Minutes dated October 10,1984 -approved. BA -1-85 (Wray)-variance approved. Adjournment 1.Roll call all members present -. 2.Carter/Schmidt 3.Luddy/Carter .Chairman 5.Mr.Nakagawa 6.Mr.Morrison 7.Mr.Nakagawa 8.Schmidt/Morrison M/S "BE IT RESOLVED by the Board of Adjustment of the City of Apache Junction,Arizona,that the Agenda dated February 11,1985,be approved as published." The motion passed unanimously. M/S "BE IT RESOLVED by the Board of Adjustment of the City of Apache Junction,Arizona,that the Minutes dated October 10,1984,be approved." The motion passed 4-0-3,with Mr.Morrison, Mrs.Blatterspiel,and Mr.Berry abstaining. opened the public hearing on BA -1-85 and asked for staff briefing. briefed the Board stating that the applicant is asking for a variance to what was thought to be the rear yard,but has since been determined by the Zoning Administrator,to be the front yard. He added that he was requesting a variance for a 26 foot setback which is now a 21 foot setback to the front yard where 40 feet is required.He commented on the major wash running through the property and said that staff recommends approval of the variance. wanted a clarification of 7th Street and 7th Avenue. stated that there is no 7th Street in the City. M/S "BE IT RESOLVED by the Board of Adjustment of the City of Apache Junction,Arizona,that the address on the application be corrected to read East 7th Avenue and not East 7th Street." The motion passed unanimously. Page Two -Board of Adjustment Minutes -February 11,1985 9.Walter Wray stated that he had purchased the property without knowing of the drainage or building code problems because of the slope.He said that i t was a land/ mobile purchase and he has not taken ownership as of yet.He added that he did intend to live in the mobile to be placed on the property. 10.Mr.Nakagawa said that staff recommends approval of the 21 foot front yard setback. 11.Board discussion. 12.Luddy/Carter 13.Board Respectfully submitted: James A.Nakagawa Acting Executive Secret APPROVED: M/S "BE IT RESOLVED by the Board of Adjustment of the City of Apache Junction,Arizona,that a variance to Section 806,allowing a twenty-one foot (21')front yard setback instead on the required forty foot (40')setback is hereby approved. The following stipulations shall be conditions of BA -1-85: 1.That the applicant dedicate the north and south thirty-three feet (33')and the west forty feet (40') of the subject property for public roadway and associated purposes. 2.That the development of the property be in substantial conformance to the plot plan as approved by the Board of Adjustment. Reasons are: 1.There are special circumstances or conditions applicable to the property referred to in the application which do not prevail on other property in that zone. 2.That the strict application of the regulations would work an unnecessary hardship and that the granting of the application is necessary for the preservation and enjoyment of substantial existing property rights. 3.That the granting of such application will not materially affect the health or safety of persons residing in the neighborhood and will not be materially detrimental to the public welfare or injurious to property or improvements in the neighborhood. 4.That the hardship circumstance was not self- imposed by the current or past property owner." The motion passed unanimously. there being no further business,the meeting adjourned at 7:29 p.m.
