asked i f there was anyone who wished to
speak in favor or against the case.There
was no one.
M/S "BE LIT RESOLVED by the Board of Adjustment
of the City of Apache Junction,Arizona,
that a variance to Section 15.0106,allowing
a twenty-five foot (25')front yard setback
instead of the required forty foot (40')
front yard setback is hereby approved.The
following stipulations shall be conditions
of BA -3-85.

1.The applicants dedicate the north,east,
and south thirty-three feet (33')of
the subject property for public roadway
and associated purposes,including a
twenty foot (20')by twenty foot (20')
cut-off at the intersection of East
Second Avenue and South Vista Road.
2.The development of the property be in
substantial conformance to the plot
plan as approved by the Board of Adjustment.
3.The applicants be allowed to use the
mobile home during construction of a
residence on the same premises for a period
of ninety (90)days,such period may be
extended for an additional ninety (90)
days upon application to and approval of
the Zoning Administrator.
The reasons for this approval are as follows:
1.The location of the wash and the Zone A
Flood Area constitute a special condition
applicable to the property referred to in
the application which do not prevail on
other property in the zone.
2.The strict application of the regulations
would work an unnecessary hardship on
the applicants by forcing them to construct
a residential dwelling in the Zone A
Flood Area.Granting of the application
is necessary for the preservation and
enjoyment of substantial existing property.

3.Granting a variance to allow a twenty-
five foot (25')front yard setback instead
of the required forty foot (40')front
yard setback will not materially affect
the health or safety of persons residing
or working in the neighborhood and will
not be materially detrimental to the
public welfare or injurious to the property
or improvements in the neighborhood.
Side yard and rear yard setback requirements
are not affected and can be met as
stated in Section 15.0107 and Section
15.0108 respectively.A reduction in
the front yard setback will not pose an
intersectional sight problem.
4.The hardship circumstance was not self-
imposed by the current or past property
owner.
The motion passed unanimously.
M/S to adjourn.There being no further
business,the meeting adjourned at 7:20 p.m.
