BOARD OF ADJUSTMENT

called the meeting to order at 7:00 p.m.and
requested the Recording Secretary to call the
roll.
called the roll,determining six present and
one absence due to illness in the family.
called for a motion for approval of the "Minutes"
dated September 21,1981.
M/S "BE IT RESOLVED by the Board of Adjustment
of the City of Apache Junction,Arizona,that
the "Minutes"dated September 21,1981,be
approved as written."
The motion passed unanimously.
announced the first item of business was the
continuation of the study of the Bed and
Breakfast issue.He called upon staff to brief
the Board.
6.Mr.Newcomer explained the new materials in the members'
packets.
7.Chairman expressed concern over the inability of the
city to monitor such an enterprise and feared
it might "get out of hand"with only one person
overseeing the project.He felt the city would
not benefit by such a business.He asked for
comment from Board members.
8.Mr.Furness stated that Apache Junction has sufficient
hotels and motels.

pointed out that the Board is asked only to
interpret whether this enterprise would be con-
sidered a "home occupation"under the city's
zoning ordinance.He reiterated his feeling that
the idea is a good one,but not at the present
time with Apache Junction being too small.
agreed that Apache Junction would not benefit by
such a project and felt Ms.Young had been vague
in answering specific questions asked by the
Board.
11.Mr.Morrison was disappointed that Ms.Young was not present;

he had hoped to ask some questions about the
financial aspects of the business.
stated that she agrees that Apache Junction is
too small for this type of set-up and fears
too,that it might get out of hand.
invited staff to comment.
referred to Mr.Burfiend's statement that the
Board has been asked to interpret that section
of the zoning ordinance concerning "home
occupation."Any ruling by the Board will be
applicable to anyone who would want to rent a
room in their home located in a single-family
residential zoning district.
confirmed this was understood by the Board.
suggested that the matter be referred back to
the city.
respondedipy stating that the responsibility for
ruling on this.matter lies with the Board.He
explained that the Planning and Zoning Comm..is
responsible for proposing amendments to the
zoning ordinance.If a special definition
needed tote put in the ordinance,
regulation by Special Use Permit,etc),the
Commission woOld be responsible.

application of this project.
suggested he prepare writtewreference:to
specific points of the portion of the zoning
ordinance that is in question.
withdrew their motion.
directed staff to gather and present the data
substantiatingithe ,Boare.s decision that this
enterpriseAs not a "home occupation."
He asked staff to brief the -Board on the next
agenda item,
explained that the applicants,Mr.and Mrs.
Winter,request a special meeting of the Board
to consider their variance due to a time
constriction.
after consulting with the other members determined
only,one weekiwouldte saved the applicant,
.and,therefore :a speciaMbeeting would not be
called.The application would be heard at -the
-next regular meeting.
There being no further business,the meeting
was adjourned at 7:30 p.m.
