MEETING OF JUNE 14,2004
The regular meeting of the Board of Adjustment and Appeals of the City
of Apache Junction,Arizona,was held on June 14,2004,at the Apache
Junction City Conference Room Center,pursuant to the notice required by law.
SYNOPSIS
Case BA -1-04 -Temporary Use Permit
CALL TO ORDER
Chairwoman Gardner called the meeting to order at 7:00 p.m.

Chairwoman Gardner announced that
Mr.Fine has requested a withdrawal of his application regarding case BA -1-04.
Chairwoman Gardner announced that a motion will be entertained at this time.

JUNCTION BOARD OF ADJUSTMENT AND APPEALS ACCEPT THE WITHDRAWAL OF THE
TEMPORARY USE PERMIT,CASE BA -1-04,BY ROBERT FINE,TO ALLOW THE PLACEMENT OF
A STATE APPROVED FACTORY BUILT STRUCTURE AND OUTDOOR AUTO REPAIR AT THE
PROPERTY LOCATED AT 2090 W.SUPERSTITION BOULEVARD."

Chairwoman Gardner announced that
this is a public hearing.Is there anyone that wishes to speak for or against
case BA -1-04?
Donald Kos,P.0.Box 9154,AJ,
85278,addressed the Board.Mr.Kos distributed photographs regarding the
address site.80%of the vehicles that are parked there are unlicensed,taken
apart,and junk all over.They don't have electric.They don't have water.
They use a generator for power.This is information regarding this property
in case this comes back before the Board of Adjustment.The County Health

Department has taken pictures of the subject site.I don't know how they
could be applying for this.We have complaints into the city regarding this
site.
George Watson,902 N.Main Drive,
A.J.,addressed the Board.J am not sure I understand what Mr.Fine was going
to do with this property.I assume he was wanting to do a shelter to work
under while he was having a building put in.
Allen Barger,651 N.Ocotillo Drive,
A.J.,addressed the Board.I am just south of the property.The talk is to
bring up the image of Apache Junction.I don't think this is doing us any
favors.I am opposed to this.We don't want our property value brought down
because of this.
Virginia McClain,2101 W.
Superstition,A.J.,addressed the Board.This property was vacant for a long
time.I t is commercial property.They did not comply with Ordinance 940.I
don't know why they were allowed to.They didn't do what everyone else was
required to do.Good businesses have been run off because they couldn't
afford to upgrade because of Ordinance 940.I would have to pay $40,000-
$50,000 dollars for on -sight improvements to meet Ordinance 940.He has been
running .a business for the past year without having to do these things.This
is not fair.Why are these rules bent for him and not everyone.
Chairwoman Gardner asked if there
was anyone else that wished to address the Board for or against this item?
Hearing none,the public hearing js closed.We will proceed .to the next
agenda item

Board Member Spelman requested that
the pictures presented tonight by Mr.Kos on case BA -1-04 be kept in the case
file.

EXECUTIVE SECRETARY INFORMATION AND REPORTS
Associate Planner Steve Abraham
announced that Board Member James Schecter submitted his resignation effective
2-10-04.Mr.Pasquale D'Amico has been appointed to fill Mr.Schecter's
vacancy.Mari Gardner has been reappointed to the Board.
There is a Board and Commission
Training Conference coming up on November 12,2004.Contact the Development
Services Department if you wish to sign up for this training.

"I MOVE THAT AN EXECUTIVE SESSION OF
THE BOARD OF ADJUSTMENT AND APPEALS BE HELD AT 6:30 P.M.,AND THE REGULAR
MEETING AT 7:00 P.M.ON JULY 12,2004,IN THE CITY COUNCIL CHAMBERS."

Chairwoman Gardner announced there
being no further business to discuss,and with no objections,this meeting is
adjourned at 7:40 p.m.
