opened the meeting at 7:00 P.A.and, asked
the Recording Secretary ,to call the roll.
called the rollHand determined five (5)
members present and one (1)member absent.
requested a motion for approval of the
"Minutes"dated November 2,1981.
M/S "BE IT RESOLVED by the Board of Adjustment'
of the City of Apache Junction,Arizona,that
the "Minutes"of the meeting of November 2,
1981,be accepted as written."
The motion passed 3-0-2 with Mr.Vaughn and
Mr.Jessamine both voting present because
of their absence at the meeting in question.
announced that the next order of business would
be the continuation of case BA -6-81 (Winter).
He asked Mr.Newcomer to brief the Board on
the case,
explained that the Winters were seeking a
variance to side yard setbacks.They are in
a GR zoning district.The property is located
at the corner of Desconso Road and Scenic
Street.
He said that the Board members requested:
further information from 'the,City Engineer ,
and from ,the Zoning Administrator concerning ,
the case.
He said a memo from the Zoning Administrator
stated the property is located in a "C"zone
in terms of flood hazard potential.The
Zoning Administrator's memorandum further
stated the right-of-way for Descanso is un-
developed,and should the right-of-way be
developed in the future,there would only be
a 50 foot right-of-way as opposed to the
current 66 foot,in which case the applicant
would gain title to the additional 8 feet of
setback.

He added, taking all of the above into
consideration,the ZoningAdministrator felt
it would be most appropriate for:the Board to
grant the requested variance and:to encourage
sound building practices.I t is obvious from
the topography of the property that the
applicant chose the best possible site upon
which to situate the mobile home,The Zoning
Administrator's recommendation was that the
Board grant the requested variance.,
stated that he did not see any hardship in-
volved in the case and therefore,planned to
vote against it.

strongly encouraged by the city.
added that the applicant's were asking for a
four foot variance on a side yard setback.
This is a road that will probably never be
built he stated.It would serve no purpose
to build a road to begin with.
He said he saw no reason for not approving
the requested variance.
MIS 13E IT RESOLVED by the Board of Adjustment
of the:City of Apache Junction,Arizona,in
the case of BA -6-81, :hereby granting the
requested ,variance to side yard setback:re---
quirements of the General: Rural-(GR)zoning:
district of thetityloning Ordinance.
The legal description of the subject property
is as'f011Ows:
The East 1/2 of the Northwest 4 of the
Northwest 4 of the Southwest ¼ of the
Northwest 4 of Section 22,Township 1
North,Range 8 East of the Gila and Salt
River Base and Meridian.
The variance shall be subject to the following
conditions:
1)The proposed plot plans submitted
with the application for either the
additions to the existing unit or the
placement of the existing unit with a
twelve -foot wide mobile home shall
be followed.
2)The additions to the existing unit or
the installation of a new unit shall
comply with the regulations of agencie
having jurisdiction.
Failure to comply with these stipulations,!,-
shall result in the revocation,of the variance.
The Board bases its decision on the following
reasons:
1)with regard to site topography and
flooding potential,the mobile home
is located on the best possible -
location son the property without
extensive site preparation which
would create an economic hardship on
the applicant.

2)Should the roadway easement to the east
of the property be developed at some time
in the future,according to the standards
adopted by the city,Descanso Road would
be a local street with a 50 -foot right-of-
way instead of the current 66 -foot easement.
Also,if fully improved,the street pave-
ment width would be 32 feet.
3)Detriment or injury to the neighborhood
will not result from the granting of this
variance."
The motion passed 4-1 with Mr.Burfiend voting
against the resolution.
