L9ipache &unction ..., May 15, 1985 MEMORANDUM TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL THROUGH: CITY MANAGER FROM: CITY CLERK SUBJECT: ARTICLE 9-2 OF THE CITY CODE (LITTER VIOLATIONS) At the May 6th and 7th meetings, discussion was held on the method of processing litter violations as prescribed by the City Code. A question arose at that time as to whether or not the Council was able to act on removing a piece of property from being considered in violation. Section 9-2-5 of this Article of the Code appears to grant that right to the Council . The final line of the section reads: "The council may either affirm or reverse the decision of the clerk or modify the scope of work as required in the notice." There does not appear to be any specific provision in the Code for the staff to exercise discretion in handling litter violations. Unless there is a code amendment, the staff must treat all potential violations as the same, no matter how little trash and debris is on the parcel in question. This item will appear on the May 20th work session agenda. "Litter" means any rubbish, trash, weeds, filth and debris which constitute a hazard to public health and safety and shall include all putrescible and nonputrescibie solid wastes including garbage, trash, ashes, street cleanings, dead animals, abandoned automobiles and solid market and industrial waste; any deposit, accumulation, pile or heap of brush, grass, debris, weeds, cans, cloth, paper, wood, rubbish or other unsightly or unsanitary matter of any kind whatsoever; and any growth of weeds to a height of over eighteen inches. B. "Private premises" means any dwelling, house, building or other structure, designed or used either wholly or in part for private residential purposes, whether inhabited or temporarily or continu- ously uninhabited or vacant, and shall include any yard, grounds, walk, driveway, porch, steps or vestibules belonging or appurtenant to such dwelling, house, building or other structures. C. "Public place" means any and all streets, sidewalks, boulevards, alleys or other public ways and any and all public parks, squares, spaces, grounds and buildings. Sec. 9-2-2 Litter on Private Property No person shall throw or deposit litter on any occupied or unoccupied private property within the city, whether owned by such person or not, except that the owner or person in control of private property may maintain authorized private receptacles for collection in such a manner that litter will be prevented from being carried or deposited by the elements upon any public place. 411 -67- AiNN Amok 9-2-3 HEALTH AND SANITATION 9-2-6 Sec. 9-2-3 Owner to Maintain Premises The owner or person in control of any private property shall at all times maintain the premises free of litter; provided, however, that this section shall not prohibit the storage of litter in authorized private receptacles for collection. Sec. 9-2-4 Procedure to Compel Removal of Litter The clerk shall enforce the provisions of Sections 9-2-2 and 9-2-3 by prosecuting violators of said sections in the magistrate court pursuant to the criminal provisions of this code. If such prosecution fails to secure compliance with the provisions of said sections or in the event of inability to prosecute violators by reason of failure to secure jurisdiction over their persons, the clerk shall compel the removal of litter by the procedure outlined in Section 9-2-5 through 9-2-9 hereof. 1 Sec. 9-2-5 Notice to Remove To compel the removal of litter through the provisions of this section and of Sections 9-2-6, 9-2-7, 9-2-8 and 9-2-9 hereof, if a person owning or controlling any property fails, neglects or refuses to remove or properly dispose of litter located on property owned or controlled by such person, he shall be given written notice by the clerk to remove all litter from such property within thirty days from the date the notice was received by him and prior to the date of compliance on the notice. Such notice shall be received not less than thirty days before the date set thereon for compliance and shall contain an estimate of the cost of removal by the city, a statement that unless the person owning or controlling such property complies therewith the city will, at the expense of the person owning or controlling said property, perform the necessary work at a cost not to exceed the estimate given in the notice, and that such person may appeal in writing to the council within thirty days from the date the notice is received by him and prior to the date of compliance. Sec. 9-2-6 Service of Notice Notice shall be personally served on the owner or person controlling such property by a police officer of the city in the manner provided in Rule 4(d) of the Arizona Rules of Civil Procedure, or mailed by certified or registered mail to the owner or person controlling such property at his last known address or the address to which the tax bill for the property was last mailed. If the owner does not reside on such property, a duplicate notice shall also be sent to him by certified or registered mail at his last known address. -68- 9-2-7 HEALTH AND SANITATION 9-2-9 Sec. 9-2-7 Appeal to Council 41110 Prior to the date set for compliance on the notice, the owner or person controlling such property may appeal in writing •to the council from the demand of the clerk. The council shall, at its next regular meeting after receiving the appeal, hear and determine the same and the decision of the council shall be final . The council may either affirm or reverse the decision of the clerk or modify the scope of the work as required in the notice. �► Sec. 9-2-8 Removal by City When any such person to whom notice, as provided in this article, has been given, and on or before the date of compliance on the notice, or within such further time as may have been granted by the council on appeal, fails, neglects or refuses to move from such property any or all litter, the clerk is authorized and directed to cause same to be removed and disposed of at the expense of the owner or person controlling such property. Upon completion of the work, the clerk shall prepare a verified statement of account of the actual cost of such removal or abatement, the date the work was completed and the street address and legal description of the property on which said work was done, including five percent for additional inspection and other incidental costs in connection therewith, and shall serve a duplicate copy of such verified statement upon the person owning or controlling such property in the manner prescribed in Section 9-2-6. The owner or person controlling such property shall nave thirty days from the date of service upon him to appeal in writing to the council from the amount of the assessment as contained in the verified statement. If an appeal is not filed with the clerk within such thirty day period, then the amount of the assessment as determined by the clerk shall become final and binding. If an appeal is taken, the council shall, at its next regular meeting, hear and determine the appeal and may affirm the amount of the assessment, modify AuIlk the amount thereof, or determine that no assessment .at all shall be made. The decision of the council shall be final and binding on all persons. Sec. 9-2-9 Lien for Removal If no appeal is taken from the amount of the assessment, or if an appeal is taken and the council has affirmed cr modified the amount of the assessment, the original assessment or the assessment as so modified shall be recorded in the office of the county recorder and from the date of its recording, shall be a lien on said lot or tract of land until paid. Such liens shall be subject and inferior to the lien for general taxes and to all prior recorded mortgages and encumbrances of record. A sale of the property to satisfy a lien obtained under the provisions of • this article shall be made upon judgment of foreclosure or order of -69- 9-2-10 HEALTH AND SANITATION 9-2-10 4110 sale. The city shall have the right to bring an action to enforce the lien in the superior court at any time after the recording of the assessment, but failure to enforce the lien by such action shall not affect its validity. The recorded assessment shall be prima facie evidence of the truth of all matters recited therein, and of the regularity of all proceedings prior to the recording thereof. A prior assessment for the purposes provided in this section shall not be a bar to a subsequent assessment or assessments for such purposes, and any number of liens on the same lot or tract of land may be enforced in the same action. Sec. 9-2-10 Placement of Litter It is unlawful for any person to place any litter, rubbish, trash, filth or debris upon any private or public property not owned or under the control of said person. CITY MANAGER'S REPORT Adl"\ None. PUBLIC HEARINGS PROPOSED ORDINANCE NO 351, PZ-3-85, WILLIAMS AND YOUNG Mayor Clarke opened the hearing to the public. Director of Planning Chuck Newcomer addressed the application for rezoning of a 3.75 acre parcel, from GR General Rural to TH Trailer Homesite Zone. Mr Frank Talbot, 735 S Ocotillo, Apache Junction, representing the applicants, requested approval of the application Mayor Clarke asked if anyone wished to speak in favor of or in opposition to the petition. REGULAR MEETING OF THE CITY COUNCIL MAY 7, 1985 PAGE 2 Mr John Hennesey, 1020 W Roundup, Apache Junction, stated that petitions have been filed against this rezoning and expressed further opposition. There being no one else wishing to address the Council, Mayor Clarke called upon the Director of Planning for recommendations. /miN Mr. Newcomer stated that the staff has no objections to the rezoning with stipulations including that the parcel not be developed into a mobile home or RV park, and that the Planning and Zoning Commission recommends denial of the application, one reason being that a change will be proposed in the Zoning Ordinance to enlarge the minimum lot size to approximately 11,000 square feet. Mayor Clarke asked why the Planning and Zoning Commission feels that the applicant will subdivide, as this is not indicated. Mr. Newcomer stated that it would be a violation should the applicant subdivide Councilman Shanks expressed her feeling that the Council cannot deny an application based on something that may happen, but should be based on fact and law Vice Mayor Eidson asked for the City Attorney's opinion. City Attorney David Alexander stated that the Council should not deny on the basis of what laws might be adopted in the future. Mayor Clarke stated that the Council should ignore the Planning and Zoning Commission's last reason for denial when deciding on this rezoning, as it has no bearing on the application. Saguaro, Apache Junction, representing the applicants, requested approval of the application. Mayor Clarke asked if there was anyone who wished to speak in favor of or in opposition to the petition. There being no one wishing to address the Council, Mayor Clarke called upon the Director of Planning for recommendations Mr. Newcomer stated that staff has no objections to the rezoning with the stipulation that dedications be made for roadways and that the Planning and Zoning Commission recommends denial of the application feeling that it would not be in the best interest of the City. Mayor Clarke asked if there was anyone who wished to speak in favor of or in opposition to the issue. Mr McNulty explained that the price the City quotes for cleaning the property is the same in every case, and we are urging property owners to clean their own property or have someone else do it and this is to alert them that it could cost them the specified amount, should the owner not clean the property. Ms Connelly explained that if a complaint is submitted and the property does not comply with Article 9-2 of the City Code, a violation must be issued Mr. McNulty stated that when the complaints are received, an inspector is sent to take pictures and in most cases, due to fire problems, notices do go out if the property violates the ordinance regardless of the extent, and the fee is based on man-power and equipment utilized. Ms Connelly stated that the present notice is based on requirements in the City Code and if the Council wishes to deviate from the present notice, it would be necessary to amend the City Code Councilman Baljo suggested that the ordinance be amended to authorize staff to decide on violations at their discretion Ms Connelly stated that the ordinance does give the property owner the option to appeal the violation. The gross site area is 19,752 square feet or 17,780 square feet net (minus required dedication on Ironwood) . The property is also encumbered by a sixteen foot (16') wide private driveway easement along its northern side. The site is located on the east side of Ironwood Drive, about 500 feet north of Roosevelt Street and is developed with a mobile home and a garage in Section 20. It is designated Local Commercial Medium/High Density Residential Opportunity on the General Plan. Surrounding land uses include single-family houses and a mobile home. The enclosed letter from the applicant is requesting that this case be remanded to the Planning and Zoning Commission. In commenting on this request, I would like to point out the Planning and Zoning Commission was in no way obligated to respond to Mr. Stachar's request for consideration of amending his application to CR-4 during the public hearing. It provides for increasing the lot size from 8,000 to 11,000 square feet for lots not in a mobile home subdivision, increases the lot width to eighty feet (80') from sixty feet (60') , and increases front and rear yards. Enclosed in your packet are two versions of Ordinance No. 383. Version #1 is as it was advertised for public hearing, and version #2 is the staff recommended version resulting from putting more thought into it. Version #2 differs from #1 in the title of the Section and in the elimination of the phrase, "not more than three (3) lots per 14 acre parcel." The reasons for eliminating this are the difficulties in interpreting its meaning. For example: 1) if through the original platting of the property, a parcel actually has five (5) square feet more than 11 acres, would it be permitted to split to four (4) lots?; 2) once a 11 acre parcel is split, it is no longer 14 acres. Which of the property owners of the new lots would be permitted to split again, first come, first served? There is an infinite variety of existing parcel sizes and geometrics of splitting, so in analyzing the effect of this Ordinance, we have used a standard 165' by 330' , 114 acre parcel and have discovered the following: 1. The basis for this decision is that there is a current movement in Arizona to redefine a recreational vehicle and we believe that this will allow us to stay within their definition. It is further recommended by this committee thatipermits not be required to install a recreational vehicle in Apache Junction for the following reasons: 1 . We feel that recreational vehicles are adequately self-controlled and policed. 2. We believe that the health, safety and welfare of the consumer is adequately protected by the industry as it stands. 3. The committee feels it would be an unnecessary hardship on all concerned. Reasons for this recommendation are. 1 This is a Commercial Opportunity Area designated on the General Plan and Superstition Boulevard is one of the main commercial opportunity areas in the next few years in the City of Apache Junction. 2. Bernard Tice requested the rezoning to split the parcel into three lots, two of which his children would occupy. 30. Mr. Hoaglin asked if the lots would be for sale 31. Mr Tice replied that he may sell the lots in the future 32. Mr. Taylor explained the problems being incurred under the current TH regulations and splitting into four or more lots making a subdivision 33. Mr. Tice commented that when he applied for a rezoning, he had applied under the current regulations of 8,000 square foot lots He said he had a double-wide on order and would like a decision tonight. 34. Commission general discussion on current regulations 35 Chairman asked if anyone wished to speak in favor 36. John Hill stated that time is of the essence, and that the applicant had to have a place for his mobile by May 23rd 37. Chairman asked if anyone wished to speak in opposition 38. Dorothy Corrigan stated she would like to see the Commission continue the case. 39. Chairman asked for Planning Department comments. 40. Mr Nakagawa stated that staff had no objections, that the rezoning was consistent with the General Plan He recommended stipulating that no mobile home or recreational vehicle park be developed unless approved by the City He added that the roadway dedications had already been obtained. 41 Chairman asked for rebuttal 42. Mr Tice commented that he did not know who Ms Corrigan was, but that he had approval from almost all of the neighbors 43 Chairman asked if anyone was living in the mobile currently on the property 44. Mr. Tice replied that there was, and that the mobile was too small for his family He commented on financial matters should the case be continued. Keith Stachar represented the applicant who purchased the property thinking that the garage being used as a residence was a legal use, when it is not. He noted other properties which had been rezoned in the neighborhood 51 Mr Vehon asked if the property is rezoned, will the garage occupancy be allowed. 52. Mr Stachar replied that the property would be brought up to Code for living quarters. He added that there is enough room for another duplex, but right now the owner just wants to legalize the garage as living quarters 53. Chairman there being no one to speak in favor, asked if anyone wished to speak in opposition 54 Larry Barenthin stated that he lived to the back of the property He commented on the septic tank and the stagnant water in the swimming pool 55 Theresa Baumann did not believe the use was proper in the midst of single-family residences She commented that there is not enough space for all that is planned or for parking She noted that her property would be devalued 56 Cindy Kolojay commented that multi-family dwelling units deface single-family homes, create more traffic, allow for more children in the neighborhood, and create more trash. 57 Ruth Blakely commented that the square footage of the lot was less than stated. She noted that Mr Stachar had a vested interest in the property because he has it for sale 58. Mr Taylor asked what they would do if the parcel went commercial. 59 Mrs. Blakely replied that they were prepared to accept that possibility. Commission discussion 83 Taylor/Jorgensen M/S "BE IT RESOLVED by the Planning and Zoning Commission of the City of Apache Junction, Arizona, that we recommend to the City Council a freeze on all trailer homesite zonings until after the City Council can hear recommendations of the zoning district proposed changes in regards to a Commission- initative, PZ-23-85, Proposed Ordinance No 383 The reason for this motion for the City Council to strongly suggest a freeze on these TH zonings is there is a deluge of applications at the present time, and many of the Commissioners and the general public and citizens of Apache Junction feel there needs to be something done, the Ordinance is not clear, is vague the way it is written as far as lot size is concerned, it doesn't address the specific lot size in regards to individual TH units and it is the general feeling that this needs to be addressed and this would be considered by us a necessary thing that we freeze all of them until after the City Council hears this on May 7, 1985." Tt is my understanding as a result of that meeting, that you will be mailing to me a copy of an agreement that the city has used previouzly which provides for construction of highway improvements at some future date. The agreement that we reached at the meeting was that the Loewensteins will install 4th Avenue as shown on their site plan at the time of construction, but that a strip approx- imately 50 feet deep at the east edge of the property will not be installed immediately, but rather will be a landscaped area with knockdown gate so emergency vehicles can cross it, if necessary. The agreement will provide that whenever the vacant property between the Apache Ho and Azure Sky subdivisions is developed and 4th Avenue is installed, the Loewensteins will complete the construction of 4th Avenue on their property, con- currently with the construction of 4th Avenue on the vacant property. In any event, the Loewensteins will complete con- struction of 4th Avenue within three (3) years. B. In consideration of the approval by the City of the building/construction plan and issuance of a permit, the Applicant agrees to dedicate to the City certain lands for public rights-of-way appurtenant to the property for which application is made, for public streets , utilities , and other public improvements. See Exhibit "C" (legal description). C. The City agrees to postpone certain offsite street improvement to the East 50 feet of 4th Avenue, PROVIDING THAT, given written notice, the Applicant agrees to design and construct improvements to standards as required and approved by the City Engineer in conjunction with other improvements in the vicinity, anticipated by the City or other private developers. D. We now have a lovely Park area that we can have outdoor bar-b-ques, with lovely trees in big pots or barrels . If you turn that into a street all that will be gone.
