The services provided by Mr. Hoyos and his staff include the required Spanish/English translations, coordination with the County Recorder's Office for voter registration information and precinct lists, mailing labels for the publicity pamphlets and sample ballots, training of election board workers, preparation of the actual computer ballots and election program, and final processing of the ballots on election night. Also included are all of the necessary supplies for each of the polling places. Since it is impossible to determine the actual costs involved at this time, I am requesting that the agreement be approved in an amount not to exceed $5,500.00. Attached is a copy of the agreement for your review. Please note that this agreement covers both a primary and general election. kmc Approver for Agenda ate Item # Fink Rea:;ng Second Reading Public Hearing _ Old Business _ZNew Business Consent Agenda 1001 NORTH IDAHO • APACHE JUNCTION ARIZONA 85220 0190 • TELEPHONE(602)982 8002 1 INTERGOVERNMENTAL AGREEMENT PROVISION OF SERVICES BY THE 2 PINAL COUNTY RECORDER AND THE PINAL COUNTY ELECTIONS DEPARTMENT 3 4 THIS INTERGOVERNMENTAL AGREEMENT is entered into this J 15th day of January , 198 5, between PINAL COUNTY, a 6 tical subdivision of the State of Arizona, hereinafter referred 7 to as COUNTY, and the City of Apache Junction. Pinal County, 8 Arizona hereinafter re- 9 ferred to as C "TY/TOWN. 10 WHEREAS : 11 1 . A .R. S . §11-952 allows public agencies to contract 12 for services and enter into agreements ; and, 13 2 . The CITY/TOWN is required under A . R. S . § 9-231 (A) to 14 hold elections for members of its council ; and , 15 3 . The COUNTY is authorized, pursuant to A .R. S . §16-172 , 16 11-251 ( 3) and 16-511 , et seq . , to perform services concerning 17 elections ; and , 18 4 . The COUNTY and the CITY/TOWN have determined that 19 the use of the services of the Pinal County Elections Department 20 is in the public interest , and the COUNTY agreeing to provide 21 such services 22 NOW, THEREFORE, in consideration of the mutual covenants 23 and stipulations set forth herein, the parties agree as 24 follows . 25 SECTION 1 . PURPOSE : 26 The purpose of the Agreement is to secure the services 27 of the COUNTY, as enumerated in Section 2 , for the preparation 28 and conduct of the Primary and General Elections for CITY/TOWN 1 Council members, to be held March 26th and May 21st 2 , 19 85 , respectively. 3 SECTION 2 . SERVICES TO BE PERFORMED BY COUNTY : 4 The COUNTY agrees to : J A. Prepare ballot formats for the CITY/TOWN Council p 6 members to be approved by the CITY/TOWN Mayor and Council . 7 B. Provide the sample ballots with the CITY/TOWN 8 Council member positions according to precincts within the 9 boundaries of the CITY/TOWN. 10 C . Provide sample ballots for public distribution and 11 issue same through the CITY/TOWN. 12 D . Provide punch card ballots to be used in each pre- 13 cinct which will allow qualified electors to vote for the CITY/ 14 TOWN Council member positions . 15 E . Provide copies of precinct registers of qualified 16 electors for precincts contained partially or wholly within the 17 CITY/TOWN limits . Said registers shall be prepared from the 18 Voter Registration records of the County Recorder. p 19 F. Cause the precinct election boards to utilize the 20 copies of precinct registers, prepared from the records of the 21 County Recorder , for the purpose of identifying the electors 22 qualified to vote in the Primary and General Elections to be 23 held March 26th and May 21st , 19 85 . 24 G . Tally official results of the election, utilizing 25 paper ballots or electronic ballot counting equipment as 26 mutually agreed upon between CITY/TOWN and COUNTY . 27 H . Verify nomination petition( s) in the event that it 28 is lawfully challenged. The obligation arises only if the 2 1 COUNTY is so directed by the Court . 2 SECTION 3 . OBLIGATION OF CITY/TOWN: 3 The CITY/TOWN or designate thereof agrees to : 4 A. Provide nominating petitions and related information r� to the prospective candidates for the Council member positions^ 6 to be filed at the 1985 Primary and General Elections . 7 B . The CITY/TOWN Clerk shall inform the COUNTY in 8 writing of the last date on which a person could register for c) the CITY/TOWN Primary and General Elections. 10 C. Provide the Elections Department with a certification I1 of the office( s) and measures to appear on the official ballot 12 for the Primary and General Elections . 13 D. Provide a certified list of candidates in alphabeti- cal order and the order of appearance of measures to the 15 Elections Department by , 19 16 E . Provide secure site( s) for locating ballot counting 17 equipment , if said equipment is utilized, and proper electrical 18 circuitry for using said equipment . 19 F . Upon completion of the canvass, prepare and issue 20 the Certificates of Election to those candidates declared 21 elected by the CITY/7Q(WN of Apache Junction. 22 G . Pay to the COUNTY, on a reimbursable basis , all 23 costs of personnel , election materials and supplies expended by 2:1 the COUNTY pursuant to this Agreement . Said payment will be 25 made by the CITY/TOWN to the COUNTY within fourteen ( 14) days 26 after presentation by the COUNTY of demand for said payment . 27 H. Provide the CITY/TOWN limits within 28 days of the election . j SECTION 4 . MANNER OF FINANCING AND BUDGETING : 2 Each party represents that it has sufficient funds 3 available in its current fiscal year budget to discharge the 4 funding obligation imposed by this Agreement , and agrees that 5 such funds shall be solely available therefor. 6 SECTION 5. TERMINATION : 7 This Agreement shall terminate upon all matters con- 8 nected with the election being resolved, legal challenges 9 excepted, or upon written notice by either party to the other 10 within 30 days of the effective date of this Agreement . Should 11 the elections herein be challenged or questioned for any reason 12 whatsoever, then in such event , the CITY/TOWN shall be solely 13 responsible for defending , legally or otherwise, said elections . 14 SECTION 6 . INDEMNIFICATION OF COUNTY : 15 The CITY/TOWN further agrees to indemnify, to defend 16 and to hold harmless the COUNTY, a body politic , including but 17 not limited to , all of its agencies, and personnel thereof , 18 from any and all actions, causes of action, claims, demands, 19 damages , costs , expenses , attorneys fees , on account of, or in 20 any way growing out of an accident , incident or occasion which 21 might arise as a result of this Agreement , except those 22 arising from the sole negligence of the COUNTY. This provision 23 extends to legal challenges which may arise from the COUNTY ' s 24 participation in the election . 25 The CITY/TOWN specifically agrees to insure and indemni- 26 fy the COUNTY against any and all damage or loss to any of the 27 electronic ballot tallying equipment or other COUNTY property 28 which may occur due to the fault or negligence of any person j other than the COUNTY. The value of the electronic ballot 2 tallying system is hereby agreed to be the then current cost of 3 similar new equipment . Further, it is hereby agreed by and 4 between the COUNTY and the CITY/TOWN that in event it is neces- 5 sary to repair the electronic ballot tallying equipment , such 6 repair will be done under the supervision of qualified COUNTY 7 personnel , for which the CITY/TOWN agrees to reimburse the 8 COUNTY for its actual costs incurred. 9 SECTION 7 . EFFECTIVE DATE AND TERM OF AGREEMENT: j0 This Agreement shall be effective after filing same 11 with the Pinal County Recorder pursuant to A . R. S . Section 12 11-952 (F) , and shall terminate as provided in Section 5 . 13 SECTION 8 . EQUAL EMPLOYMENT OPPORTUNITY: 14 The COUNTY will comply with applicable Equal Employment j5 Opportunity Contract enactments . 16 SECTION 9 . SEVERABILITY : 17 If any provisions of this Agreement or application 18 thereof to the COUNTY, CITY/TOWN, person or circumstances is 19 held invalid, such invalidity shall not affect other provisions 20 or applications of this Agreement which can be given effect , 21 without the invalid provision or application and to this end 22 the provisions of this Agreement are declared to be severable . 23 IN WITNESS WHEREOF , the parties hereby have executed 24 this Agreement on this day of , 19 25 PINAL COUNTY BOARD OF SUPERVISORS 26 By: 27 Chairman 28 By.
