Sec. Althea Nunn, Secretary Guests About 20 persons - 1. Mr. Jessamine opened the meeting at 7:10 p.m. , welcoming those- - (Chairman) present and requesting the roll call of members. 2. Mr. Gero called the roll and determined all five members to (Exec. Sec.) be present as indicated above. 3. Chairman declared that there was a quorum present at this meeting. He- noted there is one set of "Minutes" dated March 3, 1980, before the Board. 4. Vaughn/Nesser M/S BE IT RESOLVED the "Minutes" dated 3-3-80 be approved as written. 5. Chairman announced there is one public hearing being case #BA-3-80, opened the public hearing, and asked Mr. Gero, Executive Secretary, to present a report on this request. b. Mr. Gero gave the location of the request and stated the case has been properly advertised. 7. Rick Cornell, stated this request is to allow the placement of a applicant second mobile home on his acre and one-quarter of land to allow his father and mother to reside therein because of a health problem. Dr. Dean Seeman has verified the need for the family to be nearby for medical reasons in a letter in the file. 8. Chairman read Section 2504 of the Zoning Ordinance of the City of Apache Junction and opened the hearing to the public for comment. 9. Numerous persons spoke for and against this case. Questions were raised relative to a separate septic system. Mr. Gero explained that Mr. Cornell would have to meet County Health Department Standard but that was not part of the Boards criteria as adopted by the City Council. Page 2 - Board of Adjustment 10. Chairman asked Mr. Gero for his recommendation. 1 11. Mr. Gero stated a letter from a doctor has been filed stating a medical hardship exists, that Mary and Joseph Cornell have been required to move due to the health problems of their previous landlord, which forced the previous landlord to sell the property, and recommends that the variance be granted by the Board, with the stipulation that it be good until Mr. Joseph Cornell is either not living on the property or the property is sold, at which time this variance would become null and void. Further, that this motion be forwarded to Dorothy McWilliams to be certain that this application be required to meet County Health Department standards. 12. Chairman declared a short recess. Reopened meeting 5 minutes later. 13. Vaughn/Nunn M/S "Be it resolved by the Board of Adjustment of ME' City of Apache Junction, Arizona, that in case BA-3-80, application of Rick Cornell, requesting a variance to allow placement of a second mobile home on applicant's lot described as W1 SE NE SW SW Section 17 R8E, TIN G & SRB & M (also known as 1278 W. Greasewood and located on Pinal County 1 Assessor's map 100-30, parcel 24C) located in Apache Junction, Arizona, the Board finds and the public record indicated that: 1. A letter indicating that Mr. Joseph Cornell has a need for family care has been filed by Dr. Dean Seeman which indicates a medical need of hardship. 2. Mr. Rick Cornell is the owner of the property subject to this request, and resides on said property. 3. Mr. and Mrs. Joseph Cornell has been recently required to move from the lot they were residing upon due to the land owner selling the land because of a heart condition. 4. The granting of the application would not materially affect the health and safety of persons residing or working in the neighborhood. Therefore, the Board approves the application of • Mr. Rick Cornell subject to: 1. The variance shall only be valid for a period of time while the certified medical condition exists; or the property is under the ownership of Mr. Rick Cornell, whichever is the lesser. 2. That the applicant meet all Zoning Ordinance Page 3 - Board of Adjustment requirements except the one unit per lot, 1 and all building code requirements. 3. The Board requires that there shall be filed, on or before the anniversary each year of this action, a statement certified by a medical doctor of the continuing medical hardship. Each annual filing shall not be subject to a filing fee. Further, the Board instructs the Executive Secretary to provide a copy of this order to the Building Official and to the County Sanitarian so that she might be notified of the need to make a septic tank inspection. 13. Committee discussed the procedures for the Board. - --- 14. Chairman noted a discussion on no-quorum problems to-beg±n a meeting. 15. Nunn/Furness M/S- "Be it resolved by the Board of Adjustment of the City of Apache Junction, Arizona that when the Board of Adjustment has any duly advertised public hearing and at the advertised time and place a quorum is not present, the said public hearing may be post- poned to the next regular meeting of the Board pro- vided that a member of the Board or a recognized member of the city staff shall announce at the advertised time and place for the public hearing the future time and place for the postponed public hearing."
