In Attendance Regrets Joe Jessamine, Chairman Bill Furness Don Nesser (excused-illness) William Nunn William Vaughn Joe Gero, Executive Secretary Guests Numerous Persons 1. Mr. Jessamine Opened the meeting at 7:00 P.M. wel- (Chairman) coming those present and requesting the roll call of members. 2. Mr. Gero called the roll and determined the four (Executive Secretary) members indicated above to be present. Mr. Furness had indicated that he was ill. 3. Chairman declared that there is a quorum pres- ent. He noted that the "Minutes of April 7, 1980" are before the Board for action. 4. Nesser/Vaughn M/S "BE IT RESOLVED the "Minutes" dated I'I April 7, 1980, be and is hereby approved as circulated." The motion passed un- animously by roll-call vote. 5. Chairman announced there are two (2) public hear- ings before the Board, those cases being BA-7-80 and the continuation of BA-5-80. He opened the public hearing and re- quested the Executive Secretary to orientate those present as to this case. 6. Executive Secretary gave the location of the request and stated the case has been properly adver- tised. The request is to vary the Zoning Ordinance requirement that fences around Mobile Home Parks must be opaque as applied to several places where the Applicant desires to construct a fence. Mr. Pancheri stated that he wishes to construct a (Applicant) security fence at locations around his Apache Junction Mobile Home Park where none exist. This would be mainly for security purposes. However, because of the cost and the fact that the rest of the fence is chain link, he desires to continue with chain link only. He noted that the construction of the addition had begun under a Pinal County permit. It did not specifically mention a fence or fencing requirements. 8. Board Members discussed the matter of the language of the Zoning Ordinance requirement with regard to whether the word "solid" also meant that the fence must be solid. It was pointed out that the word "screened" was used earlier in the sentence. (See Zoning Ordinance, Section 2001 (e) (11)) 9. Nesser/Nunn M/S "BE IT RESOLVED by the Board of Adjustment of the City of Apache Junction, Arizona, that the variance requested in case BA-7-80, application of Gerald Pancheri for Apache Junction Mobile Home Park, 800 W. Apache Trail in Apache Junction, Arizona, in consideration that this is a continuation of a project long in progress, the construction of which was previous to City jurisdiction approved by Pinal County Planning Depart- ment, and that the request would be in compliance with previously approved standards, that the requested variance be and hereby is approved. Further, the Board of Adjustment in- structs the Zoning Administrator to issue, with regard only to Zoning Ordinance requirements, the necessary permits for the construction of said fence in compliance with this case and as set forth and approved by the Board." 11.‘ By roll-call vote, the motion passed 3-1, with Mr. Vaughn objecting. 10. Chairman stated that this was the continuation of the Public Hearing for BA-5-80 and asked the Executive Secretary to brief those present. Page 3 - Board of Adjustment Minutes of April 21, 1980 A11. Executive Secretary stated that the City staff and owners of Big Mountain wish to continue the public hearing However, a specific date cannot be set as certain data must be col- lected 12. Nesser/Nunn M/S "BE IT RESOLVED by the Board of Adjustment of the City of Apache Junction, Arizona, that the public hearing for case BA-5-80 be contin- ued to a time and place to be set by the Executive Director." The motion passed unanimously by roll-call vote. 13. Vaughn/Nesser M/S to adjourn at 8:15 P.M.
