MINUTES Present Mrs.Dunlop Mr.Carter Mr.Morrison Mr.Berry,Chairman Mr.Nakagawa,Acting Executive Mr.Gero,Executive Secretary Mrs.Samuelson,Recording Secretary Absent Mrs.Luddy Mr.Browne Secretary Synopsis Election of Chairman -Art F.Berry Agenda -approved as presented Minutes dated August 8,1983 -approved as read Minutes dated September 12,1983 -approved as read BA -13-82 (Hardwick)-temporary permit renewal -approved Guests Sterling Hardwick Sharon Hardwick Betty Espe 1.Mr.'Gero:asked the recording secretary to call the roll. 2.Mrs.Samuelson called the roll and determined that four members were present with two absent,as noted above. 3.Mr.-Gero noting there was a quorum, called for nominations for Chairman. 4.Morrison/Dunlop M/S "I hereby nominate Art Berry for the position of Chairman." 5.Chairman 6.Morrison/Carter 7.Chairman The motion passed 3-1-0,with Mr.Berry voting received the gavel and asked i f there were any questions on the Agenda;there were none.The Agenda was accepted by signifying "aye."There were no "nays." He then asked if there were any corrections or additions to the Minutes dated: August 8,1983;' there were:none.He then called for a motion.- M/S "BE IT RESOLVED by the Board of Adjustment of the City of Apache Junction, Arizona,that the Minutes dated August 8,1983,be accepted as read." The motion passed unanimously (4-0-0). called for a motion on the Minutes dated September 12,1983. Page Two -Board of Adjustment Minutes -October 12,1983 8.Dunlop/Carter 9.Chairman 10.Mr.Nakagawa "BE IT RESOLVED by the Board of Adjustment of the City of Apache Junction,Arizona,that the Minutes dated September 12,1983,be accepted as read." The motion passed 3-0-1,with Mr.Morrison abstaining. opened the public hearing on BA -13-82,a request for a temporary permit renewal from Sterling and Sharon Hardwick.He asked for staff briefing. briefed the Board regarding the case stating that this is a request for a nine -month renewal of a temporary permit to keep two mobiles on one lot.He said i t is a 1-1-acre parcel.He then gave the history of the case.He added that the second mobile is used for Mrs.Hardwick's mother.He said that there is a current state- ment from the doctor on file and apparently the need for the second mobile still exists. He said staff has no objection to the renewal. 11.Chairman asked i f the applicant would like to speak on the case. 12.Sterling Hardwick stated that the original circumstances remain the same and that his mother-in-law and father- in-law still reside in the mobile. 13.Chairman asked i f the Board had any questions. 14.Mr.Carter commented that no complaints had been received from anyone in the area and that he saw no hardship being imposed on the neighborhood. 15.Chairman asked for staff recommendation. 16.Mr.Nakagawa said that staff has no objection to the renewal request.He requested that five stipulations be required,and he read those stipulations into the record. 17.Mr.Hardwick asked i f the stipulations were the same as before or i f some had been added. 18.Mr.Nakagawa replied that the original permit never gave an expiration date and one is given now,and that the fifth condition is that the applicant submit, in writing,a request for renewal i f i t is desired,along with a doctor's certificate.He said the applicant will get a copy of the Board's Order,but they should keep track of the date themselves. 19.Chairman asked i f there were any questions;there were none.He then called for a motion. 20.Dunlop/Carter MIS "BE IT RESOLVED by the Board of Adjustment of the City of Apache Junction,Arizona,that a nine (9)month renewal for BA -13-82 is here- by approved. "The reasons for this action are: 1.There have been no complaints. Page Three -Board of Adjustment Minutes -October 12,1983 2.The original conditions remain unchanged. 3.No health,safety,or welfare problem exists. "The following stipulations shall be conditions of the permit: 1.The development shall comply with the submitted plot plan. 2.The second mobile home shall be removed when no longer needed by Ethel Mowatt. 3.The applicant shall comply with the regulations of any agency having jurisdiction. 4.The permit is valid for nine (9)months. I t shall expire on June 5,1984. 5.I f the applicant desires another renewal for the permit,the applicant shall submit the request,in writing,along with another doctor's statement,by April 1,1984,to the Planning Department."
