HomeMy WebLinkAbout1982-01-04 BOA MINUTES10.Mr.Vaughn 11.Ms.Robertson MINUTES BOARD OF ADJUSTMENT 1001 NORTH IDAHO ROAD APACHE JUNCTION,ARIZONA JANUARY 4,1982 In Attendance Mr.Burfiend Mrs.Luddy Mr.Morrison Mr.Vaughn,Vice Chairman Mr.Jessamine,Chairman 1.Chairman 2.Ms.Nendza 3.Chairman 4.Burfiend/Luddy Absent Mrs.Oberg Guests (See attached.) called the meeting to order at 7:04 p.m.and asked the Recording Secretary to call the roll. called the roll and determined five members were present and one absent,as indicated above. asked for a motion to approve the "Minutes"dated December 7,1981. MIS "BE IT RESOLVED by the Board of Adjustment of the City of Apache Junction,Arizona,that the "Minutes"of the December 7,1981,meeting of the Board of Adjustment be approved as written." 5.Chairman announced the continuation of BA -7-81 (Sieberz) and requested staff to brief the Board. 6.Mr.Newcomer detailed the case for the Board. 7.Chairman invited the applicant or representative to speak. 8.Georgia Robertson stated a 20'setback from Cody Street is now requested and a 10'setback from the west boundary. 9.Chairman invited questions from the Board members. wondered i f a size limit would be placed on the trailer. answered that,since the 20'foot setback was found to be agreeable to the applicant,i t seemed unnecessary to place such a limit on the trialer size. 12.Chairman requested a motion. 13.Luddy/Morrison M/S "BE IT RESOLVED by the Board of Adjustment of the City of Apache Junction,Arizona,hereby granting a variance for setback requirements of the GR zoning district of the Apache Junction Zoning Ordinance in case BA -7-81 for the subject property legally described as: the North 1/2 of the Northeast 4 of the Southeast 4 of the Northwest 4 of the Northwest 4 of Section 22,Gila and Salt River Base and Meridian, this variance shall be subject to the following conditions: 1.The minimum yard setback on the north side of the property shall be 20'. 2.The minimum yard setback on the west side of the property shall be 10'. 3.All other applicable provisions of the Apache Junction Zoning Ordinance shall be complied with. Iremotion passed unanimously (6-0). continued the meeting by asking staff to brief the Board on the next case,BA -9-81 (Vestal). described the request of the applicant and explained the circumstances. questioned the size of the lot. 17.Mr.Newcomer noted the lot was 5/8 of an acre,excluding easements.The measurements equal 165'x330'. 18.Mr.Morrison 19.Chairman 20.Mrs.Harold Vestal inquired about septic tank clearance. asked the applicant to step forward. introduced herself and explained the reasoning and circumstances behind the variance request. Both parents are seriously ill and require care;having them on her property would eliminate commuting to provide this care. 21.Chairman allowed Mr.Vaughn to answer Mr.Morrison's question concerning septic tanks. 22.Mr.Vaughn noted that at a previous meeting it was explained by Pinal County representative,Mr.Saxon,that hook-up to an existing tank is acceptable i f the additional users are parents of the original users.He also pointed out that the proposed motion in the packets mentions the septic requirements. 23.Chairman recognized Mr.Vaughn's desire to question the applicant. 24.Mr.Vaughn 25.Mrs.Vestal 26.Mr.Vaughn 27.Mrs.Vestal 28.Mr.Burfiend asked the applicant i f there was any objection to allowing 20'between the trailers instead of 10'as shown on the plot plan. replied that she would be willing to leave whatever space the Board requires. expressed the opinion that the 20'would provide access for emergency vehicles. commented that when the plot plan was submitted, she failed to notice that the land was lower where she had placed the second trailer then the land on the north side.She asked permission to place the trailer on the higher north side instead of the south side as indicated on the plot plan. said that that would be good building practice and would facilitate hooking up to the septic tank. MIS "BE IT RESOLVED by the Board of Adjustment of the City of Apache Junction,Arizona,hereby granting a temporary nine (9)month permit to the application of BA -9-81 to place a second mobile home'unit on the subject property legally described as: the North i of •the Southeast 4 of the Southeast 4 of the Northwest 4 of the Northeast 4 of Section 27,Township 1 North,Range 8 East, of the Gila and Salt River Base and Meridian. This permit shall be subject to the following conditions: 1.All applicable regulations of agencies having jurisdiction shall be complied with. Proof of approval of the septic system installation by the Pinal County Health - Department shall be submitted by the appli- cant to the city Zoning Administrator within 30 days of installation of the mobile home. 2.Only the applicant's parents may reside in the second mobile home. 3.Prior to the end of the nine (9)month period,i f the applicant desires to renew the permit,he must appear before the Board to request renewal and present evidence satisfactory to the Board stating the need for permit renewal. The Board bases its decision on the following reasons: 1.A hardship exists due to the ill health of the parents to be verified by presentation of written documentation by a physician to the Board." The motion passed unanimously (6 ,0). asked staff to brief the Board on case BA -10-81, Crossroads Baptist Church. narrated the required case information and stated that Rev.Clovis Hibbard would be the -represent, ative for the application. asked the applicant to speak. presented the reasons for the requested variance and information pertinent to the case. invited the Commission members'questions. inquired concerning the length of time involved. approximated a couple of years would be suffi- cient. wanted to know i f approval had been obtained for the septic system. MIS "BE IT RESOLVED by the Board of Adjustment of the City of Apache Junction,Arizona,hereby granting approval of the requested variance to the setback requirements of the GR General Rural zoning district,in case BA -10-81,for the property legally described as: the West 1/2 of the Northwest 4 of the Southeast 4 of the Southeast 4 of Section 27,Township 1 North,Range 8 East,of the Gila and Salt River Base and Meridian,EXCEPT roads of record. The granting of this variance:shall be ,subject to the following conditions: 1.Upon completion of permanent facilities designated as Phase Two on the plot plans submitted with the application,this variance shall be revoked. 2.The proposed plot plan submitted with the application shall:be:complied ,with for place- ment of the trailer. The Board bases its decision on the following reasons: 1.As a temporary variance,the placement of the trailer would present no conflict." The motion passed unanimously (6-0). stepped down due to a potential conflict of interes with the next case.The gavel was passed to the Vice Chairman,Mr.Vaughn. asked staff to -brief the Board on BA -11-481 (Griffin). presented the case to the Board,intluding the proposed plot plan of the applicant. requested the applicant to speak. 49.Mr.Griffin explained that he would like to construct one- bedroom units only on his property. 50.Acting Chairman invited questions from the Board members. 51.Ms.Luddy wanted verification that it would involve. only one more unit on the property and she asked:about parking. I t indicated no objection by those who signed (9 signatures)and it was signed by all property owners within 300'of the subject property, except for Joe Jessamine who was unable to sign due to his position on the Board of Adjustment. closed the public hearing and opened the dis- cussion among the Board members.A recess was granted to review the materials.Upon reconvening the meeting,members'comments were invited.There being none,a motion was entertained. MIS "BE IT RESOLVED by the Board of Adjustment of the City of Apache Junction,hereby granting the requested variance to Section 1305 of the Apache Junction Zoning Ordinance in case BA- 11 -81 for the subject property legally described as: Lot #35,Palm Springs Subdivision,Unit 7, according to Map Book 13,Page 15,records of Pinal County,Arizona. This variance shall be subject to the following conditions: 1.No more than five (5)dwelling units shall be constructed on the subject property. 2.All other applicable provisions of the Apache Junction Zoning Ordinance shall be complied with. 3.Construction on the subject property shall not exceed one story in height. The Board bases its decision on the following reasons: 1.To provide one bedroom units for this area is most suitable." The motion passed 3-1-1,with Mr.Morrison objecting,and Mr.Jessamine abstaining due to a potential conflict of interest. returned the gavel to Mr.Jessamine. requested staff to brief the Board on case BA -12-81. briefed the Board and,upon request of the Chairman,read the memorandum from the Zoning Administrator which recommended approval of the application. 61.Chairman invited comments in favor of the application. 62.Mr.Short presented several members of the audience as neighbors approving of his application. MIS "BE IT RESOLVED by the Board of Adjustment of the City of Apache Junction,Arizona,hereby granting the requested variance to yard setback requirements of Section 807 and Section 808 (Short)for the subject property legally described as: Lot #14,Block 2,McIlwain Addition,as per maps recorded in Map Book 8,Page 12,in the office of the County Recorder of Pinal County,Florence,Arizona. The granting of this variance shall be subject to the following conditions: 1.All rules,requirements,and regulations of agencies having jurisdiction shall be complied with 2.The plot plan submitted by the applicant shall be followed. The Board bases its decision on the following reasons: 1.The small size of the lot limits placement of the trailer. 2.A drainage ditch precludes placement eTsewhere."t The motion passed unanimously (6-0). M/S "BE IT RESOLVED by the Board of Adjustment of the City of Apache Junction,Arizona,that the Board will participate in the City Work Session,Tuesday, January 26,1982,at 7:00 p.m.in the Community Services Building to discuss zoning procedures." The motion passed unanimously (6-0). adjourned the meeting at 8:06 p.m.,there being no further business.
