" CITY COUNCIL REGULAR MEETING NOVEMBER 20, 1984 The regular meeting of the City Council of the City of Apache Junction, Arizona, was held on November 20, 1984, at the Apache Aosak Junction City Council Chambers pursuant to the notice required by law. CALL TO ORDER Vice Mayor Eidson called the meeting to order at 7.00 p.m. INVOCATION Councilman Taylor led the Invocation. PLEDGE OF ALLEGIANCE David Carter of the Apache Junction Explorers led the Pledge of Allegiance. Councilman Shanks seconded the motion VOTE: Unanimous The motion carried. Introduction of Distinguished Visitors and Guests Vice Mayor Eidson recognized the Apache Junction Explorer Scouts. AWARDS, PRESENTATIONS AND COMMUNICATIONS Director of Public Safety Bill McDaniel introduced the Explorer Scouts, a new organization through the Police Department, and outlined the training and duties of the Scouts. Vice Mayor Eidson presented a Proclamation declaring March 26, 1984, as the date for the Primary Election. CITY MANAGER'S REPORT City Manager Michael J. McNulty reported on the progress on street improvements, and stated that Central Arizona Water Project was granted an extension on signing a contract Mr. McNulty also stated that the signal light at Idaho and Highway 60 will be turned on in the near future. I PUBLIC HEARINGS PROPOSED ORDINANCE NO 333, AMENDING CITY CODE (With Emergency Clause) ) Vice Mayor Eidson opened the hearing to the public City Clerk Kathleen Connelly explained that the purpose of this amendment is to streamline council meeting procedures, and would enable the Council to have a first reading of an ordinance by title only, conduct a public hearing and actually vote on an ordinance all at the same meeting. Vice Mayor Eidson asked if there was anyone who wished to speak in favor of or in opposition to the ordinance. There being no one wishing to address the Council, Vice Mayor Eidson closed the hearing to the public. Councilman Damiano MOVED THAT ORDINANCE NO. 333, BE READ BY TITLE ONLY WITH THE EMERGENCY CLAUSE AND THE READING OF THE ENTIRE ORDINANCE BE WAIVED. Councilman Hill seconded the motion. VOTE Unanimous The motion carried. Vice Mayor Eidson called upon the City Clerk to read Ordinance No. 333, by title only with the Emergency Clause. Director of Planning Chuck Newcomer briefed the Council on the application for rezoning from GR General Rural to Trailer Homesite TH of a 9 acre parcel, located at the northwest corner of Junction Street in Section 21. Mr. Keith Stachar, 6301 E Roundup, Apache Junction, explained that plans are to develop a mobile home park on this parcel Vice Mayor Eidson asked if ar`► there was anyone who wished to speak in favor of or in opposition to the application. Mr. George Petticrew, 247 E. Junction, Apache Junction, a property owner directly across from the parcel in question, addressed the Council in opposition to the rezoning Mr. Stachar rebutted the statements made by Mr Petticrew Mr Petticrew returned the rebuttal Vice Mayor Eidson closed the hearing to the public and called upon the City Clerk to read Ordinance No 287, by title only for the first reading. APPLICATION FOR SERIES 7 AND SERIES 10 LIQUOR LICENSE, ADAM'S CHEVRON Vice Mayor Eidson opened the hearing to the public. Mr Charles Adams, 201 W. 20th Avenue, Apache Junction, owner and operator of Adam's Chevron, requested approval of the applications. Vice Mayor Eidson asked if Mr. Evans owns the property. Mr Adams replied that Evans Management Corp. owns the property and is aware of the applications submitted. Vice Mayor Eidson asked if there had been any complaints from the public. Mr Adams replied that no complaints have been expressed. Vice Mayor Eidson wished to know if the City would be liable for injuries or property damage due to someone leaving the premises drinking, with these ideal circumstances to drink and drive. City Manager McNulty explained that the State of Arizona grants the license, not the City, so the City would not be liable. City Attorney Arnold Hirsch gave the opinion that the liability would lie with the server of the alcohol, as the City has no control over the licensee. Councilman Taylor MOVED THAT THE APPLICATION FOR A SERIES 7 LIQUOR LICENSE, SUBMITTED BY ADAM'S CHEVRON BE RECOMMENDED FOR DENIAL TO THE STATE DEPARTMENT OF LIQUOR LICENSES AND CONTROL BECAUSE. 1. IT IS NOT IN THE BEST INTEREST OF THE PUBLIC NOR FOR THE PERSON DRINKING. 2. IT COULD POSSIBLY CONTRIBUTE TO ACCIDENTS AND CREATE A NUISANCE. Councilman Shanks seconded the motion. YOUNG (Second Reading) Director of Planning Chuck Newcomer briefed the Council on the application for rezoning from GR "Iak General Rural to Trailer Homesite Zone (TH), of a 1 1/4 acre parcel located on the east side of North Valley Drive and 165 feet south of Shiprock Street in Section 17, and stated that there have been valid protests received. Councilman Shanks MOVED THAT ORDINANCE NO. 314, BE READ BY TITLE ONLY AND THE READING OF THE ENTIRE ORDINANCE BE WAIVED. Councilman Damiano seconded the motion. VOTE: Unanimous # The motion carried. Councilman Hill seconded the motion Councilman Shanks commented that she felt that protests are not valid as this area is predominantly trailers already, and the protesters have trailers. PROPOSED ORDINANCE NO. 321, PZ-54-84 JONES AND BURGESS (Second Reading)) Vice Mayor Eidson informed the Council that the staff has recommended returning this application to the Planning and Zoning Commission Councilman Damiano MOVED THAT ORDINANCE NO. 321, REZONING CASE PZ-54-84 BE RETURNED TO THE PLANNING AND ZONING COMMISSION FOR A NEW PUBLIC HEARING. Councilman Shanks seconded the motion. Councilman Shanks stated that as there were substantial changes in the original application, this is being returned for further review by the Planning and Zoning Commission VOTE: Unanimous The motion carried. ECONOMIC OPPORTUNITIES ACTION TEAM VACANCIES AND NOMINATIONS Economic Development Specialist John Schoeph addressed the item stating that a number of vacancies have occurred in the various categories and requested appointment of the indicated nominees. Councilman Shanks MOVED THAT RICHARD BURKLAND, BOB BURD, TOM HARPIN, TERRY SECOR, HENRY STEELSMITH, AND RONALD WARD BE REMOVED FROM THE ECONOMIC OPPORTUNITIES ACTION TEAM WITH APPRECIATION FOR SERVICES RENDERED. NEW BUSINESS INTERGOVERNMENTAL AGREEMENT BETWEEN MARICOPA COUNTY/APACHE JUNCTION Mr. Broman briefed the Council, stating that Maricopa County is engineering Broadway Road for construction of a 4-lane roadway from Ellsworth to Meridian Drive, which will improve the traffic and drainage problems in this area, and that the City's share for the improvements to the intersection would be approximately $101,516 00 Councilman Baljo MOVED THAT THE INTERGOVERNMENTAL AGREEMENT BETWEEN MARICOPA COUNTY AND THE CITY OF APACHE JUNCTION, ARIZONA, FOR IMPROVEMENTS TO BROADWAY ROAD AND MERIDIAN DRIVE, AS PREPARED BY MARICOPA COUNTY, AND IN ADDITION THAT REGULAR MEETING OF THE CITY COUNCIL NOVEMBER 20, 1984 PAGE 7 THE TOTAL BE $101,516 00, BUT CANNOT BE EXCEEDED WITHOUT FURTHER AGREEMENT BETWEEN THE CITY OF APACHE JUNCTION AND MARICOPA COUNTY, BE AND HEREBY IS ACCEPTED. McDaniel, Director of Public Safety THROUGH: Michael J. McNulty, City Manager SUBJECT: 9-1-1 Emergency Telephone Number Ordinance Please find attached a copy of the proposed E 911 Ordinance for the City of Apache Junction. Through contact with other agencies throughout the United States who now have the E 911 System in operation, they have advised it is necessary to adopt an ordinance to keep people from misusing and abusing the system. This must be done to protect the integrity of the system and to allow the system to operate properly under any given situation. The Ordinance will also insure that city resources, equipment and manpower will be used to respond to only bona fide emergencies. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, AS FOLLOWS* SECTION I IN GENERAL That Chapter 10 OFFENSES be amended by adding Section 10-1-23 MISUSE OF 911 EMERGENCY TELEPHONE NUMBER SYSTEM, to read as follows: Section 10-1-23 Misuse of 911 Emergency Telephone Number System A Definitions 1 "Person" shall be deemed to mean any individual, firm, partnership, corporation or unincorporated association. 2 "911" shall be deemed to mean the City of Apache Junction 911 Emergency Telephone Number System. 3 "Emergency" shall be deemed to mean any situation in which a human life or property is in jeopardy and the prompt sunxnoning of aid is essential. B Prohibited Acts It shall be unlawful for any person to intentionally and wilfully dial the 911 Emergency Telephone Number and falsely report a non-existing emergency or to dial the 911 Emergency Telephone Tele hone Number wi th the intention to harass, annoy, or otherwise interfere with the intended operations of the 911 Emergency Telephone Number System SECTION II REPEALING ANY CONFLICTING PROVISIONS All ordinances and parts or ordinances in conflict with the provisions of this ordinance or any part of the code adopted herein by reference are hereby repealed SECTION III PROVIDING FOR SEVERABILITY If any section, subsection, sentence, clause, phrase or portion of this ordinance or any part of the code adopted hrein by reference is, for any reason, held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions thereof. SECTION IV PROVIDING PENALTIES Any person found guilty of violating any provisions of this ordinance shall be guilty of a Class 1 misdemeanor and, upon conviction thereof, shall be punishable by a fine not exceeding one-thousand ($1,000) dollars or by imprisonment of not more than six (6) months, or by both such fine and imprisonment. Exterior walls, which are laterally supported with those supports located no more than twenty-four (24) feet apart, are allowed a minimum thickness of sixteen (16) inches Interior walls are allowed a minimum thickness of twelve inches (12") Designed walls may be a minimum thickness of ten inches provided the h/t ratio of ten (10) is maintained (c). Compressive Strength. The units) shall have an average compressive strength of three hundred (300) pounds per square inch when tested in accordance with ASTM C67 One sample out of five may have a compressive strength of not less than two hundred-fifty (250) pounds per square inch. (d) Modulus of Rupture The unit shall average fifty (50) pounds per square inch in modulus of rupture when tested according to the following procedure ^ 1. A cured unit shall be laid over (cylindrical) supports two inches (2") in diameter, located two inches (2") from each end, and extending across the full width of the unit. 2 A cylinder two inches (2") in diameter shall be laid mid- way between and parallel to the supports 3. Load shall be applied to the cylinder at the rate of five hundred (500) pounds per minute until rupture occurs 4 The modulus of rupture is equal to 28d2 W = Load of rupture L = Distance between supports B = Width of brick d = Thickness of brick (e). Classes of Adobe (1) Treated Adobes The term "treated" is defined to mean adobes made of soil to which certain admixtures are added in the manufacturing process in order to limit the adobe's water absorption in order for it to comply with paragraph (,7) below Exterior walls constructed of treated adobe require no addi- tional protection Stucco is not required /11'\ (2) Untreated Adobes Untreated adobes are adobes which do not meet the water absorption specifications of paragraph (j) below. This shall hold even if some water absorption protec- tive agent has been added The determination as to whether an adobe is treated or untreated is to test for compliance with paragraph (3) below. Exterior walls of untreated adobe are allowed but must comply with paragraph (o) requiring Portland cement plaster applied to the outside Use of untreated adobes is prohibited within four inches (4") above the finished floor grade, unless an approved vapor barrier is used between wall and stem Treated adobes may be used for the first four inches (4") above finished floor grade, without a vapor barrier. (3) Other Types of Adobe This chapter applies to construc- tion with all types of adobe including rammed earch and poured earth adobe The types of adobe shall meet the specifications in this chapter or similar specifications which are approved by the building official. (g) Mortar Where treated adobe is required mortar shall be treated or may be Type M or S. Where adobes are allowed to be untreated any adobe mortar may be used and or Type M, S or N. Mortar "bedding" joints shall be full SLUSH type, with partially open "head" joints allowable if surface is to be plastered. All joints shall be bonded (overlapped) a minimum of four inches(4") (h). Sampling. Each of the tests prescribed in this Section shall be applied to five sample units selected at random from each 5,000 bricks to be used (i) Moisture Content The moisture content of the unit shall be not more than four (4) percent by weight (j) Absorption A dried four inch (4") cube cut from a sample unit shall absorb not more than two and one-half percent moisture by weight when placed upon a constantly water saturated porous surface for seven (7) days (k) Shrinkage Cracks. No units shall contain more than three shrinkage cracks, and no shrinkage crack shall exceed two inches (2") in length or one-eighth (1/8) inch in width (1) Use No adobe shall be laid in the wall for at least three (3) weeks after making, dependent on weather conditions. (m) Foundations Adobes shall not be used for foundation or basement walls. All adobe walls, except as noted under Group M Buildings, shall have a continuous concrete footing at least eight inches (8") thick and not less than two inches (2") wider on each side than the foundation stem walls above All foundation walls which support adobe units shall extend to an elevation not less than eight inches (8") above the finished grade Foundation walls shall be at least as thick as the exterior as specified in Section 2405 (1) Where stem wall insulation is used, a variance is allowed for the stem wall width to be two inches (2") smaller than the width of the adobe wall it supports ORDINANCE NO PAGE THREE (n) Bond Beam All exterior adobe walls shall have a continu- ous concrete bond beam with a minimum width of ten inches (10") and a minimum depth of ten inches (10"). All concrete bond beams shall be reinforced with a minimum of two (2) No 4 reinforcing rods. (o). Plastering All untreated adobe shall have all exterior walls plastered on the outside with Portland cement plaster, minimum thickness three-fourths inches (3/4") in accordance with Chapter 47. Protective coatings other than plaster are allowed, provided such coating is equivalent to Portland cement in protecting the untreated adobes against deterioration and/or loss of strength due to water Metal wire mesh minimum 20 gauge by one inch (1") opening shall be securely attached to the exterior adobe wall surface by nails or staples with minimum penetration of one and one-half inches (1 1/2") Such mesh fasteners shall have a maximum spacing of sixteen inches (16") from each other. All exposed wood surfaces in adobe walls shall be treated with an approved wood preserva- tive before the application of wire mesh (p). Piers. A minimum twenty-eight inch (28") wall section shall be required between openings and openings shall not be placed within twenty-eight inches (28") of exterior corners (q) Partitions of Wood Shall be constructed as specified in Chapter 25, wood partitions shall be nailed to nailing blocks laid upin the adobe wall or bolted through the adobe wall the 9 height of the partition, with one-half inch (1/2") DIAMETER bolts twenty-four inch (24") on center with large washers or plates, or other approved methods (r) Wood Lintels Wood lintels designed to support all imposed loads are permitted up to a maximum span of six feet (6') and shall have a minimum twelve inch (12") bearing. The land owned by me was zoned CB prior to purchase by me, I purchased that land and paid an appropriate price for it on the assumption that the area would be deNeloped generally along business and commercial lines The proposed new zoning classification would serve only to render the already existing CB land to something less than its present value. SAN MARCOS DRIVE - VACATION AND RECLASSIFICATION (AGENDA ITEM) An application for the vacation of a portion of San Marcos Drive and a request for reclassification of San Marcos Drive have been received and was reviewed by the Development Coordinating Committee (DCC) on November 21 , 1984. VACATION OF RIGHT-OF-WAY Considering the request to vacate a portion of San Marcos, the committee agrees that: 1 . Due to the lack of a transportation plan in the Apache Junction area during the time when Pinal County had jurisdiction, no provisions were made for the reservation of extension of San Marcos Drive from Superstition Boulevard to Broadway Avenue. Existing conditions find portions of the right-of-way was dedicated with the subdivision, while other portions are encroached upon by drainageways, mobile home and RV parks and commercial developments. At this time, it would be virtually impossible to extend San Marcos Drive without considerable expense to the City and hardship to businessmen and property owners. Drainageways would need to be re-routed, mobile homes moved, businesses moved, subdivisions re-designed, and additional right-of-ways acquired. 2. In the area, hodge-podge development has inadvertently redistributed traffic in such a manner that access is provided to all required areas. Plaza and Rennick Drives provide access to the north of Highway 60, while Phelps and Thunderbird Drives provides or will provide access to the south of Hwy 60. 3. Furthermore, in the long term, should major urban redevelopment occur, the City may have an opportunity to establish roadways to conform to the development of the time. Due to the nature of existing development, and if the abandonment of that portion of San Marcos Drive is vacated south of the Virginia Street alignment, there would be no need to retain the larger classification due to the residen- tial nature of the area and the low traffic volume that would be generated. 2. Adequate traffic circulation would be provided by retaining the Virginia Street alignment for present and future roadways. 3. This reclassification should include the entire North-South mid-section align- ment due to comparable conflicts south of Highway 60 to Broadway Avenue. a. No provisions were made for roadways along the West side of Superstition Plaza inwhere buildings and an alley is within the planned alignment b. The Sierra Entrada and Apache Ho subdivisions have encroached upon and have constructed drainageways in the planned alignment. c. Adequate traffic circulation and access will be provided by Plaza Drive and Thunderbird Drive, between Highway 60 and Broadway Avenue. A "street classification plan" is hereby adopted in a manner and form annexed hereto and made a part of this article by reference, said plan to be kept on file in the office of the city clerk. B. It shall be a condition precedent to the issuance of a building permit for new construction within the city that the required street right-of-way dedications and improvements be made as set forth in the street classification plan of the City of Apache Junction. C. Postponing Required Improvements. 1. The director of public works may postpone the installation of the required offsite improvements for individual single family construction, prior to issuance of a building permit, provided that the applicant enters into an agreement to participate in an improvement district for the purpose of future street improvements. 2. For application other than for individual single family construction, the installation of the required offsite improvements may be postponed by the director of public works provided the ,) applicant enters into an agreement to participate in an improvement district for the purpose of future street improvements . Should the director of public works deny a request for postponement of offsite improvements, the applicant may appeal the denial as follows: a. John Granillo represented the applicants who intended at first to live in a trailer on the subject parcel. He added that business has outgrown the present site and they want to expand the stock area 12 Chairman there being no one to speak in favor or in opposition, asked for Planning Department comments and recommendations. 13 Mr Nakagawa stated that the property to the north had been rezoned to CB-1 last year. He noted that no objections have been received from the surrounding neighbors He added that the rezoning would be consistent with the General Plan. 14. Taylor/Jorgensen M/S "BE IT RESOLVED by the Planning and Zoning Commission of the City of Apache Junction, Arizona, that rezoning case PZ-55-84, also known as Proposed Ordinance No 322, application of Glen and Doris Limestall for their property described as a matter of public record, requesting rezoning from GR General Rural to CB-1 Local Business Zone, that the Commission recommends to the Apache Junction City Council the approval of said application. The only stipulation is that when the applicable City inspection takes place, traffic entrance and exit on Delaware may be a concern The reasons for this recommendation are 1 It is a contiguous rezoning from the CB-1 granted last year to the same owner south 2 It is compatible with the Commercial Opportunity Area designation of the General Plan of the City of Apache Junction, Arizona." The motion passed unanimously 15 Chairman opened the public hearing on PZ-56-84, a rezoning from CR-1 to CB-2 in Section 15 and asked for staff briefing 16. Mr Nakagawa briefed the Commission regarding the case 17 Chairman asked the applicant to speak on the case. 18. Mikki Frazier represented the applicant whose property fronts on Highway 88 She said that parcels to the south are CB-2 and 700' north are more CB-2 parcels. 19 Mr Heermans asked what the applicants plans are 20 Mrs. Frazier replied that they have no plans for development at this time 21 Chairman there being no one to speak in favor or in opposition, asked for Planning Department comments and recommendations Page Three - Planning and Zoning Commission Minutes - November 13, 1984 22 Mr Nakagawa stated that the P&Z and City Council had been advised that the other two rezonings to CB-2 in the immediate area would not be appropriate. He recommended a stipulation of roadway dedication 23. Mr. Newcomer commented that he had consulted with the Director of Public Works on dedications for Highway 88 He said that ADOT has nothing planned for the immediate future for a 100' alignment He added that the applicant had been cautioned on setbacks should the alignment become 100'. emN 24. Leo Frazier stated that the Building Department would ask that setbacks be taken from a planned right-of-way He commented that the property had been home- steaded by the applicant's family years ago 25. Chairman closed public hearing 26 Mr Taylor asked how much of this area will be more intense commercial in the new General Plan. 27 Mr Newcomer replied that the Commission will have to take a look at this strip. He commented that since the last General Plan review, a majority of people believe that Highway 88 should be General Commercial. 28 Jorgensen/Taylor M/S "BE IT RESOLVED by the Planning and Zoning Commission of the City of Apache Junction, Arizona, that rezoning case PZ-56-84, also known as Proposed Ordinance No 323, application of Betty Kilburn for her property described as a matter of public record, requesting rezoning from CR-1 Single Residence to CB-2 General Business Zone, that the Commission recommends to the Apache Junction City Council the approval of said application Any stipulations or recommendations are The applicant dedicate the east thirty-three feet (33' ) of the subject property for public roadway and associated purposes. The reasons for this recommendation is It seems to be the consensus of the Commission that this is an appropriate zoning for this part of the City, and that the General Plan will be changed " The motion passed unanimously 29 Chairman noted the next agenda item was under Requests from other agencies, MC-Z-84-159, and asked for staff briefing. 30 Mr Newcomer briefed the Commission stating that this was a referral from Maricopa County for a rezoning from RI-8 to C-3 for a 24 acre parcel located 250' south of the southwest corner of Apache Trail and Meridian in Section 24 31. ', 38 Chairman asked if anyone wished to speak in favor 39. Thelma Link said she is a tenant and can understand the problems encountered by the Veirs. She added that the area is more business than residential 40. Chairman there being no opposition, asked for Planning Department comments and recommendations 41 Mr. Newcomer stated that this would be an appropriate rezoning for this area He asked that the off-sites be coordinated with the Department of Public Works 42. The motion passed unanimously 1 43 Chairman stated that under New Business was a discussion of Commercial Zoning Districts and possible Commission Initiative to set a public hearing He asked for staff briefing. 44 Mr Newcomer handed out additional materials and noted that one was a memo concerning the proposed commercial district regulations. He listed items based on discussion from the Commission's Special Meeting He said Hours of Operation could be eliminated �.. from C-3 and if they wished to do the same for C-1 and C-2 he had prepared a draft combining these two districts He noted that there was no answer on the legality of imposing hours 45 Mr Taylor said that the hours should stay as established 46 Commission discussion Consensus was to leave hours of operation as written 47 Mr Newcomer said another item wassetbacks and called the Commission's attention to the tables he had prepared for some of the surrounding cities L48 Commission discussion Consensus was to go with setbacks as written 49 Mr Newcomer said the C-4 and C-5 " .completely screened from outside..." could put a limit on what is completely screened He suggested a 6' wall 50.
