 3, 2012 Page 5 of 7 employees December. 24 off and that is as complex as it is to him.Kathy and staff figured out all the issues associated with it. Vice Chairperson Dietz thanked everyone for the job they have done on another excellent budget. DISTRICT DIRECTOR REPORT District Director Frank Blanco thanked them for their consideration of the preliminary budget. DISTRICT TREASURER REPORT District Finance Manager John White reflected the district director's appreciation as well. DISTRICT LEGAL COUNSEL District Legal Counsel Joel Stern thanked them for appointing him and added it is a privilege.
