9. Consideration of application for a special event liquor license for the
Boys and Girls Club of the East Valley -Apache Junction Branch for
a fundraiser to be held April 11, 2015, at Dolce Vita, 3301 S
Goldfield Road, Apache Junction The next step in the process is for
the council to hold a public hearing on the application and make a
recommendation for approval or denial to the Arizona Department of
Liquor Licenses and Control
10 Consideration of an application for a permanent extension of
premises/patio permit for the Hitching Post Pizza and Pub located at
2341 N Apache Trail The next step in the procedure is for the city
council to hold a public hearing on the application and make a
recommendation for approval or denial to be forwarded to the Arizona
Department of Liquor Licenses and Control
OLD BUSINESS
The council shall consider any business that has been previously considered and which is still
unfinished to include those items previously postponed or tabled No member of the public shall be

11. Consideration of Resolution No 15-09, amending the Classification
and Compensation Plan for Fiscal Year(FY) 2014-2015 This item
allows the mayor and council to implement the first step in a revised
employee classification and compensation plan for FY 2014-2015 as
recommended by Public Sector Personnel Consultants and based
on the study budgeted for FY 2014-2015.

The regular meeting of the City Council of the City of
Apache Junction, Arizona, was held on March 17, 2015, at the
Apache Junction City Council Chambers pursuant to the notice
required by law.

ANNOUNCEMENT OF CURRENT EVENTS
Councilmember Wilson announced the Antique Tractor Show was just
completed at the rodeo grounds and it was very successful. Kids
were waiting in line to ride a tractor.

Councilmember Wilson announced the Pinal County Fair will start
this Wednesday through Sunday with various animals,
entertainment and rides .
Councilmember Waldron announced he will be going to Washington,
D. C. next week to represent the mayor on the Keep Your Promise
legislation regarding a casino a tribe wants to build out west.
The tribe will be picking up the cost .
Councilmember Evans commented on a community service award she
received from the Southeast Valley Association of Realtors which
included $250 towards a nonprofit . She is giving that to the
community garden. She described the events that will be going
on during the final farmers' market for the season and commented
on various sponsors for the garden.
Councilmember Serdy commented he attended a Tourism Advisory
Council meeting in Phoenix last week where he met the new state
parks director, Sue Black. She is very enthusiastic with a lot
of great ideas. He has invited her to a council meeting. He
also gave out the bags and people from all over the state really
liked them.
CITY MANAGER' S REPORT
Assistant City Manager Bryant Powell commented there may be
dollars in the state grant budget for the state parks . He gave
a brief presentation on various projects in the downtown area.

OUTDOOR ENTERTAINMENT ACTIVITIES
ON HIS PROPERTIES LOCATED AT THE
SOUTHEAST CORNER OF LOST DUTCHMAN
AND NORTH APACHE TRAIL )

Councilmember Rizzi asked if
there was a specific number of events they would be allowed to
have. She thought it was capped at six.
Senior Planner Rudy Esquivias
stated the resolution approved by the commission indicated Mr.
Mohiuddin had agreed to limit the number of events to six per
year. They would be held when the winter visitors are here.
Rescinding the conditional use permit does not mean Mr.
Mohiuddin can never again hold a concert event . He will have
the option of going through the city' s internal special events
process where he presents his activity to staff. He could
partner with a nonprofit organization in the city. He would
have to do that every time he proposes to have an activity on
his property. That process is still available to him. Under
the commission' s conditional use permit, that would be limited
to six events per year.
Councilmember Rizzi commented
he stated he could partner with nonprofits She thought the
purpose of allowing him to have these events was to benefit
nonprofits . She thought that was the sole purpose of doing
these events .
Senior Planner Rudy Esquivias
stated that was part of his narrative. He wanted to hold these
events that would mostly or all be charity-oriented types of
events .
City Attorney Joel Stern
stated because they have an appellant, the appellant should be
given the opportunity to speak. After that Mr. Mohiuddin can
speak and then they can open it up to the public.
Mayor Insalaco requested the
appellant address the council .
Mr. Jim Johnson stated he is
the one who wrote the appeal . He has years of experience with
sound and radar deflection. As they can see by it, it does
bounce off the walls . The one point of about 20 degrees will
shoot directly east into the housing areas . If the stage were
turned about 180 degrees and have it running more south

southwest, there is no wall in that area. It is only chain link
fence. There would be no deflection of the sound. In the area
it is currently at the wall would have to be so high to deflect
the sound out into the desert it would cost a fortune to build
one. He can understand his point in what he is trying to do.
As he understands it, it is also relative to the nonprofit issue
that was brought up at planning and zoning, and that is that
ticket sales for the entry fee would go towards the nonprofit.
He is not sure if that is true . He is sure Mr. Mohiuddin has a
lot to gain by the revenue from the liquor and beverage sales
from it. He can see the point of why he would do it like that.
He suggested getting together with him and having all of them
work together on it and resolve it to where everybody is happy
with it.

Cristina Driscoll .

stated unless she is one of the appellants, he would ask that
Mr. Mohiuddin address the council . Then he can open it up to
the public.

Mr. Mehmood Mohiuddin
addressed the council . He stated they were planning on doing
all these events . Mr. Johnson commented he did not know how
much truth there was to these being for nonprofits . They have
copies of checks they have presented to the nonprofit
,— organizations - fallen officers, boys and girls club and the
next one they are working on is the wounded warriors . They put
that one on hold. They have the most respect for their local
neighbors . If it would cause a lot of trouble, they would
withdraw from the conditional use permit. If his neighbors have
respect for his business, the goal was to work together and
figure out how they can resolve the issue. If they are willing
to work with them, it will be a great opportunity for the City
of Apache Junction to bring tourism and the people. The last
two concerts they had, for example, the Bellamy Brothers, he had
people from White Horse, Canada, Minnesota, Ohio and Idaho and
they got their rooms and supported the local community. For

instance, he had six people come into his place and comment he
sells pizza and broasted chicken. They cannot eat there every
day. He told them to go to the Handlebar, or to Cowboy Up and
have a great steak over there. They buy groceries, food and all
their other stuff at different locations throughout the whole
community. The second concert required them to reserve 13 rooms
in the two hotels in the city. That is the reason they are
doing this, to bring more people and tourism to town. They and
two businesses on Apache Trail just spent $4 , 500, getting
together to put an advertisement in New Times Magazine for the
Super Bowl . They started seeing a good result from that ad.
The people saw the ad in it and came down the Apache Trail
They are working with other businesses together to attract more
tourism and more people to see what is going on in this area.
They are carrying the same theme as Goldfield Ghost Town and
Museum. They are trying to attract people to this area by
building a western town, western saloon and western look. That
is what Apache Junction is about . All of them sitting up there,
the most intelligent over here, see if that would help. They
are all up for it and need to work together, help each other and
help the local community. Hope Center wants to be a part of it,
along with fallen officers and wounded warriors . They come to
them to ask when they are going to have their next event They
need help. They are waiting to see what direction this is going
to go and they will be happy to do that.
Councilmember Rizzi commented
he had written a letter to retract having this approved. She
asked if he was still wanting to go forward.
Mr. Mehmood Mohiuddin stated
if his neighbors are happy and they can work it out, he would
like to go forward. However they want it, if they want him to
change the plan so that it does not bother them, he would
absolutely like to go forward. It will help the whole
community, not only them.
Councilmember Rizzi commented
she just wanted to know if he was interested in going forward as
that will assist them in making their decision.

Councilmember Rizzi asked if
it is a possibility for them to move the stage as the gentleman
suggested.
Mr. Mehmood Mohiuddin stated
they can. It is a portable stage. They hire a portable stage
that can be set up and they bring a sound system. They work on
it . He would be happy to invite them to the next concert if it
is approved. They can check out the sound system. They will be
happy to work with them and make sure they are comfortable and
not bothered. They would like to work with them as they are a
part of the community. All the community should get together to
help the whole community.
Councilmember Rizzi commented
that moving the stage is a possibility.
Mr. Mehmood Mohiuddin stated
absolutely.

he could maybe give the neighbors free tickets .
Councilmember Waldron
commented if the conditional use permit goes away it will not
stop special events for charities .
Senior Planner Rudy Esquivias
stated that is correct .
Councilmember Waldron
.�+ commented they can still come in and do that.

stated that is correct. They can go through the special events
process and if they are going to serve liquor at one of these
special events than that part of the request would come before
the council for their recommendation. As far as holding special
events in that area in general, that can still be done.
Councilmember Rizzi asked if
this business has already paid fees and gone through a process
to get this event going.

stated they have had two events that he is aware of through the
special events process, the Bellamy Brothers and T.G. Shepherd.
He does not know what fees are involved, but two events have
been held through our internal special events process . He
believed both of those also involved temporary extension of
premises to be able to sell beer.
City Clerk Kathleen Connelly
stated the nonprofits came before the council with an
application for a special event liquor license. It was not done
as an extension of premises .
Councilmember Rizzi asked if
those two events were outside.
Senior Planner Rudy Esquivias
stated they were. He showed the council on a map where the
concerts were located.
Councilmember Rizzi asked if
they paid extra fees in order to get the conditional use permit
or go before the planning and zoning commission.
Senior Planner Rudy Esquivias
stated they paid the standard fee required for any conditional
use permit . Any conditional use permit has a fee associated
with it and also an advertising fee. That fee is charged to
anybody requesting a conditional use permit . There were no
extra fees, per se, because of the type of proposal being made.
Councilmember Rizzi commented
say this goes away and they need to come in and get a permit for
another event . She asked if they would have to pay the fees
again.

stated they will .

commented if they rescind the commission conditional use permit
and Mr. Mohiuddin wants to come back next year and reconfigure
the whole activity area and apply for a conditional use permit
again, he would have to pay a new fee.
Councilmember Wilson asked
what would be the effect if they move the plans around that have
been currently approved, such as moving the stage, parking and
whatever else had to be done to make the changes.
Senior Planner Rudy Esquivias
stated there is a fourth option here. They can continue the
item and give staff a reasonable amount of time to work with Mr.
Mohiuddin and the neighbors to maybe reconfigure the site plan
in a manner that is acceptable to everybody and come back to the
council for a decision at that time.
Councilmember Wilson asked if
they can ask a question of the first person who was up here .
City Attorney Joel Stern
stated they can ask a question of the appellant. Zoning Code 1-
1612 does allow them to modify the decision, not just overrule
it or uphold it. Some modification is allowed. If they want
they can continue this and do it to a date certain so that it
does not have to be advertised. During that time he can have a
neighborhood meeting and the city should be included in that.
There will be a new site plan if there is a change.
Mayor Insalaco asked Mr.
^ Johnson to address the council. He asked what he thought of
continuing the item to allow them to work together.
Mr. Jim Johnson asked if that
is like tabling it .
Mayor Insalaco commented yes,
but it is not really tabling it .
City Attorney Joel Stern
stated they are technically not tabling it. They are extending

the time to work on it and it will come back to the council to
be considered again. It will be another public hearing.
Councilmember Wilson
commented it will give him the opportunity to work together with
Mr. Mohiuddin to come up with something they are both in
agreement to if at all possible.
Mr. Jim Johnson stated they
are willing to work with him. He wished he had approached them
before he did any of this . It might have saved a lot of time,
energy and money. He was not aware of it at all . He just now
got it . If they can come up with some kind of game plan that
everybody is happy with he does not see any reason not to
continue it . Whichever way would be the easiest, simplest and
most economical he is all for. He will pass this on to the
other neighbors in the area. One is in attendance, one has
health issues and one is working. He thinks it might be okay.
Mayor Insalaco asked Mr.
Mohiuddin what he thought of the issue.
Mr. Mehmood Mohiuddin stated
it is okay. They can be given a time period to work with them.
He is up for whatever is better for everybody.
Councilmember Wilson
commented they might want to suggest to put this off to a date
certain.
City Attorney Joel Stern
reminded them that this is a public hearing. They need to open
it up to the public and then they can make a motion.
Mayor Insalaco opened the
public hearing on the item and called Cristina Driscoll .
Ms . Cristina Driscoll, 1852
N. Goldfield, Apache Junction, addressed the council . She
stated she would like to discuss something that was not
discussed the last time. She is from Goldfield Road and they
can hear it all the way over there. She has some neighbors that
were not able to make it tonight . She cannot really speak for

them but one is in the hospital . She asked them to take into
consideration some type of testing before this is completely
approved, some kind of sound testing. If she is in bed at night
on Goldfield Road and she can hear it, she has nothing but
sympathy for her neighbors that are on Cortez who were having a
barbecue and could not even hear each other speak outside. She
asked them to be caring and considerate, especially if the sound
is traveling that far.
Mayor Insalaco commented if
they change the stage and the speakers are heading the other
way, she will be surprised in the reduction in sound that will
happen.
Ms . Cristina Driscoll stated
she hoped so.
Mayor Insalaco commented he
could not guarantee it, but being a musician himself and dealing
with this stuff, changing the position could help a great deal .
Councilmember Rizzi commented
if she remembered correctly, she thought these events were
supposed to end by 9 p.m. She asked if that was part of the
approval . They will not be playing into the middle of the
night . That is something she may need to know.

stated under the conditional use permit the events must end at 9
p.m.
Mr. Mehmood Mohiuddin stated
they are to end at 9 p.m. The noise ordinance is at 10 p.m.
They are not breaking any state or city regulations . The last

one was finished up by 5: 30 p.m. and the other by 7 : 30 p.m.
Under the conditional use permit they have to be done by 9: 00
p.m. They will make an effort to be done before that to make
sure the neighbors are not interrupted by them. They are not
violating city or state rules or regulations or the noise
ordinance. That is what they are planning to do. They would
like to work with the neighbors . He thanked the mayor for being
a musician and saying changing the speakers will make a huge
difference.
City Attorney Joel Stern
stated he is not sure that is exactly accurate. He does not
believe there is a 10 : 00 p.m. prohibition. In fact, disorderly
conduct, which is a state statute, noise can happen any time and
if it does, it is still a crime, depending on the criminal
intent. There is also a criminal nuisance statute and there is
no time limit for those. He is not sure there is a 10 : 00 p.m.
curfew on noise. He is not sure that is accurate.
Mayor Insalaco commented he
thought he had heard that it was 11 : 00 p.m. at one time.
City Attorney Joel Stern
stated there is a construction noise ordinance but he does not
recall the exact times. He believes they can start at 6: 00 a.m.
and must finish by 8 : 00 p.m. , but he does not remember
definitely. But that is construction noise, not from a stage or
band But he can look into that . He does not think it is
correct .
Mayor Insalaco asked him to
look into that if he could. He then closed the public hearing
with no one else wishing to speak and called for any council
discussion.
Councilmember Serdy commented
he is encouraged by all the parties wanting to work together and
keep an open dialogue. He thinks that once it gets approved and
there is another event, there still may be some problems . If
so, then they can keep working through it until it gets right.
There could be more barriers and more positioning until it is
done. He thinks this is good for the community and the area if
they can all make it work.

Councilmember Evans commented
she thinks it is great the neighbors are willing to listen and
possibly have this work for everyone. But with the amount of
land that is there now that he can work with, even on the
furthest south piece, if that stage faced Apache Trail and
completely got the noise going away from all residences, she
thinks it can be reconfigured easily enough that most of the
problems could be eliminated. If there was nothing but parking
on the far east section so that the noise was all deflected to
the north and west possibly. That would help tremendously.
Mayor Insalaco commented that
is what he was saying, to turn it 180 degrees .
Councilmember Evans commented
and moved further south. It should not be in the parcel behind
the building because that is part of the reflection. It should
be facing parking the 35 cars .
Councilmember Waldron
commented he is encouraged as well to have the neighbors work
with him. The council actually asked him to do that before this
even started which would have resolved a lot of these issues
before it got this far. He hopes they are able to reach some
type of an agreement If not, they can take the appropriate
action.

these discussions and whatever is going to happen need to be
completed by a week from tomorrow in order to get it through the
system and on to the agenda.

commented he does not understand what the purposes are for these
possible additional boards and commissions .

McCray stated she has a high overview as to what some of these
are. They had asked at the last meeting that she not do all the _
research prior to coming back to them. She will try to provide
them with additional information on each of them that they wish.
The age-friendly commission was found in the City of Maricopa.
It brings together folks of all ages, 20-years-old up to 80
plus, to reduce socialized isolation, provides the older
generation with more social opportunities, more civic
opportunities, and brings together various groups of individuals
from different ethnic and racial backgrounds, financial
backgrounds, representing faith, veteran and nonprofit groups.

Four construction firms were contacted to provide cost proposals utilizing cooperative
contracts with other agencies Two of the four firms were not able to provide proposals. Two
cost proposals were received on Tuesday, March 17, 2015 The cost proposals ranged from
$221,815 25 to $361.630.32.
This project includes removal and replacement of sixty concrete curb returns and curb ramps,
removal/replacement of concrete curb & gutter, and other concrete related improvements.

CONSTRUCTION AGREEMENT
PROJECT:
PWC2014-01 Apache Trail / Old West Highway Improvements — Phase 1
THIS AGREEMENT made and entered into by and between the CITY
OF APACHE JUNCTION ("City") , an Arizona municipal corporation,
and VINCON, INCORPORATED, an Arizona corporation, ("Contractor") ,
sometimes collectively referred to as the "Parties".
RECITALS
A. Contractor asserts its willingness, ability and
qualifications to provide the work and service called
for in Proposal Number 15-091 and Contractor' s estimate
dated 03/16/2015 (the "Contract Documents") .
B. City and Contractor desire to set forth herein their
respective responsibilities and the manner and terms
upon which Contractor shall render such services .
C. City has complied with the public bidding requirements
under Arizona Revised Statutes Title 34 and Apache
Junction City Code Vol . I, Chapter 3, Administration,
Article 3-7, Procurement Procedures.
AGREEMENT
NOW, THEREFORE, City retains Contractor to perform, and
Contractor agrees to render the services in accordance with the
terms and conditions set forth as follows :
1 . PROJECT DESCRIPTION: Contractor shall do and perform
or cause to be done and performed in a good workmanlike manner,
the work in accordance with and as more fully described in
Proposal Number 15-091 and Contractor' s estimate dated 03/16/2015
including, but not limited to:
A. 2, 119 Linear feet of removal of concrete curb.
B. 16, 136 Square feet of removal of concrete sidewalk.
C. 2, 147 Linear Feet of concrete curb and gutter
D. 16, 136 S. F. of concrete sidewalk ramps.
E. 750 Square Feet of detectable warning tiles at curb
ramps .
F. Removal and replacement of 433 square yards of
pavement .
G. Provide traffic control, including uniformed police.

2 . PAYMENTS & COMPLETION: The total amount payable by
the City to the Contractor in the amount not to exceed two
hundred twenty one thousand eight hundred fifteen dollars and
twenty-five cents ($221, 815 . 25) (the "Contract Sum") for the
performance of the work under the Contract Documents except for
changes authorized by properly executed Change Orders. All
contracts will be operable for their full term at the rates
quoted in the initial bid proposal, unless otherwise extended in
writing by the City. Upon notice that the work is ready for final
inspection or acceptance, a City representative shall promptly
cause an inspection to be made. Once City finds the work
acceptable under the Contract Documents, City shall promptly
submit for processing a certificate for payment stating that, to
the best of its knowledge, information and belief on the basis of
its observation and inspection, the work has been completed in
accordance with the terms and conditions of the Contract
Documents and that partial payment or the entire balance due the
Contractor is payable. Final payment shall not become due until
the Contractor submits to the all required lien waivers,
releases and any other data establishing payment or satisfaction
of all Contractor' s obligations . If any Subcontractor refuses to
furnish a release or waiver required by City, Contractor may
furnish a bond satisfactory to the owner to indemnify City
against any such lien. If any such lien remains unsatisfied
after all payments are made, Contractor shall refund to City all
monies that the latter may be compelled to pay in discharging
such liens, including all costs and reasonable attorneys fees.
3 . CONTRACT TERM: Contractor hereby fixes the time for
completion of said work as May 8, 2015 . This provision does not
limit the liability of Contractor for actual damages sustained by
City as a result of any breach of contract or warranty by
Contractor. Extensions may be approved at times as the Parties
mutually deem fit.
4. LABOR AND MATERIALS: Unless otherwise provided in the
Contract Documents, Contractor shall provide, pay for and insure
under the requisite laws and regulations all labor, materials,
equipment, tools and machinery, water, heat, utilities,
transportation, other facilities and services necessary for the
proper execution and completion of the work, whether temporary or
permanent, and whether or not incorporated or to be incorporated
in the work.
5 . INSPECTIONS AND QUALITY OF WORK: Contractor understands
and agrees that inspection of the work performed hereunder will
occur by City. Contractor agrees that City will have the
exclusive right to determine, in its sole discretion, whether the
work has been performed in accordance with the Contract

Documents . Contractor further agrees to make such corrections to
the work as may be directed by City to conform to said Contract
Documents without requirement of a Change Order or any additional
charge or cost to City whatsoever.
6. WARRANTY: Contractor shall guarantee the work against
defective workmanship or materials for a period of one (1 ) year
from the date of its final acceptance under the contract,
ordinary wear and tear and unusual abuse or neglect excepted.
Any omission on the part of City to condemn defective work or
materials at the time of construction shall not be deemed an
acceptance and Contractor will be required to correct defective
work or materials at any time before final acceptance. Within
one (1) year from the date of final acceptance due to faults in
workmanship or materials, Contractor shall begin making the
necessary repairs to the satisfaction of City within fourteen
(14 ) calendar days of receipt of written notice from City. Such
work shall include the repair or replacement of other work or
materials damaged or affected by making the above repairs or
corrective work all at no additional cost to City. In the case
of work materials or equipment for which warranties are required
by the special provisions of the Contract Documents, Contractor
shall provide or secure from the appropriate subcontractor or
supplier such warranties addressed to and in favor of City and
deliver same to City prior to final acceptance of the work.
Delivery of such warranties shall not relieve Contractor from any
obligation assumed under any other provision of the contract .
The warranties and guarantees provided in this subsection of the
Contract Documents shall be in addition to and not in limitation
of any other warrantees, guarantees or remedies required by law,
and shall survive the expiration of this Agreement for the time
period mentioned above.
'n. 7 . TAXES: Contractor shall pay all license, sales,
consumer, transaction privilege, use and other similar taxes for
the work or portions thereof provided by Contractor which are
legally enacted at the time bids are received whether or not yet
effective or subsequently applicable due to acts of jurisdictions
or bodies other than City.
8 . PERMITS & FEES: Unless otherwise provided in the
Contract Documents, Contractor shall secure and pay for all
permits, government fees, licenses and inspections necessary for
the proper execution and completion of work which are customarily
secured after execution of the contract and which are legally
required. Contractor shall give all notices and comply with all
laws, ordinances, rules, regulations and lawful orders of any
public authority bearing on the performance of the work.
Contractor represents and warrants that any license necessary to
perform the work under this Agreement is current and valid.

Contractor understands that the activity described herein
constitutes "doing business in the City of Apache Junction” and
Contractor agrees to obtain a business license pursuant to
Article 8-2 of the Apache Junction City Code, Vol. I, and keep
such license current during the term of this Agreement .
Contractor also acknowledges that the tax provision of the Apache
Junction Tax Code, Chapter 8A, may also apply and if so, shall
obtain a privilege license. Any activity by subcontractors
within the corporate city limits will invoke the same business
and privilege license regulations on any subcontractors, and
Contractor ensures its subcontractors will obtain any required
licenses . If there are taxable activities, a business license
shall be converted to a privilege license by the Contractor and
any subcontractors through the City Clerk' s Office.
9. INDEPENDENT CONTRACTOR: Contractor shall at all times
during Contractor' s performance of the services retain
Contractor' s status as an independent contractor. Contractor' s
employees shall under no circumstances be considered or held to
be employees or agents of City, and City shall have no obligation
to pay or withhold state or federal taxes, or provide workers
compensation or unemployment insurance for or on behalf of them
or Contractor. Contractor shall supervise and direct the
delivery of the materials using its best skill and attention.
Except as provided in this Agreement, Contractor shall be solely
responsible for all construction means, methods, techniques,
sequences and procedures, and for coordinating all portions of
the work required by the Contract Documents . Contractor shall be
responsible to City for the acts and omissions of its employees,
subcontractors and their agents and employees and other persons
providing any of the materials under any contract document.
10 . SUPERINTENDENT: Contractor shall employ a competent
project superintendent who shall be in attendance at the project ~
site during the progress of the work. The superintendent shall
represent and be the community agent of Contractor and
communications given to the superintendent shall be as binding as
if given to Contractor. Important communications shall be
confirmed in writing. The designated superintendent shall be
designated for each project and communicated to City before work
is performed.
11. PROGRESS SCHEDULE: Contractor shall, immediately
after entering into this Agreement, generate an estimated
progress schedule, which shall be maintained and updated during
the project . Work may progress during regular City business
hours only if it is determined by City not to disturb normal
operations .

12 . INDEMNIFICATION: To the fullest extent permitted by
law, Contractor shall defend, indemnify and hold harmless City,
its elected and appointed officers, officials, agents, and
employees from and against any and all liability including but
not limited to demands, claims, actions, fees, costs and
expenses, including attorney and expert witness fees, arising
from or connected with or alleged to have arisen from or
connected with, relating to, arising out of, or alleged to have
resulted from the acts, errors, mistakes, omissions, work or
services of Contractor, its agents, employees, or any tier of
Contractor' s subcontractors in the performance of this Agreement.
Contractor duty to defend, hold harmless and indemnify City, its
Special Districts, elected and appointed officers, officials,
agents, and employees shall arise in connection with any tortious
claim, damage, loss or expense that is attributable to bodily
injury, sickness, disease, death, or injury to, impairment, or
destruction of property including loss of use resulting
therefrom, caused by an Contractor' s acts, errors, mistakes,
omissions, work or services in the performance of this Agreement
including any employee of Contractor, any tier of Contractor' s
subcontractor or any other person for whose acts, errors,
mistakes, omissions, work or services Contractor may be legally
liable.
13. SUBCONTRACTORS: All subcontractors chosen by
Contractor will be subject to City' s approval . All
subcontractors shall be identified by Contractor prior to award
of contract . Contractor shall make no substitutions for any
subcontractor, person or entity previously selected without the
approval of City.
14 . APPLICABLE LAW AND VENUE: The terms and conditions of
this Agreement shall be governed by and interpreted in accordance
with the laws of the State of Arizona. Any action at law or in
equity brought by either Party for the purpose of enforcing a
right or rights provided for in this Agreement, shall be tried in
a court of competent jurisdiction in Pinal County, State of
Arizona. The Parties hereby waive all provisions of law
providing for a change of venue in such proceeding to any other
county. In the event either Party shall bring suit to enforce
any term of this Agreement or to recover any damages for and on
account of the breach of any term or condition in this Agreement,
it is mutually agreed that the prevailing Party in such action
shall recover all costs including: all litigation and appeal
expenses, collection expenses, reasonable attorneys' fees,
necessary witness fees and court costs to be determined by the
court in such action.
15 . INSURANCE: Contractor, at its own expense, shall
purchase and maintain the herein stipulated minimum insurance

with companies duly licensed, possessing a current A.M. Best,
Inc. Rating of B++6, or approved unlicensed in the State of
Arizona with policies and forms satisfactory to City.
All insurance required herein shall be maintained in full force
and effect until all work or service required to be performed
under the terms of the Agreement is satisfactorily completed and
formally accepted; failure to do so may, at the sole discretion
of City, constitute a material breach of this Agreement .
Contractor' s insurance shall be primary insurance as respects the
City, and any insurance or self-insurance maintained by City
shall not contribute to it .
Any failure to comply with the claim reporting provisions of the
insurance policies or any breach of an insurance policy warranty
shall not affect coverage afforded under the insurance policies
to protect City.
The insurance policies, except Workers' Compensation, shall
contain a waiver of transfer rights of recovery (subrogation)
against City, its agents, officers, officials and employees for
any claims arising out of Contractor' s acts, errors, mistakes,
omissions, work or service.
The insurance policies may provide coverage which contains
deductibles or self-insured retentions . Such deductible and/or
self-insured retentions shall not be applicable with respect to
the coverage provided to City under such policies . Contractor
shall be solely responsible for the deductible and/or self
retention and City, at its option, may require Contractor to
secure payment of such deductibles or self-insured retentions by
a Surety Bond or an irrevocable and unconditional letter of
credit. '^
City reserves the right to request and to receive, within ten
(10) working days, certified copies of any or all of the herein
required insurance policies and/or endorsements. City shall not
be obligated, however, to review same or to advise Contractor of
any deficiencies in such policies and endorsements, and such
receipt shall not relieve Contractor from, or be deemed a waiver
of, City' s right to insist on strict fulfillment of Contractor' s
obligations under this Agreement.
The insurance policies, except Workers' Compensation and
Professional Liability, required by this Agreement, shall name
City, its agents, officers, officials and employees as Additional
Insureds .

REQUIRED COVERAGE
Commercial General Liability
Contractor shall maintain Commercial General Liability insurance
with a limit of not less than $1, 000, 000 for each occurrence with
a $2, 000, 000 Products/Completed Operations Aggregate and a
$2, 000, 000 General Aggregate limit. The policy shall include
coverage for bodily injury, broad form property damage, personal
injury, products and completed operations and blanket contractual
coverage including, but not limited to, the liability assumed
under the indemnification provisions of this Agreement, which
coverage will be at least as broad as that on Insurance Service
Office, Inc. Policy Form No. CG 00011093, or any replacements
thereof.
Such policy shall contain a severability of interest provision,
and shall not contain a sunset provision or commutation clause,
nor any provision which would serve to limit third party action
over claims .
The Commercial General Liability additional insured endorsement
shall be at least as broad as the Insurance Service Office,
Inc. ' s Additional Insured, Form B, CG 20101185, and shall include
coverage for Contractor' s operations and products and completed
operations .
If required by this Agreement, if Contractor sublets any part of
the work, services or operations, Contractor shall purchase and
maintain, at all times during prosecution of the work, services
or operations under this Agreement, an Owner and Contractor' s
Protective Liability insurance policy for bodily injury and
property damage, including death, which may arise in the
prosecution of Contractor' s work, service or operations under
this Agreement . Coverage shall be on an occurrence basis with a
limit not less than $1, 000, 000 per occurrence, and the policy
shall be issued by the same insurance company that issues
Contractor' s Commercial General Liability insurance.
Automobile Liability
Contractor shall maintain Commercial/Business Automobile
Liability insurance with a combined single limit for bodily
injury and property damage of not less than $1, 000, 000 each
occurrence with respect to Contractor' s owned, hired, and non-
owned vehicles assigned to or used in performance of Contractor' s
work. Coverage will be at least as broad as coverage code 1,
"any auto", (Insurance Service Office, Inc. Policy Form CA
00011293, or any replacements thereof) . Such insurance shall
include coverage for loading and off loading hazards. If

hazardous substances, materials or wastes are to be transported,
MCS 90 endorsement shall be included and $5, 000, 000 per accident
limits for bodily injury and property damage shall apply.
Workers' Compensation
Contractor shall carry Workers' Compensation insurance to cover
obligations imposed by federal and state statutes having
jurisdiction of Contractor' s employees engaged in the performance
of the work or services; and, Employer' s Liability insurance of
not less than $100, 000 for each accident, $100, 000 disease for Adm.
each employee, and $500, 000 disease policy limit .
By execution of this Agreement, Contractor certifies as follows :
"I am aware and understand the provisions of A.R. S . § 23-900
et seq. which requires every employer to be insured against
liability for workers' compensation or to undertake self-
insurance in accordance with the provisions of this chapter,
and I will comply with such provisions before commencing the
performance of the work of this Agreement . "
If Contractor has no employees for whom workers' compensation
insurance is required, Contractor shall submit a declaration or
affidavit to City so stating and covenanting to obtain such
insurance if and when Contractor employs any employees subject to
coverage.
In case any work is subcontracted, Contractor will require
subcontractors to provide Workers' Compensation and Employer' s
Liability insurance to at least the same extent as required of
Contractor.
Professional Liability
Contractor retained by City to provide the work or service
required by this Agreement will maintain Professional Liability
insurance covering acts, errors, mistakes and omissions arising
out of the work or services performed by Contractor, or any
person employed by Contractor, with a limit of not less than
$1, 000, 000 each claim.
Certificates of Insurance
Prior to commencing work or services under this Agreement,
Contractor shall furnish City with Certificates of Insurance, or
formal endorsements as required by the Agreement, issued by
Contractor' s insurer (s) , as evidence that policies providing the
required coverages, conditions and limits required by this
Agreement are in full force and effect. The form of the
certificates of insurance and endorsements shall be subject to

the approval of the Apache Junction City Attorney' s Office, shall
comply with the terms of this Agreement, and shall be issued and
delivered to City Attorney, City of Apache Junction, 300 East
Superstition Boulevard, Apache Junction, AZ 85119.
In the event any insurance policies required by this Agreement
are written on a "claims made" basis, coverage shall extend for
two (2) years past completion and acceptance of Contractor' s work
or services and as evidenced by annual Certificates of Insurance.
If a policy does expire during the life of the Agreement, a
renewal certificate must be sent to City thirty (30) calendar
days prior to the expiration date.
All Certificates of Insurance shall be identified with bid serial
number and title. Policies or certificates and completed forms
of City' s Additional Insured Endorsement (or a substantially
equivalent insurance company form acceptable to the City
Attorney) evidencing the coverage required by this section shall
be filed with the City and shall include the City as an
additional insured. The policy or policies shall be in the usual
form of a public liability insurance, but shall also include the
following provision:
"Solely as respects work done by or on behalf of the named
insured for the City of Apache Junction, it is agreed that
the City of Apache Junction and its officers and employees
are added as additional insureds under this policy. "
Insurance required herein shall not expire, be canceled, or
materially changed without thirty (30) calendar days' prior
written notice to City.
16. CHANGE ORDERS: A Change Order is a written order to
Contractor, approved by a City representative, issued after
execution of this construction agreement authorizing a change in
the work or an adjustment in the construction agreement sum or
the construction agreement time. A Change Order signed by
Contractor indicates his agreement therewith. City may, without
invalidating this construction agreement, order changes in the
work within the general scope of this construction agreement
consisting of additions, deletions or other revisions, the
construction agreement sum and the construction agreement being
adjusted accordingly. All such changes in the work shall be
authorized by Change Order and shall be performed under the
applicable conditions of this construction agreement . City
representative shall have authority to order minor changes in the
work not involving an adjustment in the construction agreement
sum or extension of construction agreement time and not
inconsistent with the intent of this construction agreement. All

such changes shall be effected by written order and shall be
binding upon City and Contractor.
17 . SUCCESSORS & ASSIGNS: City and Contractor each bind
themselves, their partners, successors, assigns and legal
representatives to the other Party hereto and to the partners,
successors, assigns and legal representatives of such other Party
in respect to all covenants, agreements and obligations contained
in the contract documents . Neither Party to the contract shall
assign the contract or sublet it as a whole without the written
consent of the other, nor shall Contractor assign any monies due
or to become due to or to become due to it without the previous
written consent of City.
18 . WRITTEN NOTICE: Written notice shall be deemed to
have been duly served if delivered in person to the individual or
member of the firm or entity, or to an office of the corporation
for whom it was intended or if delivered at or sent registered or
certified mail, return receipt requested, and first class postage
prepaid to the last business address known to them who gives the
notice.
19. CLAIMS FOR DAMAGES : Should either Party to the
contract suffer injury or damage to personal property because of
any act or omission of the other Party or of their employees or
agents for whose acts they are legally liable, claims shall be
made in writing to such other parties within a reasonable time
after the first observance of such injury or damages .
20 . LABOR & MATERIAL PAYMENT BOND: City shall have the
right to require Contractor to furnish bonds covering the
faithful performance of the contract and the payment of all
obligations arising hereunder. Attached are standard bond forms
which must be completed by Contractor, and Contractor agrees to
conform to all provisions set forth in such forms .
21. SAFETY: Contractor and/or its subcontractors shall be
solely responsible for job safety at all times .
22 . RIGHTS & REMEDIES: The duties and obligations imposed
by the Contract Documents and the rights and remedies available
hereunder shall be in addition to and not a limitation of any
duties, obligations, rights and remedies otherwise imposed or
available by law. No action or failure to act by City or
Contractor shall constitute a waiver of any right or duty
afforded any of them under the contract, nor shall any action or
failure to act constitute an approval of or an acquiescence to
any breaches hereunder except as may be specifically agreed to
in writing.

23 . FORCE MAJEURE: Neither City nor Contractor, as the
case may be, shall be considered not to have performed its
obligations under this Agreement in the event of enforced delay
(an "Enforced Delay") due to causes beyond its control and
without its fault or negligence or failure to comply with
applicable laws, including, but not restricted to, acts of God,
fires, floods, epidemics, pandemics, quarantine, restrictions,
embargoes, labor disputes, and unusually severe weather or the
delays of subcontractors or materialmen due to such causes, acts
of a public enemy, war, terrorism or act of terror (including but
not limited to bio-terrorism or eco-terrorism) , nuclear
radiation, blockade, insurrection, riot, labor strike or
interruption, extortion, sabotage, or similar occurrence or any
exercise of the power of eminent domain of any governmental body
on behalf of any public entity, or a declaration of moratorium or
similar hiatus (whether permanent or temporary) by any public
entity directly affecting the obligations under this Agreement.
In no event will Enforced Delay include any delay resulting from
unavailability for any reason of labor shortages, or the
unavailability for any reason of particular Contractors,
subcontractors, vendors or investors desired by Contractor in
connection with the obligations under this Agreement . Contractor
agrees that Contractor alone will bear all risks of delay which
are not Enforced Delay. In the event of the occurrence of any
such Enforced Delay, the time or times for performance of the
obligations of the Party claiming delay shall be extended for a
period of the Enforced Delay; provided, however, that the Party
seeking the benefit of the provisions of this Section shall,
within thirty (30) calendar days after such Party knows or should
know of any such Enforced Delay, first notify the other Party of
the specific delay in writing and claim the right to an extension
for the period of the Enforced Delay; and provided further that
in no event shall a period of Enforced Delay exceed ninety (90)
eS calendar days.
24 . TERMINATION:
A. TERMINATION BY CITY: City shall be permitted to
terminate this Agreement if in the discretion of the Public
Works Director or his or her designee, believes Contractor has
failed to meet the terms of this Agreement. City shall provide
Notice of Termination to Contractor by Certified U. S. Mail ten
(10) calendar days before such termination takes effect.
B. TERMINATION BY CONTRACTOR: Contractor may terminate
this Agreement if City fails to make payment as agreed upon in
this document. Any other termination will be deemed a breach of
contract by Contractor. Contractor shall provide Notice of
Termination to City by Certified U. S. Mail ten (10) calendar
days before such termination takes effect.

25. RECORDS: Records of Contractor' s labor, payroll and
other costs pertaining to this Agreement shall be kept on a
generally recognized accounting basis and made available to City
for inspection on request . Contractor shall maintain records for
a period of at least two (2) years after termination of this
Agreement, and shall make such records available during that
retention period for examination or audit by City personnel
during regular business hours .
26. AMENDMENT: It is mutually understood and agreed that
no alteration or variation of the terms and conditions of this
Agreement shall be valid unless made in writing and signed by the
Parties hereto, and that oral understandings or agreements not
incorporated herein shall not be binding on the parties The
representatives of the Parties (signatory for Contractor noted
below or his or her designee, and the City Manager, or his or her
designee) shall be authorized to execute future amendments or
extensions of this Agreement.
27. SEVERABILITY: City and Contractor each believe that
the execution, delivery and performance of this Agreement are in
compliance with all applicable laws . However, in the unlikely
event that any provision of this Agreement is declared void or
unenforceable (or is construed as requiring City to do any act in
violation of any applicable laws, including any constitutional
provision, law, regulation, or City Code) , such provision shall
be deemed severed from this Agreement and this Agreement shall
otherwise remain in full force and effect; provided that this
Agreement shall retroactively be deemed reformed to the extent
reasonably possible in such a manner so that the reformed
agreement (and any related agreements effective as of the same
date) provide essentially the same rights and benefits (economic
and otherwise) to the Parties as if such severance and _
reformation were not required. Unless prohibited by applicable
laws, the Parties further shall perform all acts and execute,
acknowledge and/or deliver all amendments, instruments and
consents necessary to accomplish and to give effect to the
purposes of this Agreement, as reformed.
28. CONFLICT OF INTEREST: This Agreement is subject to,
and may be terminated by City in accordance with, the provisions
of A.R. S. § 38-511 .
29. COMPLIANCE WITH FEDERAL AND STATE LAWS: Contractor
understands and acknowledges the applicability of the American
with Disabilities Act, the Immigration Reform and Control Act of
1986 and the Drug Free Workplace Act of 1989 to the services
performed under this Agreement.

As required by A.R. S. § 41-4401, Contractor hereby warrants its
compliance with all federal immigration laws and regulations that
relate to its employees and A.R.S. § 23-214 (A) . Contractor
further warrants that after hiring an employee, Contractor will
verify the employment eligibility of the employee through the E-
Verify program. If Contractor uses any subcontractors in
performance of services, subcontractors shall warrant their
compliance with all federal immigration laws and regulations that
relate to its employees and A.R. S. § 23-214 (A) , and
subcontractors shall further warrant that after hiring an
employee, such subcontractor verifies the employment eligibility
of the employee through the E-Verify program. A breach of this
warranty shall be deemed a material breach of the Agreement that
is subject to penalties up to and including termination of this
Agreement. Contractor is subject to a penalty of $100 per day
for the first violation, $500 per day for the second violation,
and $1, 000 per day for the third violation. City at its option
may terminate this Agreement after the third violation.
Contractor shall not be deemed in material breach of this
Agreement if the Contractor and/or subcontractors establish
compliance with the employment verification provisions of
Sections 274A and 274B of the federal Immigration and Nationality
Act and the E-Verify requirements contained in A.R. S. § 23-
214 (A) . City retains the legal right to inspect the papers of
any Contractor or subcontractor employee who works under this
Agreement to ensure that the Contractor or subcontractor is
complying with the warranty. Any inspection will be conducted
after reasonable notice and at reasonable times . If state law is
amended, the Parties may modify this paragraph consistent with
state law.

APRIL 12-18,2015
WHEREAS, the First Things First Pinal Regional Partnership Council and
local partner organizations, in conjunction with the National
Association for the Education of Young Children, are
celebrating the Week of the Young Child, April 12-18,2015;
and
WHEREAS, these organizations are working to improve early learning
opportunities, which are crucial to the growth and
development of young children, and building a foundation of
learning for everyone in Apache Junction; and
WHEREAS, all young children and their families in the State of Arizona
and Apache Junction deserve access to high-quality early
childhood education; and
WHEREAS, public policies and programs that support early learning for
all young children are critical to young children s futures and
the success of our community, and

An application for a Special Event Liquor License has been submitted by Mr. Tim Sicocan
of the Boys & Girls Club of the East Valley — Apache Junction Branch for a fundraising
event to be held on April 11, 2015, at the Dolce Vita Community Center ballroom, 3301 S.
Goldfield, Apache Junction
Correspondence has been received from the building division, planning division, police
department and fire district, a copy of which is attached. The next step in the procedure
is for the City Council to hold a public hearing on the application and make a
recommendation for approval or denial to be forwarded to the State Department of Liquor
Licenses and Control.

Dear Mr. Mohiuddin:
It has been observed that you have removed and replaced the lighting fixtures that were approved and
incorporated as part of the site plan in the Third Amendment to the Economic Development Agreement
with the City of Apache Junction. This is a contractual breach and is a violation of the City's Dark Sky
lighting ordinance.
You are also notified that violations of the City's sign code exist with the placement of too many
banners. In particular, you were informed via letter dated November 191h, 2014 that the AZ Trail
Riding.com operation was not permitted unless it was approved as part of a conditional use permit. You
indicated that Mr. McFadden was no longer permitted to use the site for staging horse rentals, yet a
banner for his business is displayed on your building. Consequently, in addition to having too many
banners, the McFadden banner is an illegal off site sign. This is a contractual breach and is a violation of
the Sign Code.
Finally, you have permitted the construction of the pretend western building facades without the
requisite engineering and permit. You are instructed to remedy these matters within 14 days. Failure to
remedy the contractual breaches and violations outlined herein within this time period may cause the
City to take further action including but not limited to those specified in the economic development
agreement and the amendments thereto and enforcement action as permitted under the City code.
Any further changes to the operation of the Hitching Post/Dash In facility, including expanding the
licensed premises require an amendment to the economic development agreement(s) including but not
limited to a new site plan. The proposed permanent extension of the licensed premises for your liquor
license will require additional building code review and may trigger requirements related to maximum
occupancy,routes of egress,Americans with Disabilities Act (ADA)considerations, and fire sprinklers.
This will also require a review of the existing septic system's ability to accommodate additional
occupancy loads. In addition, should your pending conditional use permit application be approved these
same building code matters will need to be addressed.

Dear Mr. Mohiuddin.
Thank you for meeting with me, Rudy Esquivias, Senior Planner and Dave Zeilner, Building Official on
Monday, March 30,2015 at the Hitching Post. Present at the meeting were your brother Zee and Tina
Lovelace and yourself During the meeting we discussed the current status of the Conditional Use
Permit(CUP)application and the extension of liquor license application. You indicated that you were
no longer interested in pursuing either of these matters for several reasons. I indicated to you that the
CUP application and its appeal was a matter that was scheduled for another city council meeting on
April 21 and could not be stopped at this time Rudy and I inquired as to whether you wanted us to set
up a neighborhood meeting. You stated that we did not have to because you were not interested in the
CUP any longer.
As for the extension of the licensed premise for your liquor license,we noted that you would need to put
your request to withdraw in writing. As of the date of this letter, you have not sent any correspondence
to City Clerk,Kathy Connelly offering to withdraw your application.

We then discussed the violations that were outlined in my letter dated March 24,2015. We noted the
electrical work done without permits for the proposed lights for the bull riding venue and conduit that
was installed. We directed that you obtain an electrical permit for this work and any and all electrical

sky lighting ordinance compliant. We noted that the four light fixtures along the north fence were
returned to their original locations as shown on the approved site plan Please ensure that all electrical
work is completed by a licensed electrical contractor(with property permits issued) and that City
Building Inspector Tracy Post is contacted for all required inspections. Until the electrical work is
inspected and approved, there continues to be a contractual breach of the Economic Development
Agreement and a violation of the City's Dark Sky lighting ordinance.
We then discussed the sign code violations and we noted that you had removed the McFadden AZ Trail
Riding.com banner. It is our continued understanding that Mr. McFadden is not using the site for
staging horse rentals and this activity is not permitted without a CUP. One additional signage banner

Finally, you permitted the construction of the pretend western building facades without the requisite
engineering and permit. You were instructed to remedy these matters within 14 days of March 24th The
architect contacted Rudy Esquivias and indicated that he is working with an engineer. Rudy indicated to
your architect that a permit needs to be applied for that includes engineering for the structure. The city
will grant an extension until April 21, 2015 to apply for a permit Now that you have stated that you are
no longer interested in a CUP or the extension of the licensed premises, it is unclear how you intend to
utilize the pretend western building facades. Please inform the city what the intended purpose of the
facades are going to be.

Consultants, gave a presentation on the findings and recommendations resulting from a
pay study done in FY 14-15. A copy of his memo is attached.
If you wish to implement the recommendations, the first step requires an amendment to the
FY 2014-2015 Classification and Compensation Plan as adopted by Resolution No 14-18
on June 16, 2014. Resolution No. 15-09 and its amended exhibits implement this
amendment.

Background
The City's Classification and Compensation Study has been completed The following
summarizes the study's methodology, findings, and recommendations
Position Classification Review
Employees completed Position Analysis Questionnaires or Job Description
Questionnaires as termed in Apache Junction describing their job duties and
responsibilities; additionally, a minimum of one (1) employee from each job classification
participated in an interview with the consultant
A review of the questionnaires reveals 146 current job titles have been slightly
consolidated to 141 proposed job titles Minor job title modifications have been
proposed, and job descriptions updated, to reflect the work being performed
Salary Survey
Data on comparable positions was collected from the City's historical comparison cities,

Avondale, City of Maricopa, City of
Buckeye, City of Mesa, City of
Casa Grande, City of Oro Valley, City of
Goodyear, City of Queen Creek, Town of
Marana, City of
The survey compared the City's salary groups to the salary groups for comparable
positions at each agency, and reveals the City's current salary plan is competitive (within
5% of market) for 70% of the job titles surveyed, and below market for 30% of the jobs
surveyed. Of important note, employee actual salaries are not quite as competitive
Additional data collected on other pay practices, such as assignment pay, shift
differential, and payout of unused leave time finds the City's current practices are
aligned very similarly to the comparison cities

Compensation Plan Updatinq
The City currently utilizes a salary group structure containing nine (9) steps of 4 3%
each, making it difficult / unaffordable to provide step increases and move employees
"through" their salary group
A new salary schedule has been designed with 2 5% between each step to hopefully
provide for fairly regular movement of employees across their steps. A separate Sworn
Police group and step scale has also been designed for consideration and adoption.
Jobs have been placed on the salary schedule utilizing the available survey market data,
as well as according to current reporting relationships and internal equity The
recommended plan effectively places all salary groups "at market", or +/-5% of the
market average or median.
Implementation, Costs and Summary of Recommendations
We recommend the following sequence of implementation and ongoing salary
administration to move employee salaries on to, and within, the salary group proposed
for each job.
1) The salaries of 74 employees fall below the minimum step, and the salaries
of the remaining employees fall "between" a step within their proposed salary
group; to move them on to the Minimum or Next Nearest Step is estimated to
be $254,000 or 1.93% of base payroll (April 2015 approval, May 2015
payroll)
2) Provide each employee with a one-step increase effective July 1, 2015, cost
is estimated at $340,000 or 2.5% of base payroll
3) Starting in January 2016, seek to address compression and group/range
penetration by providing additional in-group step increase(s) for anyone
falling behind the pace of one step per year in title (January 2016, budget
dependent)
4) Continue to budget for annual step increases, conduct salary surveys every
2-4 years to identify any necessary market corrections, rather than adjusting
the proposed salary schedules by blanket percentages

APACHE JUNCTION, ARIZONA, DECLARING AS A PUBLIC RECORD
AND ADOPTING CERTAIN DOCUMENTS FILED WITH THE CITY CLERK
ENTITLED "CITY OF APACHE JUNCTION CLASSIFICATION PLAN

WHEREAS, the most recent Classification and Compensation Plans
were adopted in 2014 for all classified employees of the City of
Apache Junction; and
WHEREAS, adoption of a Classification Plan and a Compensation
Plan retains these plans as part of the budget for Fiscal Year
2014-2015; and
WHEREAS, on May 5, 2014, the Mayor and City Council adopted
the tentative budget for Fiscal Year 2014-2015 and on June 16,
2014, adopted the final budget for Fiscal Year 2014-2015,
establishing funding for and the positions as set forth in the
Classification Plan for Fiscal Year 2014-2015 and the Compensation
Plan for Fiscal Year 2014-2015; and
WHEREAS, the Mayor and City Council wish to amend and adopt an
amended Classification Plan and an amended Compensation Plan for
the remainder of Fiscal Year 2014-2015 in order to reflect the
results of a classification and compensation study budgeted for and
r completed in Fiscal Year 2014-2015.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and City Council
of the City of Apache Junction, Arizona as follows:
SECTION I DECLARING A PUBLIC RECORD
