August 21, 1979
A regular meeting of the Board of Adjustments was held at City Hall on August
21, 1979 pursuant to notice as required by law.
The first order of business was to swear in the members.
Roll Call
Members present
Mr. Nesser, Mr. Vaughn, Mr. Furness, Mr. Nunn.
Members absent
Mr. Jessamine
Vice-chairman Nesser declared a quorum present and the meeting was called to order.
Others present
Mr. Kiker, Attorney Haus, J. Pihajlic, and Anne Vader.
Minutes
The minutes of the previous meeting were approved as read with a motion by
Mr. Nunn and seconded by Mr. Furness.
Item #1
BA-1-79 Non-conforming Use Request by Mr. Kiker to construct a duplex in a General
Rural zone, Lot 20, Block 3, Newtown Subdivision.
Members of the Board posed questions to Mr. Kiker concerning the Non-Conforming
Use Permit, which he answered to their satisfaction.
Mr. Furness made a motion to approve or not approve the request by Mr. Kiker and
seconded by Mr. Vaughn. Motion withdrawn and the second withdrawn. Mr. Nunn made
a motion to deny the request by Mr. Kiker and seconded by Mr. Furness. Three
voted yes, Mr. Nunn, Mr. Furness, and Mr. Nesser. One voted no, Mr. Vaughn.
Motion carried.
Item #2
BA-34-79, Variance to place two (2) mobile homes on the same lot, request by
John Pihajlic and Anne Vader. The property is approximately 660' east of Delaware
on Shiprock.
Mr. Vaughn made a motion to grant the variance in accordance with Article 24,
Section 2403, L. 1 and 2, that there are special circumstances pertaining to the
health and welfare of the present owner, a temporary variance of one year from
this date is granted. Said variance permits placing two mobile homes on the
property in question, further that such variance should be in effect for not longer
than one year, renewable, during the period of current distress of the rightful
owner; that in the event of sale of said property such variance is automatically
declared null and void, and the established zoning classification for said property
applies without variance, and seconded by Mr. Furness. Motion carried unanimously.
