Regular Meeting
October 13, 2005
A regular meeting of The Board of Trustees of Apache Junction Public Library was held
October 13, 2005 at 6:00 p.m. at the Apache Junction Library pursuant to notice as
prescribed by law.With the President absent, Vice President Theresa Nesser conducted
the meeting.

2. Acceptance of minutes for
September 8, 2005 regular Meeting:

The question of accepting the agenda for the
October 13, 2005, regular Meeting was
placed before the Board. Everett Deidiker
made a motion to accept the agenda with the
request that item 7a. be moved between item
3 and 4 on the agenda.Michael Klatt
seconded the motion. All members present
were in favor.
The question of accepting the minutes for
the September 8, 2005, regular Meeting was
placed before the Board. Joyce Payne made
a motion to accept the minutes. Michael
Klatt seconded the motion. All members
present were in favor.

7a. Presentation and discussion with the
City Attorney on Board members'
Responsibilities under the State
Open Meeting and Conflicts laws.
'
City Attorney Joel Stern provided a
summary of the Open Meeting and Conflicts
laws for the Library Board.He also fielded
a few questions from the Board and staff.
Pam's question:If the staff, either Sancie or
I, decided to e-mail out an agenda or e-mail
out some background material that we
would be discussing that has been properly
noted on an agenda, is that considered a
problem?
Joel's Response:No, information by itself
is fine. If the members start to e-mail each
other with the background information and
ask what each other thinks about this or that,
then that is a no.But if it is just one way,
that is not a problem.That is a very
effective way to get information from staff
to board members.
Pam's question:It says here under the City
Provider Conflict.A conflict of interest
exists any time a public officer or employee
supplies goods or services to their public
entity not pursuant to public competitive
bidding.What happens if some member of
the board has a relative that wants to donate
some kind of service or product to the
library?
Joel's Response:A donation by itself is not
a problem.It's when there is a contractual
relationship and a member or their spouse or
other relative is going to get some kind of
money or benefit or other benefit like a
promise to move them up into a different
board or commission.
Pam's question - But a benefit like they get
named in a newspaper because they gave a
donation, is that considered a benefit?

Joel's Response: No. I don't see that as a
benefit.That's out of a public community
effort.
Everett's Question:If we make decisions on
the new addition to the library and I vote on
it, and later I get a job for the contractor that
builds it, have I had a conflict of interest?
Joel's Response:Not later.If you didn't
know anything about Your job offer or job
opportunity before, no.If you knew before
though, yes.
Everett's Question: The other question is
this doesn't apply to congress does it?
Joel's Response:They have rules but none
apply.
Everett's Question:This is just Arizona?
Joel's Response:ARS means Arizona
Revised Statutes.So that's a state law.

Pam reviewed statistics for the monthly
report and showed that most categories have
increased over one year ago.
Information on the library building design
concept project has now been presented to
the City Manager.Pam said the architects
will provide an update at the next meeting.
Meet Barbara Sexton. Barbara has been with
the Library since 2003.She has held the
position of Library Page, Computer Lab
Assistant and is currently working as a

d.Development of the Senior
Center.
8.Request for future agenda items.
Library Clerk.Barbara works part-time
checking in and out materials, assisting
patrons with renewals or lost cards and
shelving books. Barbara is currently
assisting in the conversion process to RFID
tags.
This item was requested for dikUssion by
Lori D' Arbico' who brought in an article
entitled "Library adds digital audio, books to
menu."Staff members -from Several
libraries in the EaSeValley:havC Worked out
an agreement with Phoenix Public and have
joined the Greater Phoenix Metro Emedia
Library.This database will allow people to
dOwnload audio books and ebooks.
Library staff members have determined that
the best option for use of the former senior
center space is as a public access computer
lab area.Spencer is in the process of getting
quotes back from the electrician and cabling
people to be sure this option is feasible.The
Senior Center will also receive a fresh coat
of paint as donated by New Century
Coatings. There will be new.carpeting in the
office spaces.The kitchen area will be used
by staff for lunch and breaks.
