PUBLIC HEARINGS PROPOSED ORDINANCE NO 321, PZ-54-84, JONES AND BURGESS Mayor Clarke opened the hearing to the public Associate Planner Jim Nakagawa, briefed the Council on the request for rezoning from GR General Rural to CB-1 Local Business Zone of a 30,621 square feet gross, located at the northwest corner of the intersection of North Delaware Drive and West Greasewood Street. Mr. Jerry Burgess, 349 S. Saguaro, Apache Junction, requested approval of the application. Mayor Clarke asked if there was anyone who wished to speak in favor of or in opposition to the application Mr. Keith Stachar, 6301 E. Roundup, Apache Junction, questioned the necessity for this rezoning. There being no one else wishing to address the item, Mayor Clarke called upon the Associate Planner to give recommendations. Mr Nakagawa addressed the request for rezoning from GR General Rural to CB-1 Local Business Zone of a 2 6 acre parcel, located on the south side of Superstition Boulevard between Ocotillo and Palo Verde Drives. Mr. Bill Beaulieu, 306 E. Frontier Road, Apache Junction, requested that the rezoning be approved. Mayor Clarke asked if there was anyone who wished to speak in favor of or in opposition to the petition. There being no one wishing to address the Council, Mayor Clarke called upon the Associate Planner for recommendations. Mr. Nakagawa briefed the Council on the request for rezoning from GR General Rural to CB-1 Local Business Zone of a 13,843 square foot parcel, located on the southeast corner of Superstition Boulevard and Rennick Drive in Section 20 Mr. Keith Stachar, 6301 E. Roundup, Apache Junction, explained that the property would be developed with an office building, and requested approval of this application Councilman Damiano asked what was directly east of the property. Mr Stachar stated that there is a storage buildings directly east. McNulty explained that this ordinance was a solution to the problems involved with recreational vehicles, and that Councilman Taylor would like to submit a counter proposal. Councilman Taylor suggested forming a committee, consisting of one dealer, one installer, one year-around resident, two park owners and Building Official Leo Frazier, Jr., as Chairman, all to be appointed by the City Manager to bring back a proposal that will reflect all sides of the issue. Councilman Damiano asked what is necessary for elections by districts. Mr McNulty explained that there is a lot of work involved prior to presenting this to the voters, including the census. PROPOSED ORDINANCE NO. 332, ZONING REGULATIONS Mayor Clarke opened the hearing to the public. Mr. Nakagawa explained that this is a list of commercial zones and that there are two versions of this proposal; the first having five zones which is the Planning and Zoning Commission recommendation, the second being the staff recommendation. Mayor Clarke asked if there was anyone who wished to speak in favor of or in opposition to the amendments. Mr. Keith Stachar, 6301 E. Roundup, Apache Junction, addressed the item, pointing out various objections to the amendments throughout the ordinance. Councilman Baljo agreed with Mr. Stachar on some comments but disagreed with others. Mr. Chuck Jastremzski, 5722 E 10th Avenue, Apache Junction, member of the Zoning Ordinance Rewrite Committee, stated that this ordinance was considered priority due to problems caused by using only two commercial zones, rebutted comments made by Mr. Stachar. City Attorney David Alexander suggested postponing this ordinance and considering with other amendments to the Zoning Ordinance. Councilman Damiano MOVED THAT ORDINANCE NO. 332, FOR 60 DAYS, UNLESS SOONER CONSIDERED. Councilman Baljo seconded the motion. NEW BUSINESS BUREAU OF LAND MANAGEMENT, LEASE FOR TRAIL SYSTEMS Mr McNulty explained that BLM has presented this lease as a stipulation for the Trail System that is part of the City's General Plan, and requested authorization to sign this lease for a period of 25 years oomk Councilman Damiano wished to know what developments the City is required to accomplish. Mr. McNulty stated that we are responsible for developing the archaelogical sites, plus patrolling and protecting the eleven sites, and if we don't do anything for three years they can take the leases back. Councilman Damiano MOVED THAT AUTHORIZATION BE GIVEN TO THE CITY MANAGER TO SIGN THE LEASE FOR THE TRAIL SYSTEM, FOR A PERIOD OF 25 YEARS. Councilman Baljo seconded the motion. Mr. McNulty added that once BLM is convinced that we have developed the site substantially, the City can apply for patents on the land. VOTE: Unanimous The motion carried REQUEST FOR TIME EXTENSION TO CLEAN UP PROPERTY City Clerk Kathleen Connelly stated that this is a request submitted by Mr. Len Harrold for a 90 day extension to bring his property into compliance with Article 9-2 of the City Code Mayor Clarke explained that Mr. Harrold has been very ill and in the hospital. Councilman Taylor MOVED THAT MR. LEN /► HARROLD, BE GRANTED A TIME EXTENSION TO BRING HIS PROPERTY INTO COMPLIANCE WITH ARTICLE 9-2, OF 60 DAYS, WHICH WILL EXPIRE ON APRIL 7, 1985. With the development of a commercial business, it became evident that the current 66-foot right-of-way could impose hardships on businesses, and cause governmental agencies to incur additional costs when additional rights-of-way are acquired to meet increased transportation needs. A meeting with ADOT officials revealed that the State has no current plan for future transportation needs in this vicinity, and that they have no mechanism to control development outside of the present right-of-way limits. Therefore, it becomes incumbent upon local government to take the initiative in order to plan for orderly growth and development, and to minimize hardships on businesses, as well as future .mu, costs to the public. In this regard, Resolution No. 84-70 provides for an expanded right-of-way that would be comparable to our section-line (mile) roadways, and would require dedication and improvements consistent with current City policy. Old Business PUBLIC HEARING AND CONSIDERATION New Business Consent Agendj Project Description Rezoning case No. PZ-52-84, Proposed Ordinance No. 319, is a request by the applicants Al and Norma Bellucci and Ed and Genevieve Grundstrom through Bill Beaulieu to rezone their property from GR General Rural to CR-5 Multiple Residence. The site is a vacant 5 acre parcel located on the north side of Roundup Street between Gold and Valley Drives in Section 17. it is designated Medium/High Density Opportunity on the General Plan. Surrounding land uses include mobile homes and vacant land. Attached are copies of the protest petitions filed against this case. They represent 50% of the area on the north; 100% on the west; 58% on the south; and 86% on the east side of the property within 150 feet of ....'` the rezoning area. Also attached is a letter dated November 19, 1984, from Mr. Bellucci identifying some of his reasons for requesting the proposed zone. Planning Department Comments and Recommendations Potentially, rezoning to CR-5 would allow 87 dwelling units (based on a net lot size of 4 acres) which could result in a very high density of approximately fifty (50) persons per acre. A properly executed condominium or apartment complex could be an asset to the neighborhood, while one guided only by our development standards and minimum zoning requirements could create an undesirable neighborhood situation. If approval is granted, staff would request the stipulation that the east, west, and south thirty-three feet (33' ) of the subject property be dedicated for public roadway and associated purposes. I would like to know the numberof units we would be I allowed under the classification as suggested in your staff report. I think size and quality is important as well as the number of bedrooms in each unit. The number of bedroom are going to dictate the number of people living in the project. The density you suggest could be had by going for a mobile home development on seperate lots. I am in agreement with your findings about the density as the area now exists, but it won't be that way forever. That is why general plans are developed. The central core of a city should have the highest density for that allows the tenants a lot more options. Walking to downtown, riding public transportation, walking to work, walking to recreation areas, and being able to attend public functions without having to get in their cars and drive. I am sure the general plan was developed with that in mind. In order for it to become a reality those hard decisions have to be made now. We plan to attend the meeting of December 11, 1984 and present our /l case, but would like to hear from you explaining the various options available to us. Arthur Dwight Pierce, former Board President, submitted his resignation December 26, 1984, after receiving a job offer in Dallas, Texas, which required his immediate relocation to that city. At the first meeting of the Library Board since the resignation was submitted, on February 5, 1985, the names of two individuals were put forward as possible candidates for filling the vacancy. Mr. Charles Russell recommended the appointment of Gary Doak, while Mrs. Hazel Eldridge recommended the name of Hazel Jones. Both Board members are aware that their candidates must submit completed talent bank applications, if they had not already done so, to be considered by the City Council for appointment. No further names were put forward by the Board members. If at all possible, the Library Board would like to have the Council's appointment made on February 19, 1985, so that the newly selected Board member may attend the next regularly scheduled meeting of the Library Board on March 5, 1985. The district regulations are outlined in the attached table, "Summary of Proposed Commercial District Regulations." These proposed regulations are a result of the work performed by the Zoning Ordinance Rewrite Committee, drafted into ordinance form by the Planning Department staff and incorpo- rating the amendments of the Planning and Zoning Commission as a result of their October 30, 1984 work session. Since there has been questions raised by citizens concerning the proposed setback requirements , I have attached a comparison chart, "Commercial Zoning District Setback Requirements of Cities in Phoenix Metro Area Leading in Commercial Activity." PLANNING DEPARTMENT STAFF RECOMMENDATIONS The Zoning Ordinance Rewrite Committee has done a tremendous job drafting regulations which they believe will help achieve the goal of a well-planned community. However, there are a few items I believe may prove unworkable, and offer the following recommendations: 1. I have attached the table, "Summary of Proposec Commercial District Regulations - Staff Recommended Amendments" to indicate how this restructuring would work. I have also drafted an alternative ordinance which combines the two zones for your consideration. Included in this alternative is also the elimination of references to utilities (74 as permitted as conditional uses, since they are already dealt with in Section 2303 of the Zoning Ordinance. This recommendation is based on a) difficulty of enforcement, and b) the fairness to the business owners in competing with establishments which are permitted to operate with unlim-;ed hours. A .:trenrthen,n7, of our City Code provisions on "P`wce and Quiet" may be a more equitable solution. 2. Setbacks may appear somewhat severe. However, unlike many other communities , we have not instituted provisions for insuring proper buffering and compatibility of adjacent uses through site plan reviews or landscaping. 3. Limiting floor area per business to 4 ,000 square feet in the C-3 zone, may be slightly over-restrictive, but a floor area restriction does help keep a business "local " in nature. 4 . I do agree with the Planning and Zoning Commission that an attempt should be made to convert properties presently zoned CB-1 and CB-2 to the new districts at some time in the future. However, this is a process which will take a major study to inventory existing development and uses and building permits issued. It is a process which should be instituted with the full cooperation and awareness of property owners to insure that existing rights are maintained and expanded, but not di- minished. Since Ordinance No. 332 does contain provisions for prohibiting rezonings to the old CB-1 and CB-2 districts, we have at least a temporary measure. By limiting the number of uses and intensity of development through restricting floor area, the surrounding residential districts shall he protected from excessive levels of noise or other nuisances. Section 34.0102 PERMITTED PRINCIPLE USES 1. Residential Use Types One single-family dwelling, conventional construction, per lot (permitted in addition to permitted civic or commercial uses on a lot). 2. I am pleased to report that the Arizona Outdoor Recreation Coordinating Commission and the National Park Service have recently approved funding in the amount of $102,500.00. Only 16 projects were funded out of the 56 applications submitted state- wide. Apache Junction's application and project received a ranking of fifth with an allocation of approximately 10% of the funds available to this state. Rusty Roberts represented Outdoor Systems and commented on Mr Jastrzemski's comments on billboards He said that outdoor structures are needed in the community and that more work is needed on the Ordinance 28 Chairman asked for Planning Department comments 29. Mr Newcomer stated that the abatement schedule is being looked at by the City Attorney He gave his recommendations on amendments to various sections and requested that the hearing be continued before making any recommendation to the City Council 30 Mr. Taylor said there were a few items to clear up and that an abeyance for permits may be passed by the City Council. 31 Mr Vehon commented that he would not like to make a recommendation tonite. He said an informal meeting should be held to make changes before making any recommendation to the Council 32. Mr Hoaglin said that a moratorium was discussed at the work t\ session and felt that it must be done due to the track record of the sign companies. 33 Chairman asked if anyone wished to speak in rebuttal 34. Herbert Moulton referred to sign industry and sign people, saying that the sign industry manufactures a product He felt the fault should lie with the business community for accepting those types of signs 35 Jerry Burgess said that a sign ordinance is needed He did not support a moratorium as the sign painters would not be able to make a living 36 Steve Leach said he was a sign painter and that a place like Scottsdale has more money to pay out for signs. He saw nothing wrong with billboards and said that signs have to be at least eye-level. 37 Mr Jastrzemski stated that the Committee did what they thought the community wanted and that a moratorium would be a mistake. He added that the Ordinance is liveable with the amendments recommended by staff. 38.
