Present Absent Mr.Berry Mr.Burfiend Mrs.Luddy Mr,Morrison Mr.Vaughn,Vice Chairman Mr.jessamine,Chairman Ms.Breece,Recording Secretary Mr.Newcomer,Acting Executive Secretary Ms.Oberg Guests Margaret Slancik Gloria Tenes Norma J.Corsi Eleanor Tucker Albert Tucker Hugh Warren Mary Warren Lois Broman Ruby Tettley Synopsis :Approval of Minutes dated February 1 And February 15,1982 Public -Hearings:BA -3-82 ,(Tettley) BA -4-82 (Slancik) BA -4-81 (Corsi)-Renewal called the meeting to order and asked the Recording Secretary to call the roll. 1.Chairman 2.Ms.Breece 3.Chairman 4.Luddy/Vaughn called the roll,determining six members were present and one absent,as indicated above. asked for a motion to approve the Minutes dated February 1,1982. m/S "BE IT RESOLVED by the Board of Adjustment of the City of Apache Junction,Arizona,that the Minutes dated February 1,1982,be approved as written." The motion passed unanimously 5.Chairman asked for a motion to approve the Minutes dated: February !15,1982. 6.Luddy/Burfiend 7.Chairman M/S "BE IT RESOLVED by the Board of Adjustment of the City of Apache Junction,Arizona,that the Minutes dated February 15,1982,be approved as written." The motion passed 6-0-1,with Mr.Vaughn voting "present"due to his early departure from that meeting. opened the public hearing and stepped down from the first case due to a possible conflict of interest.The gavel was passed to Vice Chairman Vaughn. 8.Acting Chairman asked staff to brief the Board on case BA -3-82 (Tettley). 9.Mr.Newcomer 10.Acting Chairman presented the case to the Board, invited the applicant to speak. Page 2 -Board of Adjustment Minutes of March 1,1982 11.Ms.Tettley 12.Acting Chairman 13.Ms.Mary Warren 14.Chairman 15.Mr.Newcomer 16.Acting Chairman 17.Mr.Newcomer 18.Acting Chairman 19.Burfiend/Berry explained her request., asked for comment from the public supporting the application.There being none,comment in opposition to the application was requested. introduced herself and referred to a letter with signatures of surrounding property owners who object to this application.She submitted three additional signatures at this time. instructed the Acting Executive Secretary to read the letter into the Minutes. "We wish to oppose the granting of variance application number BA -3-82 for the reasons that the area zoned General Rural and that the lot being 51'x 67'does not meet criteria for city or Pinal County zoning.We consider the lot to be an illegal split and therefore,it does not qualify for variance.In addition,we hope the city considers an open space lifestyle,especially in this area.Granting this variance would certainly be precedent -setting and would en- courage future unwanted high density development." (Signatures including those submitted tonight), by Richard and Lois Broman,Mary and Hugh Warren, Dorene and James Hughes,Donald Maynard,Eleanor and Albert Tucker,Rosemary Hoffmein (578 North Cortez),Rosaline Debnam. requested staff to summarize. referred the Board to the Zoning Administrator's memorandum recommending denial of the application unless the applicant provides evidence that the lot split was in compliance with the Pinal County Ordinance at the time. entertained Board discussion and,following discussion,called for a motion. M/S "BE IT RESOLVED by the Board of Adjustment of the City of Apache Junction,Arizona,that in case BA -3-82,the requested variance is hereby granted for the subject property,the location of which is a matter of record. This variance is subject to the following con- ditions: 1)The plot plan submitted shall be followed. 2)The property will become legally recorded as one parcel within 60 days. 3)Only the sister may reside in the trailer. 4)The variance must be renewed in nine months. 5)I t is not transferrable;i t is personal with applicant. 6)Agencies in this jurisdiction must be complied with. The motion failed 2-2-1,with Mr.Berry voting "present",and Mr.Vaughn and Mr.Morrison opposing. reopened Board discussion during which the public was allowed further comment. introduced herself and asked the Board to respect the letter of opposition and deny the application. introduced himself and noted the lot was too small for one trailer,let alone two. called for a motion. MIS "BE IT RESOLVED by the Board of Adjustment of the City of Apache Junction,Arizona,that public hearing of case BA -3-82 be continued until April 5,1982,at 7:00 p.m.,in these chambers." The motion passed unanimously (5-0).The gavel was returned to Mr.Jessamine following a five- minute recess. 25.Chairman asked staff to brief the Board on the next case BA -4-82 (Slancik). 26.Mr.Newcomer presented the case to the Board. 27.Chairman invited the applicant to speak. 28.Harvey Long 29.Chairman 30.Burfiend/Morrison introduced himself as the general contractor for the applicant and explained the reasons for the variance request. opened the case to Board discussion after which a motion was requested,there being no comment in favor of or opposition to the application. M/S "BE IT RESOLVED by the Board of Adjustment of the City of Apace Junction,Arizona,hereby granting the requested variance to Section 20.03 (7)of the city zoning ordinance in case BA -4-82, for the subject property,the location of which is a matter of public record.This variance shall be subject to the following conditions: The plot plan submitted with the application shall be complied with. The Board bases its decision on the following reasons: 1)Adjacent neighbor to the south has no objections. 2)No other suitable location for the addition. 3)The Zoning Administrator recommends approval." The motion passed 5-1,with Mr.Vaughn in opposi- tion. 31.Chairman asked staff to brief the Board on the next case BA -4-81 (Corsi),a renewal. Page 4 -Board of Adjustment Minutes of March 1,1982 32.Mr.Newcomer 33.Chairman 34.Ms.Corsi presented the case to the Board invited the applicant to speak. introduced herself and itated the situation had not changed since the original granting of the variance. 35.Chairman called for a motion. 36.Burfiend/Morrison 37.Chairman Respectfully submitted, arles -NeWainer Acting Executive Secretary Approved: M/S "BE IT RESOLVED by the Board of Adjustment of the City of Apache Junction,Arizona,hereby granting a 9 -month renewal of the temporary permit issued to the applicant in case BA -4-81. This temporary and revocable permit shall be subject to the same conditions as the original permit." The motion passed 5-1,with Mr.Vaughn in opposition. following distribution and general discussion of miscellaneous business (including an offer by staff to arrange a field trip to other cities' Board of Adjustment meetings,distribution of a schedule of city Board of Adjustment and Planning and Zoning Commission deadline cutoff dates and meeting dates,extending an invitation to the Board to attend a general plan study tour March 13,and rescheduling the regular July meeting of the Board to the 12th),the meeting was adjourned at 8:35 p.m.
