PERMIT PROCEDURES:
Whenever any person or group desires to reserve any portion of a City facility/equipment for an activity, a permit shall
be obtained from the Parks and Recreation Department Contact us at 480-983-2181. The Director of Parks and
Recreation shall interpret this policy and may act in any case not specifically covered by the policy.
• All lights/ramada rentals must be reserved by 3-30 p m.the day of the reservation (or the last business day prior
to the reservation).
• All reservations requiring a special service like- ball field preparation,equipment delivery,etc must be reserved
two days in advance (i.e. if someone comes in at 4 30 p.m on Monday,they can not get a ball field preparation
until Wednesday)
• Ball fields are dragged daily and bases are always out for first come/first serve use
• Multi-Generational reservations for public use can be made at any time for normal center hours Due to staff
scheduling, MGC reservations scheduled during center off hours must be received a minimum of four weeks
prior to date of event Reservations may be taken inside the four-week minimum only with prior approval from
the Multi-Generational Facility Manager.
Special Event Use: (i e tournaments,contests,demonstrations, rodeos, carnivals,festivals, etc.) It is recommended
that requests for Special Events at City facilities be initiated at least 60 days in advance

When the use of a facility has been approved, notification to the applicant from the facility coordinator shall confirm the
date, hours of use,type of activity, size of group, associated fee(s), adequate insurance coverage and additional services
required
All permits shall be revocable for cause by the Director of Parks and Recreation upon the finding of a violation of these
policies, other city ordinances or state statutes.
CANCELLATIONS & REFUNDS:
Cancellations due to unforeseen weather conditions that make it impossible to utilize the facility will be offered a credit
or transfer(refunds will be minus 10%or$5 00 whichever is greater and must be made within 3 business days with the
facilities office If a facility is cancelled or moved for any other reason,a request for credit/transfer/refund must be
made prior to the facility rental date in order to receive a partial refund or full credit/transfer.
PROHIBITED USES.
Activities which have no immediate relationship to the general purpose of the recreation program are prohibited from
using facilities, unless approved by the City Council This category of use includes but is not limited to:
1. Commercial activities*
2 Sales promotions
3 Flea Markets or Swap Meets
4 Religious services**
*Commercial activity associated with and supportive to a not-for-profit event may be permitted. Examples include, but
are not limited to,the following types of permissible activities•
• Food vendors catering a company picnic
• Stock contractor providing stock for a rodeo
• Carnival company providing rides for a festival
• Commercial vendors as part of a festival
• Entertainers & performers at a festival
• Inflatables/bounce house providers at a child's birthday party
Event sponsors will be required to follow the guidelines for obtaining appropriate business licenses for each vendor
according to the policies and practices of the City of AJ Business License office (480-474-5070)
**These events are permitted for special uses such as Sunrise Services,or for temporary hardships experienced by local
churches
PRIORITIZED USES:
The Apache Junction Parks and Recreation Department has priority use of all facilities and recreation areas When
facilities are not in use for Parks and Recreation sponsored activities,they shall be available on a permit/no fee basis to
the following
1 All other City departments
2 City Council approved special events (Considered annually during budget process )
3 Apache Junction Fire District(per IGA)
4. Apache Junction Unified School District (per IGA)
Local Youth Serving Agency Guidelines
Groups that meet the following criteria will have priority use with those above,on a reduced fee basis(25%of regular
public rates)
1. Youth Serving Agency is a 501c3 non-profit
2. Agency is governed by a local, unpaid volunteer board and unpaid staff
3 Participant members are made up of a majority of City of Apache Junction residents
4 Agency participation is open to the public and not"by invitation only" or limited by any means other than the
natural make up of the league
When facilities are not in use by the Parks and Recreation Department,or the groups listed above,they will be made
available to other Apache Junction residents,groups or organizations on a permit/fee basis. Groups or organizations
from outside the Apache Junction area are discouraged from using facilities, unless the activity is open to Apache
Junction residents, promotes the welfare of the community, and a portion of the proceeds benefit a local non-profit
entity
INSURANCE AND INDEMNIFICATION:
Individuals,groups or organizations using any city park or recreation facility shall indemnify the City and its employees
for any and all damage to the facility by any person or persons attending the affair, and all liability and damages to any
person for injuries, including death Adequate insurance, listing the City of Apache Junction as an "Additional Insured",
shall be provided by each organization using any city park or recreation facility The City of Apache Junction will
determine the amount of liability necessary. Responsibility for loss, breakage or need for repair of any furniture,
equipment or facility, shall be upon the individual signing the permit.
USE BY NON-PROFIT GROUPS/FUNDRAISING:
Non-profit organizations using any facility/equipment for charitable,fundraising activities shall provide the Parks and
Recreation Department with a financial report on projection of monies expended and the disposition of receipts. No
permit for charitable fundraising events shall be issued without the written approval of the Director of Parks and
Recreation Regardless of user category designation,all fundraising activities will be required to pay facility/equipment
use fees,and provide reconciliation records.
FACILITY USE RULES OF CONDUCT:
1. All activities shall be under competent,adult supervision with the individual or organization reserving the
facility/equipment assuming full responsibility for any damage to the facility or associated equipment. A
responsible party shall be in attendance throughout the entire activity or event
2. No apparatus,furniture or equipment shall be moved into a recreation facility unless special permission is
granted in advance and so stated in the permit Such apparatus, furniture or equipment shall be removed
promptly following the activity or event.
3. All local, county, state, and federal noise control, dust control, and light pollution regulations must be adhered
to at all times Amplified music will only be allowed in City designated areas of the park
4 Building facilities and recreational areas shall be vacated by time posted at the facility unless permission is
otherwise granted specifically in the permit It shall be the responsibility of the permit holder to assure that this
policy is properly administered Activities shall be concluded in time for proper clean up.
5. The use of tobacco or alcohol in buildings is prohibited. Tobacco and alcohol are strictly prohibited at facilities
located on school property. Smoking in outdoor recreational areas shall be carefully controlled Malt beverage
permits will only be issued at designated facilities in the City If problems occur during an event, Permittee(s)
will be given a written warning. If issues continue,citation will be issued to the violator(s)and the Malt
Beverage Permit will be pulled
6. The total number of people admitted for any usage shall not exceed the capacity of the facility involved as
determined by the Director of Parks and Recreation or the Fire District.
7. A minimum of one (1) Parks and Recreation Department employee shall be on duty at all times when Parks and
Recreation facilities are scheduled for use This employee shall exercise authority over the group and its activity
should a violation of facility use regulations be observed Said employee shall be responsible to and paid by the
City and no groups using facilities shall make any payments to such employee.
8. No material, banner, or signage of any kind shall be placed or attached to any part of the facility or area without
written permission from the Director of Parks and Recreation
9 All functions shall be confined to the specific part or area of the facility assigned to the Permittee
10. The City reserves the right to provide concessions for all activities held at ballpark facilities Concession sales by
users will be considered on a case-by-case basis
11 Some uses may require additional control personnel of the city, as deemed necessary by the Director of Parks
and Recreation. Additional personnel shall be paid for by the Permittee.
12 All city ordinances, rules and regulations shall be observed while using any park or recreation facility The
Permittee shall be held responsible for participants conduct and for any loss or damage resulting from any such
violation of these rules

allowed at Prospector Park, in limited areas. Groups sized 7 or more people that would like to consume malted
beverages at Prospector Park must obtain a Malt Beverage permit and must keep their permit on site at all
times.

agreed that the prevailing Party in such action shall recover all costs including
reasonable attorneys fees to be determined by the court in such action
13. BINDING EFFECT/ASSIGNMENT: The obligations and rights created
in this Agreement are binding upon and shall inure to the benefit of the Parties
and their successors, assigns and legal representatives. Neither Party may
assign its rights under this Agreement without the prior written approval of the
other Party. Such successor or assignee shall assume, in writing, all duties and
obligations hereunder of the prior Party and shall further agree to be bound by
and to fully perform the terms of this Agreement.
14. ENTIRE AGREEMENT: This Agreement and any attachments
represent the entire Agreement between the Parties and supersede all prior
negotiations, representations or agreements, either express or implied, written
or oral. It is mutually understood and agreed that no alteration or variation of the
terms and conditions of this Agreement shall be valid unless made in writing and
signed by the Parties. Written and signed amendments shall automatically
become part of the Agreement, and shall supersede any inconsistent provision
therein; provided, however, that any apparent inconsistency shall be resolved, if
possible, by construing the provisions as mutually complementary and
supplementary. Notwithstanding the above, items deemed as "minor
amendments" under this IGA must be such things that are administrative,
ministerial or process in nature, not policy-related that typically require City
Council/District Board approval. If a minor amendment is needed, a letter
agreement signed by the City Manager and District Superintendent shall be
executed and provided to their respective governing bodies. No official action is
required by the City Council or District Board to accept minor amendments.
15. AVAILABILITY OF FUNDS: The Parties' financial obligations under
this Agreement are contingent upon the availability of budgeted and/or allocated
funds from which payment for services, programs and equipment common to the
Parties can be made. There is no legal liability on the part of the Parties to make
any payment or payments until funds are available for the services, programs and
equipment under this Agreement and until each Party receives from each other
notice of such availability, to be confirmed in writing by the Parties'
representatives.
16. CONFLICT OF INTEREST: This Agreement is subject to, and may be
terminated by City in accordance with the provisions of A.R.S. § 38-511.

date first set forth above.

11. SEVERABILITY: The Parties each believe that the execution, delivery
and performance of this Agreement are in compliance with all applicable laws.
However, in the unlikely event that any provision of this Agreement is declared
void or unenforceable (or is construed as requiring City to do any act in violation
of any applicable laws, including any constitutional provision, law, regulation, or
city code), such provision shall be deemed severed from this Agreement and this
Agreement shall otherwise remain in full force and effect; provided that this
Agreement shall retroactively be deemed reformed to the extent reasonably
possible in such a manner so that the reformed agreement (and any related
agreements effective as of the same date) provide essentially the same rights and
benefits (economic and otherwise) to the Parties as if such severance and
reformation were not required. Unless prohibited by applicable laws, the Parties
further shall perform all acts and execute, acknowledge and/or deliver all
amendments, instruments and consents necessary to accomplish and to give
effect to the purposes of this Agreement, as reformed.
12. GOVERNING LAW, VENUE AND ATTORNEY FEES: The terms and
conditions of this Agreement shall be governed by and interpreted in accordance
with the laws of the State of Arizona. Any action at law or in equity brought by
either Party for the purpose of enforcing a right or rights provided for in this
Agreement shall be tried in a court of competent jurisdiction in Pinal County,
Arizona. The Parties hereby waive all provisions of law providing for a change of
venue in such proceeding to any other county. In the event either Party shall bring
suit to enforce any term of this Agreement or to recover any damages for and on
account of the breach of any term or condition in this Agreement, it is mutually

agreements, instruments or judgments or decrees to which
City is a party or is otherwise subject.
E. The City has been assisted by counsel of its own choosing in
connection with the preparation and execution of this
Agreement.
8. DISTRICT REPRESENTATIONS: District represents and warrants to
City that:
A. District has the full right, power and authorization to enter into
and perform this Agreement and of the obligations and
undertakings of District under this Agreement, and the
execution, delivery and performance of this Agreement by
District has been duly authorized and agreed to in compliance
with the organizational documents of District.
B. All consents and approvals necessary to the execution,
delivery and performance of this Agreement have been
obtained, and no further action needs to be taken in
connection with such execution, delivery and performance.
C. District will execute and acknowledge when appropriate all
documents and instruments and take all actions necessary to
implement, evidence and enforce this Agreement.
D. District has been assisted by counsel of its own choosing in
connection with the preparation and execution of this
Agreement.
9. TERM OF AGREEMENT/TERMINATION: This Agreement shall be
valid for a Term of five (5) years. Either Party may terminate this Agreement for
any reason upon two (2) years written notice before the fifth anniversary of the
Effective Date of this Agreement, to the other Party, by first class certified mail,
postage prepaid, sent and addressed to the other Party as set forth in this
Agreement.
10. NOTICES: Except as otherwise required by law, any notice required
or permitted under this Agreement shall be in writing and shall be given by
personal delivery, or by deposit in the United States mail, certified or registered,
return receipt requested, postage prepaid, addressed to the Parties at their
respective addresses set forth below, or at such other address as a Party may
designate in writing pursuant to the terms of this Section, or by telecopy or tele-
facsimile machine, or by any nationally recognized express or overnight delivery
service (e.g. Federal Express or UPS), delivery charges prepaid:

Canyon Junior High ("CCJH")which functions as a vehicular access way for CCJH
(seeAccess Road Paving Boundary setforth in Exhibit D). This is a private access
way into the school owned by District.
5. PARTNERED ACTIVITIES: District and City shall coordinate and
work cooperatively on any and all programs and/or services determined to be
mutually beneficial to both Parties.
6. INDEMNIFICATION AND INSURANCE: To the extent permitted by
law, each Party covenants and agrees to fully indemnify, defend and hold
harmless the other Party, its special districts, elected and appointed officers,
employees, servants, and agents from and against any and all suits, actions, legal
or administrative proceedings, claims, demands or damages of any kind or nature
relating to this Agreement, including attorney and expert witness fees, which, are
the result of any act or omission of the Party, its officers, employees, contractees,
agents, and anyone acting under its direction or control, whether intentional or
negligent, in connection with or incident to this Agreement. If any action or claim
shall be brought or asserted against either Party or its special districts, elected
or appointed officers, agents, servants or employees for which indemnity may be
sought from either Party, the Parties shall promptly notify one another in writing.
The noticed Party shall, within ten (10) working days of receiving such notice,
assume the defense thereof, and the payment of all expenses, including any
attorney fees and all court costs which shall be paid as incurred. It is understood
and agreed that both Parties may elect to self-insure or obtain insurance through
their pooling agreement with other governmental entities against any or all of the
risks related to this Agreement. This section shall survive the expiration or early
termination of this Agreement.
7. CITY REPRESENTATIONS: City represents and warrants to District
that:
A. City's execution and approval of this Agreement have been
made in compliance with the procedural requirements of the
Apache Junction City Code.
B. City will execute and acknowledge when appropriate all
documents and instruments and take all actions necessary to
implement and evidence this Agreement.
C. As of the date of this Agreement, City knows of no litigation,
proceeding, initiative, referendum, or investigation contesting
the powers of City or its officials, with respect to this
Agreement, that has not been disclosed in writing to District.
D. The execution, delivery and performance of this Agreement by
City is not prohibited by, and does not conflict with, any other

scheduling and approval from District staff, may utilize
District-managed portions of the area depicted in Exhibit

Mountain Elementary School Ball Fields Boundary set forth in Exhibit C):
i. District Duties: City shall have year-round use of the
area set forth in Exhibit C each year this Agreement is in
effect. District shall purchase and maintain throughout
the Term of this Agreement public liability and property
damage insurance and provide proof of such insurance
to City no later than July 1st of each year this Agreement
is in effect.
ii. City Duties: Commencing July 1, 2015, City shall work
with all utility providers and shall become the
responsible named party on all utility accounts and shall
pay all utility bills for the areas set forth in Exhibit C. City
shall provide all maintenance and fully manage the area
set forth in Exhibit C. City shall purchase and maintain
throughout the Term of this Agreement public liability
and property damage insurance and shall provide proof
of such insurance to District no later than July 1st of each
year this Agreement is in effect. City may operate
concession stands and retain all realized profits; and
place signage as necessary on the property. District
may use the area shown in Exhibit C free of charge after
receiving advance non-conflicting scheduling notice.
C. Other City/District Owned Shared Facilities:
District and City Duties: Each Party shall be provided
access to other Facilities free of charge after providing
advanced non-conflicting scheduling notice to each
other and obtaining appropriate approvals, however,
Facilities requiring staff will incur charges (using a cost
recovery model acceptable to each Party).
4. CACTUS CANYON JUNIOR HIGH ACCESS ROADWAY: City shall
within three years from the Effective Date of this Agreement, resurface the
portion of the South San Marcos Drive alignment on the east side of Cactus

2. PURPOSE OF THIS AGREEMENT: The purpose of this Agreement is
to set forth the services, programs and facilities common to the Parties for the
benefit of the community.
3. FACILITIES: The applicable Facilities and Parties' obligations
associated therewith include:
A. Skate Park, Pool, Ball Field and Tennis Courts at Superstition
Shadows Parks: (located at 1091 West Southern Avenue, Apache Junction,
Arizona)(see Park Boundary set forth in Exhibit A):
District Duties: City shall manage and maintain the
portion of Superstition Shadows Park year-round each
year this Agreement is in effect as depicted in Exhibit B
to include: swimming pool, skate park, adjacent parking
lot, restrooms, ball field, picnic ramadas, lighting
system, sidewalks, open space areas and landscaping.
On July 1st of each year this Agreement is in effect,
District shall pay City: A)Twelve Thousand Five Hundred
dollars ($12,500.00) for its proportionate share of ball
field utility expenses; B) Twelve Thousand Five Hundred
dollars ($12,500.00) for tennis courts and bus staging
area utility expenses.
District shall provide maintenance and fully manage the
areas as outlined in Exhibit B to include: tennis courts,
adjacent parking lot, picnic ramadas, lighting system,
sidewalks, open space areas and landscaping. District
shall purchase and maintain throughout the Term of this
Agreement public liability and property damage
insurance and shall provide to City proof of such
insurance no later than July 1'each year this Agreement
in in effect. District shall also resurface tennis courts
within three years from the Effective Date. With non-
conflicting advanced scheduling and approval from City
staff, District may utilize City-managed portions of the
area depicted in Exhibit B free of charge.

THIS INTERGOVERNMENTAL FACILITIES USE AGREEMENT (the
"Agreement" or this "IGA") is made as of the tI Wday of fl(lA`/ 2015,
("Effective Date") by and between CITY OF APACHE JUNCTION, ARIZONA, an
Arizona municipal corporation (hereinafter referred to as the "City") and APACHE
JUNCTION UNIFIED SCHOOL DISTRICT #43, (hereinafter referred to as the
"District"), collectively from time to time referred to as the "Parties", or
individually as a "Party".
RECITALS
A. Pursuant to A.R.S. § 11-952, local municipalities and school districts
may enter into intergovernmental agreements for common goals.
B. The Parties historically entered into cooperative use, construction,
and maintenance agreements for recreational and educational facilities (the
"Facilities") and activities (August 1979, October 1981, May 1983, May 1989, April
1991, and February 2001).
C. As a result of the Great Recession starting in 2008, on February 10,
2010, the District cancelled the February 2001 agreement by submitting to the
City its two-year Notice of Termination ("NOT") as allowable under the 2001 IGA
(with termination being effective February 10, 2012).
D. Since receipt of the NOT, City and District representatives have been
attempting to negotiate a new agreement.
E. The Parties intend, concurrent with this IGA, to enter into good faith
negotiations with the intent to finalize an arrangement which provides for City-
District partnerships, thereby resulting in taxpayer savings and extending
recreational and educational related services and programs for years to come.
AGREEMENT
NOW, THEREFORE, in consideration of the foregoing Recitals and the
mutual promises and covenants set forth herein, and for other consideration, the
receipt and adequacy of which is hereby acknowledged, the Parties agree as
follows:
1. ACCURACY OF THE RECITALS: The Parties hereby confirm the
accuracy of the Recitals as set forth above, which are incorporated herein by this
reference.

CERTAIN DOCUMENT ENTITLED "2015 AMENDMENTS TO THE APACHE
JUNCTION CITY CODE, VOLUME I, CHAPTER 4, FEES, ARTICLE 4-
1, PARKS AND RECREATION FEE SCHEDULE"; REPEALING ANY
CONFLICTING PROVISIONS; PROVIDING FOR SEVERABILITY; AND
ESTABLISHING AN EFFECTIVE DATE.
WHEREAS, pursuant to Arizona Revised Statutes Annotated
("A. R. S. ") Sections 9-276 (A) (1) and 9-494 (A) , cities and towns are
authorized to establish, maintain, acquire, hold, improve and
regulate public parks; and
WHEREAS, the Mayor and City Council last approved an amended
Parks and Recreation fee schedule on August 18, 2009 when it adopted
Ordinance No. 1344; and
WHEREAS, since that time, the City of Apache Junction Parks and
Recreation Department has continued to experience increased use of
its parks and recreational facilities, and
WHEREAS, City residents and individuals from other communities
use the City' s facilities; and
WHEREAS, some of the current fees and usage regulations do not
coincide with the actual usage, cost and practice of the department;
and
WHEREAS, to accommodate high use and demand, the Parks and
Recreation Department needs to establish a priority registration
and/or a priority reservation program for facility users; and
WHEREAS, a promotional discount for memberships and programs
also needs to be created to enhance off-season participation; and
WHEREAS, A R S . § 9-802 permits municipalities to enact the
provisions of a code or public record in existence without setting
forth such provisions in full text as long as the adopting
ordinance is published in full text and at least three copies of
the code or public record are filed in the office of the clerk of
the municipality and are made available for public use and
inspection; and
WHEREAS, pursuant to A. R. S . §§ 9-801 (1) and 9-802, Apache
Junction City Code, Volume I, Chapter 4, Fees, Article 4-1, Parks

record; and
WHEREAS, Resolution No. 15-22 declares as a public record the
proposed fee amendments to the city code.

OF THE CITY OF APACHE JUNCTION, ARIZONA, AS FOLLOWS:
SECTION I IN GENERAL
That certain document known as the "2015 Amendments to the Apache
Junction City Code, Volume I, Chapter 4, Fees, Article 4-1, Parks
and Recreation Fee Schedule", three copies of which are on file in
the office of the City Clerk, which document was made a public
record by Resolution No. 15-22 of the City of Apache Junction, is
hereby referred to, adopted, and made a part hereof as if fully set
out in this ordinance, pursuant to A. R. S. § 9-802 .
SECTION II REPEALING ANY CONFLICTING PROVISIONS
All other ordinances and parts of ordinances in conflict with the
provisions of this ordinance or in conflict with any part of the
code adopted herein by reference are also hereby repealed.
SECTION III PROVIDING FOR SEVERABILITY
If any section, subsection, sentence, phrase, clause or portion of
this ordinance, or any part of the code adopted herein by reference
is for any reason held to be invalid, pre-empted or unconstitutional
by the decision of any court of competent jurisdiction, such
decisions shall not affect the validity of the remaining portions
thereof.
SECTION IV ESTABLISHING AN EFFECTIVE DATE
The provisions of this ordinance shall take effect on January 1,
2016.

SECTION I IN GENERAL
That certain document (a copy of which is attached hereto)

SCHEDULE", three copies of which are on file in the Office of the
City Clerk of the City of Apache Junction, Arizona, is hereby

SECTION II REPEALING ANY CONFLICTING ORDINANCES
All ordinances and parts of ordinances in conflict with the
provisions of this ordinance or any part of the provisions
adopted herein by reference are hereby repealed.
SECTION III PROVIDING FOR SEVERABILITY
If any section, subsection, sentence, phrase, clause or portion
of this ordinance or any part of the provisions or regulations
adopted herein by reference is for any reason held to be invalid
or unconstitutional by the decision of any court of competent
jurisdiction, such decision shall not affect the validity of the
remaining portions thereof.
SECTION IV ESTABLISHING AN EFFECTIVE DATE
The provisions of this resolution shall take effect on January
1, 2016.

§ 4-1-4 REFUNDS.
All refunds shall be made in full, except for a 10% administrative processing fee, with a
$5 minimum

§ 4-1-5 PROMOTIONAL DISCOUNTS
(A) Intent. The Parks and Recreation director or his or her designee may from time to
time establish promotional discounts to encourage and increase participation in programs and
memberships, especially for off season events.
(B) Limitation With the exception of a limited quantity of free day passes to the multi-
generational center or aquatic center, no promotion may exceed 50% off the regular price of
admission
§ 4-1-6 PRIORITY USE
(A) No Fee Category. The Parks and Recreation Department has prionty use of all
facilities and recreational areas When facilities are not in use for Parks and Recreation
sponsored activities, they shall be available on a permit/no fee basis to the following
(1) All other city departments
(2) City council approved special events (considered annually during budget
process).
(3) Partner agencies with formal agreements.
(B) Partial Fee Category. Groups that meet the following Local Youth Serving Agency
criteria will have priority use with those above, on a reduced fee basis (25% of regular public
rates)
(1) Youth Serving Agency is a 501(c)(3)non-profit organization
(2) Youth Serving Agency is governed by local, unpaid volunteer board and
unpaid staff.
(3) Participant members are made up of a majority of City of Apache Junction
residents
(4) Youth Serving Agency participation is open to the public and not "by
invitation only" or limited by any means other than the natural makeup of the league (i e
no cuts and must have minimum participation/play rules in place)
(C) Full Fee Category. When facilities are not in use by the Parks and Recreation
department, or the groups listed above, they will be made available to other Apache Junction
residents, groups or organizations on a permit/fee basis Groups or organizations from outside
the Apache Junction area are discouraged from using facilities, unless the activity is open to
Apache Junction residents,promotes the welfare of the community, and a portion of the proceeds
benefit a local non-profit entity.

§ 4-1-7 PRIORITY RESERVATIONS AND REGISTRATIONS
The Parks and Recreation director or his or her designee may establish a prionty registration or
priority reservation period for Apache Junction residents Programs and facilities with the
highest participation and/or use shall be considered for priority registration or priority reservation
for Apache Junction residents.

CHAPTER 15: PUBLIC PARK REGULATIONS
Article 15-1• PARK REGULATIONS

§ 15-1-1 DEFINITIONS.
For the purpose of this chapter, the following definitions shall apply unless the context clearly
indicates or requires a different meaning
CAMP.
(1) To use real property controlled or owned by the city for living accommodation purposes
such as.
(a) Sleeping;
(b) Making preparations to sleep, including the laying down of bedding for the purpose of
sleeping,
(c) Storing personal belongings,
(d) Making any fire,
(e) Using any tents or shelter or other structure or vehicle for sleeping;
(f) Doing any digging or earth breaking,
(g) Using items associated with camping,
(h) Regularly cooking or preparing meals, or
(i) Living in a parked vehicle.
(2) The above listed activities constitute camping when it reasonably appears, in light of all
circumstances,that the participants, in conducting these activities, are in fact using the area for
living accommodations regardless of the intent of the participants or the nature of any other
activities in which they may also be engaged
CITY. The City of Apache Junction
DIRECTOR. The director of the parks and recreation department for the City of Apache
Junction, or his or her designee
PARK. Includes all city parks,trails, swimming pools,buildings,playgrounds, skate park
and/or any other public property under management and control of the parks and recreation
department, owned or leased by the city for the public benefit including but not limited to leased
Bureau of Land Management property and Arizona State Land Department property
SPIRITUOUS LIQUOR. Includes alcohol,brandy, whisky,rum, tequila,mescal, gin, vodka,
wine,porter, ale,beer,malt liquor,malt beverage or absinthe, or compound or mixture of any of
them or of any with vegetables or other substances, alcohol bitters,bitters containing alcohol,
and any liquid mixture or preparation, whether patented or otherwise, fruits preserved in ardent
spints, and beverages containing more than % of 1%of alcohol by volume, which produces
intoxication or any increase in a person's blood alcohol level
UNMANNED AIRCRAFT. Includes all unmanned aircraft as defined in Arizona Revised
State Statute § 13-2729-(F)(7), as amended
UNMANNED AIRCRAFT SYSTEM("UAS"). Includes all unmanned aircraft systems as
defined in Arizona Revised Statute § 13-2729(F)(7), as amended
§ 15-1-2 PARK OPERATIONS.
(A) Hours.
(1) Except for unusual and unforeseen emergencies,parks shall be open to the public during
posted hours, as determined by the director
(2) It shall be unlawful for a person to remain in a park or to enter a park except during the
posted hours unless a permit is obtained pursuant to division(C)below
(B) Closed areas.
(1) Any section or part of any park may be declared closed to the public by the director at
any time and for any interval of time, either temporarily or at regular and stated intervals and
either entirely or for specific uses, as the director shall find reasonably necessary.
(2) No person shall enter any closed areas of a park if the entry is prohibited, nor shall any
person utilize any portion of a park if that utilization is prohibited.
(C) Permits and scheduling.
(1) Park activities sponsored or co-sponsored by the city shall have first priority over any
other use.
(2) Any person or group of persons may use any park for any recreational purposes not
otherwise prohibited within this chapter
(3) A written permit shall be obtained from the director whenever any person or group
desires to reserve any portion of a park for any activity Reservations shall be made in
accordance with reservation and facility use guidelines as established by the director.
(4) Any person or group aggrieved by the denial of a permit shall have the right to appeal
the decision of the director to the city manager or his or her designee Any appeal to the city
manager shall be served with the city clerk's office within 5 working days if a notice of
disapproval is received from the director. The city manager or his or her designee shall act upon
the appeal within 5 working days following receipt thereof. The city manager's decision is final
and binding on both parties.
(5) A park use permit may be revoked by the director upon determining that the park is
being used contrary to any representation made by the applicant; any conditions of the permit;
or any city ordinances or state law.
(6) Continuous use of facilities shall be limited to city-sponsored or co-sponsored activities
or affiliate groups as approved by the director. Continuous use shall be interpreted to be any
regularly scheduled or reoccurring activity
(7) Facility use fees will be established by the director as set forth in Chapter 4 of the city
code and may be amended on an as needed basis
(D) Insurance and indemnification, hold harmless
(1) Any person or group reserving a park shall defend, indemnify and hold harmless the city
and its elected officials and employees and for any and all damages to the facility caused by any
person or persons attending the activity, and all liability and damages to any person for injuries,
including but not limited to, death or serious bodily harm
(2) Adequate insurance as determined by the director shall be provided naming the city, its
elected officials and employees as "additional insured parties "
(3) Responsibility for loss,breakage or need for repair of any piece of furmture, equipment
or portion of the facility or areas shall be upon the individual sigmng the permit application.
§ 15-1-3 PROHIBITED ACTIVITIES.
(A) Amplified sound or music A permit from the director is required for amplified sound or
music in city parks and public recreation areas. Music with language designed to incite violence
is prohibited Nothing in this division is intended to prohibit first amendment expression or
speech.
(B) Animals Except with respect to horses as provided in division(0)below,no person shall
bring or allow to enter into a park, any animal owned or under control of such person,unless 1)it
is a service animal as defined under ARS §11-1024(J)(5),as amended, or 2) it is restrained at all
times (except when participating in an organized program authorized by the city) on a reasonably
adequate leash not greater than 10 feet in length. The person in control of any such animal shall
dispose of their animal waste in a trash receptacle Animals are not allowed in areas of the park
where posted as prohibited (except when participating in an organized program authorized by the
city) Wild or exotic animals or reptiles are not allowed to be brought into any park without the
written permission of the director Owners are responsible for the aggressive actions of their
animals and may be asked to leave the park if the director considers such animal to be a safety
risk to persons and other animals based on their behavior.
(C) Unauthorized water usage. No person shall swim,bathe or wade in any waters or
waterways, splashpads, sinks, toilets, or drinking water fountains in, or adjacent to any park,
except in such waters and at such places as are provided in such parks, and in compliance with
the regulations as are adopted by the director No person shall enter any waters or places
customarily designated for the purpose of swimming or bathing, or congregate therein when the
activity is prohibited by the director No person shall use any water source at any city park for
swimming, animal swimming or bathing,washing clothes, or cleamng fish, except at places
designated for those activities.
(D) Camping. Camping is prohibited in parks, except with the express written permission of
the director. Campers, trailers or motor homes shall not connect to any electrical supply, water
supply or waste service without the written permission of the director
(E) Climbing. No person shall climb on any fence, tree, art feature, or other structure other
than playground equipment designed for such purpose
(F) Commercial activity No person shall advertise, solicit goods or services or engage in any
commercial activity within a park without prior authonzation from the director.
(G) Compliance with laws All persons shall comply with all federal, state, county and city
laws,rules and regulations when visiting city parks.
(H) Compressed gas cylinders No person shall bang into any park a compressed gas cylinder
(such as helium to fill balloons)without obtaining prior written permission from the director
Propane containers used in connection with barbeque equipment are exempt from this
prohibition
(I) Damaging facilities No person shall graffiti, vandalize, damage or remove any park
property such as tables,benches,ramadas, lighting, steps, ramps,railings, fencing,barbeque
grills,playground equipment, drinking fountains,plants, court surfacing, curbs or paving, or
other structures of any kind This shall include: applying adhesive stickers to any park property
equipment, signs or any other surfaces, standing on table tops; swinging from ramada roof
beams, skateboarding or bicycling on any railing,bench, table,wall, step or other structure,
wastefully or improperly using the restroom or water facilities,or cause the lighting facilities or
electrical appliances to be turned on or used without the written permission of the director.
(J) Endangerment of Wildlife. No person shall commit any act in a park so as to endanger the
health or safety of area wildlife, to include but not limited to: rabbits, snakes,birds or any
wildlife in violation of ARS § 13-2910, Cruelty to Animals, as amended
(K) Debris,junk, trash, litter and garbage No person shall bring into or dump, deposit or
leave any debris,junk, trash, litter or garbage as defined in Apache Junction City Code, Vol I,
Chapter 9. Health and Sanitation, Article 9-1- Property Maintenance Standards, § 9-1-2
Definitions within any city park. Debns,junk, trash, litter and garbage may not be placed in any
waters in any park, or left anywhere on the grounds thereof,but shall be placed in the trash
receptacles, where receptacles are not provided, all debris,junk, trash, litter and garbage shall be
carried away from the park by the person responsible for its presence and properly disposed of
elsewhere. No person shall bring debris,junk, trash,litter and garbage into or upon park
premises except refuse or trash generated at the park while using the park. In no circumstances
may a person dump or leave in the park furniture, appliances, construction material,bio-hazard
waste or chemical waste.
(L) Food, gum, drinks and personal props. No person shall bring food, gum, drinks or
personal props such as traffic cones, skateboard stacking, makeshift jumps, obstacles or ramps
into the skate park.
(M) Glass containers It is unlawful for any person to possess a glass container in any park
No person shall throw, toss or otherwise propel, or break any glass object in any park or any
street or alley adjacent to such park
(N) Golfing. No person in a park shall use any portion of the park for golfing purposes, or
make use of any golf club or ball in any park, except at places designated for golfing by the
director
(0) Horses. No person shall bring a horse or other equine into a park, or ride one in any
location in a park or landscaped area, except on designated bridle trails or paths or with the
written permission of the director Where permitted,horses or other equine shall be ridden with
reasonable due care and shall not be allowed to graze or go unattended
(P) Interference with park activities. No person shall interfere or disrupt the reasonable use of
the park by other patrons
(Q) Model toys and unmanned aircraft systems. No person in a park shall bring into or use
any remote controlled or self-propelled model toy or unmanned aircraft, including but not limited
to model airplanes, drones, model rockets,model boats,model cars or other models, except in
the areas designated by the director or with written permission from the director
(R) Motorized vehicles. No person shall bring into or operate in a park any motor vehicle of
any type, including but not limited to, any automobiles,motorcycles,motor bikes,motorized
skateboards or 3-wheeled scooters, except in those areas or on roads or paths designated for such
vehicular use by the director Inoperable motorized vehicles must be removed from the park
within a 24-hour time period or the vehicles will be towed away at the owner's expense to a
storage facility No portion of a park is to be used as a place to repair vehicles
(S) Non-motorized vehicles.No person in a park shall operate or ride a skateboard, roller
skates, a bicycle, scooter or tricycle-type three wheeled scooter(also known as a "Trike")on
grass, landscaped areas,ramada areas,basketball, tennis and racquetball courts or on structures
and fixtures, including tables,benches,playground equipment,railings, steps,ramps,buildings
or where such activity is specifically posted as prohibited, or in such a manner which creates a
serious safety risk to themselves or to other park users.
(T) Projectile devices No person shall use any portion of a city park for archery, firearm
practice or other projectile activities
(U) Public nudity/indecency.No person shall engage in sexual intercourse or expose or
display their genitals or private parts in a public park Nothing in this division is intended to
prohibit protected First Amendment expression.
(V) Public profanity. No person may use language designed to incite violence Nothing in this
division is intended to prohibit protected first amendment expression and speech.
(W) Spirituous liquors. It is unlawful for any person to consume spirituous liquors in a
municipal park except that beer and wine is permitted in areas designated for such use by the

director Individuals consuming beer and wine shall do so only having first obtained a permit
issued by the director.
(X) Smoking. The act of smoking any substance, and including the use of e-cigarettes in any
park facility shall only be allowed in designated areas
(Y) Use of restroom facilities.No person shall urinate or defecate in a park except within a
toilet or urinal provided inside a restroom facility
§ 15-1-4 ENFORCEMENT AND PENALTY.
(A) Enforcement. The director, park rangers and police officers shall, in connection with their
duties imposed by law, diligently enforce the provisions of this chapter. Requests from park
rangers must be strictly adhered to in the interest of public safety. Park rangers have authority to
issue citations to any park user in violation of any provision of this chapter
(B) Ejection for violations. The director, park rangers and police officers have the authority to
eject any person from any park for violating any provision of this chapter Following ejection, it
is unlawful for any person to enter or reenter any park during the ejection period.
(C) Confiscation of property The director,park rangers and police officers have the authority
to seize and confiscate any property, thing or device in the park, used contrary to the provisions
of this chapter, including but not limited to glass bottles, cigarettes, skateboards,bicycles, skates,
motorized skateboards, weapons of any type,model toys, and unmanned aircraft or unmanned
aircraft systems
(D) Interference with official duties It is unlawful for any person to interfere with the official
duties of a park ranger
(E) Penalty. A person convicted of a violation of any provision of this chapter shall be guilty
of a class one misdemeanor and shall be punished as authorized under Apache Junction City
Code, Vol I, Chapter 1 General, Article 1-1• General, § 1-1-11(A)Penalty

§ 4-1-2 DEPOSITS
(A) The Director of Parks and Recreation or his or her designee may require deposits or
clean-up fees for equipment/facility rentals deemed necessary equal to or up to the amount of the
rental fee.

§ 4-1-4 REFUNDS.
All refunds shall be made in full, except for a 10% administrative processing fee, with a
$5 minimum
§ 4-1-5 PROMOTIONAL DISCOUNTS
(A) Intent The Parks and Recreation director or his or her designee may from time to
time establish promotional discounts to encourage and increase participation in programs and
memberships, especially for off season events.
(B) Limitation. With the exception of a limited quantity of free day passes to the multi-
generational center or aquatic center, no promotion may exceed 50% off the regular price of
admission
§ 4-1-6 PRIORITY USE
(A) No Fee Category. The Parks and Recreation Department has priority use of all
facilities and recreational areas. When facilities are not in use for Parks and Recreation
sponsored activities,they shall be available on a permit/no fee basis to the following
(1) All other city departments
(2) City council approved special events (considered annually during budget
process)
(3) Partner agencies with formal agreements.
(B) Partial Fee Category. Groups that meet the following Local Youth Serving Agency
critena will have priority use with those above, on a reduced fee basis (25% of regular public
rates).
(1) Youth Serving Agency is a 501(c)(3)non-profit organization
(2) Youth Serving Agency is governed by local, unpaid volunteer board and
unpaid staff.
(3) Participant members are made up of a majority of City of Apache Junction
residents
(4) Youth Serving Agency participation is open to the public and not "by
invitation only" or limited by any means other than the natural makeup of the league (i.e.
no cuts and must have minimum participation/play rules in place)
(C) Full Fee Category. When facilities are not in use by the Parks and Recreation
department, or the groups listed above, they will be made available to other Apache Junction
residents, groups or organizations on a permit/fee basis Groups or organizations from outside
the Apache Junction area are discouraged from using facilities, unless the activity is open to
Apache Junction residents,promotes the welfare of the community, and a portion of the proceeds
benefit a local non-profit entity
§ 4-1-7 PRIORITY RESERVATIONS AND REGISTRATIONS
The Parks and Recreation director or his or her designee may establish a pnority registration or
pnority reservation period for Apache Junction residents Programs and facilities with the
highest participation and/or use shall be considered for pnority registration or priority reservation
for Apache Junction residents.
