CITY COUNCIL SPECIAL MEETING SEPTEMBER 27, 1984 The Special Meeting of the City Council of the City of Apache Junction, Arizona, was held on September 27, 1984, at the Apache Junction City Council Chambers pursuant to the notice required by law /1mk CALL TO ORDER Mayor Clarke called the meeting to order at 7 15 p.m. ROLL CALL Councilmen Present: Councilman Hill, Councilman Damiano, Councilman Taylor Councilman Shanks, Vice Mayor Eidson, Mayor Clarke Councilman Absent. Councilman Steelsmith Staff Present City Manager Michael J McNulty City Clerk Kathleen Connelly Director of Planning Chuck Newcomer City Attorney David Alexander Economic Development Specialist John Schoeph PROPOSED RESOLUTION NO. 84-53, COMMERCIAL ZONING MORATORIUM City Manager Michael J. McNulty briefed the Council and public on the proposed resolution, stating that the Zoning Rewrite Committee is near the finalization of the rewrite of the Zoning Ordinance and due to the increasing number of requests for rezonings which will cause continuing legal controversy because of the types of development that are permissable under our definition of CB-2 zoning, and that until a solution is reached, all applications for CB-2 rezonings not be accepted for filing or acted upon by the City. om\ Mr McNulty stated that there are six requests for CB-2 rezoning in process currently. Mr Keith Stachar, 6301 E Roundup, Apache Junction, addressed the Council in opposition to the moratorium, objecting to insufficient notice prior to this proposition. Mr Earl Laabs, Jr , 370 E 12th Avenue, Apache Junction, suggested that there be a 30 day transition period prior to a moratorium. Mr John Granillo, 930 E. Desert Avenue, Apache Junction, expressed sympathy for the Planning and Zoning Commission and Council in their difficult decisions, but opposed a moratorium Mr Mike Kovacs, 710 S Lawson, Apache Junction, opposed the proposal referring to Maricopa County zoning practices. Additional discussion was held between the City Manager and Councilmembers pertaining to the reasons for a moratorium. IIP"'""s Mr. Tony Vehon, 230 W Tepee St., Apache Junction, member of the Zoning Ordinance Rewrite Committee, asked if a rezoning was approved for CB-2, after zones for CB-2 were changed, would this rezoning change? Mr. McNulty stated that any with these circumstances would stay as rezoned Councilman Damiano asked who the protesters on the petition were Mr. Stachar stated that most of the signatures were those of business people in the community. No action was taken on the proposed resolution from lack of a motion Councilman Damiano MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, THAT THE CITY COUNCIL HOLD AN EXECUTIVE SESSION ON SEPTEMBER 27, 1984, AT 8 11 P.M., IN THE CITY HALL COMPLEX. LYNN FOR FINAL APPROVAL OF ISSUANCE OF NOT TO EXCEED $3,3000,000 IN INDUSTRIAL DEVELOPMENT REVENUE BONDS (A J WELLNESS CENTER)) Mr Jim Lanche, Lawyer with the firm of O'Connor, Cavanaugh, et. al., outlined the proposal of Industrial Development Bonds to finance the project, Apache Junction Wellness Center. Vice Mayor Eidson asked if Mr Lynn defaulted, would the City be liable. Mr. Lanche replied that no, the City would not be liable. Additional questions were asked by the Council in regards to the other projects Mr. Lynn had initiated Vice Mayor Eidson MOVED THAT BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, THAT RESOLUTION NO. 84-57, A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, APPROVING THE ISSUANCE OF $3,300,000.00 IN INDUSTRIAL DEVELOPMENT REVENUE BONDS, (GENE E. Introduction of Distinguished Visitors and Guests /11.,„ State Representative Roy Hudson, addressed the Council and public with a request that assistance be donated to Velma Furness for medical bills due to her health. AWARDS, PRESENTATIONS, AND COMMUNICATIONS None. CITY MANAGER'S REPORT Mr. Scott Ellsworth, of Henry and Horne, presented the Financial Statements for the year and reported on the annual audit conducted. Mr. Ellsworth commented on the improvements in the accounting system PUBLIC HEARINGS PROPOSED ORDINANCE NO. 338, AMENDMENT TO CITY CODE, CHAPTER 10, OFFENSES, (With the Emergency Clause) Mayor Clarke opened the hearing to the public. Director of Public Safety Bill McDaniel explained that this ordinance is to prevent the abuse of the emergency telephone number, 911, which possibly will be in use by July 1, 1985 Mayor Clarke asked if there was anyone who wished to speak on this issue. Hondo, Apache Junction, explained that the Limestall's wish to expand their business and requested approval of the rezoning. Mayor Clarke asked if there was anyone who wished to speak in favor of or in opposition to the application. There being no one wishing to address the Council, Mayor Clarke called upon the Director of Planning for recommendations Mr Newcomer stated that the ink Planning staff has no objections to the rezoning and the Planning and Zoning Commission recommends approval of the application. Mr. Newcomer briefed the Council on the application for rezoning from CR-1 Single Residence to CB-2 General Business of a 3.1 acre parcel, located on the southeast side of Highway 88, about 300 feet northeast of Tomahawk Road in Section 15 Ms Mikki Frazier, Rt 1 Box 1223, Queen Creek, Arizona, representing the applicant, addressed the item and requested approval of the rezoning. Mayor Clarke asked if there was anyone who wished to speak in favor of or in opposition to the application. There being no one wishing to address the Council, Mayor Clarke called upon the Director of Planning for recommendations. Mr. Newcomer stated that the Planning and Zoning Commission recommends approval of the rezoning and the Planning staff has no objections with the stipulation of dedication of the east 33 feet on the subject property. McNulty added that this is to demonstrate to the State Legislature that cities can act responsibly to a problem without the State mandating a solution. A study of requirements in other Valley cities was conducted and a draft ordinance was drawn up and reviewed by the Development Coordinating Committee on September 6, 1984, with their comments incorporated. A major item of discussion amoung the Committee members was whether requirements could be made retroactive. It was decided that requirements could not be made retroactive in the Zoning Ordinance and would also be inappropriate in any other section of the City Code unless an overwhelming threat to the public health and safety could be proven. Planning Department and DCC Recommendations At the September 6, 1984 DCC meeting, the draft of Section 2329 was reviewed, amendments made, and recommended for approval . Please note that the DCC recommendations included a six foot (6' ) fence height while the Planning and Zoning Commission is recommending a five foot (5' ) minimum height. If the Council desires to follow the Planning and Zoning Commission recommendation, I would also recommend that a maximum height of six feet (6 ' ) be included. An excellent point was made by the Commission concerning latches. It was pointed out that a short adult may have trouble reaching over a six foot fence to access the latch, but would not have a problem reaching over a five foot gate for the latch. McDaniel, Director of Public Safety GJ4W SUBJECT: Zoning ordinance RE: Swimming Pools On July 6, 1984 Officers from our department responded to a drowning in the south- west part of the city. The residence where this incident occurred is a mobile home on a single lot. On the property was an inground pool. The property was surrounded by a chain link fence. The gates were not self closing or self latching. After observing the fence the Building Department was called for an inspection because at the time we were unsure if the fence complied with the Code (see attached Building Department report). In further checking the Code we learned that in Zoning CR-I, CR-2 and CR-3 home- owners are required to have a fence not more than six feet nor less than five feet with self closing and self latching gates. In all other zoning areas the fence has to be only four foot high with self closing and self latching gates. We feel this a problem for safety reasons. The Public Safety Department is requesting that you look into the possibility of having the Code amended so that all zoning areas require a six foot high fence with self closing and self latching gates where in the ground pools are installed. It is our opinion that a person could drown just as easily in any zoning area as they could in a CR-1, CR-2 or CR-3. It is not our intention to make pool ownership more difficult for the homeowners of Apache Junction, but safer for all citizens of Apache Junction. The site is a vacant 4 acre parcel located on the southwest side of Highway 60/89 at the northwest corner of Winchester Road and Sixth Avenue in Section 21. It is designated General Commercial Opportunity on the General Plan. Surrounding land uses include vacant land and a trailer sales business. Planning Department Comments and Recommendations Staff had no objections to the rezoning noting that it would be consistent with the General Commercial Opportunity General Plan designation for the site. Staff does recommend stipulating the dedication of the north, west, and south thirty-three feet (33' ) of the subject property for public roadway and associated purposes. The applicant filed for the abandonment of Fifth Avenue, Sixth Avenue, and Sombrero Road abutting the subject property on October 30, 1984. This application is being processed and may be ready for your consideration at your December 18th meeting. The 1981 State Urban Lands legislation established a process for the orderly planning and development of State Trust Lands in and adjacent to municipalities and rapidly urbanizing areas. As you are aware, the State is a major landholder in Section 16 (City Hall ) and Section 32 (schools) in the City as well as lands to the north, east, and south of the present City limits. Since these lands in the Apache Junction area are not currently classified as suitable for urban planning, the only process by which private development may occur on these lands is through their commercial lease process. This commercial lease process is very detrimental to the long range planning in our area since leases for development can be granted which are in conflict with our General Plan and can be carried out according to very loose development guidelines established by the State Land Department with little control by the local jurisdiction. Development through the Urban Lands process, on the other hand, requires strict conformance to a General Plan as well as a detailed plan of development. Additionally, the lands may be actually sold to the developer instead of leased, an aspect which is particularly important to encourage residential development. State Lands in Sections 16 and 32, Township 1 North, Range 8 East are currently within the corporate boundaries of Apache Junction The remaining State Lands are either adjacent to, or are within 3 miles of existing corporate boundaries It is anticipated that most or all of these lands will be annexed by Apache Junction in 1985 Should the State Land Department feel that the areal extent of this application is too large to proceed with reclassi- fication in a reasonable timeframe, we would request that immediate consideration of reclassification be given to those lands located in Sections 3, 7, 8, 9, 10, 11, 14, 16, 23, 26, and 32 of Township 1 North, Range 8 East. These lands are either contiguous to developed areas, or have been leap- frogged. Reclassification is necessary to permit infill and orderly expansion of development c) This designation is being requested by the City of Apache Junction 2. No full impact study on the generation of revenues to the Trust resultant from the classification has been performed. However, the revenue potential is great due to the increasing level of development in the area and the diminishing availability of private lands 3 As can be seen on the "Existing Land Use Map - 1981," contained in the enclosed document, "Apache Junction. 2001, Apache Junction, Arizona, General Plan," these State Lands are adjacent to already developed areas and would not encourage leapfrog development patterns. 4. In addition to the State Lands being adjacent to existing development in a rapidly growing area, the completion of the Superstition Freeway to the south of the City will place great demands that these lands be put into commercial , industrial , and residential uses. Amok 5 There is no question that the State Lands covered by this application are now appropriate for planning for urban growth The City has already adopted a General Plan which includes a land use plan and policies for development of these State Lands (see Map #2) The City is very willing to cooperate with the State Land Department in refining these plans and policies so that the objectives of the State Trust and the growth policies of the City can be maximized 6 With the exception of the State Lands in Section 8, 9, 10, 11, and 12, Township 1 South, Range 8 East, these lands are within the certificated areas of private water companies which have or will be contracting for Central Arizona Project water which will provide a 100 year assured water supply to service anticipated growth and development 7 See Question #3 8 The only local planning authority other than the City of Apache Junction having jurisdiction over these lands is Pinal County The City and County are in constant coordination over growth policies, zoning decisions, and infrastructure expansions concerning these lands. ^ s 9 The maps and text of the enclosed "Apache Junction General Plan" support the consistency of this classification with the City's development policies 10 Please refer to Chapter 2 of the enclosed General Plan for a discussion of the effect of natural features on the potential development of these lands. 11 Documentation of the impact on existing leases in the area under consideration will require further study by the City and the State Land Department. Should major conflicts exist, the existing development on lands under lease could be evaluated for conformance to the City's on the County's planning policies Should the development be the most appropriate use of the land, then the lease application area could be eliminated from consideration of reclassification at this time. 12. Please refer to the enclosed General Plan. 13. The long-term interests of the Trust would certainly be best served by this classification It would generate lease rates or sale prices far in excess of the current revenue generating capacity of these lands under the current classification. It would encourage developers of large- scale, high quality projects to seriously consider these State Trust Lands as a viable location for their projects 14 The document "Apache Junction 2001, Apache Junction, Arizona, General Plan" is enclosed 15 The City of Apache Junction does not intend to pursue development planning of these lands, however, we would anticipate a high degree of coordination between the City and any preparer of development plans. 16.
