EXCERPTS FROM THE MINUTES OF A SPECIAL MEETING OF THE MAYOR AND
COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, HELD ON APRIL
9 , 1984 .
The Mayor and Council of the City of Apache Junction,
Arizona met in special session in the chambers of the Council
on April 9 , 1984 at the hour of 7 . 00 p.m.
The Mayor called the meeting to order and upon roll
call , the following answered present .
Wendell Clarke, Mayor
Jimmy Eidson, Vice Mayor

Absent :
After discussion, it was determined that the Mayor
and Council should adopt a resolution ordering and calling a
special bond election to be held in and for the City of Apache
Junction, Arizona on May 15 , 1984 , seeking the approval of the
qualified electors thereof of the issuance and sale of up to
and including $1 , 500 , 000 aggregate principal amount of City of
Apache Junction, Arizona Street and Hignway User Revenue Bonds ,
Project of 1984 . Thereupon, the following-captioned Resolution
,aas introduced and read in full :

RESOLUTION ORDERING AND CALLING A SPECIAL BOND ELECTION TO BE
HELD IN AND FOR THE CITY OF APACHE JUNCTION, ARIZONA, ON MAY
15 , 1984 , TO SUBMIT TO THE QUALIFIED ELECTORS THEREOF THE QUES-
TION OF AUTHORIZING THE ISSUANCE AND SALE OF UP TO AND INCLUD-

After discussion, it was determined to be in order to
adopt a resolution adopting a form of ballot and ordering
notice of the special bond election to be given to the quali-
fied electors of the City. Thereupon, the following Resolution
was introduced and read in full :

RESOLUTION ORDERING AND CALLING A SPECIAL
BOND ELECTION TO BE HELD IN AND FOR THE
CITY OF APACHE JUNCTION, ARIZONA, ON MAY
15, 1984 , TO SUBMIT TO THE QUALIFIED ELEC-
TORS THEREOF THE QUESTION OF AUTHORIZING
THE ISSUANCE AND SALE OF UP TO AND INCLUD-
ING $1 , 500 , 000 AGGREGATE PRINCIPAL AMOUNT
OF CITY OF APACHE JUNCTION, ARIZONA STREET
AND HIGHWAY USER REVENUE BONDS, PROJECT OF

BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY
OF APACHE JUNCTION, ARIZONA, AS FOLLOWS.
Section I . That a special street and highway user
revenue bond election in the City of Apache Junction, Arizona ,
hereinafter referred to as the "City" , be and the same is here-
by called to be held on May 15 , 1984 , at the following pre-
cincts and polling places :

The polling places will be open at 6 : 00 a .m. and
close at 7 : 00 p .m.
Absentee voting shall be permitted in accordance with
the provisions of Title 16, Chapter 4 , Article 8, Arizona
Revised Statutes , as amended. A qualified elector may vote
absentee if : ( 1 ) the elector expects to be absent from the City
or his voting precinct at the time of holding the election;
( 2 ) the elector is physically unable to go to the polls; ( 3 )
the elector is 65 years of age or older ; ( 4 ) the elector ' s
place of residence is more than 15 road miles from the polling
place for his precinct ; ( 5 ) the elector cannot attend the polls
on the day of the election because of the tenets of his reli-
gion; or ( 6 ) the elector is legally blind. The absentee voting
materials may be obtained by contacting the office of the City
Clerk , 1001 North Idaho Road, Apache Junction, Arizona, tele-
phone : 982-8002 .
The purpose of the election is to permit the quali-
fied electors of the City to vote on the question of whether
City of Apache Junction, Arizona Street and Highway User
Revenue Bonds , Project of 1984 , in the maximum principal amount
of $1 , 500 , 000 should be issued and sold, in one or more series,
pursuant to Title 9 , Chapter 6, Article 5 , Arizona Revised
Statutes , and all amendments thereto; the proceeds of which
shall be used for the purpose of improvement , construction,
reconstruction, acquisition of rights-of-way or maintenance of
City streets and highways and to pay all necessary legal,
financial consultant , engineering and contingent costs con-
nected therewith. The bonds are to bear interest at a rate rot
to exceed twelve percent ( 12% ) per annum from the date of their
issuance, said interest payable semiannually on the first day
of January and the first day of July of each year until the
maturity of each bond of each series and said bonds to mature
over a period of not to exceed ten ( 10 ) years from the date of
issuance of each series and said bonds to mature on the first
day of the same month of each year which may be either January
or July. If approved and sold, the bonds are payable solely
from revenues derived from taxes, fees , charges and other
moneys collected by the State of Arizona and returned to the
City for street and highway purposes pursuant to law, which

have not been theretofore specifically allocated and pledged
for the payment of any other indebtedness of the City, such
highway user taxes as are necessary to pay principal of and
interest on the bonds sought to be issued will be irrevocably
appropriated for the purpose of paying such principal and
interest .
Section II . That by reason of the urgent need for
the improvements to be made from the proceeds of the bonds
herein sought to be authorized, the immediate operation of the
provisions of this Resolution is necessary for the preservation
of the public peace, health and safety, and an emergency is
hereby declared to exist , and this Resolution will be in full
force and effect immediately upon passage and adoption, and it
is so enacted.

WHEREAS, the Mayor and Council of the City of Apache
Junction, Arizona, hereinafter referred to as the "City" , have
adopted Resolution No . 84-16 ordering and calling a special
street and highway user revenue bond election to be held in and
for the City on May 15 , 1984 ; and
WHEREAS, it is necessary to adopt a form of ballot to
be submitted to the qualified electors of the City at said
election and to direct that notice be given of the election,
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND
COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, AS FOLLOWS :
Section I . That the ballot to be used in the special
bond election to be held on May 15 , 1984, shall be in substan-
tially the following form:

Question
Shall the City of Apache Junction, Arizona
( the "City" ) , be authorized to issue and
sell , in one or more series , Street and
Highway User Revenue Bonds , Project of
1984, in the maximum aggregate principal
amount of $1 , 500 , 000 to provide funds for
the purpose of improvement, construction,
reconstruction, acquisition of rights-of-
way or maintenance of City streets and
highways and to pay all necessary legal ,
accounting, financial and other contingent
costs in connection therewith; such bonds
to bear interest at a rate of not to exceed
12% per annum, said interest payable semi-
annually on the first day of January and
the first day of July of each year until
the maturity of each bond of each series
and the bonds to mature over a period of
not to exceed 10 years from the date of
issuance of each series , said bonds to
mature on the first day of the same month
of each year which may be either January or
July; principal and interest to be payable
solely from taxes , fees , charges and other

and returned to the City for street and

Section II . That the notice of special bond election
will be given by the Clerk of the City causing a copy of Reso-
lution No. 84-16 to be published in full for one insertion in
the Mesa Tribune, a newspaper published in Maricopa County,
Arizona and of general circulation in the City, such publica-
tion to be made within a period of not less than fifteen, nor
more than thirty, days prior to the date of the election.
Section III . That the Clerk of the City shall cause
to be printed and delivered to the election boards , to be by
them furnished to the qualified electors offering to vote ac
the special election, ballots as set forth above.
Section IV. That the special election shall be con-
ducted and the poll lists kept , and the votes cast thereat
shall be counted and tabulated and the returns thereof shall be
made in the manner provided by law and only persons shall vote
at the special election who are qualified electors of the City.
Section V. That in order to comply with the absentee
voting requirements required in special bond elections , the
Mayor and Counsel of the City hereby appoint an election board
to serve as the Absentee Ballot Board for all Precincts and
said board will meet at City Hall , 1001 North Idaho Road,
Apache Junction, Arizona, to tally and canvass the absentee
ballots .
Section VI . That in order to comply with the Voting
Rights Act of 1965 , as amended, the following proceedings per-
taining to this election will be translated into Spanisn and
posted, published and recorded in each instance where posting,
publication and recording of such proceedings are required, to-
wit : Resolution No. 84-16 ordering and calling special bond
election, ballot , all absentee voting material and all instruc-
tions at the polls .

Section VII . That as soon as the polls are closed,
the election officials shall canvass the votes cast, seal and
direct the same to the Mayor and Council of the City. The
Mayor and Council of the City will meet in special session on
May 21 , 1984 , the first Monday succeeding the day after the
date of the election, to canvass the returns of the election.
The Mayor and Council will be governed by the vote of the
majority of the qualified electors of the City voting at said
special bond election on the question submitted.
Section VIII . That by reason of the urgent need for
the improvements to be made from the proceeds of the bonds
herein sought to be authorized, the immediate operation of the
provisions of this Resolution is necessary for the preservation
of the public peace, health and safety, and an emergency is
hereby declared to exist, and this Resolution will be in full
force and effect immediately upon passage and adoption, and it
is so enacted.

JUNCTION, ARIZONA, AT THE SPECIAL BOND ELECTION TO BE HELD
IN AND FOR THE CITY OF APACHE JUNCTION, ARIZONA, ON MAY 15,
1984, ORDERING THAT NOTICE OF THE ELECTION BE GIVEN TO THE
` . . n QUALIFIED ELECTORS OF THE CITY OF APACHE JUNCTION, ARIZONA,
AND DECLARING AN EMERGENCY.
WHEREAS, the Mayor and City Council of the City of Apache Junction,
Arizona, hereinafter referred to as the "City", have adopted Resolution
No. 84-16 ordering and calling a special street and highway user revenue
bond election to be held in and for the City of May 15, 1984; and
WHEREAS, it is necessary to adopt a form of ballot to be submitted
to the qualified electors of the City at said election and to direct that
notice be given of the election,
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE
CITY OF APACHE JUNCTION, ARIZONA, AS FOLLOWS
Section I. That the ballot to be used in the special bond election
to be he d o� n May 15, 1984, shall be in substantially the following form
OFFICIAL BALLOT
FOR SPECIAL BOND ELECTION HELD IN AND FOR THE CITY OF
APACHE JUNCTION, ARIZONA, ON MAY 15, 1984, TO SUBMIT TO
THE QUALIFIED ELECTORS OF THE CITY OF APACHE JUNCTION,
ARIZONA, THE FOLLOWING QUESTION.
- Question
Shall the City of Apache Junction, Arizona (the "City"),
be authorized to issue and sell, in one or more series,
Street and Highway User Revenue Bonds, Project of 1984,
in the maximum aggregate principal amount of $1,500,000
to provide funds for the purpose of improvement, con-
struction, reconstruction, acquisition of rights-of-way
or maintenance of City streets and highways and to pay
all necessary legal, accounting, financial and other
contingent costs in connection therewith; such bonds to
bear interest at a rate of not to exceed 12% per annum,
said interest payable semiannually on the first day of
January and the first day of July of each year until the
maturity of each bond of each series and the bonds to
mature over a period of not to exceed 10 years from the
date of issuance of each series, said bonds to mature on
the first day of the same month of each year which may
be either January or July, principal and interest to be
payable solely from taxes, fees, charges and other
moneys collected by the State of Arizona and returned to
the City for street and highway purposes pursuant to law
which have not theretofore been specifically allocated
and pledged for payment of any other indebtedness of the
City, such highway user taxes as are necessary to pay
principal of and interest on the bonds to be irrevocably
appropriated for the purpose of paying such principal
and interest?

Section II That the notice of special bond election will be given
by the Clerk of the City causing a copy of Resolution No. 84-16 to be
published in full for one insertion in the Mesa Tribune, a newspaper
published in Maricopa County, Arizona, and of general circulation in the
City, such publication to be made within a period of not less than fifteen,
nor more than thirty days prior to the date of the election
1 Section III. That the Clerk of the City shall cause to be printed
and delivered to the election boards, to be by them furnished to the
qualified electors offering to vote at the special election, ballots as set
forth above
Section IV. That the special election shall be conducted and the
poll lists kept, and the votes cast thereat shall be counted and tabulated
and the returns thereof shall be made in the manner provided by law and only
persons shall vote at the special election who are qualified electors of the
- City.
Section V. That in order to comply with the absentee voting re-
quirements required in special bond elections, the Mayor and Council of the
City hereby appoint an election board to serve as the Absentee Ballot Board
for all Precincts and said board will meet at City Hall, 1001 North Idaho
Road, Apache Junction, Arizona, to tally and canvass the absentee ballots.
Section VI That in order to comply with the Voting Rights Act of
1965, as amended, the following proceedings pertaining to this election will
be translated into Spanish and posted, published and recorded in each
instance where posting, publication and recording of such proceedings are
required, to-wit Resolution No. 84-16 ordering and calling special bond
((( election, ballot, all absentee voting material and all instructions at the
polls
Section VII. That as soon as the polls are closed, the election
officials shall canvass the votes cast, seal and direct the same to the
Mayor and Council of the City The Mayor and Council of the City will meet
in special session on May 21, 1984, the first Monday succeeding the day
after the date of the election, to canvass the returns of the election. The
- Mayor and Council will be governed by the vote of the majority of the
qualified electors of the City voting at said special bond election on the
question submitted.
Section VIII. That by reason of the urgent need for the improve-
ments to be made from the proceeds of the bonds herein sought to be
authorized, the immediate operation of the provisions of this Resolution is
necessary for the preservation of the public peace, health and safety, and
an emergency is hereby declared to exist, and this Resolution will be in
full force and effect immediately upon passage and adoption, and it is so
enacted.
