1.Chairman called the meeting to order and asked the recording
secretary to call the roll.
2.Ms.Breece called the roll determining five members were present
and two absent,as indicated above.
3.Chairman asked staff to brief the Board on case BA -10-82 (Koselka/Long).
4.Mr.Newcomer presented the case noting the parcel zoned GR was smaller than
currently required for that classification,making setback
compliance impossible.
5.Mr.Long introduced himself as the applicant's representative and
offered to answer Board questions.
6.Chairman invited public comment in opposition;there was none.Public
comment in favor was requested,whereupon four members of the
audience indicated their support of the application from
their chairs.
7.Mr.Frazier presented staff recommendation of approval.
8.Chairman called for a motion.
9.Luddy/Dunlop*M/S "BE IT RESOLVED by the Board of Adjustment of the
City of Apache Junction,Arizona,that the requested
variance to yard setback requirements of the zoning
ordinance in case BA -10-82 be granted.
"This variance is subject to the following conditions:
1.The front yard shall be reduced to no less than 30 feet.
2.The north side yard shall be reduced to no less than
10 feet.
3-All other setbacks and -applicable zoning ordinance
provisions shall be complied with."
The motion passed unanimously (5-0).
10.Mr.Gero announced the Planning and Zoning Commission will be
studying and possibly amending Article 8 -General
Rural of the zoning ordinance which will greatly reduce
and possibly eliminate this type of problem.
11.Chairman called for approval of the Minutes dated August 2,1982.

12.Luddy/Dunlop MIS "BE IT RESOLVED by the Board of Adjustment of
the City of Apache Junction,Arizona,that the Minutes
dated August 2,1982,be approved as presented."
The Motion passed 3-0-2,with Messers.Burfiend and
Jessamine voting "present"due to their absence at
that meeting.
13.Ms.Luddy noted reasons were not read into the BA -10-82 motion;
the motion was amended by concensus to include:
"The Board bases its decision on the following
findings:
1.The size and shape of the lot make compliance
with the required setbacks difficult without
creating a hardship on the property owners."
14.Mr.Newcomer announced the zoning ordinance will be discussed at
the August 24 meeting of the Planning and Zoning
Commission,outlined the new open meeting law,dis-
tributed a schedule of deadlines,and asked the
Board to complete and return a personal information
update sheet.
15.Chairman adjourned the meeting at 7:12 p.m.,there being no
further business.
