called the meeting to order and asked the Recording
Secretary to call the roll.
called the roll,determining one member was absent,
as indicated above.
asked for a motion to approve the Minutes dated May
3,1982.
M/S "BE IT RESOLVED by the Board of Adjustment of
the City of Apache Junction,Arizona,that the Minutes
dated May 3,1982,be adopted,as presented."
The motion passed unanimously (6-0).
asked staff to brief the Board on BA -5-82 (Southard).
stated the applicant requested a continuation of the
public hearing until the next Board meeting date.
called for a motion to that effect.
M/S "BE IT RESOLVED by the Board of Adjustment and
Appeals of the City of Apache Junction,Arizona,that
the public hearing on case BA -5-82 be continued until
Monday,July 12,1982,at 7:00 p.m.,in these chambers."
The motion passed unanimously (6-0).
asked staff to brief the Board on BA -7-82 (Holmquist).
explained the subject property was located in the
Sierra Entrada Garden Homes subdivision where the lots
are substandard size.The applicant requests a
variance to rear yard setback requirements to construct
an addition to an existing covered patio.

11.Chairman invited the applicant to speak.
12.Mr.Holmquist noted the variance was requested for three reasons:
1.Cooling advantage
2.Appearance
3.Community benefit by tax increase
13.Chairman asked for staff recommendation.

presented the Zoning Administrator's recommendation
for denial.
asked for comment in favor or oppositon,there being
none,Commission discussion was opened.
noted the Zoning Administrator's comment that the
patio was not on the plat recorded with Pinal County.
felt he could locate other documents supporting his
contention that the patio was approved by Pinal
County.
18.-Chairman commented that that was irrelevant due_to Grand-
fathering.
19.Vaughn asked Ilene Taylor,Planning and Zoning Commission
member in attendance,to state the progress made
on the Sierra Entrada planned development ordinance.
20.Ms.Taylor noted that the case had not yet come before the
Planning and Zoning Commission.
21.Mr.Morrison felt all variances in this subdivision should be
held pending adoption of a planned development
ordinance.
22.Ms.Luddy cautioned the Board to be consistent,-nOtiwarSiMilar ,
variance request had been denied just last month.

contended that this variance request should be
approved since i t is an open:patio and leaves several
feet more rear yard than the application that was
before the Board last month.
argued that with the planned development being
processed the Board should wait on matters dealing
with this subdivision.
25.Chairman called for a motion.
26.Burfiend/Morrison MIS "BE RESOLVED by the Board of Adjustment of the
City of Apache Junction,Arizona,that the:requested
variance in case BA -7-432 be denied.
The Board bases its decision on the following reasons:
The Zoning Administrator recommends denial in his
memorandum dated May 24,1982:"Section 2309c of the
City's Zoning Ordinance grants dispension for lots
of a substandard depth,such as the applicant's.
However,the aforementioned Section specifies that no
rear yard shall be less than 20 feet.
In addition upon looking at the enclosed Pinal-County
application and plot plan for the residence i t

appears that the existing patio cover was built
without a permit in violation of the code in effect
at the time of construction.
For these reasons,I recommend the requested variance
be denied."
The motion passed 4-2-0,with Messers.Jessamine
and Vaughn dissenting.
(During the discussion of the motion,Mr.Berry
suggested the applicant might be able to extend
only the roof of the existing structure for more
shade.)

stated.that.complaint has.been lodged against the
applicant that conformance to variance stipulations
was not being met.
suggested a public hearing be scheduled so the
applicant would have the opportunity to defend her-
self.A motion to that effect was requested.
M/S "BE IT RESOLVED by the Board of Adjustment of
the City of Apache Junction,Arizona,that an
advertised public hearing be held on July 12,1982,
at 7:00 p.m.,in these chambers,regarding complaints
against BA -4-81 (Corsi)."
The motion passed 5-0-1,with Mr.Vaughn dissenting.
asked for further business.
presented the following items:
1.Zoning Administrator requests that building permit
requirements be attached to variance orders.
2.Board of Adjustment and Planning and Zoning six
month schedules were distributed.(Third Monday
in September tentatively set for regular meeting
due to Labor Day holiday.)
3.General Plan correction to amendment packet
distributed.
4.Legislative Action on Open Meeting Law distributed.
adjourned the meeting by•concensus at 7:45 p.m.,there
being no further business.
