Project Description
Rezoning Case No. PZ-19-84, Proposed Ordinance No. 277, is a request
by the applicants Margaret Strauss, Apache Junction Associates ,
Alfred Schlehlein, Richard Herrle, and Murray Roth to rezone their
property from GR General Rural to CB-1 Local Business Zone, CB-2
General Business Zone, and CR-5 Multiple Residence Zone. The site is
a vacant 36-acre parcel located between Broadway, Tomahawk, and U.S.
Highway 60 in Section 28. It is designated Local and General
Commercial Opportunity, and Medium/High Density Opportunity on the
... General Plan. Surrounding land uses include a mobile home park, a
church, DAV office, vacant land, mobile homes , and Roger Grimm's Sun
Unlimited Septic Tank System business.
Planning Department Comments
Staff does recommend stipulating the dedication of the north and east
fifty feet (50' ) of the subject property for the public roadway and
associated purposes with the 50 foot dedication intended to be measured
from the centerlines of Broadway Avenue and Tomahawk Road.
At issue with this rezoning case is a General Plan problem. The strip
of land along Highway 60 is designated General Commercial Opportunity
to which the requested CB-2 zoning on Parcel 2 conforms. However,
the area on the Land Use Plan designated for Local Commercial use
appears to be limited to the corner of Broadway and Tomahawk. The

applicant' s proposal to have the 400 foot wide Parcel No. 1 zoned CB-1
along Tomahawk from Broadway to Highway 60 appears to exceed reasonable
interpretation and determination of the Plan designation boundary for
Local Commercial . Staff believes that a residential zone between the
Local Commercial and General Commercial designations would be consistent
with the City's Plan. The CR-5 zoning on Parcel No. 3 would appear
to be consistent with the Medium/High Density Opportunity designation.
The topography of the site was the determinant that prompted the applicant
to have CB-1 zoning extend along Tomahawk Road. The site is characterized
by Weekes Wash running north to south through the property. The applicant's
reasons that such a wash would preclude a comprehensive multiple residence
development extending from Parcel No 3 on the west side of the Wash to
Parcel No. 1 on the east side of the Wash. While there is merit in the
applicant's argument, it may not be sufficient to override General Plan
policy considerations.
Planning and Zoning Commission Recommendation
The Planning and Zoning Commission at their regular meeting of June 12,
1984, after public hearing, voted to approve the following motion•

"BE IT RESOLVED by the Planning and Zoning Commission of the City of
Apache Junction, Arizona, that rezoning case PZ-19-84, also known as
Proposed Ordinance No. 277, application of Margaret Strauss, Apache
Junction Associates, Alfred Schlehlein, Richard Herrle, and Murray
Roth for their property described as, a matter of public record,
requesting rezoning from GR General Rural to CB-1 Local Business
Zone; CB-2 General Business Zone; and CR-5 Multiple Residence Zone,
that the Commission recommends to the Apache Junction City Council
the approval of said application.
"Any stipulations or recommendations are:
The applicant dedicate the north and east fifty feet (50' ) from
centerline of the subject property for public roadway and
associated purposes.
"The reason for this recommendation is:
It is the best and highest use of the land as planned by the owners
and developers, even though it is not in agreement totally with the

Project Description

by the applicants Portus Idso and Marshall and Portia White to rezone
their property from GR General Rural to Trailer Homesite Zone (TH) .
The site is a developed 1 .25 acre parcel located on the southwest
corner of Smoketree Street and Main Drive in Section 18. It is
designated Medium Density on the General Plan. Surrounding land
uses include vacant land, mobile homes, a mobile home park, and
,_,, junk automobile storage.
Planning Department Comments
Potentially the rezoning would allow 87 persons per acre which would
not comply with the General Plan. The staff does recommend stipulating
the dedication of the north thirty-three feet (33' ) and the east
thirty-three feet (33' ) of the subject property for public roadway
and associated purposes.
In order to control the density on this parcel , staff recommends as a
stipulation the prohibition of the development of an RV park or mobile
home park on the parcel , except as otherwise permitted by the City of
Apache Junction.

Project Description
Rezoning case No. PZ-21-84, Proposed Ordinance No. 279, is a request
by the applicant Duane Beeman to rezone his property from GR General
Rural to Trailer Homesite Zone (TH) . The site is a developed
0.9 acre parcel located at the southeast corner of Greasewood Street
and Warner Drive in Section 18. It is designated Medium/High Density
Opportunity on the General Plan. Surrounding land uses include
vacant land, mobile homes, houses, and the Silverado Mobile Home Park
to the west.
Planning Department Comments
Potentially, the rezoning would allow 87 persons per acre which would
comply with the General Plan. However, if the property is split and
developed as described by the applicant, the expected propulation for this
site would be seven (7) persons. The staff does recommend stipulating the
dedication of the north thirty-three feet (33' ) and the west thirty-
three feet (33' ) of the subject property for public roadway and
associated purposes.

Project Description
Rezoning case No. PZ-24-84, Proposed Ordinance No. 283, is a request
by the Fprlicants George and Jean Vaughn through Charles Reese to
rezone property from GR General Rural to CB-2 General Business
Zone. The site is a vacant 4.75-acre parcel located at the northeast
corner of Broadway and Royal Palm in Section 21 . It is designated
General Comrriercial Opportunity on the General Plan. Surrounding land
uses include vacant land, and a mobile home park.
Planning Department Comments
Staff had no objections to the rezoning noting that it would be consistent
with the General Commercial Opportunity General Plan designation for the site.
Staff does recommend stipulating the dedication of the west forty feet (40' )
and the south fifty feet (50' ) of the subject property for public roadway
and associated purposes.
Staff also recommends the stipulation of additional right-of-way on the south
and southwest corner of the parcel due to the unusual geometrics of the
intersection of Royal Palm Road and Broadway Avenue and Highway 60. This
recommended stipulation, as stated in the attached memorandum of June 26th
from the Public Works Director, would provide the City and the State
Department of Transportation a degree of flexibility in formulating a
safe design for the intersection. The applicant, the applicants' consulting
engineer, and the Department of Transportation have all been consulted in
this matter.

The Planning and Zoning Commission at their regular meeting of June 26,
1984, after public hearing, voted to approve the following motion:

"BE IT RESOLVED by the Planning and Zoning Commission of the City of
Apache Junction, Arizona, that rezoning case PZ-24-84, also known as
Proposed Ordinance No. 283, application of George and Jean Vaughn through
Charles Ree e for their property described as, a matter of public record,
requesting rezoning from GR General Rural to CB-2 General Business Zone,
that the Commission recommends to the Apache Junction City Council the
approval of said application.
"Any stipulations or recommendations are:
1 . The applicant will dedicate the west forty feet (40' ) along
Royal Palm Road, the south fifty feet (50' ) along Broadway Avenue,
and a forty foot (40' ) strip parallel to the Highway 60 right-of-way

explanations were provided, it was agreed as follows:
1 . The applicant will dedicate the West 40' along Royal Palm; the South 50'
along Broadway Road, and a 40' strip parallel to the Highway 60 right-of-
way, and connecting Royal Palm and Broadway Roads by a curve acceptable to
the City + 240' .
2. A reservation for rights-of-way pending intersection designs for future
signalization agreed upon between the City and the State; said parcel being
40' wide and parallel to the highway right-of-way as described in #1 above,

Project Description

by the applicants Stanley and Virginia Holsinger through Gerald
Hartshorn to rezone their property from GR General Rural to Trailer
Homesite Zone (TH) . The site is a developed 27,000 square foot parcel
located on the west side of Ocotillo Drive about 150 feet south of
Ohio Street in Section 19. It is designated Medium/High Density
Opportunity on the General Plan. Surrounding land uses include mobile
homes, houses, and a trailer park.
Planning Department Comments
Staff had no objections to the rezoning noting that it would be
consistent with the Medium/High Density Opportunity General Plan
designation for the site. Bill Eakins proposed CR-3 zoning to the
south in Case No. PZ-18-84. No roadway dedications are requested as
the right-of-way already exists.

Proposed Ordinance No. 294 will ammend the city's Floodplain
Management Ordinance to comply with Arizona Revised Statutes, as revised
in H.B. 2534.
Proposed Resolution No. 84-27 provides legal notice, in compliance
with H.B. 2534, that the city intends to maintain control of floodplain
management within the city limits.
Approval of both proposals is recommended to provide for the continu
ation of existing service levels and prevent a hardship on the citizenry.

___ - APACHE JUNCTION, ARIZONAA, RETAINING THE RESPONSIBILITY FOR
_ - THE MANAGEMENT OF FLOOD. LAIN ACTIVITIES TO REDUCE FUTURE
FLOOD LOSSES PURSUANT TO THE NATIONAL FLOOD INSURANCE ACT
OF 1968 AND TITLE 45, CHAPTER 10, ARTICLE 4 OF THE ARIZONA
REVISED STATUTES AND AMENDMENTS THERETO, AND DECLARING AN
EMERGENCY
WHEREAS, certain areas of the City of Apache Junction are subject to
periodic flooding from streams and rivers causing serious damages to properties
within these areas,
WHEREAS, it is the intent of this Council to require the recognition
and evaluation of flood hazards in all official actions relating to land use in
the floodplain areas having special flood hazards, and
- WHEREAS, this body has the legal authority to adopt and enforce land
use control measures to reduce future flood losses pursuant to § 45-2350, Arizona
Revised Statutes and amendments and supplements thereto,
NOW, THEREFORE, BE IT RESOLVED by the Mayor and City Council of the
City of Apache Junction, Arizona, as follows:
" ,_ , SECTION 1. That the Mayor and City Council of the City of Apache
Junction assures the Federal Insurance Administration that it will enact as
necessary, and maintain in force for those areas having flood hazards, adequate
land use and control measures , h Pffective enforcement provisions consistent
with the criteria set forth it jn 1910 of the National Flood Insurance
r Program Regulations, and
I1 SECTION 2 That the duly appointed Floodplain Administrator or his
authorized representative, is hereby vested with the responsibility, authority
and means to (a) Delineate or assist the Federal Insurance Administrator, at
- his request, in delineating the limits of areas having special flood hazards on
available local maps of sufficient scale to identify the location of building
sites, (b) provide such information as the Federal Insurance Administrator may
request concerning present uses and occupancy of the floodplain, (c) cooperate
with Federal, State and local agencies and private firms which undertake to study,
survey, map and identify floodplain areas, and cooperate with neighboring com-
munities with respect to management of adjoining floodplain areas in order to
prevent aggravation of existing hazards, and (d) Submit an annual report to the
Federal Insurance Administrator on the progress made during the past year within
the community in the development and implementation of floodplain management
measures

, SECTION 3 That the duly appointed Floodplain Administrator, or his
authorized representative, is hereby appointed to maintain for public inspection
and to furnish upon request a record of elevations (in relation to mean sea level)
k of the lowest floor (including basement) of all new or substantially improved
structures located in the special flood hazard areas. If the lowest floor is
below grade on one or more sides, the elevation of the floor immediately above
must also be recorded.
1 SECTION 4 That the Mayor and City Council agrees to take such other
official action as may be reasonably necessary to carry out the objectives of the
program.
SECTION 5. WHEREAS the immediate operation of the provisions of this
Resolution is necessary for the preservation of public peace, health and safety
of the City of Apache Junction, an emergency is hereby declared to exist, and
this Resolution shall be in full force and effect from and after its passage,
adoption and approval of the Mayor and City Council of the City of Apache Junction,
and it is hereby exempt from the referendum provisions of the Constitution and
laws of the State of Arizona.

JUNCTION, ARIZONA, AMENDING CHAPTER 5, VOLUME II OF THE LAND DEVELOP-
MENT CODE OF THE CITY OF APACHE JUNCTION, PERTAINING TO FLOODPLAIN
MANAGEMENT; PROVIDING FOR REPEAL OF CONFLICTING PROVISIONS, PRO-
VIDING FOR SEVERABILITY; AND DECLARING AN EMERGENCY.
BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION, ARIZONA, AS FOLLOWS•
SECTION I IN GENERAL
That Section 2 0, DEFINITIONS, be amended by adding a defi-
- nition for "Regulatory flood elevation" to read as follows
"Regulatory flood elevation" means the elevation which is
one foot above the base flood elevation for a watercourse
for which the base flood elevation has been determined and
shall be as determined by the criteria developed by the
Director of Water Resources for all other watercourses
That Section 5.1, Subsection 5 1-3 (1) be amended to read
s0. a as follows.
(1) New construction and substantial improvement of any
structure shall have the lowest habitable floor, including
the basement, if any, elevated to at least the regulatory
flood elevation. If there is no base flood elevation on
tl the FIRM, the lowest floor, including basement, shall be
elevated to at least the regulatory flood elevation as
determined by an Arizona Registered civil engineer Upon
the completion of the structure the elevation of the
lowest habitable floor including basement shall be certified
by an Arizona registered professional engineer and provided
to the Floodplain Administrator. Exception nonresidential
structures may meet the standards in Section 5 1-3 (2).
• That Section 5 1, Subsection 5.1-3 (2) (a) be amended to
read as follows
(a) be floodproofed so that starting at a point from the
regulatory elevation, and below the structure is watertight
with walls substantially impermeable to the passage of
water, and,
That Section 5 5, Subsections (2) (a) and (b) be amended to
read as follows:
(a) over-the-top ties be provided at each of the four
corners of a mobile home, with two additional ties per side
at intermediate locations, except that mobile homes less
than 50 feet long require only one additional tie per side
(b) frame ties be provided at each corner of a trailer with
five additional ties per side at intermediate points, except
that trailers less than 50 feet long require only four addi-
tional ties per side, and,

That Section 5.5, Subsection 5.5-2 be amended to read
as follows
5 5-2 The following standards are required for (a)
trailers not placed in trailer parks or subdivisions,
(b) new trailer parks or subdivisions, (c) repair,
reconstruction or improvements to existing trailer
parks or subdivisions that equals or exceeds 50 per
max. •.;,;�_ cent of the value of the streets, utilities, and pads
before the repair, reconstruction or improvement
commenced, and (d) replacement trailers
That Section 5 5, Subsection 5.5-2 (2) be amended to read
as follows
(2) All trailers shall be placed on pads or lots eleva-
ted on compacted fill or on pilings so that the bottom
of the structural frame or the lowest point of any
attached appliances, whichever is lower, is at or above
- the regulatory flood elevation. If elevated on pilings:
That Section 5.5, Subsection 5 5-2 be further amended by
adding Subsections (3) and (4) to read as follows.
(3) Trailers other than mobile homes may be exempted
from these standards provided all of the following condi-
tions are met
(a) The placement of the trailer is intended to be
temporary, i.e. Less that six (6) months
{ (b) The trailer is maintained in a mobile state,
+[ i e without skirting, or awnings which are
attached to the ground
(c) The trailer is inhabited and the trailer
constitutes the principle place of residence
for the inhabitant.
(4) The replacement of a trailer which was damaged by a
Y flood to more than fifty percent of it's value before this
flood is hereby expressly prohibited
That Section 5.6, Subsection 5 6-1 is amended to read as
follows
5 6-1 There shall be no encroachments, including fill, new
construction, substantial improvements, and other develop-
-
ments unless certification by an Arizona registered profes-
" sional civil engineer is provided demonstrating that
encroachments shall not result in any increase in flood
levels during the occurrence of the base flood discharge.
That Section 5.6 is further amended by adding Subsection
5.6-4 to read as follows
5 6-4 Waste disposal systems shall not be installed wholly
or partially within a floodway
SECTION II REPEALING ANY CONFLICTING PROVISIONS
All ordinances and parts of ordinances in conflict with the
provisions of this ordinance or any part of the code adopted herein by
reference are hereby repealed

SECTION III PROVIDING FOR SEVERABILITY
If any section, subsection, sentence, clause, phrase or
portion of this ordinance or any part of the code adopted herein by

by the decision of any court of competent jurisdiction, such decision
shall not affect the validity of the remaining portions thereof.
SECTION IV EMERGENCY CLAUSE
It being necessary for the preservation of peace, health and
safety of the City of Apache Junction, Arizona, that this ordinance
become effective immediately, an emergency is hereby declared to exist
and this ordinance shall be effective immediately upon its passage and
adoption

SUNDANCER RESTAURANT & LOUNGE
In accordance with the procedures for processing applications for
liquor licenses , notice was posted on the premises at 1535 E. U.S .
Highway 60, Apache Junction, on the 25th day of June, 1984, by the
Deputy City Clerk . The notice remained posted for twenty (20)
days , during which time written arguments in favor of or in oppo-
sition to the proposed license were to be filed with the City
Clerk . As of this date , there have been no objections addressed
to the City on this matter . Correspondence was received from the
Director of Public Safety and the Director of Public Works , a copy
of which is attached . The next step in the procedure is for the —
Council to hold a public hearing on the application and make
recommendation for approval or disapproval to the State Department
of Liquor Licenses and Control.

Project Description
Rezoning case No. PZ-35-83, Proposed Ordinance No. 236, is a request
by the applicants Howell and Carolyn Anderson to rezone their property
from GR General Rural to Trailer Homesite Zone (TH) . The site is a
vacant 10-acre parcel located on the west side of North Valley Drive,
300 feet north of Tepee Street in Section 17. It is designated Medium
Density on the General Plan. Surrounding land uses include vacant land,
houses , and mobile homes.
Development Coordinating Committee (DCC) Comments
Potentially, the rezoning would allow 87 persons per acre which would
not comply with the General Plan. The DCC does recommend stipulating the
dedication of the east thirty-three feet of the subject property for
public roadway and associated purposes, and that Planned Development
zoning be applied in this case in order to control the density. The
applicants felt that Planned Development zoning would not be financially
possible at this time.
There are valid protests on file with the Filkeys, the Tandys, the
Smiths, and the Carters objecting to this rezoning. In order for this
rezoning to be adopted, the City Council must approve it by a 3/4' s
vote.

The Planning and Zoning Commission at their regular meeting of May 8,
1984, after public hearing, voted to approve the following motion: .-.

"BE IT RESOLVED by the Planning and Zoning Commission of the City
of Apache Junction, Arizona, that rezoning case PZ-35-83, also
known as Proposed Ordinance No. 236, application of Howell and
Carolyn Anderson for their property described as, a matter of
public record, requesting rezoning from GR General Rural to

Dear Mr. Nakagawa and members of the P & Z Commission
Per your recent correspondence we were made aware of
the request by Howell and Carolyn Anderson to rezone their
property from General Rural to Trailer Homesite. We would
like to submit our protest to the rezoning of this property
for the following reasons :
They now presently have a trailer park which is located
adjacent to the acreage they are now trying to rezone. The
present trailer park does not appear to come up to city re-
, quirements. It is very dirty, very unsightly, the opaque
fence consists of a cyclone fence with a few shrubs and lots
of weeds . There is no fence on the east side, thus allowing
their dogs to roam freely. Trash is allowed to pile up be-
side their trash containers and eventually blows over onto
the joining properties . There are junk cars and other debris
on the property. The streets are unpaved within the park caus-
ing an excessive amount of dust especially since there appears
to be no enforcement of a speed zone within the park or on the
property which they wish to have rezoned . (They are now using
the property which they wish to rezone as an entrance and
exit into the existing park. )
We are not protesting the property being developed into
a NICE park which would be an asset to the other parcels
which join it, but we are protesting the development of
another park like the one that already exists . We feel that
the present park should be brought up to "standards" before
they are permitted to expand into another one .

PROPOSED CONTRACT OF EMPLOYMENT
AGREEMENT dated this day of J„np ,
1984, between the CITY of APACHE JUNCTION, a municipal corporation
j� of the State of Arizona, acting by and through its duly authorized
officers, hereinafter called the "CITY," and Arnold N Hirsch and
David Alexander, hereinafter called "ATTORNEYS."
WHEREAS, the City desires to employ Attorneys and Attorneys
desire to accept employment from the City, and
WHEREAS, the parties desire to record the arrangements made
for such employment
THEREFORE, IT IS AGREED:
1. Employment City hereby retains and employs said Attorneys
and associates, to act, under the title of City Attorney, as
attorneys for the City and to render to City and its duly authorized
officers all legal advice and to represent the City and its duly
authorized officers in all mat ;;r •s including litigation, which may
be pending or which may hereinafter be instituted in any Court of
competent jurisdiction and before all administrative agencies and
departments of the government brought by or against said City,
during and throughout the continuance of this agreement, and to
examine and approve contracts of said City, to undertake such
- collections as requested, to render legal opinions and all other
legal services as City may require
2 Acceptance Attorneys hereby accept the employment and
4 promises and will render to the best of their abilities the services
described herein during the continuance of this Agreement
3 Term Subject to the provisions as hereinafter provided,
the term of this Agreement shall commence on the 1st day of July,
1984, and shall terminate on the 30th day of June, 1986
4. Compensation. For services rendered by the Attorneys
under this Agreement, the City shall pay to Attorneys a fixed an-
nual fee of $65,000 Dollars, payable in twelve (12) equal monthly
payments, plus costs, payable on the last business day of each
month, commencing July, 1984
5. Costs and Expenses. In addition to the fixed annual
fee described in paragraph 4 above, the City shall reimburse
Attorneys for out-of-pocket expenses incurred by them in the
performance of Attorneys ' duties under the provisions of this
Aggrement Said expenses shall include, but not be limited to,
long distance telephone charges, out of town travel expenses, in-
" vestigative costs, expert witness fees, deposition charges, tran-
script costs, brief costs, court costs, and photocopy charges All
such expenses shall be paid by the City upon submission of receipt-
ed statements or billings therefor.
6 Extraordinary Expenses For those months when time spent
by the contracting attorneys exceeds eight-five (85) hours, the attor-
neys will be compensated for any hours in excess of eight-five (85)
hours at the rate of sixty-five dollars ($65 00) per hour.
7. Duties. Attorneys are engaged to supply all legal serv-
ices required by the City, its council , staff, boards and commissions
in their official capacities Attorneys agree to faithfully repre-
sent the _,..rests of the City as its general counsel for the period
designated hereinabove, and to provide, furnish, and pay for all
overhead expenses and personnel necessary to accomplish those ends.
Attorneys shall be available at all reasonable times to render the
services required hereunder and a member of the firm shall attend
the regular and special meetings of the City Council . The meetings
of staff, boards and commissions of the City shall be attended only
upon the express direction of the City Manager.
8 Working Facilities. Attorneys shall furnish assistance of
other attorneys and offices, legal secretaries and such other faci-
lities and services suitable and adequate for the performance of
their duties as set forth in the Agreement.
9 Independent Contractor. In performing the services herein
specified, Attorneys are acting as independent contractors and
shall perform their services in accordance with the standards, canons
and practices approved by the State Bar of Arizona
10. Extent of Services Attorneys shall devote the necessary
time, attention and energies to the duties herein specified, provided,

On June 19th, the City Council authorized the process to negotiate proposals for
street improvements to Phase I of the 20-mile street bonding program. In this regard,
the firms of Cella Barr Associates; Franzoy-Corey Civil Engineering Company, O'Dell
and Associates Consulting Engineers, Parsons, Brinckerhoff, Quade & Douglas, Inc. ;
Ritoch-Herz-Powell Consulting Engineers, Inc. ; Royden Engineering Company; and Wilson
& Company Engineers were contacted and offered an opportunity to submit proposals for:
PW Project 84-12 Palm Springs Mobile Home Estates 1 .56 miles
PW Project 84-8 Junction - Idaho to Tomahawk .75 mile
PW Project 84-6 Lost Dutchman - Meridian to Ironwood 1 .00 mile

The Apache Junction Development Guide, as adopted by the City Council on June 15,
1982, has been revised in order to clarify and simplify procedures. The major
changes consist of the following:
1 . General Information:
- Plan submittal procedure clarified.
2. Improvement Plans:
- Pavement section modified to require two-course construction.
.•., (3/4" - 3/8" AC over 1 3/4" - 3/4" AC)
- Frames and covers to be adjusted prior to finished AC course.
3. Improvement Plan Checklist - Streets:
- Formula for pavement tapers are provided for each street classification.
- Provisions are made to eliminate undulations in existing or planned roadways.
4. Improvement Plan Checklist - Water:
- The City Engineer's approval is required for the placement of hydrants
in the public rights-of-way.
5. Sections on Storm Drainage have been rearranged for clarity.
- Provisions are included to require Drainage and Retention Covenants to
be described on the plat or be recorded by separate instrument.
- Provisions are made to eliminate the analysis of drainage areas upstream
of Highway 60 IF development is South of Hwy 60.

Coordinates.

FOR LITTER VIOLATIONS
Three property owners have submitted written requests to the Council ,
asking for additional time to bring their respective property into
compliance with Article 9-2 of the City Code. Copies of these requests
as well as copies of pictures of the property in question are attached.
Roy and Margaret Riddle are requesting an extension of an additional
sixty (60) days after the expiration of the initial thirty (30) day
period. The initial period will expire July 23rd. An additional
sixty days would extend to September 23rd.
Marilyn Shine is requesting an extension until September 30th so as
to permit time to sell the property. Since this property is over-
,ft... grown with high weeds, Council should consider the fire hazard involved.
Virginia Asan is requesting an extension until the end of July. She
hopes to have the property cleaned before July 18th, but is uncertain
as to the exact date.
These requests will appear on the July 17th agenda for your action. A
proposed motion is attached for your consideration.

7. Chairman opened the public hearing on PZ-24-84, Proposed
Ordinance No 283, rezoning from GR to CB-2 in
Section 21 He asked for staff briefing.
8 Mr Newcomer briefed the Commission regarding the case
9. Mr. Broman stated that staff had met with the applicants
and their engineer and that an additional dedication
was agreed to along parallel line connecting
both Royal Palm and Broadway to Highway 60

11 Jean Vaughn stated that she and her husband were willing
to follow the recommendations for providing
easements for roads.

with the General Plan. He added that there is

15 Taylor/Rogers M/S "BE IT RESOLVED by the Planning and Zoning
Commission of the City of Apache Junction, Arizona,
that rezoning case PZ-24-84, also known as
Proposed Ordinance No. 283, application of George
and Jean Vaughn through Charles Reese for their
property described as, a matter of public record,
requesting rezoning from GR General Rural to
CB-2 General Business Zone, that the Commission
recommends to the Apache Junction City Council
the approval of said application.

"Any stipulations or recommendations are:
1. The applicant will dedicate the Jrty
feet (40') along Royal Palm Road, tnt. .,outh
fifty feet (50') along Broadway Avenue, and a
forty foot (40') strip parallel to the Highway 60
right-of-way and connecting Royal Palm and
Broadway Avenue by a curve acceptable to the
City ±240'
2. A reservation for rights-of-way pending
intersection designs for future signalization
agreed upon between the City and the State,
said parcel being forty feet (40') wide and
parallel to the Highway right-of-way as described
in #1 above, thus making the total right-of-way
parallel to the Highway right-of-way eighty feet
(80' ) in width Said curve connecting Royal Palm
and Broadway shall be ±200'.
3. Until such time that the intersection and
signalization design is confirmed between the
City and the State, the applicant shall not
develop within the reservation area as described
in #2 above.
"The reasons for the recommendation are:
1 The rezoning application is in conformance
with the General Plan of the City of Apache
Junction, Arizona
2 It appears to be the best use of the land
at this time."
The motion passed unanimously.
16 Chairman opened the public hearing on PZ-26-84, Proposed
Ordinance No. 285, rezoning from GR to TH in
Section 19 He asked for staff briefing.

Commission of the City of Apache Junction, Arizona,
that rezoning case PZ-26-84, also known as
Proposed Ordinance No 285, application of
Stanley and Virginia Holsinger through Gerald
Hartshorn for their property described as,
a matter of public record, requesting rezoning
from GR General Rural to Trailer Homesite Zone
(TH), that the Commission recommends to the
Apache Junction City Council the approval of
said application
"The reasons for this recommendation are:
1. The request is consistent with the General
Plan's Medium/Hig, Density designation.
2 It conforms to the surrounding area.
3. It is the best use of the property "

under Requests from Other Agencies. He asked
for staff briefing.
25. Mr. Newcomer briefed the Commission regarding the case
stating that the applicants are requesting a
zone change from GR to MHP in Section 31.
He said there is no objection to the request

for the property located at the Northwest
of the Southwest A of the Northeast A of
Section 31 , Township 1 North, Range 8 East,
Gila and Salt River Base and Meridian, Pinal
County, Arizona, requesting rezoning from GR
General Rural to MHP Mobile Home Park, that the
Commission recommends approval to the Pinal
County Planning and Zoning Commission and the
Pinal County Board of Supervisors
"The reason for this recommendation is.
The request conforms to the City of Apache
Junction's General Plan."
The motion passed unanimously

28. Chairman asked for staff briefing on SUP-149-84
29. Mr. Newcomer stated that this was a request for a Special
Use Permit on the same parcel as the last case
to allow for placing travel trailers on
mobile home spaces for at least three years
30. Mr Vehon asked if this was requested for all lots
or just a percentage.
_.:._.- 31. Mr. Newcomer replied that a 10 percent range is allowed in
any or all of the park.
32. Mr. Rogers felt that the permit should be issued for one
year with a review after that period
33. Mr. Newcomer said that generally a special use permit is
kept down to a 2-year period
34 Commission discussion on time periods of special use permits
35 Chairman called for a motion.
36. Taylor/Vehon M/S "BE IT RESOLVED by the Planning and Zoning
Commission of the City of Apache Junction, Arizona,
that in Pinal County case SUP-149-84, application
of Robert Rush and Robert Lenz for their property
described as the Northwest of the Southwest
of the Northeast ; of Section 31, Township 1
North, Range 8 East, Gila and Salt River Base
and Meridian, Pinal County, Arizona, requesting
a special use permit at least three (3)
years to place recreational vehicles on mobile
home spaces, that the Commission recommends to
to the Pinal County Planning and Zoning Commission
and the Pinal County Board of Supervisors the
approval of said application
"The reasons for this recommendation are
1. This area is Medium/High Density on the
City of Apache Junction, Arizona, General Plan
2 The request would conform with the contiguous
property thereof."
The motion passed unanimously
37. Chairman asked for staff briefing on PC-PZ-24-84
38 Mr Newcomer briefed the Commission stating this was a rezoning
from MHP to RVP in Section 34.
39. Chairman there being no applicant present and no one to
speak in favor or in opposition, asked for
Planning Department comments
40 Mr Newcomer stated there was no objection and that the
request would be in compliance with the General
Plan.
41 Mr Rogers asked if this was located in a heavy industrial
area
42. Mr. Newcomer replied that it was industrial or high density
residential.

Commission of the City of Apache Junction, Arizona,
that a public hearing be held by the Commission on
PZ-39-84, Proposed Ordinance No. 301, at their
regular meeting of July 24, 1984, to consider by
Commission Initiative the amendment of the Zoning
Map Classification from Trailer Homesite Zone (TH)
to CR-3 Single Residence Zone for the property

Synopsis
Approval of Agenda dated June 11 , 1984 - as presented.
Approval of Minutes dated February 27, 1984 - as published
BA-23-80 (Boso) - approval for 12-month extension of Special Use Permit.
1 Chairman opened the meeting and asked the recording
secretary to call the roll.
2 Mrs Samuelson called the roll and determined that all members
were present
3 Chairman there being no additions or deletions to the
Agenda, asked that it be approved
4. Gardom/Carter M/S that the Agenda be approved as presented
There were no objections from the Board.
5 Chairman there being no additions or deletions to the
Minutes of February 27, 1984, asked that it
be approved
6 Gardom/Carter M/S "BE IT RESOLVED by the Board of Adjustment
of the City of Apache Junction, Arizona, that
the Minutes dated February 27, 1984, be approved
as published "

7. Chairman opened the public hearing on BA-23-80, and asked
for staff briefing on the case
8. Mr. Nakagawa stated that this is a one-year extension to
the original Special Use Permit for an auto
repair facility in a GR zone. He said that the
City has been approving this since 1980 He
informed the Board that there have been no
complaints filed. He noted one added stipulation
was that the "A" frame hoist be moved into the
yard area within sixty days.
9. Chairman asked the applicant to speak
10 Howard Boso said there have been no complaints and that he
tries to keep everything neat and orderly

11. Mr Gardom commented that he had visited the site and that
it was orderly. He felt the permit should be
allowed to be continued for another year
12. Mr. Schmidt concurred with Mr. Gardom
13 Mr Morrison asked if there was supposed to be a higher fence
and an enclosure when this permit was first
granted
�._ 14 Mr Boso replied that a diagram was drawn up as to what
he had to do and that he had conformed to that
diagram.
15 Mr Nakagawa stated that there is a 5'-6' screened fence
in the work area and that it appears to comply
with the conditions set forth
16. Mr. Morrison asked Mr Boso if he pays for a business license
17. Mr Boso replied that he does, also sales tax
18 Mr Morrison asked if since the lot is zoned GR if it was
legal to have a business on a GR lot.
19 Mr Nakagawa replied that the City inherited the use permit
from Pinal County and that he was not sure where
I Pinal County got the authority for it. He
added that the City decided to continue permitting
the operation on a year-to-year basis. He
commented that a precedent was set in granting
an extension
20. Mr. Morrison felt that the extensions had to be stopped.
21 Mr Boso stated that there had been no written complaints,
{ but that one of the Board members had gone to
the neighbors wanting them to turn in complaints.

23. Chairman called for a motion.
24. Gardom/Carter M/S "BE IT RESOLVED by the :oa,d of Adjustment of^
the City of Apache Junction, Arizona, that a
twelve (12) month extension of BA-23-80 allowing
an auto repair garage at 1536 W. Roundup Street
is hereby approved. The following stipulations
shall be conditions of the permit
1 The approval would be granted on a year-to-year
operation with extensions, provided that
nuisance complaints are not filed Upon
receipt by the City of Apache Junction of a
written complaint filed against Mr. Boso's
auto repair service, Mr. Boso will be duly
notified and will be given the opportunity
to be heard on the matter The Board of
Adjustment may refuse to grant future
Il extensions of Pinal County SUP-59-77 based
upon written complaints.
2 The approval of use cannot be transferred to
another person without a hearing and Board
of Adjustment approval
3 This approval is for car repair only, and does
not include body or fender work.

4 The location is be be kept in a clean order
and "junk" automobiles will not be permitted
All parking shall be on the owner's property
and any signs shall be approved by the City
Zoning Administrator
5 The applicant shall relocate the "A" frame
hoist to the enclosed yard area within sixty
(60) days of this public hearing (by August
10, 1984).
6. Any provisions contained in the City Zoning
Ordinance which are applicable to property
located in a CB-2 zone and which does not
conflict with the special requirements, as
set forth in this resolution, shall also
be applicable
= 7. The applicant shall notify the City of Apache
Planning Department, in writing, of his desire
to have his permit renewed for another twelve
months by May 5th of each year.
8. This permit expires on August 8, 1985, unless
a renewed prior to that date
9 Failure to comply with the provisions as set
forth in this resolution shall result in the
discontinuance of the special uses granted to
Mr Boso by Pinal County SUP-59-77."
