FEBRUARY 16, 1985
The special meeting of the City Council of the City of Apache Junction,
Arizona, was held on February 16, 1985, at the Apache Junction City Council
Chambers pursuant to the notice required by law
CALL TO ORDER
Mayor Clarke called the meeting to order at 10 00 a m.

DISCUSSION ON HOME RULE OPTION
Presentations were made to the
City Council by Department of Public Safety, department of Public Works,
and Community Services on departmental needs
Superintendent of Community
Services Jeff Bell, presented the City Council with a draft copy of a
five year plan for use of parks and open space and proposed park
improvements. He explained the plan would be reviewed by the Parks and
01141 Recreation Commission later in the month and would be presented in final
form to the Council in early March
Chief McDaniel explained the
various needs of the Department of Public Safety and the additional
service and protection that would be supplied by meeting these needs.
He pointed out the impact that the acquisition of the Bureau of Land
Managements parks land would have on his department.
Director of Public Works Rich
Broman, explained the need for street maintenance programs in addition to
new paving and pointed out that the maintenance of city streets was being
handled by a small crew with limited equipment.
City Clerk Kathleen Connelly
presented the Council with a memorandum auttining the needs of the City
Clerk's office
Mayor Clarke suggested that the
Council consider installation of fire hydrants, the street department and
street equipment, public safety, and parks and recreation as priorities
in the use of possible funding if the home rule option is approved by
the voters
Mayor Clarke asked that direction
be given the City Manager to work with the Chamber of Commerce on a newpaper
and for use of home rule funds He pointed out that city funds would not be
used for the ad

AWARDS, PRESENTATIONS AND COMMUNICATIONS
City Manager Michael J. McNulty introduced representatives from
the Bureau of Land Management to present to the City leases on the
acreage for the trail systems.
Mr Art Tower, Area Manager for Phoenix Resource Area, BLM,
presented the lease to the Council for 1620 acres
Mr. John Granillo, Jr., President, Apache Junction Youth Soccer
League, presented a plaque to the Community Services Department for
participation in a successful season.
CITY MANAGER'S REPORT
Mr McNulty reported on the six-month financial report for the
City, and stated that Maricopa County has been requested to conduct a
study of the intersections of Meridian and Superstition, and Meridian
and Broadway for the purposes of determining whether traffic signals
will be warranted, and they have reported that these will be installed
with the City's participation.

PROPOSED ORDINANCE NO. 319, PZ-52-84,

Vice Mayor Eidson opened the
hearing to the public.

Newcomer, briefed the Council on the request for rezoning from GR
General Rural to CR-5 Multiple Residence of a 5 acre parcel, located on
the north side of Roundup Street between Gold and Valley Drives in
Section 17, and stated that there have been protest petitions filed
making it necessary for a 3/4 vote of the City Council for approval of
the rezoning application.
Mr Al Bellucci, 2386 N. Valley
Rd., Apache Junction, stated that this is designated as Medium/High
density on the General Plan and requested approval of the application
Mr. Ed Grundstrom, 7665 Redwood
Blvd., Novado, California, requested approval and argued the benefits
of the rezoning.
Mr. Bill Beaulieu, 306 E.
Frontier, Apache Junction, designated representative for the
applicants, pointed out reasons for approval
Mr. Kenneth Ragan, 2386 N.
Valley Rd , Apache Junction, spoke in favor of the petition, pointing
out advantages.
Mr Allan Price, 1328 N. Gold
Drive, Apache Junction, resident of 13 years, addressed the item with
opposition.
Ms Lillian Castro, 1381 W.
Roundup, Apache Junction, spoke in opposition to the application.
Councilman Damiano asked if a
compromise of CR-4/PD was proposed, would the protesters agree.
Ms Castro stated that they
would not.
Ms Angela Borlin, 1428 W
Greasewood, Apache Junction, spoke in opposition to the rezoning.
Councilman Baljo addressed the
item with particular regard to the General Plan being only a guide for
zoning.
Mr. Newcomer stated that the
Planning staff recommended rezoning of this property to a lower
density, and the Planning and Zoning Commission recommended denial of
the application.
Mr. Ragan again addressed the
item asking why the General Plan was adopted and not adhered to

Vice Mayor Eidson opened the
hearing to the public.
City Clerk Kathleen Connelly
explained that this ordinance is to bring the language of the City Code
into compliance with the contract for the City Manager, and has been
submitted with the emergency clause, and must be adopted in order for
the City Manager's contract to be valid
Vice Mayor Eidson asked if
there was anyone who wished to speak in favor of or in opposition to
the issue. There being no one wishing to address the Council, Vice
Mayor Eidson closed the hearing to the public.
Councilman Shanks MOVED THAT

ADDITIONAL ENGINEERING AND DESIGN
COST, PROSPECTOR PARK
Superintendent of Community
Services, Jeff Bell, explained that additional funds received from the
LWFC grant program will allow expansion of Prospector Park, and
requested approval of additional design, engineering and construction
management cost.
Councilman Taylor MOVED THAT
FUNDS IN THE AMOUNT OF $9,000.00 BE GIVEN TO CARTER ASSOCIATES OF
PHOENIX, FOR THE ADDITIONAL DESIGN, ENGINEERING AND CONSTRUCTION
MANAGEMENT COST, FOR PROSPECTOR PARK.

NEW BUSINESS
CONTRACT FOR CITY MANAGER
) City Attorney David Alexander
explained that this is a proposed one-year contract for the City
Manager with provisions for compensatory time, vacation time payment,
and other types of severance pay.

CONTRACT FOR THE CITY MANAGER IN THE AMOUNT OF $49,500.00 BE APPROVED
AS PRESENTED.

ESTABLISHING COMMERCIAL ZONING
DISTRICT REGULATIONS (With the
Emergency Clause)
Mr McNulty stated that the
public hearing was held at the previous Council meeting, and was post-
poned for 60 days unless earlier considered, and since the Zoning
Ordinance will be declared public record, it is necessary to act on the
recommendations of this ordinance, and recommended the staff recommen-
dation combined with Councilman Baljo's suggestion of a 6 foot masonry
wall for C-1 zone as in the other commercial zones
Councilman Baljo suggested that
an amendment also be proposed pertaining to set-backs, striking 35'
requirement and leave it at 25'

PROPOSED RESOLUTION NO. 85-05,
DECLARING PROPOSED APACHE JUNCTION
ZONING ORDINANCE AND ZONING MAP AS
PUBLIC RECORD
Mr McNulty stated that this
resolution is necessary due to action contemplated in March, adopting
the entire zoning ordinance as public record.
Vice Mayor Eidson announced
that the Planning and Zoning Commission will hold a hearing on March 6,
1985, on the readoption of the entire ordinance including recent
amendments, and the City Council will consider the readoption of the
same on Thursday, March 7, 1985, both to be held in the City Council
Chambers
Mr. McNulty pointed out that
the only changes being proposed are the commercial zoning amendments.
Councilman Baljo MOVED THAT
RESOLUTION NO 85-05, A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE
CITY OF APACHE JUNCTION, PINAL AND MARICOPA COUNTIES, ARIZONA,
DECLARING AS A PUBLIC RECORD THAT CERTAIN DOCUMENT FILED WITH THE CITY
CLERK AND ENTITLED PROPOSED ORDINANCE NO. 350 (PROPOSED APACHE
JUNCTION, ARIZONA, ZONING ORDINANCE, AND THE PROPOSED ZONING DISTRICT
MAP, CITY OF APACHE JUNCTION, ARIZONA), WHICH WILL BE ADDED TO THE CODE
OF THE CITY OF APACHE JUNCTION, ARIZONA, VOLUME II, LAND DEVELOPMENT

meeting.

SUBJECT: PROPOSED RESOLUTION NO. 85-06---ESTABLISHING DATE OF
PRIMARY ELECTION, POLLING PLACES AND PRECINCTS, HOURS
FOR VOTING, ELECTION OFFICIALS AND METHOD OF VOTE
In accordance with Arizona Revised Statutes, Title 16, the City Council
must adopt, by resolution, certain rules and regulations pertaining to
the conduct of the primary election. Among the regulations that must
be stipulated are the actual date of the election, the designation of
voting precincts and polling places, the hours that the polls will be
open, designation of the election board officials, rate of pay, and
the method of voting.
I have combined all of these legal requirements in Resolution No. 85-06.
This resolution has been written in both Spanish and English in order to
comply with the Federal Voting Rights Act.
This resolution has been written with the emergency clause so that it
becomes operative immediately upon adoption.
Attached is a map of the polling places to be used for the primary election.

A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF
APACHE JUNCTION, PINAL AND MARICOPA COUNTIES, ARIZONA,
AUTHORIZING A PRIMARY ELECTION TO BE HELD ON MARCH 26, 1985,
ESTABLISHING POLLING PLACES AND VOTING DISTRICTS, PROVIDING
FOR THE RECORDATION OF THE ELECTORS' CHOICE, PROVIDING FOR
ELECTION OFFICIALS, AND DECLARING AN EMERGENCY

Election for the City of Apache Junction; and
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF
THE CITY OF APACHE JUNCTION, PINAL AND MARICOPA COUNTIES, ARIZONA, AS FOLLOWS
SECTION I DESIGNATION OF ELECTION DATE
That the Primary Election for the City of Apache Junction be held and conducted
on Tuesday, March 26, 1985
SECTION II DESIGNATION OF POLLING PLACES AND VOTING DISTRICTS
That Pinal and Maricopa County precincts be used and that the voters residing
in Pinal County Precincts 22A and 22 B and Maricopa County Precinct Apache
shall vote at Superstition Mountain Elementary School, Ironwood Drive and
Broadway Avenue, Apache Junction, Pinal County, Arizona, and that voters
residing in Pinal County Precincts 22C and 22F shall vote at Apache Junction
Junior High School, Southern Avenue and San Marcos Drive, Apache Junction,
Pinal County, Arizona; and that voters residing in Pinal County Precincts
22D and 22E shall vote at Community Christian Church, Superstition Boulevard
and Valley Road, Apache Junction, Pinal County, Arizona.
The polls shall be open on said date of the Primary Election from 6 00 a m
until 7 00 p m
SECTION III DESIGNATION OF ELECTION OFFICIALS
The following officers will be appointed to conduct the Primary Election on
March 26, 1985, for Pinal County Precincts 22A and 22B and Maricopa Precinct
Apache One Inspector, Two Judges, Two Clerks, One Marshal, One Alternate

$4 00 per hour or not less than $30.00 per day, whichever is greater.

On February 6, 1985, we received confirmation from the Maricopa County Highway
Department that a traffic study had been made which indicated that traffic
signalization is warranted at the intersection of Meridian Drive and Superstition
Boulevard. It is anticipated that Maricopa County will be providing the City with
intergovernmental agreements for the installation of traffic signals at this
location; however, as the study also warranted 4-way stop signs, it is recommended
that said traffic control devices be installed during the interim.
With the City Council ' s affirmative action in these regards, the Maricopa County
Highway Department will be contacted and the 4-way stop signs installed accordingly.

SECTION I IN GENERAL /IN
It is in the public interest to insure safe, effective and efficient traffic
flow along public rights-of-way within the City of Apache Junction, Arizona,
and whereas an engineering study has determined that appropriate warrants are
met for the establishment of a four-way stop at the intersection of Supersti-
tion Boulevard (University Drive) and Meridian Drive, the Director of Public
Works and the Director of Public Safety are hereby empowered and directed to
initiate appropriate action to install traffic control devices
SECTION II REPEALING ANY CONFLICTING PROVISIONS
All ordinances and parts of ordinances in conflict with the provisions of this
Ordinance, or any part of the code adopted herein by reference, are hereby
repealed.
SECTION III PROVIDING FOR SEVERABILITY
If any section, sub-section, sentence, phrase, clause, or portion of this
Ordinance, or any part of the code adopted herein by reference, is for any
reason held to be invalid or unconstitutional by the decision of any court
of competent jurisdiction, such decision shall not affect the validity of the
remaining portions thereof
SECTION IV PENALTY CLAUSE
Any person found guilty of violating any provision of this Ordinance shall
be punished by a fine not to exceed $1,000.00, or imprisonment for a period
not to exceed six (6) months, or by both such fine and imprisonment Each
day that a violation continues shall be a separate offense punishable as
hereinabove described

OF TRUSTEES
Alice Polomskey has resigned from the Library Board of Trustees.
With the resignation of Dwight Pierce accepted at the February 19, 1985
Council meeting, we now have two vacancies on the Library Board.
As far as I know there is one talent bank application for
the Library Board. This is from Gary Doak, who has been recommended
by Mr. Charles Russell, a present Library Board member. A copy
of that talent bank is attached. I will be advertising the vacancy
through a news release and will request interested applicants to
fill out a talent bank form. Any responses I receive will be
presented to the Library Board of Trustees for their recommendation
at the April 2, 1985 regular Library Board meeting.

The agenda of March 5th contains two requests for grants of funds
from two local agencies, which brings it to three this year. (The
food bank was the first. )
Since there are a number of other agencies in the community that
will be encouraged to request funds from the City, I believe that
it would be in the best interest of the City for the Council to
'~ enter into an agreement with the Community Foundation to act as
the City's agent in social service needs of the City.
As to the two agencies requests, the budget balance is $5000.00.
Since I do not know what either group is requesting, I am unable
to recommend a specific amount.

SUBJECT: APPOINTMENT OF ELECTION OFFICIALS Consent Agenda
Arizona Revised Statutes 16-531 requires that not less than 20 days prior to
an election, the city council take action to appoint members of the election
board. Where possible and when there are a sufficient number of applicants
for a particular precinct, the board members should be appointed to serve
in their respective precincts. All board members are required to complete
a training session and be certified prior to election day.
I have reviewed all of the talent bank applications on file with the city
and all potential applicants have been contacted. Many of the workers from
previous years are unable to serve because of previous commitments, family
illness, absence from the city on election day, etc. At this time, my
final recommendations are incomplete. These recommendations will be
presented to the council at the Monday night work session.
Because of the lack of applicants in certain precincts, it will be necessary
to appoint individuals to work outside of their precints. Every measure
will be taken to insure that these individuals are not inconvenienced as
far as having to travel a great distance to the polls.
Due to the large number of registered voters in the combined Precincts 22C
and 22F, I am recommending that the council appoint two separate boards to
process voters at the junior high school . This will enable the voting process
to go much more quickly. This board will be able to use the same marshal
and inspector.
Due to the fact that candidates will appear on the ballot for the primary
election, I strongly recommend that any member of the council , particularly
those running for office, refrain from making changes in my recommendations.
If there is some reason why an individual may be better suited to serve on
the election board, please discuss it with me.

SUBJECT: REQUEST FOR EXTENSION TO CLEAN PROPERTY
In accordance with Article 9-2 of the City Code, Mrs. Dorothy Thaxton has
requested additional time to bring her property into compliance with city
regulations pertaining to litter and junk vehicles.
Mrs. Thaxton informed me immediately upon receiving the notification of
violation that there would possibly be a need for additional time due to
the fact that she would have to request vehicle titles in order to remove
them from her property. Her letter indicates that this is the reason
why she needs more time.
Since it has taken as long as three months in previous cases to receive
�► a title through the Division of Motor Vehicles, the Council may wish to
grant an extension of 60 or 90 days.
Pictures of the property in question will be available at the work session
if the Council wishes to review the file.

Dear Mr. & Mrs. Thaxton:
The City of Apache Junction has recently received a complaint concerning litter,
debris and overgrown weeds on property located at the above captioned address.
According to the Pinal County Recorder's Office, you are the owner of record of
this particular property.
Article 9-2 of the City Code of Apache Junction requires that the "owner or person
in control of any private property shall at all times maintain the premises free
of litter " In accoraance with Section 9-2-5 of the City Code, you are hereby
requested to take whatever steps are necessary to remove all weeds, debris aria
litter from the above indicated property within thirty (30) days from receipt of
this notice Unless steps are taken by yourself to remove the violations, the
City of Apache Junction will proceed to perform the necessary work at a cost to
you to be estimated at $62.38 per hour for a minimum of four (4) hours.
If you wish to appeal this notice, you must do so, in writing, to the City Council /�
within thirty (30) days from the receipt of this notice and prior to the date set ► 1
for compliance.
I have enclosed, for your reference, a copy of Article 9-2 of the Apache Junction
City Code as well as photocopies of pictures taken of the property in question.

Requests for Bids for the improvements to Phase III-A was advertised and posted
in accordance with City policy. As the bid opening was scheduled for 2:00 p.m.
on February 25, 1985, we cannot provide advance information as to the number
of contractors submitting bids or their cost proposals at this time.
Phase III-A projects are as listed:
PW-84-26 Goldfield Road, U.S 60 to Broadway Avenue 1 mile
PW-84-27 Goldfield Road, Broadway to Superstition Blvd. 1 mile

HURF BONDING ROAD PROJECT - PHASE III-A
Attached for your information is a bid comparison list of the contractors
submitting bids for Phase III-A.
As National Applicators indicated certain exceptions in their proposal , a call
was made to discuss these items which resulted in the understanding that the
bid submitted is for a total job, complete. Furthermore, references as indicated
in the bid proposal were called as follows:
City of Casa Grande, Arizona
Mr. Tom Long - In general , was satisfied with contractor' s work and would
hire again.
Maricopa County Highway Department
Mr. Tom Hirsch - Had good and *poor experiences with the contractor.
* Poor experiences resulted from an inexperienced County
inspector and an inexperienced construction superintendent.
Statement was made that the County would award another low-
bid project to this contractor.
City of Coolidge, Arizona
Ms. Vicki Culp - Indicated a $300,000 airport project was performed by this
company. The superintendent was easy to work with and performed
some work beyond the limits of the contract. Statement was
made that they probably would award another low-bid project
to this contractor.
