negotiations, representations or agreements, either express or implied, written

signed by the Parties. Written and signed amendments shall automatically

therein; provided, however, that any apparent inconsistency shall be resolved, if
possible, by construing the provisions as mutually complementary and
supplementary. Notwithstanding the above, items deemed as "minor
amendments" under this IGA must be such things that are administrative,
ministerial or process in nature, not policy-related that typically require City

agreement signed by the City Manager and District Superintendent shall be

Parties can be made. There is no legal liability on the part of the Parties to make
any payment or payments until funds are available for the services, programs and
equipment under this Agreement and until each Party receives from each other
notice of such availability, to be confirmed in writing by the Parties'
representatives.

terminated by City in accordance with the provisions of A.R.S. § 38-511.
IN WITNESS WHEREOF, the Parties have executed this Agreement as of the
date first set forth above.

To: The Most Honorable Mayor John Insalaco and
Apache Junction City Council Members
Re. Proposed North Apache Trail City Park
Dear Mayor Insalaco and Council Members,
We would like to suggest some ideas for discussion:
Grade the park to include rolling hills and dells, Perhaps construct a rock garden Park users
could follow a trail to a vantage point on top with a view of the Superstitions.
Minimize grass areas Utilize drought tolerant, low water-usage vegetation. Plant as many
desert trees as possible.
Build an ADA compliant trail around the park's perimeter that follows a meandering arroyo with
small pools. The park could be graded to drain all or most rain water into the arroyo The arroyo
could then flow into a small retention pond. Add boulders around arroyo, pools and the pond for
a natural look. Plant native trees and vegetation around the pond, the arroyo and the trail.
include informational plaques by the plants,
Ask AJ K-12 students to submit ideas
Use local nurseries for plant type consultation and for purchase. (Shady Way Gardens?)
Allow volunteers to participate in the construction and/or planting operations.
Build a fenced playground in a location away from roadway traffic
Install picnic ramadas Maybe a few larger ones could be reserved I rented for day use events.
Build a covered performance stage surrounded by tiered berms Spectators could bring their own
lawn chairs or blankets for seating. Include a dance area by the stage
Keep pavement to a minimum. Build a vehicle parking lot along North Apache roadway, Prohibit
motorized traffic in the park
Install restrooms for park users,
We realize space is limited for the proposed park. Will the current plans incorporate the
possibility of acquiring additional adjacent acreage in the future?
Thank you for your consideration of these ideas.
