NOTICE OF SPECIAL MEETING
OF THE
APACHE JUNCTION CITY COUNCIL
Pursuant to Arizona Revised Statutes §38-431 .02, notice is hereby
given to the Apache Junction City Council and to the general
public that the Apache Junction City Council will hold a special
meeting open to the public on Thursday, March 7, 1985, at 7:00 p.m. ,
in the Apache Junction City Council Chambers, 1001 N. Idaho Road,
Apache Junction, Arizona.
The agenda for the meeting is as follows:
1 . Call to Order -- Roll Call .
2. Public Hearing on Proposed Ordinance No. 350 (PZ-2-85),
Adoption of Apache Junction, Arizona, Zoning Ordinance and
Zoning District Map, City of Apache Junction, Arizona, which
will be added to the City Code of the City of Apache Junction,
Arizona, Volume II, Land Development Code (with the
emergency clause) .
3. Adjourment.
Copies of the agenda and additional information regarding any of the
items listed above may be obtained through the City Clerk's office,
1001 N. Idaho Road, Apache Junction, Arizona, Monday through Friday,
8:00 a.m. to 5:00 p.m. , excluding holidays.

ZONING ORDINANCE
REQUEST FOR AGENDA ITEM - MARCH 7 , 1985
Background
Proposed Ordinance No. 350 is the readoption of the Apache Junction ,
Arizona Zoning Ordinance. The text and Zoning District Map was
declared a public record by Resolution 85-05 on February 19th, and
2-page notices were run in the Mesa Tribune and the Apache Junction
News, giving ample opportunity for public awareness of the proposed
ordinance.
The memo of February 13, which was transmitted with your copy of the
proposed ordinance, details the minor revisions from our existing ordinance
(including the recently adopted commercial zones) .
Other necessary revisions not included in the draft ordinance, but which
should be included are:
1. The amendments to the new commercial zones adopted
by the Council .
2. Page 85, Section 16.0406 (3) should read, "Maximum
floor area per business shall be 4,000 square feet" .
3. There is an error on the new Zoning District Map in
Section 22 near the intersection of E. Superstition
Boulevard and Cortez Road. The CB-2 designation
should be CR-2.

4. Councilwoman Taylor suggested that a new definition
for "travel Trailers" be included. However, in
investigating our ordinance , it is apparent that all
our definitions and regulations on mobile homes ,
RV's , travel trailers , park models , etc. need
comprehensive revision and would suggest approaching
any revisions in a comprehensive manner.
Planning and Zoning Commission Recommendation
The Planning and Zoning Commission will be making their recommendation
on March 6th. I will transmit their written recommendation to the
Council on March 7th.
Recommended Motion
In the motion adopting the proposed ordinance , staff recommends the
following amendments be set forth:
1. The text of C-1 and C-3 commercial zoning district
regulations to be amended to conform with the
regulations as adopted by Ordinance No. 332.
2. Section 16.0406 (3) to read, "maximum floor area per
business shall be 4 ,000 square feet".
3. Zoning District Map to indicate CR-2 classification for
the property located at:
West 2 of the Northeast 4 of the Northeast
4 of the Northeast 4 of the Northwest ; of
Section 22 , Township 1 North, Range 8 East,
Gila and Salt River Base and Meridian.
4. (Other amendments) .

COMMISSION ON PROPOSED ORDINANCE NO. 350
At their special meeting of March 6 , 1985, the Planning and Zoning
Commission voted 5-0 (Jorgensen/Taylor) in approval of sending the
following recommendation to the City Council .
Adopted Motion
"BE IT RESOLVED by the Planning and Zoning Commission of the City of
Apache Junction , Arizona , that in case PZ-2-85 (Proposed Ordinance No.
350) that the Commission recommends to the Apache Junction City
Council the approval of said Ordinance, including the Zoning District
Map by reference, with the following amendments:
1. The text of C-1 and C-3 commercial zoning district
regulations to be amended to conform with the

originally submitted by the Zoning Ordinance Re-Write
Committee.
Reasons for Recommendation
1. This Zoning Ordinance will provide one of the implementation
mechanisms for carrying out the objectives of the Apache
Junction General Plan and will conform to the request of
the City Attorney and the Planning Department staff."

AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
PINAL AND MARICOPA COUNTIES, ARIZONA, AMENDING THE APACHE JUNCTION CITY CODE
BY REPEALING ORDINANCE NO 71 AND ALL AMENDMENTS THERETO AND ADOPTING BY
REFERENCE A NEW APACHE JUNCTION, ARIZONA, ZONING ORDINANCE BY ADDING TO THE
CITY CODE OF APACHE JUNCTION, ARIZONA, VOLUME II LAND DEVELOPMENT CODE A NEW
CHAPTER 1 ENTITLED APACHE JUNCTION, ARIZONA, ZONING ORDINANCE, REPEALING ANY
CONFLICTING PROVISIONS, PROVIDING FOR SEVERABILITY, PROVIDING PENALTIES, AND
DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA, THAT.
SECTION I IN GENERAL
1 Ordinance No 71, adopting the Apache Junction, Arizona, Zoning
Ordinance and all amendments thereto, including the adoption by
reference of the map entitled Zoning District Map, City of Apache
Junction, Arizona, and all amendments thereto, are hereby repealed
2. That certain document known as the City Code of Apache Junction,
Arizona, Volume II Land Development Code, Chapter 1, Apache Junction,
Arizona, Zoning Ordinance and hereinafter referred to as the Apache
Junction, Arizona, Zoning Ordinance, which includes by reference
the maps entitled Zoning District Map, City of Apache Junction,
Arizona, three (3) copies of which are on file in the Office of the
City Clerk of Apache Junction, Arizona, which document was made a
public record by Resolution No. 85-05 of the City of Apache Junction,
Arizona, is hereby added to the City Code of Apache Junction, Arizona,
referred to, adopted and made a part thereof as if fully set out in
this Ordinance
SECTION II REPEALING ANY CONFLICTING PROVISIONS
All ordinances and parts of ordinances in conflict with the provisions of
this Ordinance, or any part of the code adopted herein by reference, are
hereby repealed.
SECTION III PROVIDING FOR SEVERABILITY
If any section, sub-section, sentence, phrase, clause, or portion of this
Ordinance or any part of the code adopted herein by reference is for any
reason held to be invalid or unconstitutional by the decision of any court
of competent ,jurisdiction, such decision shall not affect the validity of
the remaining portions thereof
SECTION IV PENALTY CLAUSE
Any person found guilty of violating any provision of this Ordinance shall be
punished by a fine not to exceed $1,000.00, or imprisonment for a period not
to exceed six (6) months, or by both such fine and imprisonment Each day
that a violation continues shall be a separate offense punishable as
hereinabove described
SECTION V EMERGENCY CLAUSE
It is necessary for the preservation of the peace, health, and safety of
the City of Apache Junction, Arizona, that this Ordinance become effective
immediately, an emergency is declared to exist, and this Ordinance shall
become effective immediately upon passage and adoption.
