MEETING OF MAY 9,2005
The.regular meeting of the Board of Adjustment and Appeals of the City
of Apache Junction,Arizona,was held on May 9,2005,at theApache
Junction City Council Chambers,pursuant to the notice required by law.
SYNOPSIS

Request by Patrick Musser for a sign variance for Shell Oil,Products

Chairwoman Gardner called the meeting to order at 7:00 p.m.

City Attorney Joel Stern announced that thereis a court reporter present
tonight:._Try not to conflict with each other when speaking,One person at
a time,so that she knows exactly who is speaking.It will be transcribed.
Mr.Abraham has an interesting update .for you on this case.
Chairwoman Gardner announced for the record .that Board Member D'Amico arrived
at 7:05 p.m.

Chairwoman Gardner announced Case
BA -1-05:This is a request by Patrick MusSer.of RHL DesigrrGroup,on behalf
of Shell Oil products,for a variance to Section 21_22 (c)(In No Case Shall
any Sign:)of the Zoning Ordinance to allow the continued use of a detached
monument sign located on publicly owned right-of-way.The subject property,
1621 W.Apache Trail,is located at the southeast corner .of the intersection
of South Ironwood Drive and West Apache. Trail.
Associate Planner Steve Abraham,will be briefing the Board on thecase and,
update the Board with an exhibit.On 'May 6,RHL Design,representing Shell -
Oil:Products; mithdrew.their variance_ request Case -BA -1405.He passed:out -
-Exhibit A.'Basically,this-requires ,an updated motion.Because this was a
public hearing,we will Still have to have the.public hearing and go ahead and
accept or not accept their withdrawaltby motion.I -have the-recommended
motion.Staff does recommerd that the BOard accept the withdrawal.Mr.
Abraham passed out the recommended Motion to Board Members.

Associate Planner Steve Abraham said yes,before the public -hearing.

Board Member Spelman asked does this mean they are going to take the sign
down?
Associate Planner Steve Abraham said the sign will have to be relocated and
that will be up to the Zoning Administrator after this proceeding to
facilitate that.
Chairwoman Gardner asked if there were any other questions?Hearing none,
this part is closed.Do I need to go through all the words for the hearing?
City Attorney Joel Stern advised you may open up to the public.
Chairwoman Gardner asked if there -are any individuals that wish to address the
Board?Please state your name and address for the record.Hearing none,this
portion of meeting is closed.The applicant is not here to make a
presentation.The letter speaks for itself.Would someone like to read it?
City Attorney Joel Stern advised someone may want to read i t into the record
even though i t is going to be part of the record.

REQUEST CASE BA -1-05 BY RHL DESIGN,ON BEHALF OF SHELL OIL PRODUCTS,TO ALLOW
THE CONTINUED USE OF THE DETACHED MONUMENT SIGN LOCATED ON THE CITY OF APACHE
JUNCTION RIGHT-OF-WAY LOCATED ON THE SOUTHEAST CORNER OF APACHE TRAIL AND
IRONWOOD DRIVE."

EXECUTIVE SECRETARY INFORMATION AND REPORTS
Associate Planner Steve Abraham said one item not included in the packet was
that the City Council recently appointed certain members to the Board of
Adjustment and Planning and Zoning.Unfortunately,I apologize,I do not have
the completed list with me this evening.When we do have that completed list
we will forward it to the board members as soon as possible.
