At this time the public has the privilege to address the council with requests, communications, comments
or suggestions relating to city business.All speakers must have already submitted a written "Request to
Speak"form to the city clerk no later than the conclusion of the city manager's report portion of the
agenda. If there is a group speaking on the same item, they should select a spokesperson.All such
remarks shall be addressed to the council as a whole and not to any member thereof. The mayor is
authorized to ask a speaker to stop speaking and leave the podium or to adjourn the meeting if anyone
becomes disorderly, uncivil, makes personal attacks or continues to speak about items that are not
within the jurisdiction of the city after being warned such issues are beyond the jurisdiction of the city to
act. The council may not answer questions of the speaker, discuss the matter with one another, but may,

-The groundbreaking ceremony for The Wolff Company's new apartment complex

4. 25-626 City Manager's Report
City Manager Bryant Powell shared the great turnout for the annual holiday tree lighting event
and thanked the Police, Public Works, and Parks and Recreation Departments for their hard
work in hosting the community event. He also spoke about the success of the annual Shop with
a Cop event. He stated it was strongly supported by the community and he is grateful for the
coordination with our Police Department.
Mr. Powell announced the street signs for Facio Avenue have been received and asked the
community to keep an eye out for an invitation for an upcoming event to make this change. He
also wished everyone a very safe holiday season and encouraged fireworks safety.

6. 25-628 Presentation, discussion, public hearing and consideration of Ordinance No.
1573, repealing current Apache Junction City Code, Volume 1, Chapter 8:
Business, Article 8-8: Requirements for Community and Civic Events, in its
entirety; and adopting by reference a new Chapter 8: Business, Article 8-8:
Special Events; repealing any conflicting provisions; providing for severability;
providing for penalties; and establishing an effective date.
Councilmember Johnson moved,seconded by Councilmember Nesser that Ordinance No. 1573 be
read by title only and the reading of the entire ordinance be waived.
Motion passed unanimously.
City Clerk McKinney read Ordinance No. 1573 by title only, repealing any conflicting provisions;
and providing for severability.

Mayor Wilson stated Items 6 and 7 are related to the same subject matter and will be presented
together. The Public Hearings will be combined but there will be separate motions for each.
Parks and Recreation Management Analyst Riley King presented that in May of 2025, Staff
shared market research on neighboring cities' special event policies and shared sections of the
City Code that have been identified for updates/additions. Council gave Direction to Staff to
review the existing code and bring back recommended changes for consideration. Those
changes were presented to council and discussed at the November 4, 2025, meeting.
Parks and Recreation Staff was asked to bring back the final changes to a Public Hearing. The
intent will be to repeal Article 8-8 "Requirements for Community and Civic Events" and replace
with Article 8-8 "Special Events" in its entirety. The most significant changes include:
1. Shifts focus from business licensing to all aspects of special events
2. Simplifies and combines all processes for Community Events and Civic Events
3. Clarifies event definitions and exclusions
4. Eliminates some fees
5. Clarifies requirements for an event permit, and reinforces consequences for hosting an event
that impacts city resources without permission

Should the council vote to move forward on this, the resulting ordinance and resolution will go
into effect February 1, 2026.
Councilmember Heck inquired on what qualifies for a special event permit.
Councilmember Nesser asked if the requirement for 60 days advanced notice is set in stone.
Mayor Wilson opened the Public Hearing, receiving no comments from the public, he closed the
Public Hearing and asked for a motion.
7. 25-636 Presentation, discussion, public hearing and consideration of Resolution No.
25-38, a resolution of the mayor and city council declaring as a public
record that certain document filed with the city clerk titled "2026
Amendments to the Apache Junction City Code Volume I, Chapter 8:
Business, Article 8-8: Special Events"; repealing any conflicting
provisions; and providing for severability.
Vice Mayor Schroeder moved,seconded by Councilmember Soller that Resolution No.25-38,a
resolution of the mayor and city council declaring as a public record that certain document filed
with the city clerk titled "2026 Amendments to the Apache Junction City Code Volume I,Chapter

severability be approved.

public parking spaces
4. Updates appeals and penalties to match other chapter 8 sections
Should the council vote to move forward on this, the resulting ordinance and resolution will go
into effect February 1, 2026.
Councilmember Nesser inquired if we accept other counties health permits besides Maricopa
and Pinal.
Ms. King and Parks and Recreation Director Liz Langenbach responded to Councilmember
Nesser.
Mayor Wilson opened the Public Hearing.
Mehmood Mohiuddin, 2341 N. Apache Trail, Apache Junction, AZ, commented on the
importance of the county health permits.

Chapter 2: Subdivision and Minor Land Division Regulations"; repealing
any conflicting provisions; and providing for severability.

titled"2025 Amendments to the Apache Junction City Code,Volume II, Land Development Code,

City Attorney Joel Stern explained that this Item is a continuation from December 2, 2025, where
Council adopted Ordinance No. 1569. In 2023, the Arizona State Legislature passed and
approved Senate Bill 1103, which amended the Arizona Revised Statues for cities and towns
(A.R.S. §§ 9-500.49)to note that city councils may pass an ordinance authorizing
administrative city staff to review and be the approval authority of"site plans, development
plans, land divisions, lot line adjustments, lot ties, preliminary plats, final plats and plat
amendments without a public hearing". Within the City of Apache Junction, staff already
administratively approves most of those items, but preliminary plats, final plats, and the
amendments of plats are all items currently approved by the city council at public meetings.
Because this statute's provisions were optional, no text amendment to city code had been
required to change the city's processes and procedures. However, earlier this year, the Arizona
State Legislature passed and approved House Bill 2447, which modified A.R.S. §§ 9-500.49 to
City of Apache Junction,Arizona Page 6

make these noted, previously-optional changes mandatory, so that a city shall now pass an
ordinance authorizing administrative staff approval of all noted items.
As the approval of preliminary plats, final plats, and plat amendments are the only items our city
code currently requires city council approval for among the noted list, this text amendment
proposes modifications to the Apache Junction City Code, Vol. Il, Land Development Code,
Chapter 2: Subdivision and Minor Land Division Regulations to comply with HB 2447.
Chapter 2: Subdivision and Minor Land Division Regulations, contains many references to the
Planning and Zoning Commission and City Council Hearings that plats would be presented for
review and approval, all of which are proposed to be modified to re-word the code language to
identify administrative personnel as the approval authority and remove requirements for Public
Hearings, per the requirements of HB 2447.
The affected portions of the city code are identified in the Redline Exhibit "Draft Amendment
Redlines to Apache Junction City Code, Volume II, Land Development Code, Chapter 2:
Subdivision and Minor Land Division Regulations"while a clean copy showing the proposed
amended text without any notations is also provided.
Mr. Stern stated that Council will need to approve Resolution No. 25-31 in order to make
Ordinance No. 1569 effective.
Councilmembers had no concerns.
Mayor Wilson opened the Public Hearing, receiving no comments, he closed the Public Hearing
and asked for a motion.
Motion passed unanimously but Councilmembers did state their frustrations with the State
forcing their will upon local governments.
11. 25-631 Presentation, discussion, public hearing and consideration of Resolution No.
25-24 of Conditional Use Permit ("CUP") case P-25-38-CUP, a request by
Roers Companies, represented by Greg Davis of Iplan Consulting, for the
approval of a 300-unit, three-story, multi-family residential rental community
on approximately 13-acres zoned City Center("B-3") near the southeast
corner of Idaho Road and the Scenic Street alignment.
Councilmember Heck moved,seconded by Councilmember Nesser that the presentation and
discussion of Resolution No.25-24 Conditional Use Permit Case P-25-38-CUP be continued to
January 20,2026,and the discussion, Public Hearing and consideration of Resolution No.25-24 on
February 3,2026.

Planner Nicholas Leftwich stated the applicant has requested a continuance until January 20,
2026, to allow for more time to address the traffic and architectural concerns.
Councilmember Johnson asked if the January 20, 2026, meeting is enough time for the
applicant.
Roers Company representative Peter Schroeder assured Council that they will be ready by the
next Council meeting.
City Attorney Joel Stern confirmed with the applicant that they would like to present at the
January 20, 2026, meeting and have a Public Hearing.
Mr. Peter Schroeder confirmed that was correct and that they would also like to have the
Council vote that evening.
Councilmember Soller asked if the Council will receive the new information prior to the meeting.
Mr. Stern reminded Council of the Open Meeting Laws. He suggested an Old Business Item on
January 20, 2026, and then the Public Hearing and consideration on February 3, 2026.
Mayor Wilson asked Mr. Leftwich to explain the density requirements for the area of this
apartment complex and the process of making a change to the General Plan.

Assistant City Manager presented that on September 4th, 2025, the City issued a Request for
Proposal for conduit and fiber installation. On November 3rd, 2025, the city received nine
responses: Mears Broadband LLC, BPG Designs LLC, Pauley Construction LLC, TeamFishel,
Hp Communications Inc, Allo Fiber Allo Communications, B&F Contracting, MP NexLevel, and
Kimley Horn. IT Staff reviewed the responses and found that all the vendors were over budget.
IT Staff respectfully requests to reject all responses for RFP IT2025-01 Conduit and Fiber
Installation for the City, and staff will work to re-engineer the project scope to a more
manageable budget and use procurement resources available.
Councilmember Soller inquired why the City's budget was so far off from the bids that were
submitted.
Councilmember Johnson asked if the bids were broken down into priority areas.
Councilmember Heck asked if this project would complete the City's fiber optics.

Donna Carr, 2178 W. Virginia Avenue, Apache Junction, asked about previous technology that
the Public was able to use at Call to the Public and she also spoke in opposition of the proposed
Roers Company project.

WHEREAS, January is nationally recognized as Anti-Human Trafficking Month,
a time dedicated to raising awareness, supporting victims and
survivors, and strengthening our collective efforts to combat this
horrific crime; and
WHEREAS, human trafficking remains a widespread and underreported crime
occurring in communities across the United States, including
Arizona, affecting individuals of all ages, backgrounds, and
demographics; and
WHEREAS, the fight against human trafficking requires the collaboration of
schools, churches, non-profits, law enforcement, businesses, and
concerned citizens to intervene, disrupt trafficking activity, and
provide resources and compassionate care to victims; and
WHEREAS, the City of Apache Junction joins statewide coalitions, community
organizations, and the Not in Our City movement in demonstrating
its commitment to bring light to the darkness of human trafficking to
increase public awareness of the impact this crime has on
communities throughout Arizona; and

LIQUOR LICENSE FOR NEX GEN
An application for a Series 10 Beer and Wine Store Liquor License has been submitted by
Lauren Merrett for Nex Gen, located at 420 N. Apache Trail, Apache Junction, AZ 85120.
The Arizona Department of Liquor Licenses and Control received the application on December
22, 2025, and the Apache Junction City Clerk's Office received the application from them the
same day.
The applicant was notified by a first-class letter and e-mail of the public hearing and was
encouraged to attend to address any questions council may have. A Notice of Public Hearing
was posted at the establishment on December 23, 2025, to comply with state law requirements.
Correspondence related to inspections of the premises for safety and code compliant matters
have been received from the Apache Junction Police Department, Building and Safety Division,
Planning and Zoning Department, and the Superstition Fire and Medical District. All four entities
find compliance with the inspection requirements and recommend approval. Their responses
are attached to Legistar for your review.
The city council may now make a recommendation for approval or denial to the Arizona State
Liquor Licenses and Control on this application. This recommendation must take place within
sixty (60) days of the filing of the application, therefore must be done by February 30, 2026.

Background
According to A.R. S . 9-471 (0) : "a county right-of-way or roadway
may be transferred to an adjacent city or town by mutual consent
of the governing bodies of the county and city or town if the
property transferred is adjacent to the receiving city or town and
if the city or town and county each approve the proposed transfer
as a published agenda item at a regular public meeting of their
governing bodies . A transfer of property made pursuant to this
subsection shall be treated by the receiving city or town as if
the transferred property was newly annexed territory. "
On November 18, 2025, the mayor and city council of the City of
Apache Junction, Arizona, passed Resolution No. 25-32, a
resolution approving and authorizing the "Intergovernmental
Agreement between Maricopa County and the City of Apache Junction
for Annexation and Permitting of Meridian Road", in which the city
partnered with Maricopa County to facilitate the conveyance and
city annexation of Maricopa County' s Meridian Drive right-of-way
between Elliot Avenue and Ray Avenue on the west side of the
street.
Subsequently, on December 10, 2025, the Maricopa County Board of
Supervisors approved and authorized their execution of the same
Intergovernmental Agreement (IGA) , fulfilling the A.R. S .
requirements noted above necessary for the right-of-way transfer
from the county to the city.

To complete this process and the IGA, staff have prepared Ordinance
No. 1570 as the formal annexation ordinance expanding the city' s
boundaries to include the identified right-of-way.
Due to the length of the legal descriptions and map exhibits of
the annexed area, the corresponding portion of the ordinance has
been made a separate document, titled "Legal Descriptions and Map
Exhibits of the P-25-104-AM Meridian Drive Annexation" . Staff have
prepared Resolution No. 26-03 in order to declare this document a
public record so that it may be referenced within Ordinance No .
1570, per the provisions of A.R.S § 9-802 . This reduces the length
of the ordinance and reduces the significant publishing costs that
would apply if otherwise left in the ordinance.

AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE
CITY OF APACHE JUNCTION, ARIZONA, EXTENDING AND
INCREASING THE CORPORATE LIMITS OF THE CITY OF
APACHE JUNCTION, ARIZONA, IN CASE P-25-104-AN,
PURSUANT TO PROVISIONS OF TITLE 9, CHAPTER 4 ,
ARTICLE 7, ARIZONA REVISED STATUTES AND AMENDMENTS
THERETO, BY ANNEXING CERTAIN RIGHT-OF-WAY
CONTIGUOUS TO THE EXISTING CITY LIMITS OF THE CITY
OF APACHE JUNCTION AS MORE FULLY DETAILED IN THAT
CERTAIN DOCUMENT TITLED "LEGAL DESCRIPTIONS AND MAP
EXHIBITS OF THE P-25-104-AM MERIDIAN DRIVE
ANNEXATION"; REPEALING ANY CONFLICTING PROVISIONS;
AND PROVIDING FOR SEVERABILITY .
WHEREAS, according to the provisions of A.R. S .

Apache Junction, and includes an accurate map of the proposed
territory to be annexed; and

WHEREAS, the provisions of A. R. S . § 9-471 and amendments
thereto, have been fully observed.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY
COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, AS FOLLOWS :
SECTION I : IN GENERAL
1 . The legally-described territory referenced in #2 below
is, annexed to the City of Apache Junction, Arizona, and
that the present corporate limits shall be extended and
increased to include territory which is contiguous to
the present City limits :
2 . That certain document containing the legally
described territory, but more particularly described
in the document titled "Legal Descriptions and Map
Exhibits of the P-25-104-AM Meridian Drive
Annexation" of which one paper copy is on file in
the office of the city clerk and one electronic copy
is accessible on the city' s website
(www.apachejunctionaz .gov) , which document was made
a public record by Resolution No. 26-03 of the City
of Apache Junction, is hereby referred to, adopted
and made a part hereof as if fully set out in this
ordinance, pursuant to A. R. S . § 9-802 .
SECTION II : RECORDATION
That a copy of this ordinance, together with an accurate map
of the territory hereby annexed to the City of Apache
Junction, Arizona, certified by the Clerk of the City be
forthwith filed and recorded in the office of the County
Recorder of Pinal County, Arizona .
SECTION III REPEALING ANY CONFLICTING PROVISIONS
All ordinances and parts of ordinances in conflict with the
provisions of this ordinance or any part of the codes adopted
herein by reference are hereby repealed.

SECTION IV PROVIDING FOR SEVERABILITY
I£ any section, subsection, sentence, phrase, clause or
portion of this ordinance or any part of the codes or
regulations adopted herein by reference is for any reason

court of competent jurisdiction, such decision shall not
affect the validity of the remaining portions thereof.

Background
P-25-38-CUP is a proposed Conditional Use Permit (CUP) to allow for
the development of a 300-unit, three-story multi-family residential
community. The proposed project is located on an approximately 13-acre
site near the southeast corner of Idaho Road and the Scenic Street
alignment. The property is currently zoned City Center (B-3) .
The City Council first reviewed and discussed this Conditional Use
Permit proposal at the City Council Work Session on November 18, 2025.
At the December 2, 2025 public hearing, after the city council' s
discussion, the applicant requested additional time to confirm whether
they could adjust operational plans in the manner the city council had
suggested, and the consideration of the Conditional Use Permit was
continued to the December 16, 2025 meeting.
At the December 16, 2025 meeting, the applicant requested another
continuance to January 20, 2026 in order to further address traffic
questions and architectural design concerns expressed in the prior
meetings. The City Council voted to continue the agenda item P-25-38-
CUP and its corresponding Resolution No. 25-24 for presentation and
discussion on January 20, 2026 and for discussion, public hearing &
consideration to be held on February 3, 2026.

SECTION II REPEALING ANY CONFLICTING PROVISIONS
All resolutions and parts of resolutions in conflict with the
provisions of this resolution or any part of the codes adopted
herein, are hereby repealed.
SECTION III PROVIDING FOR SEVERABILITY
If any section, subsection, sentence, phrase, clause or portion of
this resolution or any part of the codes or regulations adopted
herein is for any reason held to be invalid or unconstitutional by
the decision of any court of competent jurisdiction, such decision
shall not affect the validity of the remaining portions thereof.
