Present Absent Mr.Berry Mr.Burfiend Mrs.Luddy Mr.Morrison Mrs.Oberg Mr.Vaughn,Vice -Chairman Mr.Jessamine,Chairman Mr.Newcomer,Executive Secretary Mr.Eidson,Liaison Ms.Breece,Recording Secretary None Guests Mr.Kelly Brown Mr.George Luddy Mayor Clarke Synopsis Public Hearings:BA -5-82 (Southard)Board of Appeals BA -6432 (ROgelstad) called the meeting to. order and asked the Recording -=Secretary to call the roll. 1.Chairman 2.Ms.Breece called the roll,determining all members were present. 3.Chairman asked for a motion to approve the Minutes of April 5, 1982. .Burfiend/Vaughn ,M/S "BE IT RESOLVED by the Board of Adjustment of the City ,of Apache Junction,Arizona-,that the Minutes dated, April 6,1982,be adopted,as presentedi' TheAlotion passed ,6-0-1 with Mt.Luddy votifig'"present" due to her absence at the last, meeting. 5.Chairman asked staff to brief the Board on case PZ-5-82 (Southard). 6.Mr.Newcomer .Chairman .Vaughn/Berry stated the applicant wished the Board to continue the public hearing due to attempt to resolve matter with the building official. called for a motion,following Board discussion. M/S "BE IT RESOLVED by the Board of Adjustment and Appeals of the City of Apache Junction,Arizona,that the public hearing on case BA -5-82 be continued until the -Monday June 7,1982,regular meeting at 7:00 p.m.,at the City Hall Complex,1001 North Idaho Road." The notion,passed unanimously (7-0): 9.Chairman asked staff to brief the,Board on BA6-82"(Rogelstad),. 10.Mr.Newcomer presented the case as being a request for a variance to rear yard setback requirements for a lot in Sierra Entrada Garden Homes Subdivision.The applicant wishes to put a roof over a patio area which would reduce the rear yard setback to 12'. 11.Chairman invited the applicant to speak. He explained lots in this subdivision are substandard size.He stated the original buyers'covenants set rear yard setback requirements at 12'in compliance with county regulations which were in effect at the time.When the city was incorporated,the setback was changed to 25'.(Because of the substandard lot size, Section 2309 (C)allows reduction of 5';thus,the current 20'.) He contended the original 12'is conducive to the intent of the subdivision as "garden homes." asked i f policy was being established for the entire subdivision. reiterated that the planned development would eliminate such problems. hoped square footage requirements were being included in the proposed planned development ordinance. expressed concern that a further variance might be requested once the 12'minimum was adopted by the planned development. wondered i f setting this precedent might result in several requests for the same. responded that anyone could submit an application for variance. noted the normal setback of 25'had already been reduced to 20'. responded that the original covenants stated 12' yard setback. rear asked the applicant i f it would be possible to wait for a decision on this matter;that the planned development would resolve the issue for the entire subdivision. answered L that the building official had suggested they pursue a variance.He felt the city should grant the variance since they had followed prescribed procedures. pointed out that the subdivision's substandard lot sizes cause problems.He felt approval should be granted because of this and the fact the applicant had done all the city had asked.He called for a motion, there being no public comment in favor or opposition. M/S "BE IT RESOLVED by the Board of Adjustment of the City of Apache Junction,Arizona,that the requested variance in case BA -6-82 be denied.The Board bases its decision on the following reasons: 1.Section 2309 (C)of the city zoning ordinance provides the property owner with sufficient relief , from the normal 25 foot setback requirements of the CR-3 zoning district to make reasonable use of his property. 2.The Zoning Administrator recommends denial in his memorandum dated April 20,1982. The motion passed 5-2-0,with Mr.Jessamine and Mr.Vaughn dissenting. Page 3 -Board of Adjustment Minutes of May 3,1982 25.Chairman asked if there was further business. 26.Mr.Newcomer noted the change to the Rules and Procedures had been completed.He detailed procedures for Board field trips. 27.Chairman adjourned the meeting by concensus at 7:40 p.m.,there being no further business.
